Hello to all!!!
 

 On Feb 10 my application was approved from TCS. They sent it to NVC Feb 26. When should I start calling NVC for Case Number?

First of all, start calling NVC about March 10th to see if they have received your file.  It seems to take about a week to get from Texas to New Hampshire.  Then, count on about 20 business days (about a calendar month) between the receipt at NVC and the assignment of your case number.

i have a dilemma regarding my taxes, anyone wanna comment?
 

i'm domiciled in california, which is a community property state.  in other words, any income i earned after the marriage is considered a 50-50 split with my wife.  the way i see it, i have 2 options:

 

1.  MFS (and amend to MFJ after wife receives SSN).  Benefit here is that I don't need a SSN/ITIN for my wife.  Drawback is the extra $ i will owe, as well as the complexities introduced by the community property rules.  due to these rules, does she need to file a tax extension if we go this route?

 

2.  MFJ.  I will take a trip to see my wife in april and return on april 11.  if i prepare my taxes and have her sign the return+ITIN documents, I should be able to mail everything off prior to april 15.  The only drawback I see here is that the tax transcript may not be available in time for the interview.

 

what do you guys think?

Unless your wife has a copy of her passport certified by the consulate or embassy in India, she will have to submit her PASSPORT (or other original documents in lieu of her passport) with the ITIN application.  Choose carefully.  The IRS can hold the passport for 60 days!  I had my spouse send her passport to the consulate in Sydney Australia - it only took 5 days (and $50).  Being without a passport at this stage of your application could really hurt you.

 

You don't need the 2013 tax transcript for the interview - but your spouse will have to carry a FULL copy of your 2013 Federal Tax Return.

OK - Now that I know my petition is at NVC, I'm trying to make sure I've got the I-864 nailed.  I have two questions...

 

1.  On Page 1, Part 2 is all about the Principal Immigrant.  Is the Mailing Address (questions 2a - 2h) the place where my spouse CURRENTLY lives (in Australia) or should it be my address here in the States (where she will live once she immigrates, and where we want her Green Card and SSN card sent)? 

 

2.  I will be providing 3 years of tax transcripts.  On Page 5, question 13, should I check this box (because it expressly says I'm only providing the most recent tax return), and check Box 14, as well?

 

Honestly, this document is so poorly designed!

I called NVC this morning and found out that my petition was received yesterday, February 25th (from TSC - Dates in signature below).  Without prompting the customer service rep told me to wait 20-30 business days before calling for a case number.

 

Lindystephan and I are on the exact same journey timewise.  It's nice to be able to check in with each other!

Apologies, let me restate my question. My company intends to transfer me to the US. What evidence do I need to show that my foreign earned income will continue in the United States to justify the use of foreign earned income as the ability to sponsor? Should there be a statement in my letter of employment with Japanese salary of intent to transfer to the US?

I would suggest that you ask your employer for a letter that has these elements:

 

1.  Azabu-san is employed with <company name>. 

2.  Azabu-san joined the company in its <Japanese city> office at <date>, and holds the title of <your job title>.

3.  Azabu-san's current salary is xxxxxxxxxxJPY, which is the equivalent of xxxxxxUSD.

4.  As of <date>, <company name> intends to transfer Azabu-san to its US subsidiary located in <US city>.

5.  Azabu-san's salary will remain at xxxxx USD.

6.  If you have any questions, please contact xxxxx-san in <your Japanese city> at <Japanese phone number> or Mr./Ms. xxxxxxxxxxxxxxxx at <your US city> at <US phone number>

 

Be sure what you submit is a "wet" copy - meaning that it has an original inked signature by whoever signs it.  If your Japanese writer has an inkan, put that on too - that makes it look very original!

Ezorro4, the National Visa Center (NVC) is in Portsmouth, New Hampshire, which is very far away from Washington DC.    I don't think you can rely on Washington's info to determine whether NVC is open and working.

I received notifications that my 130 and 129f were approved on Feb 3rd, received hard copies like a week later from TSC.

On Feb 5th, received notification I29f sent to NVC

On Feb 14th received notification 130 sent to NVC

I called NVC about 129f they told me it will get cancelled because if defeats the purpose of processing the 129f if the 130 was approved at the same time.

Question: how long does it take for NVC to receive my file from TSC if notification was on Feb 14 ? and will I get a notification from USCIS once NVC receive the 130 ?

 

ben2fat, I was at TSC.  It took 13 business days for me to receive the notification from USCIS that my case had been shipped to NVC.  It will probably be around March 1st for you.

They were open this morning, but snow started up after the AM commute. They must've given up and gone home at some point.

 

Guys, the weather was not supposed to be that bad - but the storm moved more further north and east than expected.  I'm in the Hudson Valley of New York, and we got 3-4 fresh inches today.  I got my truck stuck in a snow bank this afternoon, and spent a whole hour trying to dig it out.  So I'm sure New Hampshire folks wanted to get home before it got too bad.

Is this a case where I should have asked to speak to a Tier 2?   My case status has not changed since 1/31, when my petition was approved.

How long does it take to generate 2013 tax transcripts? I mean, if my joint sponsored hasn't filed their taxes yet. I would assume it takes time for these tax transcripts to actually be generated in the IRS system.

 

Here is what I found:

 

IRS Tax Transcript Frequently Asked Questions

Recent guidance from the Department of Education and the IRS suggests that if you file your 2013 taxes electronically and have any owed taxes paid in full at the time of submission or are due a refund - IRS Tax Return Transcripts will be available generally 2 - 4 weeks after your return has been processed.

 

If you filed electronically, but do not pay in full any taxes due - your tax return will not be processed until May 2014 and may request your IRS Tax Return Transcript 2 - 3 weeks after that point.

 

Those that file a paper return will unfortunately need to wait even longer to make the request for their tax return transcript. If you expect a refund or owe no additional taxes, you can request your transcript 8 - 11 weeks after your tax return has been submitted and received. If you owe any amount, even if it is paid in full at the time your return is submitted, your tax return will not be processed until June 2014 and you will not be able to request your transcript until 2 - 3 weeks after that point.

My point, NLR, is that the window for maintenance began at 9 a.m., and they didn't send out the warning until 4 p.m.  Normally, one gets a warning BEFORE the maintenance window starts - not half-way through.

I think TSC is one of the slow service centers to send petitions. Remember, you may or may not get another status update only when it ships. My suggestion: call up USCIS and ask if the petition has been sent out. If they say yes, ask for the EXACT date.

I just wanted to check to see if I'm the only one in this position:

 

I received my NOA2 notification by email on January 31st.  They mailed me the hard-copy on February 3rd.  My status on the USCIS site has not changed.  NVC does not have my petition yet.

 

Honestly, how long does it take TSC to ship the stuff to NVC?  I'm assuming if it left TSC, I'd have a different status date!  I'm not expecting them to bundle up all the approved petitions every day and ship them, but I would have thought they send them weekly, at the very least!

 

Am I out of line in thinking Elvis should have left the building by now?

When writing my name, case number and date of birth on the back should I list my date of birth is US style dates or the style of my country?

TYorke1, I'm a USC, but I've worked overseas for years.  I ALWAYS write dates in    DD MMM YYYY    order.  MMM is the alphabetic month.

 

For example, I would write today's date as 6 FEB 2014.  My birthday as:  10 APR 19xx  (I'm not telling!).

 

Unless a form specifically gives you a format, using the dd mmm yyyy format makes SURE there is no confusion.

I've just gone through the passport thing with my spouse.  We did not DARE send her passport to the IRS, since we are in the middle of the I-130/NVC process.  However, she was able to send her passport to the US Consulate in Sydney Australia.  They certified a COPY of her passport.  She had the passport back in 5 days.  That's the only way to go in my opinion.

Any Aussies from either NSW or QLD out there?  When I go to the Police Certificate site for Queensland, it says that the police report is delivered directly to the US Consulate.  Therefore, my spouse will not be able to turn it in with her IV documents.  May I assume that NVC will know this, and not hold us up waiting for a police certificate that will never be sent to NVC?

 

The Australian Federal Police site says both NSW and QLD send directly to the US Consulate in Sydney.  Guess that means we have to get our NVC number so that it can be married up at the Consulate, right?

 

Who has gone through this?

My questions:

 

1.  Based on reading everything I can find, the only way to know if your case has reached NVC is that you have to call them yourself, right?  We are using an attorney, as we are a same-sex couple, and felt more comfortable having a well-known law firm behind us.  Is there ANY way that either the attorney or we would find out the NVC receipt number without calling them?  I should give NVC at least two weeks before started to bug them every day?  When we fill out the DS-261, can we put my name, my spouse's name, and our attorney's name?  Does this mean all three of us would get every email?

 

2.  Both of us are retired.   I retired in May 2011.  I have my Tax transcripts for 2010, 2011, and 2012 ready to go, and the amount on the 1040 is more than substantial for the poverty rate.  I have no W-2s, as I was a partner in a firm - so, therefore, an owner.  I have gotten a letter from my former employer stating the total of retirement benefits I will get every year from now on, and they are more than double the poverty rate.  Will this be sufficient?  Should I attach my future Social Security income stream as well?  I'm still 5 years away from being able to collect Social Security.

 

Rhetorical question:  what do people do with all their time once they get the green card?  I've been obsessed with all the details of visas (my own Australian residency visa and my spouse's US green card) since 2010!  Oh..I guess there is ROC, and then Citizenship!

I got through to NVC on the first dial this morning!  Calling early in the morning really helps.  I waited 15 minutes on hold, and then Agent Sara came on the line.  We received our case number/IID on March 28th!  Hooray!  I've filled out Saylin's form for update!  24 business days from NVC receipt to case number assignment.

 

I did forget to give Agent Sara our email addresses though!  We are using an attorney (I wrote to her, as well, to give her the case number!), but I'd still like to get the email updates.  Guess I'll have to call again.

Can Saylin or someone else please answer my question on tax return?

 

My wife went who is a US citizen went to tax firm to get her taxes done. She was going to file "Married - Filing separately" so we don't have to get ITIN number for me. But at tax firm they told her she will need to file W7 and apply for ITIN even if she files married but filing separately since it won't allow them to proceed with her return w/o my ss number.

 

She hasn't sent her return yet, but my question is do we really have to apply for ITIN number even if she wants to file married filing separately? or can we just write NRA by hand on her tax return and send it? I am afraid I won't get my certified copy of passport before tax return is due.

 

It is highly likely that the tax software that is being used is set to disallow "NRA".  You (the "alien"  - very big grin!) do NOT have to file an ITIN for her to file, but it is also highly likely that she will not be able to "e-file" her taxes - as the tax firm's software will not allow it.

 

Get the tax firm to print out the tax document, hand-write "NRA" on her tax return, make 2 copies of the signed documents for her protection, and mail in the hard copy of the return to the IRS.

 

You will need to make sure YOU do not have to file a US tax return for 2013.  Should be pretty easy if you are not in the USA yet!

 

I am not a tax professional.  I am a USC who is filing MFS for 2013 as my spouse is not yet in the US (and won't be until at least July at this rate!).  We were intending to file MFJ, but my tax professional found that it was much more advantageous (and legal) for us to file MFS for 2013.   This is not true for everyone, but we were going to get hit with terrible capital gains on an Australian house we sold.  The US tax laws are much harder than the Australian laws as far as selling a house that was your primary residence.

It might be okay with minor surgeries, but I'd still see if there's some way you can get it. Or, call up the panel physician and see what they say.

 

 

 

OK - now I'm freaking out a little.  My partner is nearly 60 years old.  To take all her "medical records" with her to the panel physician would probably be over 200 pages.  I thought the US was interested in whether she had any communicable diseases.  Why would she have to present records that show she was one of the first IVF patients in Australia (unsuccessful, by the way) or that she had her appendix out as a child, or that she had a bone spur on her left shoulder?

 

That just feels very invasive to me, and she is very sensitive about the IVF stuff (it was very physically invasive and painful, and emotionally draining).

 

I had prepared her to take her vaccination records, and her titers for immunities.

 

I did not have to present medical records when I got my Australian residency visa - just fill out forms, get a chest x-ray, and present my immunization card.  What is REALLY needed (for an Australian citizen)?????

 Unfortunately, the TSC is slower than a snail. I wonder if if depends on what day of the month your file gets approved since they send the files over in batches to the NVC ?   Do they transfer files twice a  month? once a week? or when they reach 500 to a batch?    The letter I received from TSC the day after I was approved said my file was at the NVC. I'm not dumb enough to believe it is already there... I wonder if it says it was shipped in their system? 

 

LoveMyTico - my data:  NOA2 from TSC on January 31st.  Sent to NVC on February 18th.  Arrived at NVC on February 25th.  Hope this gives you an idea of when you might get to NVC...

how does one become a march nvc "filer"? is it enough our noa2 was issued in march or must nvc receive our case in march as well? I am just wondering if i should start hanging out here or wait for april. biggrin.png

 

Ivy, the NVC Filer forum "rolls" every month.  You usually join when you get your NOA2.  At the end of March, Saylin starts the April thread, and deactivates the March one.  Come on board!

I think you're the one that's confused laughing.gif When I say timeline, I do indeed mean the VJ timeline. The reason is because this is quite useful as data. Although I much prefer signatures, the functions here on this website doesn't use that; only from timelines. I suppose I could always start requiring timelines and signatures before being added to the spreadsheet! rofl.gif

 

Ok - I'll cop to being the confused one!!!!!  I still think you need to make people swear they've read Posts 1 and 2 before they are added!!!!

Please add a timeline. I'm not adding anyone to the spreadsheet anymore until you have a timeline created. Once that's done, re-post those dates and I'll add you.

 

 

I can read people's timelines, there was no reason to post yours tongue.png But the 3 dates I asked for do not appear on timelines.

I'm wondering if the use of the word "timeline" is confusing some people since there is a VJ "timeline" and most people put dates in their signatures.  I think what we want everyone to do is to add their dates in their SIGNATURES, right?  So perhaps using the phrase "please add your NVC dates in your signature" might be more specific, especially since the dates on your wonderful spreadsheet are NOT the dates on the VisaJourney "timeline" option.

 

Or, are you requesting that people create the VisaJourney timeline?

 

Perhaps *I* am the one who is confused!!!

I just looked at the screenshots for the DS-260. Holy sheep. I know that it is an older version but maybe for those of you who have filled it out recently can give me insight. Do they still ask for beneficiaries parents names, birth dates/death dates, all addresses lived at since age 16? All previous employers?

 

That's a ####### load of info that I need to get from my parents if this is the case. I guess I also need to ask them if they have ever been a member of the Taliban, since that question is on there too!wow.gif

I created spreadsheets for three items that I knew would be hard-to-get/hard-to-remember info:  Places lived since age 16, Education, and trips to the US.  Since my spouse is pushing 60, those addresses were really hard!

 

Luckily, my spouse worked at her last employment for 12 years - they only want the last 10 years - so we only had one line for that!

 

Take the time to gather the data - it took us a lot of time - that's what we did while waiting on our NOA2!!!!
