To all members of VJ,

If my fiancee got the visa today, does she have to enter in the U.S right away or there is a month period? how does the fiancee visa work? she's thinking staying in Japan for couple of months to prepare everything before coming to U.S, she's worried that might get expired the visa before she get everything ready.

Please help us, thanks!

I'm presuming your fianceé has the K1 visa? She has up to 90 days in which to enter the US upon receiving the visa and then a further 90 days to get married. Hope this answers your question.

I beg to differ, fiance(e) has 6 months to enter US and then 90 days to marry upon arrival.

I think pushbrk's statement was right on-mark. She needs to establish what her permanent address is going to be, and then that's what you'd put on the I-129f... Your petition probably won't be approved by July, so she needs to decide where she wants to go in July, and stay there.

Frankly, visiting her mom sounds like a peachy option. You can then put her mother's address on the I-129f and she can then deal with the embassy in Spain.

Hey everyone, I have ANOTHER question. Just to fill everyone in, we sent the I-129f petition
packet to USCIS in California on November 1st and received the NOA1 on the November
8th, I believe. Anyways, we're applying for the K-1 Visa and have been waiting about 4 1/2 months.
Any November filers received their NOA2's yet?

Okay here's my question...
About how long is the process from when the USCIS sends your petition packet to the embassy
to the time the embassy receives it and schedules your interview, approves/denies it? I understand people
have to wait for it to arrive at the embassy, and then wait for it to sit at the embassy
for awhile? Then we have to wait for an interview to nbe scheduled (in the meantime we should be collecting
police papers/hospital papers). I have heard it can take 2-3-4 months from the time the documents are sent from USCIS to the time
the visa is denied. Is that true? I realize all cases vary, but I am just
trying to find out the AVERAGE time. I first heard that the ENTIRE process takes 5-6 months from the time you send the I-129f petition packet
to the USCIS to the time your visa is either APPROVED or denied, it takes 5-6 months, but now Im thinking it takes about 8 months to one year
for the ENTIRE process to be finished, from sending to the USCIS to getting visa approved or denied.

Thanks a lot everyone! I hope this jumbled collection of words in which Ive tried to formulate into a question makes sense!
Thanks again!

littleasianman7,

Read this thread, http://www.visajourn...h...opic=78&hl=

There are 164 pages so i suggest starting from the page 164 and work your way back to get the most current info.

In my case, it will be almost 11 months from time of petition submission to interview date, I did have a delay of approximately one month for an RFE then a NOID (Notice of Intent to Deny). The RFE was my mistake but the NOID was them asking for paperwork that HAD already been submitted.

DO NOT LOSE THE NOA2!!

You do not need the NOA2 at the interview, they wouldn't have the interview if you did not receive the NOA2 to begin with.

You will need that to file AOS. If you lose it, it will cost $$$, I believe $200+. Someone will correct me if I am wrong.

Dear all,
My fiance filed the I-129 and NOA1 was issued on Dec 7th 2007.

We sent petition by the help of lawyer. In the I-129F instruction it was told that we had to attach relationship proof. when my fiance brought bunch of our relationship proof to the lawyer (letters, cards, photos), lawyer returned most of them and only attached 2 of our pics along with the petition. He said to my fiance, I should just bring the rest of proof on the interview.

It's been almost four months and We are worried that something wrong happened with our petition. So I want to know what all of you attached as relationship proof when u filed the I-129F petition. I am worried that those 2 pics were not considered sufficient, yet that's what our legal advice did, and that that rest of our -abundant- prood shall be brought on my interview once our case is approved.

Pls give response and advice as to our case!

Many thanks in advance smile.gif

If what the lawyer did submit is not enough evidence, you will get an RFE. No big deal really, just submit what the lawyer didn't submit to begin with.

When I submitted my petition, I only provided some photos, copy of my finacee's and my passport showing entry and exit stamps when we traveled together, some phone bills, Western Union receipts and a two page letter detailing how we met.

The bulk of our evidence of relationship I sent to her to take to the interview.

Have your fiance call the service center handling the petition to check on the status of it, read this link for details:

Thank you all for the input smile.gif

I am on a payment plan with the law firm, and so far have just made
an initial payment of $500. So I suppose I could still bail, as I have yet
to submit any info/documents.

Here is why I chose to use a law firm (and please feel free to comment
as to whether my reasoning is sound, as I could be wrong)...

I only have 3 pictures of me and my fiancee together, all taken on the
same day at the same beach. In each picture, I am wearing sunglasses,
though the photos are close up enough to tell that it's me (still, I figure
wearing sunglasses isn't a good thing). Also, the pics aren't dated.

In addition, I still have my flight itinerary, but not the boarding passes.
We also didn't do a lot of emailing prior to meeting, but rather, communicated
through Instant Messenger (only saving a few trivial conversations) and over the
phone. Fortunately, I do have receipts of the phone cards I used.

Anyway, due to the above factors, I fear that there are some weaknesses in
my case. Therefore, I figured hiring a reputable law firm might add some
leverage and help assure success.

Are my concerns reasonable, or am I worrying too much? Let me know your
thoughts.

For #1, how long after going does it take to get the actual report? Do they mail it, or does she have to go back to pick it up?

When my fiancee went to get hers, they told her she could pick it up in a few days. She ended up picking it up a week later since she was going to visit her sister in Koh Samet. Most people have been told that they will mail it to them in a few weeks.

Got some questions:

1. Can the police report be done via the mail, or must it be done in person in Bangkok?

2. For the medical evaluation, how far in advance of the medical date does it need to be done?

3. For question 20 on the DS-230, what do you do if she lived in several cities, but for less than 6 months? Just leave a "hole" in the timeline?

4. For questions 22 on the DS-230, I don't think she can honestly remember every place she worked for the last 10 years. She works at beauty salons, and is constantly switching between them as her friends leave or the shop shuts down and a new owner takes over. I'm just going to assume a "best effort" should be enough? Put jobs that don't have room on the form on a "supplemental"?

1. Has to go in person and present her passport and sign some forms.

2. Not sure, I had my fiancee do hers a week ago and her interview is not until May 29th.

3. List them all, do a supplemental page if needed.

4. List all possible, do a supplemental page if needed.

Well, our case is different because he was in the US illegally from 2002-2007 (a fact I didn't know until much later) and we have two children. He wasn't deported out of the country but left voluntary. The judge we spoke to let him stay in the US until our daughter was born and told him that he shouldn't have any issues getting a Visa to enter the US. I'm just concerned that something might go wrong or that that might get in the way. I need him here to help rasie our children and I am so nervous that I'm going to mess something up.

With that being the case, an immigration attorney would be a good move. Research them though, make sure you get a good one.

The protesters are blocking access to airports, from what I read at BKK Post, they have successfully blocked 3 airports. Hopefully the state of emergency will curtail this from happening.

PAD supporters in Songkha block Hat Yai airport

HAT YAI: -- Supporters of the People's Alliance for Democracy in Hat Yai headed to the international airport there to stage a protest.

The protesters blocked the entrance to the Hat Yai international airport to protest against the announcement of state of emergency in Bangkok.

Maybe a change of heart????

No Phuket airport blockade, says PAD; tourism suffers as tourists cancel trips

PHUKET, Sept 2 (TNA) - Supporters of the People's Alliance for Democracy (PAD) in Thailand's southern resort island of Phuket vowed to continue their protests despite the announcement of a state of emergency, but would not block the island's international airport.

Natcharong Eakpeumsap, head of the PAD support group in Phuket, said the anti-government protest supporters on the island would not block the airport as airline service was the only and the fastest mean of transportation which could take them to join the PAD protests at the Government House compound and at Makkawan Rangsan Bridge in Bangkok.

The Phuket PAD leader said the airport blockade would have a greater impact on international tourists rather than local travelers. The PAD would instead demonstrate at the city's Sapanhin Park.

Meanwhile, Apichart Sangaree, president of the Association of Thai Travel Agents or ATTA, said the political turmoil had threatens to damage the country's tourism industry.

The ATTA president admitted the current situation had impacts on travel agents as September was the high season of Australian and Asian travelers.

Mr. Apichart also expressed concern that if the turmoil does not end soon, the tourism industry would suffer, as from October onwards is the 'high season' period when a million European travelers usually travel to the kingdom.

The ATTA president added that the association must evaluate the situation daily and hoped the government would not declare a curfew as this would frighten the tourists. (TNA)

Hi All, Question probably been asked many times but I got my noa1 on June 15th and got a touch on July 8th. I would love to see my Thai fiance by xmas.
Is it possible to get approved and an interview done by mid dec? The waiting is driving me crazy. I pray everyday for a quick approval.

Thanks all

I don't want to discourage you at all, so I'm trying to think logically here. First of all, fill out your timeline, as I have no idea when you sent your I-129f petition to USCIS, nor do i know what service center you sent this to. This is all relevant information in determining about how long your process will take.

If you sent it in on June 1st, you may be looking at an October, november, or december NOA 2 date. OR if processing goes faster than what it is going at now, maybe you could get your NOA 2 in September. From the NOA2 you have to wait for it to be sent to NVC, then from NVC to the embassy, then you gotta deal with all the packet 3 stuff being sent in, then when that's sent in, you gotta wait for the interview date which could be scheduled anywhere from realistically 2-4 months just for an interview date. Sorry man but I really don't think it's possible that she'll be over here BEFORE December or IN December. I hope, of course, for your sake that she is. Hopefully you filed at CSC as VSC is taking longer to process now than CSC.

I wouldn't count on anything until it arrives at the embassy and they have scheduled an interview. Once the interview is scheduled and packet 3 is in order as well as medical and shots, the only thing that could delay it is a death in the Royal family.

Look at my time line, 1 week short of a year to get my wife here.

Just popping in for a quick update.

Ou has been here for a little over a month and is loving it!! A week after she arrived we moved from Yorba Linda to Huntington Beach / Fountain Valley, only 3+ miles from the beach and so much cooler down here. She actually gets pretty cold at night!!

We have been up to the N. Hollywood to Wat Thai a few times and we stop by Thai Town in Hollywood on the way home. Everything she needs we can get here where we live, we have many Vietnamese/Khmer/Chinese markets nearby, we just spent buko $$$$ at the market today but i have authentic Thai Food EVERYDAY!!!

We will marry in a few weeks and file her AOS, not looking forward to the paperwork BS again but it's a necessary evil. She is anxious to get to work and go to the local Jr College, OCC. Her english is awesome but I want her to take an ESL class to improve her writing skills. Believe it or not, her english is better than all the Vietnamese that work for me and they have been here for YEARS.

Good luck to those just beginning their visa process..........it sucks, but WELL WORTH IT!!!

They pulled her from the line, asked a few questions and that was it. She said that she had her bags before anyone else on her flight had finished Immigartion. All in all, it took her 30+ minutes from disembarking the plane and getting through Immigration.

She has already asked where the Thai Market is.....................we're going there first thing tomorrow and probably to the Wat in Thai Town this weekend. We have to have a spirit house for the new home we're moving to in a few weeks.

Just got back from LAX..........Ou is now on American soil!!

POE was pretty easy, I told her when she got in line for Immigration, to tell one of the Immigration officials that she is here on a K-1 Visa. They pulled her from the line, asked a few questions and that was it. She said that she had her bags before anyone else on her flight had finished Immigartion. All in all, it took her 30+ minutes from disembarking the plane and getting through Immigration.

I'll do the Visa Interview and POE review in the next few days.

Awesome!! Congrats!!

I just spoke with Ou and she is counting down the hours. She is going to go to a few markets today to get some stuff for me and then hit the rack early, she leaves for the airport 5 AM Wednesday, Thailand time!!

Finally........................this process will be 2 weeks short of a year when she gets here.
