No, I was wrong, it was on travel.state.gov  You (and any family members immigrating with you to the United States) must obtain an original birth certificate issued by the official custodian of birth records in your country of birth, showing your date of birth, place of birth, and parentage. Important Notice: All Immigrant Visa applicants must submit a long form original birth certificate. Short form birth certificates will not be accepted.

The certificate must contain the:

  • Your date of birth
  • Your place of birth
  • Names of both parents
  • Indication by the appropriate authority that it is an extract from the official records

Hi Kaylara,

 

I'm indeed a Dutch citizen and gave them the white form from the city council (they told me this was the right version, sigh). After it got rejected, I read more into this and found out that you can get documents apostilled.. Never heard of it and if they are giving me troubles - I will get a new version apostilled. Weird that my lawyer never told me this...

 

What version did you submit to the NVC?

The White form won't work. You need the long form Green version.  And I don't know about whether or not they need it apostilled, (pretty sure that they don't) but we have all of our stuff (even the American stuff) apostilled just in case.

If the checklist is general, it's usually a false checklist. If it has specifics, it's not a false checklist.  If you're concerned, call and ask which you have.

Same troubles here.. It's no false checklist and even the lawyer is having a hard time to find out more about this issue. And the drama continues..

Are you the Dutch citizen? If you're having a problem with the birth certificate, perhaps you submitted the wrong version. Did you submit the long form? Or the short white form that you get from the Gemeente? (And did you get it Apostilled?)

Wow, I am amazed that you guys have a record of who picks up the call at NVC. Haha, whenever I call, I'm so tired of being on the line that it takes me a second to keep track, I don't get a chance to catch their name since I am so excited they picked up. :P Will see who I get next time I call NVC though! Seems like they are really, busy and closing earlier. I called at 11pm and didn't go through.

If I don't catch their name the first time, I ask them to repeat it, and then I write it down. I have a notebook with just immigration notes in it, and a whole new section dedicated to the NVC process. I keep track of the calls in this notebook by having entries with the following format:

Then I draw a line under that entry so it's delineated. 

 

In the beginning, I used to write my USCIS case number/NVC Case Number/IIN and the NVC phone number at the top of the page. I have all of that info memorized at this point, so I stopped doing that. (And NVC is on speed dial. :P

 

I think that it's important to keep a log of this information because I am not waiting for them to contact me in writing. If something goes wrong, I need to be able to hold to appropriate person accountable.  My friend who is a lawyer said that is the exact reason why they do everything in writing. You can argue that a phone call never happened. It's harder to claim that about an email, fax, or mailed letter.  I think that the NVC records their calls, and I'm certain that they have a call log. If you have accurate info written down, then you are covering your own butt. :)

I got the same answer...but obviously untrue.  Everything they need is there and they haven't even touched it yet!!  We are just hoping for a June interview...we are May 2013 filers and after USCIS we want it DONE!!!  :ranting: 

Looking at your timeline, I'm going to estimate that (assuming no checklists) you'll get case complete around May 2nd. Which would be awesome because that puts you into line for the June Scheduling.  

 

I'm a March 2013 filer. I'm also hoping for a June interview date. I just want this to be over already.

We have been married for under 2 years, but I did find it weird that he spoke about the $985.  I think he's trying to make money off of me since I did the I-130 by myself and had most of my documentation ready for the AOS and IV. I had even sent in the DS-261 and had paid the AOS fee prior.  He even told me that he didn't need to charge the full amount since I had done half of the work.

Although pay stubs and an employment letter are technically optional, NVC may still request them in a checklist, so be careful. But, if he's been at the same job for that long, the chances are higher it won't be requested.

I talked to JR this morning and told me that I can call as much and as often as I want to check on the status of my application.


 

The $985 fee is the adjustment of status fee. I've given my case to a lawyer and that's what he told me how much that fee is....hopefully he's wrong?

Hey guys,

 

I am wondering if someone can estimate how many days/weeks does it take for NVC to complete case from the day the packet was received by them. Ours was received on Apr 11, 2014. I called NVC last night and they stated it takes around 30 business days. Is that true? And if so, how long of a wait approximately is it until the interview (in Montreal) once the case is completed.

 

I'm worried because I have a vacation planned in mid-June and don't want the interview date to clash with it.

I've been taking averages from Saylin's spreadsheet, from the time the last packet was sent till the case complete date.  My averages have been around 25 days.

I stay with my in-laws when I visit  since my husband still lives with them.. ( awww) 

So I don't have to fork over hotel money... I already told my husband we will be purchasing a bottle of Jose and celebrating.    Neither one  of us are really drinkers but I will make an exception !! 

 

We talked about restaurants last night on the phone.  He said we can goto the Outback  and I said  "NO WAY"  I want Costa Rican food. I can get Outback any old time.   I like the little bars on the side of the road.  

 

He can't wait to come back and eat american food. He is tired of rice and beans everyday !!   He has been americanized already so he really does miss it.  He is dying for a cheesesteak !!  

LOL yesss my husband does the same when I'm in Santo Domingo. AND then he has the balls to tell people he's only eating american food because I won't eat rice and beans, which is a LIE!!! lol  I'm sure we'll hear something soon!!

my packages were received on the 15th and 18th and they aren't up to those dates yet. I was hoping for an April CC too but Obviously  its May now.

AHHHHHHHHHHHHHH!!!!!!!!!!!!!!!!!!!!!! SOOOO excited!!! I am so thankful to ALL of you.  I swear this process would be even HARDER if it wasn't for you guys. 


My lawyer made the same mistake and I got really pissed after an argument.. so I sent the correction the following monday. It was received 3 days after the original ...  You would think since immigration is supposed to be thier specialty..... they would know the rules....  and you can't tell me they never got a checklist in the past...   I was thinking of printing out Saylins WIKI and handing it to them tonight at my meeting.  

Do it!!  I gave my lawyer the site, and told him that he should check it out.  VJ is a Cliff Notes for immigration lawyers and for people like us who are smarter than the lawyers :)

Ahhh finally my civil documents were reviewed, and I was told the DS-260 was accepted:) :)  Now they just have to review my revised AOS which I sent because I didn't put N/A in a box.  I wish we could all meet somehow and have a huge celebration somewhere!

Well I just called NVC to see if maybe just maybe it had been Completed already while I wait for the checklist...but the lady was atleast nice and answered some of my questions. All she said was it is under review and can take the full 30 business days...So I asked her about the PCC checklist. And she said you will get the checklist as soon as they process what is missing and isn't. And then I asked her about the interview dates, and she said that they "schedule throughout" And they are done with May but haven't started June yet...which to me doesn't mean "throughout"...but the point is there is hope. She also stressed that it all depends on the availability of the consulate. It would suck if they fill up slots right before I am put in the queue. Feeling down now....

Soon!!! I'm sure we'll hear something soon. We've gotten this far :)

This is by far the most nerve-wrecking part for me now. NVC logged the IV docs in on April 11. Anxiously waiting for a Checklist for the PCC and a case complete. Does the Checklist come first in email, or do they just complete the case and find out when you get the CC email? I just hope that it finishes soon enough for a June Interview. Been waiting over a year since we first filed and now it's just becoming ridiculous.

 

Congrats to everyone who has received CC. I hope you all get June interviews.

I'm starting to freak out now.. I sent in my AOS package on 04/08/2014, it arrived on 04/10/2014 (according to usps tracking), and sent IV package on 04/11/2014, it arrived on 04/14/2014 (according to usps tracking). As of now, they have RECEIVED ONE package on 04/17/2014; but they don't know what it is yet. That is the only update I have on my case. DS260 has not been reviewed either. I have been calling every or every other day, and same response. "We don't know what was received, we just know a package has been received. It can take up to 30 days." one of the reps even said that's odd, send an email with tracking numbers, etc. I have done all of that. I'm just worried because of the original documents, and the fact it has been so long.

I'm getting annoyed and paranoid, because we started our "Journey" with I-130 in February last year..

I wouldn't worry.  Mine was received on 9th and another on the 11th, and they weren't registered in their system till the 16th and 15th.  I read in another post and it made sense, maybe they are purposely taking their time in registering incoming mail into their system because they are so backed up with their work.   I know I would be the same way you are, and I would just send an e-mail.  I'm sure your packages will be registered before they reply to the e-mail :)

I resent my revised AOS April 7, NVC got it the 9th (I had the tracking number to see when it was received), they didn't put it in their system till the 16th!! IV they put in the 15th! DS-260 was done March 26th.  I hope they hurry up and I can be with my husband in the summer!! :(

We'd have no basis to sue. If we're going to complain to anyone, it has to be to the USCIS and our representatives in government. It's the USCIS that chose to process the DACA filers instead of us. 

 

 

Do you know your rights under the US immigration law? Do you understand US citizens petitions filing for their immediate relatives  legally are supposed to come first over all petitions. Do you understand Obama's DACA executive order is illegal because it is unconstitutional. Do you understand what is happening to our petitions is illegal?  What do you mean we do not have a case? Please.

 

I do know my rights under US immigration law. I also understand the way the laws in the US work.  

 

Obama didn't order the USCIS to give DACA filers priority, they chose to do that. How, exactly, is Obama's executive order unconstitutional? 

 

I reiterate, having a class action lawsuit against the president will get dismissed. He has the right to sign executive orders. The government agency that we all applied to decided to process the DACA applications instead of the I130's. If we're going to go after anyone, it has to be against them. And I don't honestly think that a lawsuit would achieve our goals here. I believe that putting pressure on them through the media, and contacting our representatives, and also the USCIS directly will have the best outcome. If you really want to fix the problem, you should focus your energy there. I also think that we should attempt a legislative fix to this problem.

The only way to get this moving is to file a class action against the Obama administration. A court case with the petitioners being US citizens who rights are being violated because of Obama's executive order DACA is the best way to go.  It's an election year and immigration is a hot topic. The court case will get huge media attention.

New processing times came out today. They've gone from Feb. 12, 2013 to Feb. 13, 2013.  I'm not even optimistic that *I* will hear from them in the next month.
