IR-1 / CR-1 Spouse Visa Process & ProceduresCalifornia to Texas & Texas to California - Part 2

Not yet Wade. We were promised it by Thursday, so far nothing and our emails since have fallen on deaf ears. It's very, very easy to become instantly cynical after what we have all been through.

It's either gone to NVC, and the email wasn't sent to us, or we have been forgotten about. I'll be sending a further email to Angela first thing Monday for clarification.

Don't think I'll rest until I see case numbers being allocated from our little group. Even with all this elation, still only 4 cases have arrived at NVC from Texas.

We shall see what next week brings....

I am still doubting that everything is working as expected. You hit the nail on the head with this:

It's very, very easy to become instantly cynical after what we have all been through.

I will not be happy until my wife and son are home. I can't wait for the newspaper article to be published in print and online. I will do another blast to get the word out on the article and I have a ton of others that will get the word out online about the article as well. At this point, I think it is the only way to ensure that USCIS will make sure we 36,000 are taken care of.

Roll on Monday Xelance. We were promised Thursday at the latest, but nothing. KInda bummed my weekend, I was hoping for evidence we were out of the black hole.

Did you get the email from USCIS stating that it was sent to NVC?

On February 10, 2011, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly.

IR-1 / CR-1 Spouse Visa Process & ProceduresPOLICE CERTIFICATE QUESTION

Hello, newbie here on this site. Applicant is in the Philippines. AOS fee is paid and AOS package is already sent to NVC. IV fee is paid, we're putting together the IV package.

My question would be regarding the police certificate under the "DOCUMENTS REQUIRED" page on NVC.

You can get this certificate thru the National Bureau of Investigation correct? Not from Local Police?

Also, the applicant worked and stayed in KOROR, PALAU from NOV 2005 to MAR 2007. Does this mean she has to get some form of Police Certificate there too?

Any input from anyone with similar situation? Thanks! =)

I believe that the Police Check is done by CBI, someone else can chime in on that.

The Police Check has to be done for any country that the applicant has lived in for over 6 months except the US.

Good luck!

Well, I am going to give up on the VISA journey if we don't have it by Jan or Feb but I'm NOT giving up on my fiancee.

I have spoken to my corporate HR and inquired about our office in Thailand but she is steering me towards Hong Kong or Singapore, they have some real needs there. Thailand is still not out of the questions though, the Thai office is going to be aggressively going after business in Vietnam so we'll have to see.

If I do take on one of those, I will go to Thailand and marry my fiancee and take it from there. If I end up in Hong Kong or Singapore, at least it will be a piece of cake to get a Thai national a visa, unlike the long process we have to endure for the states.

IR-1 / CR-1 Spouse Visa Process & ProceduresConfused, what to file and what order?
Thank you.

I have been reading the USCIS site as well and I am more confused....

Do I need to file the I-485 now as well?

According to the guides here all I need to do is to file the I-130 and G-325a for each of us now and then the rest is done when they send her a package from the Embassy.

So, I do not need to send our marriage certificate and sons birth certificate now?

Man, I don't want to screw this up to delay my families return.

IR-1 / CR-1 Spouse Visa Process & ProceduresConfused, what to file and what order?
I know that I will need to file IR-1 / CR-1 for my wife but am suffering a total brain lock at the moment, more so after reading the guides. A little background on situation...........

Wife came to US on K-1 in June 2008, we married 9 weeks later, found out she was pregnant a month later, and got laid off a month after that. All kinds of "goodness" and "badness" in a short period of time.

Unemployed until Feb 2009 when I took a job in Florida, baby came 3 months later, employer closed up shop 4 months later, again, all kinds of "goodness" and "badness" in a short period of time!!

Due to all the financial uncertainty, cross country move, son's arrival and out of work AGAIN, we did not file for AOS, money was tight. Wife's mom and dad were ill and we decided that she should go back home to see them and they can see they new grandson before anything happened to her parents. Wife and son have been in Thailand with her family since March 24th.

I just recently re-located back to SoCal again to accept a really good job this time. We are in good shape financially now to file for the IR-1 / CR-1.

My question is this:

Do I just file the I-130 Package now and once approved they will request the other required filings and documentation?

I have all supporting documentation such as marriage certificate, sons birth certificate, lease of home in Florida in both our names, etc....I am pretty sure I do have everything, it's just a matter of writing the check and sending it all in to the Chicago lock box.

I would appreciate it if any of you who have already filed and had a similar circumstance as I can provide some input.

Thanks!!

IR-1 / CR-1 Spouse Visa Process & Procedures1-130 got approved yesterday

Hello,
So I checked my USCIS status yesterday and it said that my 1-130 petition got approved. Now I was reading the guides for the 1-130 and it said that NOA2 will be sent to me and a few weeks later a packet of forms will be sent to my wife overseas. My question is that between now and when I receive the NOA2 in the mail, what can I or should I do to speed up the process through the NVC? Thank you very much.

Congratulations...............

Would have been nice if you had created a Timeline to assist others in the same situation.

IR-1 / CR-1 Spouse Visa Process & ProceduresImpacts of TSC to CSC transfers in Oct/Nov/Dec applicants?

please can you all experts who are saying oh all you oct/nov/dec filers will be ok, can you answer why all these 36000 were transferred to TSC and why that strategy failed? and now you are asking all Oct/Nov/Dec/Jan filers not to be worried eventhough these TSC to CSC transfers are happening? and i see a strong possibility of significant delays at CSC, NVC step and Consulate step for these Oct/Nov/Dec/Jan filers.

importantly answer my question - why 36,000 are transferred from CSC to TSC and back again to CSC?

Contact USCIS and make a formal request to your questions via the Freedom of Information Act (FOIA). We don't work there.

No one is complaining here, of-course your applications can be processed before as long as it is not impacting the Oct/Nov/Dec applicants, isn't that be good for everyone? i hope that is how they are being done. as far as being absurd you are in your shoes, oct.nov/dec filers are in their shoes.

When you're at 5 months into this process, address then, don't speculate. You're going to give yourself an ulcer at this rate.

IR-1 / CR-1 Spouse Visa Process & ProceduresImpacts of TSC to CSC transfers in Oct/Nov/Dec applicants?
Of the 36,000 transferred to TSC from CSC in November 2010, it is my understanding that approximately 5,000 have been approved, so that would leave 31,000 left. If CSC is approving 20,000 a month, you could possibly be delayed 6 weeks.

The USCIS guidelines state 5 months for I-130's, that is JUST a guideline.

All of the above means nothing because we have no idea what is going to happen.

I was unfortunate to go through the major issues that USCIS had in 2007-2008 and now 2010-2011. When we filed our K-1 in 2007, we were just a few weeks short of one year of processing for something that normally took 6 months. This is why I was persistent at keeping on USCIS ####### this time, hammering them with email, phone calls, call them out on Twitter and Facebook, contacting local and national media.

Although we received our approval tonight, I have an interview at noon tomorrow with a reporter. I will hold USCIS accountable and speak for those who are still dealing with all this BS.

Raj,

Just a word of advice... I'm not accusing you of doing anything (yet) but..... I wouldn't come in this room and start spewing ####### out of your mouth about Oct/Nov/Dec/Jan filers. A lot of us in here have seen some of your posts in other threads (two of which are locked) and I can promise you.... it will NOT be tolerated in here. We are stressed, out of patience, and quite frankly.... have no compassion for the people that have filed after us and are complaining about "wait times". Once again, I'm not bashing you... just giving you some advice.

God Bless.

It's probably too late now for the article to help us BUT we still have to go through NVC and the respective Embassies. Having the article in print may help if any of you run into any problems at all with then next two phases.

I also hope a local attorney reads it and explores a class action, honestly I hate ambulance chasers but you have to take advantage of them like they take advantage of us.

Wow, almost 5 more pages to go through........

As stated earlier today, I had an interview with Cindy Carcamo of the Orange County Register about this whole USCIS screw up. The paper took an interest in my story due to my sons health condition. The interview was much longer than I expected, probably because she was "old school" and took notes on a note pad, she did a lot of writing, LOL

I provided her with a copy of the Alert that was posted on USCIS website the other day, all pertinent emails for everyone that I had contacted at USCIS and other documents from USCIS. All in all about 3/4 in thick!!

She took interest in how my Congressman had basically ignored my plea for help, I threw him under the bus big time. Someone that I previously met many years ago and HAD respect for. He lost quite a few votes due to his inaction.

I provided her a link to this thread a few weeks back and she has been here reading.

I brought up waitingonthelords specific situation and Rachel's roller coaster ride yesterday and today.

The article will be in print and online soon, she was not able to give me a specific date but assured me it would be published. I am about to send her some pictures to include in the article, she wants a wedding pic and some other misc pics.

As soon as the article is posted online, I will let you guys know. Although we have some traction now, it would be advisable to comment on the story when it is available.

Good luck all!!

I was talking to hubby last night about this and his take on it is that they just feed us bull...they just say things to stall time and fix all their screw ups!

Just because they are approving people they think we will forget about all their misleading info and mishandling of this whole process. Sure we will all be happy to be approved, but what about all the stress caused and unnecessary time lost because of their stupidity? It's quite frustrating. I feel it for some of you even more than myself, (like you Wade) who have been just given the run around non-stop and have serious issues going on with their loved ones and need this process to move as quickly as possible.

What's the point in offering expedites in the process when they actually don't expedite. smh...boggle my mind

I threw a bit of a fit after the Tier 1 guy told me that I received a notice on 1/27(which i didn't get) and that I could call back in another 2 months. RIGHT! That would make 9 months at USCIS, and my application was filled out perfectly, tons of info to prove my 12 year relationship, but 9 months, that makes sense.

Got transferred to a Tier 2 Officer and she said she was expediting my case, BUT considering most people that had a dire situation with an expedited case still had to wait 6 months, I'm not going to hold my breath.

So, you guys think this means my case wasn't transferred back to CSC?

Email Angela Barrows, reference the alert and tell her the Custom Support still has no clue, the are mis-informing customer still. According to her, that was rectified.............
