IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsBackground Security Checks on i130 Petition

I'm a March 2013 filer, who is still waiting to finish up at the NVC. In 3 days, our petition will be 1 year old. We're hoping that my husband will be able to join us in the states by June, but if they don't fix the delays they're having at the NVC, we may be looking at July. So that's a grand total of 15-16 months.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - May 2014

My second checklist response got to NVC today (sent in another marriage certificate [certified] and proof of employment, even though I work abroad they want that now).  I called to request a supervisor review on the case (again) because they say my marriage cert wasn't certified when it IS.  But the lady, Joy I think, told me I couldn't request one if mail is pending.  I need to wait for them to review that and then if they checklist me for a third time I can then ask for a supervisor review.

*sigh*

:clock:  :clock:  :clock:  :clock:

####### is up with that? Didn't the USCIS tell you that your marriage certificate wasn't certified as well?

I would call in the evening to try to get someone who isn't Joy. She's lovely if you want to hear that you should wait 30 days for whatever it is that you want. But she isn't the kind of operator who will actually attempt to help you fix something. For that, you want someone like Gus, Waldo, Jim, or the always wonderful Todd. Regardless, I'd call a few times and see if you get the same answer, because I've gotten opposite answers from different operators, and then I'd just keep calling a few times and see what the majority opinion was.  If you get the right operator though, you may get a supervisor review faster. (And I'd mention that the USCIS claimed the same thing about your marriage certificate, until you sent it back and showed that it was certified.)

May I ask a silly question?

Does NVC always schedule interviews 30 days or more after CC? I've seen everyone getting June interviews and I checked Dwheels' spreadsheet, and it seems that way. I thought that since Buenos Aires embassy has very little inmigrants my interview date would be right away after CC. How wrong am I?

Yeah, I got case complete April 10th and thought I was going to get an Early June interview because Amsterdam really is not that busy of a Consulate for immigrant visas. I'm *still* fuming that it's June 17.  As soon as my file gets to Amsterdam I'm going to try to reschedule it.

I showed the kids that Daddy's Medical is a week from tomorrow, and that if all goes well, he should be here by sometime the week of the 24th, next month, and they started cheering and dancing around like lunatics. Sure as hell beats hysterical crying.  :P  Just treading water here, waiting for June 17th to get here. (Our request for an earlier interview date was denied.)   I hope everyone else is doing alright.

No, it remains "At NVC" until it goes to the embassy. The only notification you get is by email about a week after your case is complete.

Thanks!!

I'm hoping for the same thing!

If we get delayed in the process and end up with with a Julu interview, I'll beg the embassy to move it to June!

How long does it take for D261 to be available once teh case # is assigned?

Police certificate does not take a day.  I wrote a full thread on our experience getting the police certificate here.

I hired a lawyer in February, and I realized a month later that he was the problem for my case being delayed.  In all honesty, the people here on Visajourney know so much more than lawyers after what I've been going through and what I've been reading.  My AOS got sent back because he filled it out wrong, AND filled out the corrected one wrong. I did the DS-260 myself and fixed the AOS myself and nothing else has been sent back.  I also did the I-130 myself and no problem.  All of us should open up a law firm.

Do I receive a checklist for my DS-260 once it is reviewed and if they find something wrong with it?

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - April 2014

Hi guys,

I have an AOS question:

My form got sent back to me because I had the wrong amount on line 19 (2013 adjusted gross income).   I used line 37 from my 1040, but was told by NVC I should've used line 22.  Also, I had money from self employment that line 22 from the 1040 doesn't include.  Do I include that as well?

Thanks!

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC stage should i need a lawyer?

My opinion is don't use a lawyer unless you have a special circumstance.  I ended up using one because I thought I might need help filing out the AOS form, and I ended up doing it myself because my lawyer got it wrong.  There's a forum on here that's EXTREMELY helpful and everything I've done I've always referred back to the forum and it's come out right.  The link is below, and any questions you have it's answered by people going through the process or who already went through it.

http://www.visajourn...ilers-may-2014/

I am waiting for my case number form the nvc. My lawyer gave me a timeframe of about 45-90 days to finish my nvc stage once she get the number... is this realistic? I have seen other cases finished in one month or less. Should i even pay to do this or should I be doing this myself? Im highly frustrated because even with a lawyer i got an rfe in the I-130, because her proof of a bone fide marriage was statements from the wrong people and could have been avoided. which costed me more time and money..... I need some sound advice on this.

Thanks

I'm at this stage too. My opinion is not professional, but I think using a lawyer is a waste of money, especially since she was not really efficient at the USCIS stage.

However, from the spreadsheet with current processing times at NVC (data taken from visajourney: https://docs.google....anc&hl=en#gid=0) I believe that time frame is somewhat correct.

Yours could take less or more time than this, but the average (from the moment you get your number) seems to be 55 days. Using a lawyer will not change this I think :)

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - May 2014

Oh no, don't say that. My wife and I also have some really bad days. In a long distance relationship it's so easy to just hang up the phone after a fight. I also believe that most of our fights would wind down if we were together face to face to see our body language or to just hug each other and dissipate the situation. However, since we are apart, communication and discussion are crucial. We give some time to cool off and then talk about the fight. I have learned so much about my wife this way. We often realize our fights are due to misunderstandings like she took my tone of voice the wrong way, or I thought she meant something different than what she intended, etc. I hope this helps a little. Cheer up! :goofy:

Oh, that is a tricky one. When I started my AOS packets for my wife and stepdaughter I researched the same issue in VJ, other websites, and asked at least 3 different NVC reps. I never got a solid definite answer, so I used my common sense (I know, dangerous thing to do in this process):

In my wife's AOS, I put her as the principal immigrant and then added 1 for other dependents (my stepdaughter). In my stepdaughter's AOS, I put my stepdaughter is the principal immigrant and then added 1 for my spouse. This way each application showed a total of 3 household members, which is the accurate number of family members that would be supported by my income. In my case, just myself, wife and stepdaughter.

Is your friend the sole sponsor or is he using a co-sponsor? Only asking because if he is the only sponsor and using just his earned income, then he could still fill out the I864EZ for each one (wife and daughter each have their own visa petition). Shorter, easier form = less headaches :)

This is a very difficult situation for both sides as you well know.  I'm not privy to details but you both need to try and take a deep breath think before you speak because it's easy at least for me to just react.  This kind of stress tears people apart and may be the reason they do this to us, just a guess.   So at least one side needs to be able to stay calm and not react.  Not an easy thing to do but someone has to do it.

I don't think he is sick of you at all just stressed and men have a tendency to not tell us what is going on, on their side.  I think the art of talking to a man specially when asking a question is asking it then being quiet until they answer.  Men unlike us take their time and think for the most part before they answer, don't interrupt just wait.   It works for me and my husband and we rarely get upset with each other.   I wish you well and I'll keep you in my very long payer list. God bless you and your loved ones.   (F) (L) (F)

Thanks Guys!!!  i'll keep doing my part and just hope for the best.   I definitely think this wouldn't happen in person because I don't know how many times I've been over and for months at a time, and any misunderstanding get resolved quickly.  I think we're both frustrated with not getting the interview date that's probably causing more fights.  Thank you soooooo much.  I just needed to vent and make sure our situation wasn't unique.  Your words of encouragement really helped me :)  I'll be praying for both of you also  :goofy:

Case complete was on the 23rd. Just found out today!!

That's good no? Amazing even right??

My happiness is kind of confused because it's the 27th. and no email with no further information such as scheduling medical and or interview has arrived...

The super awesome lady on the phone said she no clue when the email will and told me I can do nothing but sit and wait....

Any clue how long normally an email takes to arrive?

It's like I wanna scream so loud but then it doesn't feel like it's complete sigh* I weird probably but this means no more checklists and such right?

It takes around a week. Also, don't forget yesterday was a holiday. Buttt the good news, is your case is complete!!

Internet is very slow where I am in Thailand so unable to read posts. No word from the
Bangkok Embassy about change in interview date. The tears have finally stopped falling
as I am now with my family after over a year apart. I was walking down the street
and holding my wife's hand very tight and I realized something was very different.
In the past I knew that soon enough I would have to let go and return home and all
the pain that would be involved. Just then it dawned on my heart that
I never have to let go of her hand again.

SOOOO HAPPY FOR YOU!!!!!!!!!!!!!! You and your family deserve this and much more. You 3 look so happy and perfect together!!!!

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - May 2014

Hello guys! I made a thread about this but i think it's better to post it here in the NVC thread.

Here is the issue:

I'm having some trouble understanding and really want to go over the documents and information I have before NVC processing.

I was married back in December 2013 and went back here in the US. Applied for a job and got hired January 2014. When I applied there was this form W4 and about claim and taxes. One question in there about your civil status in line 3 of first page, there is a note stating "If married, but legally separated, or spouse is a nonresident alien, check the ?Single? box." and so I did check that. Will that be a conflict to the NVC processing? I was claimed in tax of 2013.

2nd: I'm applying for a health insurance through coveredCA health insurance. The civil status question. I don't want any conflict between this visa application for my wife in connection with AOS. When I talked to an operator. He's asking me if my marriage is already recognized by the state of California? when I told him that my wife is still a nonresident alien but a petition filed for her so I may file for a joint tax if she comes here before 2014 tax season or if not (file married but separate tax file for 2014) If the state of California does not recognized the marriage yet then i should put "single". He is talking about current situation.

3rd:I'll be using my current income for the AOS. Employment letter, Pay stubs, etc. And in my pay stubs it is written there that in my tax info is claiming single due to that line I checked. Will that be a conflict?

Thanks you so much!

1.  I put Single for mine because it does say spouse in a nonresident alien and NVC processed my case with no problem.

2.  I just asked my insurance here at work about that.  Each insurance carrier will have different rules, but they told me that once he is physically here in the states all I have to do is send a copy of his Visa to show he just got here so they can cover him.  And this shouldn't have a negative impact because NVC shouldn't expect you to be paying extra for a person who doesn't even live with you yet.

3.  Get return transcripts for 2013, 2012, and 2011.  There should be no conflict.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - May 2014

First my last two posts:

In Topic: NVC Filers - May 2014

30 April 2014 - 05:12 PM

May is my month (My gut feeling) Still I will not call NVC until next week. I just received an email my I 864ws were delivered today so I will let the hard working men and women at NVC take time to review. It was the second AOS checklist. The first one I sent on Tuesday April 8 and was told to wait 20 working days and at some point 30 working days. Then on Monday I was told that one case was completed after that review, so when I call next week I will ask the exact date this particular case it was completed and work backwards to the April 9 when they received the AOS and that will give me the approximate days I should wait before I start a frenzy of calls. My two cents.

In Topic: NVC Filers - May 2014

20 May 2014 - 11:57 AM

I had mentioned earlier that I was gonna take a hiatus from my frequent NVC phone calls. So I broke the streak today. I made the phone call and had the longest wait ever, before one of the operators came on and told me that it will not be long before my case is complete. Why? I calmly asked, and she said its because they were reviewing April 26th mails (It was a Saturday) and she noted that my I864W was received on May1. I wonder how many days they take to review an average day's mail. Time will tell..... crossed fingers and toes.

THEN TODAY 5/22/2014

I called NVC this morning and finally the operator told me that the cases are complete and waiting for Embassy scheduling!.

CONGRATS!!!!!!! Almosttttttttt there!!!

I really want to go to Wildwood this weekend.....  Jersey shore is awesome !! It takes me about 2.5 hours to get to  Wildwood.  Wish my hubby was here . We love the shore...  ( big big sigh)

OMG I just realized you were in Philly!! Idk why I was thinking you were in Texas  :bonk:

If you ever come to Jersey let us know!!  I'm like 2.5-3 hours away from Wildwood too.

Yeah i agree, but unfortunately i had to go to work. haha
My wife is in town but she has her nursing exam the next day so we probably just cook out in back yard!!

lol awwww but at least you'll get to have the first cook out of summer!! Make a burger for me, i'll swing by after the park lol

can't really rely on their BS...  When I first submitted my documents , they were received April 15th.  On May 1st they had reviewed my docs and issued that stupid checklist for my husbands birth cert. Someone called and they were told that docs with the date April 1st were being reviewed...  They were 2 weeks off. So the NVC just ratteled off a date  ...   Someone else reported April 30th  at the beginining of the week..

It seems to be  taking about 2 weeks + 1 or 2 days.

We'll see if it's true their working on 4/30 cases.  Because my case was complete 4/30 and I still have no interview  :(

I tell my husband how awesome his english is. He gets all embarrassed !   HA HA

Just speak english to him. Speak slow and make him learn.   My husband even has the slang down pat. He watches TV in english over there.  Shows like Big Bang Theory and Friends. It helps him so he doesn't lose it !  He's been back in CR since Nov 2011 and since we talk everyday and he watches english TV shows, he hasn't lost anything.

We all need a CC by Friday.  That would put us in the running for July scheduling.

How long does it take for the NVC to ship the file after they schedule an interview?  Do the ship it right  out?  A day or two? or do they hold on to it to get one last jab ?

I have no idea.  My case was complete was 4/30 and I still haven't had the interview scheduled.  Hopefully they send it so they can't get bored and just look for stuff on it.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - May 2014

My husband lived here for 3 years. I was the ONLY person who spoke english with him. He didn't speak a word of english when I met him.  I love his accent and his grammer mistakes are adorable.  He insists that I correct him when I hear something worng  but I know what he means and I think its cute.  My spanish is horrendous. I understand  but its very difficult to talk back and have a conversation. I am sure I sound like a caveman. But his family is amazing. they speak slow. My husband only speaks english with me.   I send CD's for my husband to study while he is  waiting. He is very shy. He tells me he understands about 95% of what I say but he is afraid of interacting with strangers for fear they may not understand him and he won't understand them. And he is embarrassed that his grammer is not perfect.    We talk everyday for about an hour and we text constantly during the day. He writes in spanish and I write in english. Its good for both of us to learn !!

Stress is horrible.  I try to keep my head straight by thinking of how good everything will be when this is all over.

My bills are killing me. Last Friday I just had to fork over $500 to replace the steering column in my car. I was out of work 4 days last week because I had no way to work. That was so stressful. My job is like 45 minutes away.

I keep telling my husband we need to play the lottery more often. We really need to win.

LOL I tell him the same thing!!! Wellll if we win, i'll make sure to throw a few million your way.

I'm happy to know that I'm not the only one with similar problems.  After this whole process, we deserve a vacation!!!!

I used to text him in english, but we stopped because when he dropped out of the english class I got pissed, but I"ll probably start doing that again.  I hope you, me, and everybody here hears something good soon!!

Sorry to bring up the loathsome H-word, but this Monday is Memorial Day.

We all need to plan exceptionally distracting activities to survive this holiday.

AHHHHHHHHHHHHHHHHHHH!!!!!!!!!!!! I thought about this too, I don't know if I'm happy for the day off of work or I'd rather work with a chance to see my husband sooner!!

LOL! Hoping the weather will be nice enough to sit by the pool and read. Haven't picked up a book since December and I need some Vitamin D, desperately.

YESSS ME TOO!!! This jersey weather has sucked!!! lol we'll do a sundance or something lol

We applied April 2013. I can't stand watching the time fly by.  So much time wasted that I could be with my husband !

and I hate my job too. ( I am so stressed out about this dumb job because it is soooo horrendous)  Everyday I have to force myself to go to work. I can't do anything until this is nightmare is over either.  I have been applying for jobs since the day I started this job. I should be grateful I even have a job, but for real..  I can't take much more.  My doctor did prescribe anxiety meds but I don't like taking any kind of drugs...  So I don't take them !!  I have gained waight due to stress.. and being heavier than I am used to stresses me out even more !!

I'm on hold right now with NVC. I didn't call last night because I am getting really disgusted. 23 minutes and counting. I did get through the first dial though... I'll probably be on hold for 45 minutes.

Not quite 45 minutes.. This operator had a hard time speaking english... She told me they have no mail waiting for review.... I asked her to check again cuz its been there since May 8th...  Then she says.. we have no email waiting for review....  NOT EMAIL MORON !!!!!  I said I sent a fedex.   OH, ok... its not reviewed yet !!

OH MY LORD ! ! !! ! !  Please GOD, let this be over soon !!!

LoveMyTico I feel your pain.  I have also gotten anxiety over all of this and sometimes take it out on my husband, when he seems so calm about everything.  I've been handling everything, with him maybe doing a few things here and there, and it stinks. The job I have also barely covers my bills as of now, I can only imagine when he gets here and with no knowledge of english. I paid for him to take english classes and he dropped out bc he said there was nobody to practice with. So this process has me extremely stressed and just thinking of all the work that will come even after he's here has me stressed too. I feel as though I've gained weight too, and I didn't think about that, it probably is due to stress.

All the docs submitted to NVC WILL BE FORWARDED to the embassy. NVC does not keep docs. They just go through them to make sure they correct and accurate.

Once they accept them and case complete. The entire file is then forwarded to the embassy for the final decision by the CO.

Good luck

THANK GOD!!! Thank youuuuu. That would've been a pain to get all that stuff.  The last time I had to travel like 3 hours each way just to get my birth certificate, and then find street parking in Manhattan or pay $50 for half hour parking!! You are my hero of the day! lol

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - May 2014

Hope everybody had a good weekend! THIS WEEK i'm positive we'll get tons of updates!!!!!

Question - Should I be getting another certified copy of my birth certificate, get it apostilled or whatever you call it, and then get it translated to spanish again for my interview in Dominican Republic (whenever I get it)? AND should I have my husband's birth certificate, police certificate, and our wedding certificate translated to english again?

Or will NVC send all that to the embassy?
