So is this normal for the NVC to send reminder emails about the checklist more than once?  I received the official checklist email on Friday May 2nd. I responded with the Birth Cert and it  has been at the NVC since May 6th in the am. So yesterday around 4:30 pm I receive a reminder email asking for the documentation.. then the lawyer forwards the email to me letting me know he received it...I called the NVC at 10:30 last night and told them the document is there and verified that is the only thing we need.  I got the 30 day blah blah blah.  So I wake up this morning to another NVC reminder to send the requested documents. (1:40am)  I just find it odd that they are sending so many reminders and I only received the origianl checklist less than a week ago.( 3 business days).. and they don't even scan the mail for a few days after it gets delivered.    its so strange....  Below is the request..

It's a sinister plot that has been hatched between Joy, Arthur and your attorney - designed to render you completely out of your gourd before you get a Case Complete.  I wouldn't be surprised if you get a zillion more of these from all of Joy's cohorts at the NVC...

 

The straitjacket will arrive in the mail this evening...

I made the same mistake too! The way it is setup wasn't really helpful and the numbering threw me off too!

 

That first page is so poorly designed!  All they would have to do is put "Section 2, continued" at the top of the right hand column, and NOBODY would be confused.    OR, run a black line down the center to clearly delineate the columns....   OR, keep the numbering scheme 2a  2b   2c

 

No graphic artists in the Government, I fear.

Yes, I would love to have a definitive answer, although I know that might be difficult to come across. haha The main reason I ask is because that will be my window of time to go and secure a job before we make the move the U.S.

 

Jeff, your medical must still be current when you enter the US.  Most medicals are good for 6 months.  That's where the 6-month thingie comes from.  If the visa says you must enter before six months, and your medical expires BEFORE that six months on the visa, be sure to be in the US prior to the medical expiring.

Next steps:

 

Hey, I just learned something new today.  When you get checklists, they come from the NVC Attorney's mailbox.  Did you know your attorney has the ability to email them back and ask questions?  I don't think we peons can do it, but apparently the attorneys can!

 

I put together the checklist response package (barcode cover, original letter, my explanation of why we cannot get a Victoria PCC, plus screen shots of the website that clearly states we cannot get a Victoria PCC), and wrote to my attorney about the sitch, telling her I was going to ask for a Supervisory Review and asking her if she had any other strings to pull.  She must have taken a late lunch, because when I didn't hear back from her by 2:30, I packed up my checklist response packet and went to the Post Office for next-day delivery.  When I got back, I had an email from her asking me to hold off on doing anything (uh-oh - I hope she doesn't read VisaJourney!), and she would write to the NVC Attorney.

 

Since it is taking them so long to review documents, I'm hoping she'll be able to get it all cleared up by the time someone scans in my packet!

 

I haven't been breathing since last Friday night when they told me I was going to get a checklist.  Not sure I'm breathing now.

 

I know that reviewers cannot know every single thing about every single country, but it really would be nice if they would listen to us every once in a while.

OK - I've got some answers.  Not the ones I wanted, but enough to get me on to the next step.

 

I got a checklist this morning.  It was asking for the Australian Police Certificate.  It sent a list of instructions for how to GET a police certificate, including the sentence: 

 

If you are applying through the New South Wales or Queensland Police, your police record will be sent directly to the US Consulate in Sydney.

 

And then gave me the standard cover sheet and told me to mail the documents to New Hampshire.  Anyone else see a conflict here?

 

So...I called this morning during prime time, and waited a LONG time, but got to speak to Agent Abbie - she with the Noo Yawk accent (it was charming).  She looked at the file, and was very puzzled by the fact that the case is NOT complete, because she said the code for the Queensland Police Certificate has a "P" in front of it indicating that is goes directly to the Consulate.

 

I said, "So, that means I have a "Case Complete" then, right?"

 

She said, "No."

 

I said, "So how will I get a case complete from NVC if the PCC goes directly to Sydney."

 

She said, "There is something funny here.  It is asking for two police certificates. Did she live anywhere else in Australia?"

 

"Yes," I answered.  "She lived in the State of Victoria for 20 years. 

 

"OK.  Let me talk to a supervisor for a minute. Hold on."

 

Waiting....waiting....waiting...

 

"Oh," said Abbie, coming back, "then she'll need to get a police certificate from Victoria."

 

Sigh.

 

"Abbie," I said, "they are the same police certificate.  You just have to apply through your state.  And Victoria will not give a police certificate to anyone who is not CURRENTLY living in Victoria.  It's on their website."

 

"Ah," she said.  "Then send us a cover letter stating that Victoria won't give a police certificate.  Then we can close this out."

 

Me..."Thank you so much, Abbie.  It was very confusing, and I appreciate your help."  (FUMING INSIDE - how come *I* have to prove that Victoria will not issue a police certificate??????????????????)

 

Abbie:  "You are welcome.  That was really confusing.  Good luck"

So...I have the pages printed from their website, and hopefully I can turn this around ASAP today.

 

This will set us back a good two weeks.  No June Interview, for sure.  And we already have tickets (changeable, thank goodness) for July 7th to come back to the US.

Love reading everyone's stories of how they've met :)

 

We met online - but not in a gaming site or a dating site.  I lived in Hong Kong at the time, and my spouse is Australian.  We were each friends with a US woman who was having surgery.  She introduced us to each other via email so that we could let each other know the outcome of the surgery.

 

We were email friends for two years, then we each got webcams and started Skyping.  I didn't want to fall in love, because, at the time, neither of our countries would have let us be together via immigration.  But when we met in person in 2009, we knew we wanted to be a couple.  Luckily, Australia changed its immigration laws in 2009 so that I could apply for a permanent residency visa.  And then, when it looked like DOMA was going to fall, we went ahead and got married in the US.  We applied for our I-130 the day after DOMA was ruled unconstitutional.

 

So we've been friends for 8 years, a couple for 5 years, and married for a little over one year.  And we have done this across many many oceans and seas, and with many 23 hour transcontinental flights.  Cathay Pacific and Korean Air have gotten a LOT of our dollars!

Quick question on the AOS I-864 form:

 

We both live in Canada and my partner (USC) earns money in CAD dollar.  He is keeping his job so we're including a letter from his employer stating that he is working from home once we move to the US.

 

On the I-864 form, Part 6. Sponsor's Income and Employment section, do I write the income amount in CAD dollar ($XX,XXX CAD) or convert the amount into the US dollar and explain it in the cover letter?

 

Austin, does your spouse have a letter that states what the salary is?  Is the letter in Canadian $$$$ or US $$$$?  I would put the same amount on the form that is in the letter, and put CAN or USD as appropriate.  If the amount is well over the poverty line amount, I wouldn't worry to much, but I WOULD annotate it in the cover letter (if it is not in US Dollars).

 

Just my opinion.  I have not checked the I-864 instructions to see if it specifies using USD.amounts.

So no agent told you over the phone what was wrong?? They just told you a checklist was on its way?

 

What is wrong is that the PCC in Australia is sent directly to the Sydney consulate.  There is no option for a petitioner  from Queensland or New South Wales to get the PCC sent directly to him/her.

 

So - of COURSE - the PCC is missing.  What should be happening is that NVC should give us case complete with a provisional checklist that says that the PCC must be sent to Sydney prior to the interview.  I don't understand why that letter (checklist) has not yet been generated.  The AOS is done - and the IV appears to be done except for this issue.

 

There was no way to frontload this PCC - it could not be sent to Sydney until the case file is there.

 

So both Jack and Kelly said there would be a checklist.

Jack, last Friday night, looked at the file and said there would be a checklist for the PCC (even though it doesn't get sent to NVC).  Kelly, today, said there was a checklist but that...."it takes several days".  I had pretty much assumed it would come in the middle of the night last night.

Update for me...Just got off the phone with very soft-spoken Agent Kelly (I seem to get the Ks - Kelly, Kim, and Ken!!!).

 

My AOS is fine.  Our IV packet was reviewed on May 2nd, and we will be issued a checklist for the PCC (which gets sent directly to the Consulate in Sydney - not to NVC).  I told her I was concerned about the fact that I have never gotten ANY emails from NVC, even though I know they have the correct email on file.  She said it "takes a few days" for them to be generated.  I think I should have gotten it by now!

 

Anyway - I was glad to see the AOS was fine.  They received my packet on April 10, but they didn't scan it in until April 15th.  Looks like I made the 2013 tax cut-off!!!

 

COME ON EMAIL!!!

My husband filed MFJ even though i dont have any itin with the help of h and r block but then we had a doubt about it so he went to irs directly and changed it to MFS to make it simplier..now we are still waiting for the transcript.

 

If you have already submitted your 2013 tax return to NVC, you will not need the transcript for the interview.  However, if your husband has amended his 2013 tax return, you may need to have a copy of the amended tax return (plus W-2s and 1099 copies) at the interview. Be sure to have a copy in your folder at the interview!

Would it be okay even if theres no transcript available during interview? My husband filed in april also.what other alternative i can bring if theres no transcript?

 

If you do not have the transcript, you must bring a full copy of the 2013 tax return, plus any W-2s and 1099s (to prove income) with you.  Be sure to sign and date the copy - even if you filed electronically.

Here is what I found:

 

When will your tax transcripts be available?
A. If you were not required to send a payment to the IRS, your transcript information should be available two weeks after
filing electronically or eight weeks after filing by mail.
B. If you had to send the IRS a payment, your transcript should be available after May 1st if you filed electronically and
after June 1st if you filed by mail.
C. If you filed for an extension, your transcript should be available two weeks after your final return is filed.

Guys how long did you wait for 2013 tax return?, we're waiting 9 weeks and it's still not ready

 

I filed on April 12th and I'm still waiting.  I can see that the IRS has it, but I have not received my refund yet,  nor is my transcript available.  Was yours filed electronically or manually?  If Manually, it's usually not ready until June.

MsGoyave, it's really hard to know exactly what is wrong with the passport page - whether it is missing or, as you suggested, too dark for them to read easily.  Are you set up to receive emails from them?  I know that waiting two more days is killing - but until you know exactly what is wrong, you might be agonizing for the wrong reason.

 

I'm supposedly getting a checklist, too, but nothing has come through!  I'm calling tomorrow to ask about it.

My husband did not file taxes for 2012 and 2011. What would he write in the i-864 where it asks for the "total income as reported on Federal tax returns for the most recent 3 years"? 

Would it be N/A for both year and total income because he did not file?

or would it be 2012  - $0 and 2011 - $0?

Just wondering what everyone else put as I don't want to get a checklist for leaving those lines blank.

He already wrote the letter explaining why he didn't file for those 2 years.

We are in the process of submitting our  AOS and my lawyer wants me to write a letter stating reason of my unemployment.  I have no idea how to begin and whom should be the letter made out to be?.. etc

 

Did anybody else had do this?  

 

 Is there is some kind of template or sample that I can follow?  Any help is greatly appreciated.

I don't think there is an official template, but here's a sample that might get you started:

To Whom It May Concern:

 

For the past <timeframe>, I have been <a student, a temporary visitor who is not allowed to work, lazy (just kidding)>, and, therefore, have not been employed. 

 

<Add a sentence about whether and how this situation will change or not after the visa is granted>

 

<Add a sentence about how you have supported yourself - your spouse, your parents - and how this may (or may not) change.>

 

If you are the USC, make a statement about whether or not you have paid taxes (probably not) and why you have not/are not required to pay US income tax.

I have a question...when you call the NVC during the day, are you ever passed from the Customer Service people to Adjudicator people?

 

I called last Friday night, after 5 p.m.  Agent Jack was lovely, but he had to put me on hold to ask someone else how to interpret certain "codes" he found on our file.  He seemed to indicate that we'd be getting a checklist (our State in Australia sends the PCC directly to the Consulate, so, of course, it is missing).  He also seemed to indicate we'd need two PCCs - one from Queensland and one from Victoria - which is totally incorrect.  Something he said sounded like they were waiting for Sydney to tell them what to do.

 

We have gotten no checklist - so I'm confused.

 

Do you think it is worth it to try to call on Monday (after Sydney might have replied to any questions) and see if I can get any better info?  ( I'll know if Joy or Arthur answers that I'll be toast.)  Can the customer service people really see what is happening on the files, or are they limited to certain fields or "codes"?  If we don't get answers within the next 3 days or so, we can kiss a June interview goodbye...

 

Thoughts from those of you who are daytime callers?  Any wisdom from Aussies from NSW or QLD who might have had a similar experience?

Oh wow.  I've just talked to Jack (sweet man!) at NVC, and our case just got VERY complicated.  It's been reviewed, and we are going to get a checklist for what looks like TWO police certificates. 

 

Now...my partner is from the State of Queensland.  If you are from Queensland, you apply for your PCC through the Queensland Police Department.  They check the Federal Police Database and then send the report directly to the Sydney Consulate.

 

BUT...she lived in the State of Victoria for about 20 years.  In the State of Victoria, you apply for a Police Report and it is sent directly to you.

 

What Jack seems to say (but he wasn't sure) was that we were going to get a checklist for TWO police certificates.  ONE of them has to be sent to the NVC and ONE of them is sent directly to the Consulate.  This is going to delay our case by up to 3-4 weeks, which just burns me.  Victoria checks the same Federal Database that Queensland does!!!!

 

Think I am going to write my attorney for help on this one!  Of course, now we have to wait for the official checklist.  But Jack seemed to think that the Victoria Police Report is going to have to reach NVC before they even contact Sydney. 

 

Why does it have to be so complicated?????

You know what?  I'm sitting here - scared to call the NVC, because I'm scared to hear that they still haven't touched my file.  There have now been 4 people here on VJ with dates AFTER mine who have Case Complete.  It's Friday, and if nothing happens, there are then 3 days (since I don't call until after business hours) until any new news.  Sigh. 

 

Funny thing...my partner has entered the Diversity Lottery for 5 years now.  We checked yesterday, and she did not win a slot.  This is the FIRST year that this news hasn't TOTALLY devastated us!  I'm rather glad - it means we didn't take up a slot that someone really really needed....

A quick question

I just called NVC and they gave me my case number but not the IIN, she told to wait for 10 days or so before they email.

Is this the procedure?

They are stalling you.  You should be able to get the IIN over the phone.  You do not have to wait for the email.  You should have an IIN within 24 hours after the case number is available.

Hey guys - what should I do? My wife's address has a "/" in the house number but the online DS-260 doesn't allow it!!!!

 

Had the same problem.  Our Oz Address is:  43/175 High Meadows Drive

 

I had two choices:  43-175 High Meadows Drive

 

or:  Unit 43, 175 High Meadows Drive

 

Will either of these work?

Guys when we call NVC to ask if they have recieved our case do they ask for approval number too? I called them for the third time today. Yesterday they said they haven't recieved it today the guy I thnk Shawn asked me to read the first two lines of my approval letter. Simce my husband has it I told him I don't have it yet so he said ok then call when u have it. Is it normal? Or was he just mr. Nasty pants? Lol

 

Unfortunately, he was being Mr. Nasty Pants, as the first two lines of the letter say something about allowing them 30 days before inquiring....

In reference to my question above, did anyone else have the same verbiage on their IV Receipt that unless you're doing EP you have to send in the DS-230 instead of the DS-260? I'm guessing the receipt verbiage just was never updated and that what Saylin's guide says is the correct way to do things. Please let me know. 

 

The verbiage is old and outdated.  EVERYONE fills out the online DS-260 now.

I just chuckled lol. Pouring rain in Jersey. Not sure where spring or any resemblance of Spring is at. Defintely doesn't help during this process. Warm weather always makes everything better :)

I went ahead and called NVC as I could not wait any longer. I spoke to nice guy Kevin and he cruelly put me on hold for a while only to come back and tell me.. CASE COMPLETE. What?! I'm in shock right now.

OK - I just talked to Agent Ken and asked him if my packets/DS-260 had been reviewed.  I told him everything had been sent in on April 10th.  He told me it was going to take LONGER because everything came in at the same time!!!  That has to be BS.  He said it would probably take another week.  And then he *helpfully* (I'm being snarky) said "We'll send you an email when it has been reviewed."

 

I'm calling back on Friday afternoon.

 

VERY disappointed.  Just hoping they will still be scheduling Australia next week.....
