Hi,

 

Our case was transferred to CSC on January 14th and we still have not heard anything yet. We live together in Australia and several cases from here with our same PD date have been approved already. Any thoughts on what has happened to our case? I am worried there might be an RFE, would it tell us when I check our case status online? I listed my in-laws address here in Australia for us to receive mail, our home address here in Australia as where we reside and my parents address in Florida as where we mailed our application from. Would this cause problems? I included a letter of clarification to explain why we mailed from the USA.

 

Also, does anyone know if the NVC process if moving along okay for people thus far?

 

Do you get your approval in the mail or is the case status online accurate?

Hi!  I'm the USC part of an Aussie/USC couple.  I happen to be in the US right now, and my partner is in QLD.  Mail is taking about two weeks to get back and forth at the moment - especially where we've been hammered with snow and ice.

 

Do check your status online, but if you have an RFE, you won't know EXACTLY what is going on until you get the snail mail.  I was transferred to TSC in December, and it took 35 days for approval.  I'm betting you are pretty close!

 

And yes, you will know that you are approved via the online system.

That's your approval, don't worry! This is totally normal for CSC. California doesn't send separate notices to tell you that they've transferred your case to NVC, they do it all in one. You have NOA2 and your case should be at NVC in about two weeks. Congrats!

 

Boston, is that what we should expect from NSC and TSC too?  Just one "combo" approval/ship-to-NVC ?

hi everybody!
Ive been a silent follower of this threat for a bit now, its been about a month since i got transfered to TSC, and over 6mo since my process started, is it too early to call and figure out whats going on with my case?
Btw, we are a same sex couple who filed the day DOMA was struck down, im not sure if that matters or not nowadays

PS: congrats to all transfers/approvals!



 

We are also a same-sex couple who filed the day after DOMA fell!  We were also transferred to Texas, and last Friday were approved.  It took 31 days to be approved once we were transferred.  Your time must be coming soon!

This is true, I need one for the year I spent in Hong Kong and they require the interview letter or I think the "packet 3 letter"

 

Hong Kong is one country that requires the interview letter.  Japan is another.

I usually expect to see notices from USCIS first thing in the morning.  However, it appears that today, a real human being picked up my petition.

 

I got the "Your Alien Registration Number has been changed...." notification!

 

Last Friday, a June filer got this message on Friday, and was approved the next Monday.  Here's hoping the same thing happens.

 

I actually straddle the month - I applied on June 27, got notice of receipt on June 28, but my POA date is July 1st.  So I am posting on both the June and July forums!

 

So...this is 30 days from transfer to TSC.  And again, it just means a human picked up the file and assigned a number to it...

 

I could either get approval, or an RFE.  We'll see!

Hey guys, I'm getting a little worried. We got transfered to CSC on Jan 8th and we haven't heard anythign from them. Maybe it has something to do with the fact that we're a same sex couple. I don't know really.

Don't sweat it, lorenalen.  I'm a same-sex couple, too.  I filed the day after DOMA fell, and was transferred to TSC on December 27th.  It's just going to take time.

 

Believe me, I shake my fist at the heavens every day when I check my email and there is no NOA2.  It's day 213 today.  Ridiculous.

No, we are not.  I'm NOA1 July 1, transferred December 30 to TSC.  Absolutely nothing.  No RFE.  No approval.

Most of us get three notices.  EVERY TIME your petition is touched, it is scanned and a notice is generated.  Your petition was picked up and put in a box (transfer - letter 1), then shipped from the NBC shipping dock (transfer - letter 2), then received at whatever office they transferred it to (transfer - letter 3).  The letters are automatically generated, and the text is pre-programmed into the computer (and is not always germane to the exact thing that is happening).

 

Someone hasn't changed the text on letter 2 to read "another service center" and it still reads "to your local USCIS office" - because that is what USED to happen.

 

Don't fret over it - it WILL be sent to a major service center (TSC, CSC, NSC).

That could be good news, actually.  Everytime your file gets moved, it gets scanned.  I don't know for sure, but it might be that your file was taken out of a box and placed on someone's desk!!!  Best of luck (to all of us!).

psv57 - I got a scan of my hard-copy notice from my attorney.  I've been transferred to the Texas Service Center.  While I got my first email notice on December 27th, the official "notice" date on the hard-copy transfer is December 30th.

I am expecting mine to get a RFE and just want to get it done with since I know that will take time... Mine was sent from my lawyer with only marriage certificate and no other bonafide evidence... Don't ask.... sad.png  Should know be more assertive as it's my file.  I knew better and wasn't assertive, so now time shall be wasted.  Just hope I don't get a straight denial first.   A RFE would be welcome. A straight approval will be a miracle....

 

I presented my immigration attorney (a specialist for my type of case) with heaps of evidence.  She also said she was only sending in our marriage certificate.  I was surprised, but really, for an I-130 approval, the only requirement is a bonafide marriage certificate.  More evidence will be required at the interview, I'm sure.  I will be surprised (and pissed off) if we get an RFE.

Hi.  I'd like to be added to the July spreadsheet.  I've been reading and posting in the June 2013 filers, as I filed on June 27th.  However, my Priority Date is July 1, 2013.  I've not been transferred yet.  The only "special" thing about my case is that it is probably one of the first stand-alone I-130s from a same sex couple.  I filed for my spouse the day after Section 3 of DOMA was repealed.

Ugh, my MIL had a seizure today. We don't know what's going on with her, but she had a TIA a few years back, so I'm actually pretty worried about her health. If it deteriorates any more, we're going to wind up having to go back to NL for a little while.

 

Kaylara, I know what that feels like.  My spouse had a cerebellar infarct (stroke) last summer when I was in the US and she was in Australia.  Talk about a terrible situation!  Best of luck to your partner, and to your MIL.

I'd love to ask a question of all you VJ brothers and sisters...

 

To what extent do you and your partner share the work on your IR-1/CR-1 process?  Does the USC do most of the work or the non-US citizen?  Do you share it equally?

 

Of course, there is no right or wrong here!  I'm just curious.

 

My disclaimer:  I'm the USC, and I have done 95% of the work.  The reasons?  I've already done my OWN process for a Permanent Residency Visa for Australia, and I'm more familiar with the paperwork.  I had to get a Police Certificate from the USA, Japan and Hong Kong.  I've already had to "prove" my relationship for the Australian visa, so I knew how to gather and organize all the civil documents and other proofs. My partner does not enjoy email, chat or forums, and I love them.  We chose to use an attorney in New York City, not too far from where I live (about two hours away).  And, of course, it was easier for me to hassle the NVC for info!

Your SSN will be delivered to your house.  But...it will be good to gently remind the officer at immigration that you have applied for a Social Security Number.  I understand that there is a field on their screen that they have to check to get the process going.

Thanks to both of you who replied to my question.

So will it be available to pay online through the CEAC website? And then the Green Card will be sent to my address in the US? Do you know how long that takes?

 

You will be given instructions on how to pay the Green Card fee at your interview.  It is done online - but not through CEAC.  You do NOT have to pay it before you enter the US, but your physical green card will not be generated before the fee is paid.  It behooves you to pay it as soon as possible after your interview so that the card comes as quickly as possible (to the US address you put in your DS-260 form).

 

While the Visa page, combined with the stamp at your POE, are "technically" your "Green Card", you will find that many bureaucracies (like the Department of Motor Vehicles) don't understand this.  These bureaucracies think that you must present your physical Green Card to be considered a Legal Permanent Resident, but this is not true.

 

So getting that physical green card as quickly as possible is a good thing.

Is that even possible? Did you check if you can be present at the interview? I just read the Poland embassy website and I'm pretty sure my daughter and I can't be there. Ugh. :( I really want to be with my wife on interview day but don't know if I should go and then hope we get the passport back in time to go to the states or let her go by herself and then come at a later date so I don't burn a lot of vacation days (I only have 6.5 days left). I hope that made sense. Any input? I read we can have the visa dropped off at a courier location near the embassy and that that shortens the time we'll have to wait, but it's still 3 business days I think. 

 

Write to publicwaw@state.gov and see if you can be present at the interview....

 

The Warsaw website is not clear.

Is that how it's generally done when it comes to the petitioner attending the interview? Written approval by email? If so I'll email the embassy in Poland. But I don't what to do that if it's not the norm.

 

Those are the instructions for the Sydney Consulate.  You'll have to rely on the Warsaw Consulate website for your instructions.

I just received email confirmation allowing me to attend my husband's interview with him. I made the request on Friday afternoon, received confirmation back Wednesday morning.

 

That should mean that you got yours as well! You emailed long before me :)

 

I am going to print off the email to bring just in case; they said they added me to the list but I don't trust them! Haha.

Got my email this morning.  I had not been able to sleep last night, and fired off a letter from me (the prior two had been from Julie) at midnight.  Got a reply at 10:20 this morning.  The person on the other end said we MUST bring the email to show to the guard.   I am sooo relieved!

Are you buying later tickets just to be safe?

 

We have family coming in to town (in Florida) so I want my husband to fly to the USA on July 31st or August 1st but I am nervous to buy tickets in case his passport doesn't arrive in time.

 

We are in Western Australia so it may take even longer to get to us :/

 

When Julie needed to get her passport copy certified to apply for an ITIN (which was denied by the IRS - the twits), she received it back in 3 days flat.  They say 5-7 working days for the visa on the website - 1-3 for the sticker to be generated and 3-5 for the Express Mail.

 

But I just read a very confusing story about a woman who had her interview in Sydney on May 20th, was given the "You are approved" piece of paper, but her passport is STILL not back to her.  She went into AP - or so she was told, and then they told her it WASN'T in AP, but they were still reviewing.  I think her folder must have ended up on the bottom of some pile.  She is devastated, as you can imagine!

 

So I don't think we can count on anything, really, until the passport is back in our hands.  That said, we are still trying to plan for a 15th or 16th getaway.  We are also shipping a cat back to the US, so I'm trying to do the logistics for ALL of us!

Hi back!

 

Our interview is July 1st, and I expect we'd have her passport in hand on either the 7th or the 8th.  We are arranging for flights the week of the 14th, but don't have them yet.  Our other two Sydney Consulate compatriots for July 1st interviews are traveling on July 16th and 18th.

 

And NO!!! they have not responded about my attending the interview, and I am starting to panic.  We wrote them on June 12th and got an Auto-reply on the 20th.  We wrote again on the 23rd and got an auto-reply right away - but no answers.  Snikit15 got her permission 4 days after she emailed (and that was after WE emailed), so I'm starting to be very, very paranoid. 

 

If we don't hear anything by Friday, I am going to try to call them - and I'll go through the US Citizen's Services section if I have to.  If we don't hear anything from anyone, we are going to bring copies of our emails to them and their auto-replies and fall on the mercy of the guard.

 

I will be very very angry if they have fobbed us off for some reason.

Interesting. I will definitely check. 

 

The only problem for me is that I have just 6.5 days of vacation left for the year and want to go to the interview,but have read that it can take 5 business days just to get the visa via DHL. So I would be cutting it really close to be there for the interview and then possibly burn through everything for the rest of the year without any days to spare when my wife finally gets here, not helping her acclimate etc. What would you advise in my situation? Do you know if it takes Australia that long to get the visa to the beneficiary? Maybe it's just a Poland thing.

The Australian Consulate says that it can take 1-3 days to place the stamp in the passport.  We leave a self-addressed Express Post envelope with them, and they mail it to us via Australia Post.  This can take 3-5 days.  Our interview is on a Tuesday (July 1st).  I think we'll get her passport back on Monday or Tuesday of the next week.  So yes - sounds like about the same timeframe as Poland.

 

If think if I had to make a choice of taking my vacation days to go to the interview, or taking days off when my spouse arrived in the US, I, personally, would choose the latter, if you have confidence in your wife's being able to present well.  Your wife will have some mild jet lag when she arrives in the US, and might appreciate having one or two days to get used to the new time zone, but then I'm sure she'd like some time with YOU!

Just out of curiosity, does it help your case if the beneficiary's spouse is at the interview? Do COs like to see that? We have a daughter too. Should we bring her? Jw.Thanks


My attorney said it was helpful to have the petitioner at the interview. It shows that the petitioner has made the effort to come to the beneficiary's country. Be sure your Embassy or Consulate allows it though. We had to get written permission (via email) for me to attend the interview.
