All of this discussion just proves that you need to get proper tax advice from a tax preparer that is familiar with two-country families!

 

And...like someone mentioned above, it all depends on timing.

 

Our case:

 

We married in March, 2013, so for this US tax year, we will file "Married, Filing Jointly".

But...we are still stuck in I-130 la-la land (otherwise known as the Texas Service Center) and there is no way we'll have my spouse's green card by April 15th.

So we have two options:  ITIN or Extension

 

Perhaps it is my paranoia - but I feel that filing an extension puts a big red mark on your tax file that says "Audit ME!  Audit ME!

 

But trying to get an ITIN when your spouse is in another country, AND, you are in the process of getting a green card is really hard.

 

In order for my spouse to get an ITIN in time for me to file, she would either have to mail her passport to the IRS (for identity purposes) OR she'd have to mail her passport to the US Embassy in Sydney to get her passport "certified".

 

The IRS in the US says they will return the passport within 60 days.  That's TWO MONTHS!  She cannot be without her passport for two months right now!  And, I love how the IRS says, "If you don't have your passport back within 65 days, call us, and we'll see what we can do."  I mean, REALLY!

 

So I think we are going to go the Sydney route - we'll express mail the passport down there, and include an express mail envelope to get it back.  Hopefully, she'll won't be without her passport for more than two weeks.  I have more confidence in the US Embassy than I do with the IRS!

 

We could file an extension, but I am due to get a very large refund this year, and I do not want to delay that!  We need the refund!

 

Again:  be very careful, and get the right tax help!

Corlitoa, Here is a pdf file that has all the info necessary for the DS-260.  You will have to fill out the DS-260 online when the embassy says to - but you can use this file to get all the data ready.

There are several countries (Japan, Hong Kong, and some states in Australia) that will not return a PCC to the applicant - they send it directly to the Embassy/Consulate where the interview will take place.  If Uruguay will ONLY send the PCC to the NVC, it would behoove you to have an IV cover sheet attached so that it can be automatically scanned in.

 

If Uruguay will only send the PCC to the appropriate Embassy/Consulate, that is usually not an issue as long as NVC is clearly aware of the fact that Uruguay does this (it has to be in their Adjudicator's Manual).  If the PCC is going directly to the NVC, or to the Embassy/Consulate, be SURE to write that in your IV packet cover letter so the NVC reviewer knows what is happening.

We will be submitting our I-130 next week.  Two weeks ago, my spouse had a stroke, and subsequently, they found a hole in her heart which may have to be fixed by open heart surgery.

 

I have read a lot about the medical examination, and it appears that what they are looking for are communicable diseases like tuberculosis and syphilis, among others.

 

The surgery should fix her heart condition.  Will this kind of medical history (stroke/heart) keep her from being approved? 

 

I don't think it will, but I should would like some validation from someone who has had a similar experience.

My Stupid RFE:

 

We received a checklist for a Police Clearance Certificate.  My spouse lives in Queensland, Australia, and the NVC's instructions in the checklist clearly state that the PCC is sent directly to the US Consulate in Sydney.

 

Does not compute....

 

Turns out, they expected her to get TWO checklists - one from Queensland, which they had correctly encoded to be sent directly to the Consulate, but ANOTHER checklist from the State of Victoria, where she lived for 20 years.

 

On the instructions from NVC, there is a URL for the Victoria PCCs - I mean, IN THE LETTER THEY SENT US - that, if you open it, says that the State of Victoria will NOT give police certificates to people who DO NOT CURRENTLY LIVE in Victoria.

 

AND, the fingerprint checks for Australia are nation-wide.

 

So, the checklist was for an unnecessary Police Certificate, which could not be gotten anyway.

 

It took me 5 days of calling NVC to finally figure out what was going on behind the scenes.  The checklist never specified that it was a certificate from Victoria that was missing.

 

We would have had a case complete over a week ago except for their error.  ARGH!

Hi everyone!!

I was trying to find out about the procedure of getting married after entering the US on K1 visa.  But couldn't find anything in particular.  What is the legal procedure for getting married in NY state.  My fiance stays in Long Island. I am thinking of a traditional Temple wedding & then small party to our friends later on. But want to know what is the procedure  to legalize our marriage.  Anybody from India who got married under K1 visa can help me? Or whoever having information on legal procedure could also help me.  In India, there is a one month notice period involved if you are going for registered marriage.  If its a traditional wedding, you just have to fill a form & apply for registration to your local authorities i.e. marriage registrar. Not sure about the procedure in US.My case has been forwarded to NVC & I am waiting for case number.  

 

 

You and your partner will need to get a marriage license first - from NYC or your county clerk, depending on where your fiance lives.  There is a 24-hour waiting period in New York.  So...your license will have a date and a time stamp on it.  Your celebrant (judge, holy person, whoever you choose - but they must be LEGALLY able to perform a wedding in New York State) cannot sign your license until 24 hours after the time stamp.  So don't plan a wedding until after you've had your license for at least 24 hours (they are good for 60 days). You will then get your marriage certificate (the one with the seal on it - you'll need this later!) mailed to you after your celebrant files the paperwork with the city or county clerk.

 

Look up the info on Google for his town (if it is not part of Queens or Brooklyn) for the county or city clerk's office.

Yep - it depends upon the rules of the state in which you marry.  Your K-1 visa has a built-in expectation of marrying - it doesn't matter when as long as it is within the 90 days.

 

I think what you might have read might be for those entering with visitors visas, marrying quickly, and then applying for an Adjustment of Status.  That can look a little fishy.

 

You should be fine!

It really is simple - just tell your story!  Some of us met online first, then made that first big trip to meet in person (scared, and excited!).  It doesn't have to be a work of art (I think it's supposed to be a single page).  Mention dates.  Mention where and how you met.  Mention any facts about introducing your love to your family, friends, etc.  Talk about the fun.  Talk about the struggles of being apart.  Talk about how you know s/he is THE ONE.

 

You are trying to satisfy the requirement of having met in person within the past two years.  Just be sure your story includes that key fact!

This means that you have enough money so that you will not try to claim welfare or unemployment benefits when you come to the US.  Perhaps you have a special training that will make it easy for you to get a job.  Perhaps your partner has a very good job, or a lot of assets (bank accounts, investments, real estate) so that the two of you have enough money to live on.

 

You need to be able to prove that you have your own financial safety net.

Try posting in the Australia portal for specific information related to the P3 and interview.

 

Your I-129 will be sent to a central PO Box. From there USCIS will decide which office it goes to for processing, based on several criteria.  You have no control.

 

Regarding wait times, our I-129 went to California, but at that time it was the slowest. The system is in constant flux.

 

We filed our AOS in October and are being told to expect the green card in June.  Others filed in December and have already received the Green Card. You just have to ride it out.

Grr, they should add this onto the USCIS website instead of just saying we apply as any other hetero relationship. Fingers crossed for no RFE's!

 

I'm an I-130 filer, so this doesn't apply to us (same-sex, married in New York), but it infuriates me that the petitioner is responsible for PROVING that the place where they intend to marry lawfully allows it.  I know most of us same-sex couples probably have a good grasp of the law in our respective states, but honestly - to make *US* prove it?  Definitely growing pains here.

 

So...it does show that we will face heightened scrutiny with our petitions.  Darn

Gemini,

 

Marriage and marriage rules are controlled by the state where you are getting married (not the state where you live).  Go online and search for marriage requirements for the state/county in which you want to be married.  I was married in New York State/Columbia County. No SSN required, but you must have applied for the license 24 hours BEFORE your ceremony.

 

In some states, there is a 3-day waiting period.  So it really depends where you are getting married.

Hey everyone.

I got e-mail from Embassy of Buenos Aires telling me I'll have my visa and package at the DHL office between Monday- Wednesday  :)  I was starting to get worried with all this backlog thing, but fortunately it only took few extra days for me.

 

Anyway, my question is...

I have a flight to Newark with scale in Atlanta (1:30' h scale). Where do I need to do the immigration process, in Atlanta during the scale or in Newark? How long did it take for you?

 

Also, I have my vaccinations list from my asigned Dr. He told me I only needed to get one, the Influenza, which I got some days ago in a public clinic, and they put a stamp and seal on the Dr's prescription for the vaccine. So I have the list that he gave me, plus this paper that says I have put the one I had left. Should I put this along with the X-rays envelope and present it like that?

You will go through Immigration in Atlanta.  1 hour and 30 minutes is a very short layover time in Atlanta.  There is a good chance you may miss your flight to Newark.  Go to the POE section of Visa Journey and read about peoples' experience in Atlanta.  It will really depend on what time of day you come through Atlanta.  You will probably have to change terminals as well.  3 hours between flights would be more prudent. 

 

But...if it is quiet, you might just find that 1.5 hours is perfect!

 

You will, most likely, not have to present your x-ray envelope in Atlanta.  Have it in your luggage, though.  Do have your list and your paper with the doctor's seal on it with your immigration packet (the DO NOT OPEN one), and hand all of that to the immigration officer.

Could it possible be because the "Nannygate" Visa denial and now you are going for a K1 that they think you are just petending to be a same sex cope to get her to US.

 

I mean it has happened on these vary pages where someone posted "I am a man, I married a girl to come to us. I told her i am gay. Now I am in love with a boy and want him here in us with me".

 

Seems the CO doubt the validity of your relationship and all. What kind of merging of lives have you shown? Your wedding plans and all that stuff.

 

And well also like I have told people nothing says commitment like marriage. 10 years together and not married even for same sex? They might think its all a setup.

If the Filipina cannot get to the US, then how can this poor same-sex couple get married?  The Philippines will certainly not marry them.  For both parties to get visas to a country where they COULD marry (and it looks like Brazil is the only current option) is difficult and expensive.  And, the possibilities for a USC to bring a same-sex partner to the US is only one year old.

 

If they've been together for 10 years, it might still be hard to prove this, as they might not have been able to do anything (legally) together in the Philippines to prove they are together. 

 

Also - I myself COULD have gotten married to my Australian partner three years prior to DOMA's demise, but my immigration attorney said NOT to - as it would affect my partner's safety in trying to enter the US on the Visa Waiver Program.

 

So...go easy on this couple for not marrying.  They have had the option denied them in the US until last year, and then when they tried, it blew up in their faces.

 

OP - please tell me that your immigration attorney is a SPECIALIST in same-sex cases in the US...

It's always OK to hand-write on the form if you need to.  I know about Japanese addresses, having lived in Japan for a while.  Either hand-write them in, if you feel comfortable doing so, or have your fiance(e) write them, scan the document, and send it to you to finish.

On the I-864, in the spaces for information about the sponsor and beneficiary, there is a space to put a zip code and there is also a space for a postal code. What would be the difference?

 

Zip Code is a US postal code.  ONLY use the Zip Code field if you are using a US address.  Use the postal code field for any other country.

 

ZIP is an acronym for "Zone Improvement Plan" - a plan to move mail faster....

A very odd thing happened to me between about midnight and 2 am Eastern time (afternoon in Australia).  I was checking my status via the CEAC site and the page changed!!!  Instead of entering just the "type of visa" and "Case Number" - there was another box in between these that asked for the "Place".  It's a huge drop-down menu of all the Embassies/Consulates!

 

I still got the "In Transit" message, so went away for an hour or two.  Then I checked the status page again.

 

The "Location" drop-down menu was gone!!!  Methinks they were messing with the site during the night!

 

Did anyone else happen to see this?  You would have had to have been a US night-owl to have caught it...

Thank you Sukie for the response. I'm actually aware of that. My question relates to the IV-turned-temporary GC by a POE stamp. If, for example I wait until the last day of the IV validity before I enter the US, will I even have a valid temporary GC until the real thing arrives?

 

Sorry, MoBar - I misunderstood.  I know the I-551 stamp in your passport is good for one year - but I don't know if the counter starts when the visa is placed in your passport, or if the counter starts at POE.  I'm sure someone on this forum will know, though!

It is six months from the date of your medical exam.  You MUST enter the US before this date (six months from medical).

    I know very well who's in charge, sorry I didn't make myself clear.  What I mean is the games they play and the Embassy did look at my documents except for one.  If they don't usually do this they should because it's their job to let us know what they expect in terms of documents if one is unsure since they have Carte blanche to do as they wish with our lives.

 

Soloenta, your post reminded me of a time, many years ago, when I was an auditor for the bank that ran the "Carte Blanche" credit card.  It appears to still be a valid credit card under the aegis of Diner's Club...

 

The person who was the business leader of the card (Headquartered in the Midwest) had obviously never had a French lesson, or been to France.

 

This person pronounced the card:  "carty blank"

 

I nearly DIED when I heard that!!!  Snort!

I could have sworn I read that you don't have to amend it. But if you do, I too am curious as to what must be done. I specifically had read that you didn't have to file as married if they had never visited the states because the spots where you specify SSN or Alien number cannot be filled out.

 

And now I am hearing you must write in Non Alien Resident. How on earth do normal people get through a process like this when 90% of lawyers have no idea how to approach these situations and the common man doesn't know to sift through pages and pages of information to find his answer. And when he does there are so many conflicting reports. I agree, it's way better to be safe than sorry but this just becomes ridiculous at this point. Why did they approve the AOS in the first place if it is not to their liking?

 

I agree it can be confusing - and it is MORE confusing because accountants keep telling people the wrong thing.

 

If you are married, you have three choices:  Married, filing jointly;  Married, filing separately;  or Head of Household (additional rules apply to this category)  No other choice is legally correct as far as tax rules go.

 

You may or may not get through the NVC and the interview if you are married and have filed "SINGLE".  The problem comes because you have incorrectly filled out your status with the Internal Revenue Service (IRS) - and your Consulate or Embassy may see this as a real problem.  For some people, it is a comedy of ignorance and error.  But your Consulate or Embassy may see this as a sign of fraud - because why would a married person file as "Single" unless they really were NOT a couple?

 

Accountants use tax software that doesn't understand bi-national couples and the struggles we go through.  The tax software does not allow "NRA" or Non-Resident Alien to be filled in the SSN/ITIN field.  Those of us who need to file where our spouses do not have ITINs or SSNs must file our tax return MANUALLY.  In other words, you have to mail a paper copy of your return to the IRS - instead of filing your return electronically.  If you file a PAPER copy, you can easily write "NRA" in the foreign spouses SSN/ITIN field.

 

If you were guided incorrectly by your accountant (and it seems like this happens to about 95% of us), it behooves you to file an amendment as Married, filing Separately as soon as you can.  If your interview is approaching quickly, file the amendment, and bring a copy of the amendment form to your interview.  Explain that your accountant steered you wrong - I can almost guarantee the Case Officers will understand this.  But showing that you KNOW you made a mistake, and showing that you are doing everything in your power to CORRECT your mistake will get you a lot further.  It might not save you in the end, depending upon your Consulate/Embassy and your particular Case Officer, but acknowledging the mistake and showing action is a positive thing.

 

Oh, and fire your accountant.

Interesting reading, LoveMyTico.  When do these sessions usually occur?  I'd love to ask some questions!!!

 

My attorney sent us a copy of the interview letter, even though she knew we got a copy too.  She asked if we had any questions, and I asked her about bona fide documents to take.

 

But knowing she is an AILA attorney, and knowing that she actually wrote the how-to-for-lawyers book for the AOS and IV forms, I asked her two questions...

 

1.  How does the Adjudicator's Manual get changed?  Especially when I know there are errors?

2.  What can be done about the disparity in what the I-864 instructions say and what NVC checklists (leave Place of Residence blank if the same as Mailing address issue)?

 

I will report back if she has any solutions.  Those of you whose cases have been affected by clear NVC errors (like W-2s for people working overseas and my case - PCCs required in error) - maybe we can make a difference for those of us who come later.

Hey everyone!! Haven't been on here since yesterday morning. Been making travel arrangements and booking hotels. Also, started collecting all my documentation for the Portfolio my husband will take to the interview. We decided we'll take advantage of having to go to Paris for the interview to make it a mini 2 night- 3 day vacation.
Plus it's final exams at school and I'm swamped with grading and submitting grades. ANDDD the World Cup started, so need to watch those.

We've been doing the same thing!  We've decided to make a 3-day trip to Sydney.  Our son lives there, so we're flying down early on a Sunday morning and spending the day with him, then we're going to do the Sydney Harbour Bridge Climb on Monday, with our interview on Tuesday.  We wrote the consulate yesterday (they do not allow phone calls) to get formal permission for me to attend the interview together.

 

We're rather giddy at this stage.  I was on the 'net last night booking flights and a hotel....

I have tears in my eyes.  I am so happy for all of you who have interview dates today and the best thing is that it looks like you are not having to wait too long.

Can anybody answer this question.

 

We may or may not get checklisted for a Hong Kong and a Singapore Police Clearance Certificate.  If we do will they give us a Case Complete and we can get the Police Certificates sent direct to the Consulate ready for the interview.  This will save, like, a month.


 

Hong Kong will not send a police certificate to you - they will send it directly to the consulate.  I believe that someone else said that Singapore will not issue a certificate to a non-resident.  If this is true, and you get checklisted for it - you may have to "prove" that you cannot get a PCC from Singapore by photocopying the page on Singapore's website where it says this.

 

This is what I had to do to get NVC to close my case - because they were asking for a Police Certificate from Victoria, and my partner lives in Queensland.  I could never talk an agent into letting me talk with a supervisor about the fact that NVC was incorrect.

Congrats!  That's exactly one year from your NOA1 date!   :dance:

 

Actually, it's not.  The actual NOA1 date has been in question throughout this process.  On my case complete letter, my priority date was listed as June 27, 2013, which is the date they received and logged my petition.  But the letter came dated July 1st.  So I've never really known which date was my NOA1.

 

Anyway - it will have been a little over a year for the whole process - and I will be soooo thankful it will be over for two years.  Then we'll have to get the conditional visa changed to a 10-year one!

 

Then a year later go for citizenship!

 

So I'll be on Visa Journey for a looooooooooooooooong time!

OOOOOH!  What good news from folks!!!  It's early morning here in Australia, and I see that my L-Girls all got great news overnight.  Wondering if LindyStephan has checked in (he can't be an L-Girl - well, maybe an honorary one....), as he's in the same date-range as the rest of us!!!

 

Also - Snikit15 - wondering about you!!!

 

I have to have breakfast before calling - I'm one of those people who need to eat first thing in the morning...it's only 5:15 p.m. in New Hampshire, so I'll have plenty of time to eat before finding out if we have an interview date.

 

We had originally booked to fly out of Australia on July 7th, because we figured on an early June interview.  But because NVC screwed up our case, that date is really not possible.

 

Also, we're taking our grandkitty back to the US with us - and that will change how we get back to the US (we normally stop in Hong Kong for a few days - but no stopping now!!!) and I've been on tenterhooks because I have to rebook flights for us AND make sure we can get the cat home at the same time!

 

I'll check in later to let you know what happens!

Yes Ma'am.... mine came through at 6:02am EST. I was driving to work and happened ot look at my email  while I was at a Red Light !!!  It was a good feeling but my first thought was " WHERE THE HECK IS MY INTERVIEW LETTER?"  not in those exact words.. :rofl:

Just received (10 minutes ago) our official "Case Complete" email.  While I'm excited to get it, I'd MUCH rather get the Interview letter!

 

How low we have stooped!!!  But like another Aussie couple here, I'm surprised that the NVC process has been so much HARDER.  It's like they are doling out the lifeline one little centimeter/inch at a time!!!!

I have a package waiting to be reviewed as well and I received a Case Complete on Monday. My other package was not even scanned until June 6th though, it was just additional documents I forgot.

 

Did the person that you spoke to say that you will get a new Case Complete date? What do they mean by "update" your case?

I had a package scanned in May 9th, and another one (the same info) on May 15th.  They gave me case complete based on the May 9th data.  They did NOT hold me up waiting for the data from the 15th.

It sure is alot of money !!  I saw that post when I woke up this morning and almost had a heart attack.. My husband only has to pay $75.00  or at least that is what the instructions say.    But $75 is alot of money in Costa Rica. I think the xray is additional. Not sure about the labs.   That is why he went to his family doctor to get up to date on his vaccinations.  Maybe Sukie's partner had to pay so much because she got more vaccinations at the appointment??? Not sure.. That is a huge amount of money for a medical

 

Julie had ALL her vaccinations and titers done before the medical.  So the $475 is just for the exam, bloodwork and x-ray.

 

I cannot remember how much I had to pay in Hong Kong when I got my Australian residency - but I don't think it was over $300.

 

It's definitely a rip-off - especially since we have to pay over $30 for the train ticket to get to Brisbane!

We're in Brisbane and are in the AOS pending paid stage.

 

Where did you do the medical? Do you think we should get it done now?

 

 

 

 

 

Hi Olives24!  We're on the Gold Coast!

 

Your medical is good for 6 months, meaning you have to enter the US within six months of the date of your medical exam.  So you need to make sure your timing works for that.  I would suggest you call the civil surgeon in Brisbane when you know your case is complete.  Your interview won't be for 4-6 weeks after the case is marked complete, and that should give you plenty of time to schedule the medical exam (we called on a Thursday and got a slot on the next Tuesday) and get the results back before your interview.

 

The civil surgeon is right at Central Station on Ann Street.  You have to walk two blocks away (to Queen Street) for the blood tests and then up the mall for the X-ray.  We were done in less than two hours.

My partner went for her Medical today in Brisbane, Australia.  We were lucky - they scheduled the exam for her even though we don't have our Case Complete email yet, nor our interview date.  Turns out all they wanted was her case number, so we could have gotten her exam done two months ago!

 

Anyway, I was surprised that they told her it would take seven days for the results, AND, she has to go back to their office to pick it up.  It takes us an hour-and-a-half train ride to get into Brisbane.

 

The receptionist said we could have it mailed to us for an extra $20, but firmly discouraged this method.

 

I, myself, think that $475 for an exam is an outrage, and having to go back to pick it up is too.  However, it is the last "tick" of the box prior to our interview, and for that, we are both thankful.

 

I see LifeOnHold got her CC email on June 9.  That means ours will probably come on June 11.  Sure wish we'd get that interview email, though!

 

I've not seen any interviews given in the last three working days at NVC...
