! i prayed to the christain god for 2 weeks and got no answer. Then i prayed to the Allah and got no answer. A friend suggestd i pray to the wiccan god. i prayed for 2 days and it answered my prayers! Our NOA2 came in email tonight. i did not know gods could be so powerful. No reply to my email... If I don't receive anything by noon tomorrow... I'll be calling USCIS again. I know how it works... their logic is: "Hey, this application was returned from NVC, I have 180 days to resubmit this one. I'll just put it over here in this corner and let it collect dust until then." It makes me furious because THEY made the mistake. They input the wrong code into the computer and it NEVER went to NVC. They haven't heard the last of this. I already notified my Chain of Command (military) that I would be contacting my Congressmen and Senators. i just don't know what good it will do because I am a resident of Washington but live in California. Any ideas on which Senators/Congressmen to contact (WA or CA)?

Hey Chief, a Congrint will probably do much better than anything that we could do. I wished i was still on Active Duty because this is the route that I would take. If I recall correctly, they have 72 hours to act upon a Congrint.

Absolutely no one is looking at the tragedy of this situation. USCIS is not responding to me as well as 1,000's of others who have had their cases transferred from CSC to TSC. NO ONE CARES!! With all do respect, if you have a heart, you'd take some initiative rather than pass the buck like everyone else.

I've put in two service requests. Don't worry, you're not missing anything. As I found out today, my first Service Request resulted in an update of "initial background check", or lovingly referred to as Blue Dot number 2.

My lawyer admitted today that there may be a "problem" in Texas, and I say that is the first step to recovery!



Have you engaged your attorney about taking this further? Has your attorney taken a look at this thread?

I can't I'm working. Do you think they will let you do anything without an appointment? I just don't think going there is going to make a difference. Hope I'm wrong. But going there with a bunch of people and protesting with signs and all is another story. I think we all need an attorney to look into our cases and file a lawsuit if its possible.


I am not concerned whether they will or will not see without out an appointment, I am making a statement, won't leave until I speak to a USCIS employee, that does not include the Rent-a-Cops.

I would if I was close. I am so close to TSC but there is nothing I can do.. they wont give me an interview or anything.. sometimes I wonder if going to the immigration court here in dallas will be better... jaja


I don't have an appointment, just a lot of documentation NOA1, I-797C for transfer to TSC stating "to speed up the process", letter from TSC stating approval for expedite, printout of the US Code that ThomasJones was so kind to find for us and printouts form here as well as other forums where other filers have been approved, especially the NOV filers at TSC.

Oh, and I am serious about possibly getting arrested, I will not be violent but WILL INSIST that I be seen right then and there, worse they can do is get me for trespassing. I'll be logged in Twitter on my Droid as well......................

(b) Policy
It is the sense of Congress that the processing of an immigration benefit application should be completed not later than 180 days after the initial filing of the application, except that a petition for a nonimmigrant visa under section 1184 © of this title should be processed not later than 30 days after the filing of the petition.


Well, here is another section of the US Code... and it now shows that the USCIS is in violation of the United States Code. At least for those of us now over 180 days. :bonk:

I think we need to go to either TSC's doorstep to protest or go straight to Washington to protest. This waiting is annoying while people with NOA1 dates of November are getting approved!!!!!

People in similar situations as we are in go and do stupid things and get arrested and get on TV but do get attention doing so. We need something more than just contacting media to get our voices heard. We need to form a big group (more than 50 people) to protest which is almost an imposible thing to do since we all are from different parts of the country. I would be willing to fly to Dallas and protest if there was a big group.

Thanks for the info and kind words. I just woke up, 0600 PST, and feel like a freight train ran me over.

Been trying to call my wife for updates but cannot get through. I have to send her more money via Western Union today for the hospital/Dr's fee's. This is all out of pocket even though I have full coverage with Tri-Care, but I can still file after I get all my sons medical records and then get them translated in Bangkok. It may almost cheaper to pay out of pocket since it cost the equivalent of $25 per page for translation...............yeah, what a cluster **!!

Last night I lost Internet connectivity while "tweeting" to god and everybody; thankfully the Internet was back when I got up. What else can go wrong!!!

When my head clears up, need coffee, it will be time to raise hell. I am going to email, fax, call, etc all day.

I am trying to gain some composure before I start writing more emails all night. Tomorrow I plan on calling anyone and everyone who should take action on our case. I feel like my heart has been ripped out of me, I am supposed to take care of my family but how can I when USCIS is doing this. I feel like I am totally letting my wife and son down, my wife is scared. She has a hard time understanding why it takes so long for a family to be reunited. If I could get work in Thailand, I would be there in a heartbeat.

I am losing faith in the country that I love and have served so faithfully, I feel like it has turned its back on me. It's a shame, if I was a celebrity or had tons of money, this would not be an issue. This country has lost its luster, the American Dream is dead............

I am feeling pretty low at this point. I just got off the phone with my wife, she is at the hospital in Surin, Thailand, my son has been admitted again with a 102 fever and pneumonia. He is only 20 months old and this is his second bout with pneumonia in 6 months. I was able to talk to him on the phone before they administered his IV, he said "po" which means daddy in Thai and he sounded so weak.

I am feeling so helpless........

Something has to be done!! Contacted Congressman and corresponded with local district office as well as the office in Washington DC. Contacted local and national media and my pleas are falling upon deaf ears. Sent a plethora of emails to all the USCIS DHS emails that I was able to farm from the Internet, and nothing from the Ombudsman as well.

I am at a loss, not knowing what to do next.

If anyone from the media or USCIS is reading this thread, I am begging you to take action ASAP. At such a young age and dealing with two bouts of pneumonia and bronchitis, this can have everlasting effects on my sons health.

I'm scared and desperate.

Aide from Congressman's office called me about an hour ago while I was still at work, at home now since I was felling like fecal matter. It was a direct response to the email that i had sent earlier in the morning. He was nice and cordial but was not happy that I had CC'd the reporter with the email and I said that I understood but was taking all measures to get some traction with with is going on in this fiasco. He has made contact with TSC but no response from them yet, I passed on to him that TSC was closed yesterday due to the weather.

Our situation is truly the "Perfect Storm", literally and figuratively.........................everything going against us.

Came across this, kinda felt it made some sense to our situation. Not sure, I do have a migraine right now..........

A successful business man was growing old and knew it was time to choose a successor to take over the business.

Instead of choosing one of his Directors or his children, he decided to do something different. He called all the young executives in his company together.

He said, "It is time for me to step down and choose the next CEO. I have decided to choose one of you. "The young executives were Shocked, but the boss continued. "I am going to give each one of you a SEED today - one very special SEED. I want you to plant the seed, water it, and come back here one year from today with what you have grown from the seed I have just given you. I will then judge the plants that you bring, and the one I choose will be the next CEO."

One man, named Jim, was there that day and he, like the others, received a seed. He went home and excitedly, told his wife the story. She helped him get a pot, soil and compost and he planted the seed. Everyday, he would water it and watch to see if it had grown. After about three weeks, some of the other executives began to talk about their seeds and the plants that were beginning to grow.

Jim kept checking his seed, but nothing ever grew. Three weeks, four weeks, five weeks went by, still nothing. By now, others were talking about their plants, but Jim still didn't have anything growing and he felt like a failure.

Six months went by -- still nothing in Jim's pot. He just knew he had killed his seed. Everyone else had trees and tall plants, but he had nothing. Jim didn't say anything to his colleagues, however, he just kept watering and fertilizing the soil - He so wanted the seed to grow.

A year finally went by and all the young executives of the company brought their plants to the CEO for inspection.

Jim told his wife that he wasn't going to take an empty pot. But she asked him to be honest about what happened. Jim felt sick to his stomach.It was going to be the most embarrassing moment of his life, but he knew his wife was right. He took his empty pot to the board room. When Jim arrived, he was amazed at the variety of plants grown by the other executives. They were beautiful -- in all shapes and sizes. Jim put his empty pot on the floor and many of his
colleagues laughed, but a few felt sorry for him!

Jim was the only one with the courage and honesty to bring me a pot with my seed in it. Therefore, he is the one who will be the new Chief Executive Officer!"

Got a direct response from the Congressman's office in Washington DC, I am assuming it is via the request I made via his web site. What is very interesting is that she addressed me by my retired rank from the Marin Corps, I have never included my rank in any correspondence. It would appear that they did a check on me? An assumption on my part.

I have been in contact with Tony Capitelli at the District Office and up to this point have not had any feedback from him.

Below is the body of an email that I have sent to officials at USCIS including the Ombudsman and the Texas Service where my wife petition was transferred to from the California Service Center. Please do take the time to read it, upon doing so, I hope that you can get the right people to act upon it.

Since I first sent this letter, my son has been to the hospital 2 more times due to complications of his bronchitis. This morning I received a call from my wife that my son is now suffering a high fever and is taking him to the hospital once again. We were approved for expedite processing of the petition due to my sons health condition over 80+ days ago, no action has been taken by USCIS since.

As each day passes, I am more concerned with my sons health deteriorating, I cannot fathom the worse case scenario. I myself am medically retired from the Marine Corps with Crohn's Disease, the STRESS of this process is taking a toll on my health as well.

Please, I am begging someone to find out what is going on with this whole process. I cannot get a straight answer from anyone.

I am writing email this out of frustration, mainly due to not being able to get any answers from USCIS and the delays in the legal immigration of my wife.

On July 21, 2010, I filed I-130 for my wife, Kampong Pinongram, receipt number WAC109023722. We are just one couple of the 35,000 applicants that were transferred from the California Service Center to the Texas Service Center on November 3, 2010 due to the case load at California Service Center. The I-797C states on the first line the following:

"This is to advise you that in order to speed up processing we have transferred the above case to the following USCIS office for processing: Texas Service Center"

I received the I-797C on November 8, 2010. On the same day, before I was even aware that our case was transferred, I requested an expedite for processing due to my sons health, he is a US citizen and with my wife the applicant, in Thailand. I made a trip to Thailand the end of October so I could meet with my sons doctors and to gather documentation on his illness and all the hospital stays. My son has been hospitalized for pneumonia and bronchitis which he still receives breathing treatments for. I was unable to bring my son back with me as I am employed full time and have no way of caring for him, my wife is the primary care giver. On November 15, 2010, I received notification from the Texas Service Center that stated "Documentation submitted meets the requirements for expedite processing of your application/petition." (Referral ID: T1B3121001253CSC)

As of this writing, it has been over 2 months since I received this letter and my son has had two more stays in the hospital and no status on the I-130. I have made numerous phone calls and each time have been told something totally different as to why the "expedite" has not been completed. On one occasion the CSR actually hung up on me when I stated that on all my previous calls I was being told something different from the previous call. Last Thursday I actually spoke to someone that was helpful and understanding and escalated my call to a higher level of support. Notes were added to our case, Referral ID: WTC0191101875CSC, and the gentleman that I spoke with recommended that I ask my Congressman and Senator(s) for assistance. I am taking his advice and scheduled a meeting with Congressman Dana Rohrabacher tomorrow afternoon, January 25, 2011 at 3 PM. I also spent the whole weekend making contact with local and national media outlets to get some attention to this matter.

As an FYI, I am a member of an online community that is going through the process of bringing our loved ones to the States and have been sharing the difficult experience with our applications being transferred in order to speed up the process, only to know other I-130 applicants that have filed after us have already been approved and their applications forwarded on to the National Visa Center. It is my hope that action will be taken to expedite my wife's application as stated by the letter dated November 15, 2010 from the Texas Service Center. If your not able to assist me personally, please pass this on to someone who can. Thank you for taking the time to read this.

Yeah, I hear you! That's what my wifey also tells me, if we irritate them more, they will push us down the stack!! I think seeing the people who filed after you get approved, does make one feel uneasy, helpless, complete wreck! Anyway, that's the fact of life!! They decided to screw us & there's nothing we can do to avert it! No choice! :crying: :crying:


You have a choice. Raise hell with your elected officials and contact your local and national media outlets. Don't just sit around wondering if and when you'll get approved. Do something about it. If more people would raise a stink like I suggested, it would help.

Son is back in hospital with breathing complications, I am teetering on the edge.

Just sent another e-mail to Congressman's aide and CC'd my contact at local paper as well.

Good morning Tony,

Have you been able to find out what is going on with my wife's I-130 which was approved for expedite over 80 days ago? My wife had to take our son to the hospital again last evening due to breathing problems, his bronchitis is not improving.

I am at a loss for words in regards to this whole fiasco, the health of my son is not getting any better and our approval for an expedite has been literally ignored by all. Does anyone care?

What does it take to get anyone's attention in this matter, especially when the health of a 20 month old child is at stake. What's the real purpose of getting an expedite? To appease and give us a false sense of belief that it is actually being expedited. It's like, expedite approved, move to the ignore stack.................

I am so ANGRY, I have done all that i can to keep my cool but have no idea how much longer I can do that.

I feel for you guys :( This TSC is such a mess :( But although we are approved, guess what we were told when we sarted asking why our case hasn't been sent to NVC yet? To wait 90 days after approval and just then start inquiring why our case wasn't sent to NVC!! Can you imagine 3 months it takes for them to sent approved petitions to TSC!!!! Huuummmm... So you better be patient and don't give up, coz although TSC approves them, it will take many days to reach NVC, unfortunately :(


All, keep posting all the roadblocks and inconsistencies that we are encountering. I may be PM'ing some of you this week with contact info of some of media outlets that have been in contact with me and are actively following this thread. I wished that more individuals would speak up to what is going on with them rather than lurk.

I appreciate your diligence in contacting the media. I'm wondering what kinds of outlets you've had luck with. In other words, what is the best way to go about it so I can do the same? Is it emails/letters? Are you looking up stories and emailing specific reporters or just sending letters to the editor? Are you forwarding links to this thread?


Contacted national and local media by way of "farming" email addresses from the Internet, feedback forms and immigration articles that I can track the article author down, Twitter has been pretty good as well. I have been providing links to this thread as a whole as well as some specific post in this as well as other threads. They are watching, it just depends on if/when they will pursue it.

I am pursuing all avenues to bring attention to this whole USCIS fiasco. Just so you guys know, there are some media outlets that I have contacted that are following our situation, unfortunately I cannot name who they are at this time. Lets just hope that some of them do follow through on exposing the poor management and customer service in place at USCIS.

Got an email from TSC.............wanted to confirm my receipt number.

Off to meeting with client now, hopefully some good news later in the day??


The email I received earlier today was from Denice Mitchell. It was a response to my follow up email to her on Thursday which I CC'd Congressman Rohrabacher's aide. I had left the last digit off of the receipt number in my my original email that I sent to Barbara Valarde Monday morning which I forwarded to Denice Mitchell Tuesday and followed up on yesterday. Damn, does that confuse you?

We'll have to wait and see what happens now. At least I know that a manager at TSC is personally looking into my situation.

I am mentally and physically exhausted with this whole ordeal.

Oh, I also got an email from a writer for the local paper tonight, going to answer it now. Regardless of what happens, I want to make damn sure that this whole fiasco is made known to the general public.
