Ok, so. Try getting a service request, and also send an email to their HQ. Quote the transfer notice details along with the fact that you are still waiting beyond 60 days, and have not gotten any kind of answers from the Service center, who wants you to have a service request first. (Which is unacceptable, and just takes their processing time out to 90 days instead of the 60 you were told.) If you can't get a service request based on the Priority date in the system, you can also tell them that you're unable to open a service request, despite the letter that you have because of the processing dates. I would copy the Ombudsman on all this. Also your Congressperson and Senators if you've contacted them in the past. If you haven't yet done so, I seriously suggest doing it now.

 

(I do remember vaguely what's going on with your case, but it's like 2am here, and I'm brain-fried. I should be more coherent after some sleep.)

I just hung up with tier II and I have no idea who to trust... their system is completely ...

I checked my case status this morning regarding my two applications and had the happy news that my wife application is approved and my daughter's application is reopened...So basically the purpose of my call was to check what the heck is "reopened".. So, the tier II tells me that both the cases are under review as of now and the online system is inaccurate.. Then why on earth do you have that online system and your tier 1 reps read off of that. Now I have to call my wife again and shatter her once more....

Under review could be a good thing, I think. If you were told that they were already approved, then they should just be checking their work and getting ready to ship it out to the NVC.

I contacted them a month ago when I found out I had an "Rfe" that hadn't been sent out yet.  Once they get back to me (last time it took them 2 months) I'll make sure to include that the RFE they sent me was ridiculous.

 

Here's the email I'm sending to my senator and congressman:

 

Attached you will find a copy of the RFE I received in the mail yesterday. TSC states that the marriage certificate I sent in was not ?registered with the civil authorities?. With my original I-130 packet, I sent a certified copy of my marriage certificate which indicates in various places the registration number, and the date and time in which it was registered. In fact, I called the county in Colorado where I was married and it is impossible to obtain a certified copy of a marriage certificate without it first being registered. To me, this means one of two things. Either the officer working my case is so obtuse they truthfully couldn't find the information they needed, which was recorded in multiple places on the documents and which in my opinion makes them unfit to work their job. Or the RFE was maliciously applied to my case in a tactic to keep my extreme processing times (almost 10 months total- twice the national "goal", and over 60 days at TSC) out of the national average. Because as I'm sure you are aware, once an RFE is applied to a case, the processing times are no longer averaged into the national statistics. Due to the persistent incompetence I have encountered with USCIS and TSC I believe either option is equally likely. But because this bogus RFE was "requested" November 28, yet not sent out until December 31 (a convenient 60 days after transfer) I am leaning more towards the later.

 

 

 

 

I am now forced to send another certified copy of my marriage certificate to the USA via DHL (which costs me $60) this time with a cover letter explaining explicitly where one can indeed find the date and time my marriage was registered, plus the registration number. The cover letter is written with so much detail that even an unqualified TSC officer will be able to follow it.

 

 

 

 

When I petitioned for my husband in March of 2013, the time frame from petition to visa in hand was eight months. Even pessimistically speaking we were sure to have the visa in ten months. Yet here we are, ten months in and not even at the National Visa Center. And I assure you, my petition was impeccable.

We know that PROCESSED IN ORDER RECEIVED part is a crock. There are cases around mine that have been already sent to nvc. Another has an rfe. But the others, like mine, still waiting. So if they really r processed in the order rcvd, then y havent i heard anything from them yet? How can they make these claims????? Maybe that is the way it should be done, but it is apparent they are not following their rules. Oooooooo SO angry now!!!

 

Well, I think that seeing HOW they write that statement is very telling. They could have stated that more information is required sometimes, and that causes the case to be pulled out of the queue to be dealt with. But they don't. They say it's the customer's fault. Which I'm sure that it is in a fair amount of cases. However, the ones that we've been seeing lately are just nuts. Sometimes people with half their case missing. #######?  That's why I said send it to the ombudsman. If they know that they're doing this (again) than they can address it in their next round of recommendations. If they don't know about it, then they can't even attempt to fix it.

We got a Case Number!

Now I want to opt-in to the Electronic Communication with NVC, and I have a question: it looks like you can't do electronic processing UNLESS your Embassy is in Canada, Mexico, China, Jordan, Turkmenistan, Syria, or Yemen. 

 

What about if your embassy is anywhere else? Can you still Opt-In for Electronic Communication?

 

This is STILL confusing.

*hugs* I don't think you can do Electronic Processing. But Amsterdam will be a cakewalk compared to the rest of this stuff. I've dealt with them on more than one occasion, and unlike their buddies over here at the USCIS or NVC, they're fast, precise, and efficient. Seriously, I think the Consulate in Amsterdam is probably the best government agency I've ever dealt with.

Its really awful.  All this time wasted on requesting things that aren't required and saying you aren't legally married without checking first is a waste of the time they should be spending on our approvals.  They seem happy to use any stupid reason at all to delay things.  But why?

For each type of application or petition, USCIS has established processing time goals. Specific processing time calculations are based on the number of months of application or petition receipts that comprise the level of active pending cases on hand within the agency.

Mr. Moore highlighted that processing times are posted 45 days after they are reported from the field offices or service centers to allow for a quality control process that ensures the integrity of the data. Mr. Moore shared that due to the 45 day delay, some of the times may not be as helpful for applicants under certain circumstances.

He explained that USCIS strives to process cases in the order in which they are received, but some cases are completed out of sequence due to issues like the need for the applicant to submit more evidence. Such delays from the customer cause a case to be removed from the adjudication processing line and placed into a category referred to as active suspense. These suspended cases awaiting applicant action are not factored into the processing time calculations."

So, my theory is that this is just another extension of them gaming the numbers. (Btw, I believe that Texas has been flagged by the Ombudsman's office for this behavior before. I'll go back and reread their reports to congress so I can give you a direct quote.)  We'll be able to see it if the numbers that they put out this month show a more than proportional increase in the numbers of RFE's in relation to the number of approvals based on past months data. If we see a more than proportional increase, then I think we have the reasoning for those bizarre RFE's.  

 

That being said, the Ombudsman's office is compiling information for their report to congress which is due in March. (I believe. I'll double check that, too.)  I think we should make sure that they are very much aware of the on-going problems we're having.

So, it is past the "60 days" for me. Making an e-request is out of the question as it doesn't have the relevant field to put in the request for our petition. Husband contacted the attorney yesterday and attorney told him he would e-mail them. I don't know which address. He should be calling up to put a service request in but I don't know if he is going to do that or not. I did tell my husband to tell him that because that was what was stated in the supplement to transfer notice. Husband said the attorney already knows about it because he got a copy too.

I'm not sure about how it works with your attorney, but I'd be pushing him for some answers about whom he's contacting. Then I'd have your husband start contacting your Congressperson at the very least.

Sent in my RFE on 12/30 n received confirmation by postal service it was delived 1/2/14. Then received an email from USCIS on 01/03/14 that my case could be denied due to abandonment on my behalf if I don't respond within a timely matter THEN got an email today while on hold with NCSC that they did in fact received the RFE I sent in and when the tier 2 sup. reached the phone she told me we had to allow yet another 60 days for processing. All I could do was cry. This isn't right. They lost our documents and we have to suffer for it.

When did you originally get your RFE?

TSC is the worst, isn't it??!!  My congressman and senator will definitely hear about this!!

 

Tier 1 says "I have some information I have to give you" and goes on and on what an RFE is, then says if I have a question I can contact a lawyer and do I have paper and pencil.  I say "I don't need paper and pencil I live abroad I am not going to contact these people".  She says "okay but you could also make an infopass appointment..." I cut her off "I live ABROAD I am not GOING TO MAKE AN INFOPASS!!!"

 

She finally transferred me.  Ugh.  I hate to be rude to these people, but good GOD!

Please, please, please, contact the Ombudsman about this. They probably will not be able to help you, but they seriously need to know about these insane Requests for Evidence. (Also, customer service people telling you to go to an infopass appointment when you're living outside of the country. ####### is that #######?)

I have a forgetful uncle who might remember to get it done if I bother him a few days in a row.

 

I'll call tomorrow and see what the deal is for getting an apostilled license.  And I don't want to sound unappreciative, but I honestly really doubt that that's what they want.  Nowhere in the RFE did they mention there was an issue with it being certified, just that it wasn't registered.  I feel like an apostilled certificate doesn't change whether it was registered or not, just whether it is a real document or not.

That being said, I've read and re-read, and that *shouldn't* be what they're asking for. (But it's not like we haven't heard them asking for things that are not requested in the original instructions like the beneficiary's birth certificate, or for things that have already been sent in previously.)  I included apostilles for everything I had, both for me and for my husband, but they're attached to the originals, so I figured it couldn't hurt. 

 

Would it be possible to get a faxed statement or emailed statement from the county clerk stating that your marriage is registered?

Is the apostilled version for international not domestic? I have no idea. I never even heard of it until i read i had to get all my docs certified before sending them to the embassies in wash dc.

How long do they give you to return the rfe?

Apostilled versions are longer (for the marriage certificate), contain more information, and I believe are acceptable for foreign governments. At least, that's how it worked in the Netherlands. I had to get everything apostilled. Marriage license. Birth Certificate. Etc.

I'm assuming that they just decided to change it today, since I sent more than one email to that address and never got any response, much less one saying that the address was not operational anymore.

That being said, if they wanted an apostilled marriage certificate for everyone, then they should have stated so in the instructions. I would totally send an email to the Ombudsman, btw. You've been waiting a long time since you apparently "got" your RFE only to find out that it's ridiculous.

So got the RFE today- they said "the copy of the marriage certificate you submitted does not indicate your marriage was actually registered with a civil authority in the state of Colorado.  Therefore, please submit a complete and legible copy of a marriage certificate establishing that your marriage was registered with a civil authority"

 

What does that mean?  I already sent a certified copy, do I just send another one?

Wait! Don't just send the same thing back! When I was going through immigration in the Netherlands, they rejected our county license, and wanted one that was apostilled by the state of NJ. You can probably order it online or go to the state's record office and get it right away. Perhaps, as stupid as it sounds, that is what they're asking for.

Hey guys, you were all 100% correct... at 9:30AM exactly it seems like whoever had my case came straight to work and APPROVED IT!!!!

 

On January 6, 2014, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations

Yep, I'm waiting for them to actually send it out now!  For those of you who are going to hit your 60 days tomorrow or this week, I strongly suggest that you email the service center directly, as well as the Service Center HQ and the Ombudsman. I'd also call and get a tier 2 and try to get a service request open. If you can't open a service request because they refuse to issue one to you, I think that you need to send that information to the Ombudsman and give the agent name and number along with the date and time you called. Then you should call your Senators and Congresspeople.  

If you want, I'll see if we can help pen a letter to send out to the USCIS leadership again. Only, I think this is going to take a very concerted effort. I think that a letter needs to go out for each day that you're waiting beyond 60 days. A different letter each day, nonetheless. And it needs to be copied to the Ombudsman at the very least, but I also think that we should be sending it to ALL the congresspeople and senators.

Thanks Stacey.. Monday morning I'll be all over my email.    My office moved me to another office really far away. Monday is my first day working out in the stix.  Sorry for them but I have more imortant things to do then work. Hopefully the movers took everything to my new office so I can set it up and start WATCHING !   If my computer doesn't make it there, its fine because my mail comes to my phone too !  HAHAHAHAHA   I hate how obsessed I have become with waiting for this approval.   This process turns us into different people...    

I was doing that as well. It sucks. It sucks really bad. :(  I woke up this morning and was going to check my case number, and then I went... Oh wait, I don't need to do that anymore. Hard to break the habits of the past 9 1/2 months. I'm still kind of stunned.  Your time is coming, and soon, girl! 

 

Can't wait to see everyone from march and April over here at the NVC. It's definitely exciting to get approved but it's just another waiting game. Got approval 12:11 and still no case #. My packets are sitting here ready to go!!!! Be careful on those roads up there. Your not far from my parents. They are 1 1/2 hrs west of philly. Reading area. Don't miss shoveling and driving in the snow. Tues it's supposed to be in the 30's here. Burrrr that's cold for SWFL!! Stay safe and keep your chin up!

I can't wait to see everyone from early last year done with this part! And the rest. I swear, I'm going to have a friggin' party when this is all over.

No, I never got any response to my email from them. I actually sent them out 2 emails (just looked through my sent emails)  One on Dec. 13, asking if they could confirm that my case was physically present in their facility, and then one on Dec. 31.

Oh, I'll still be around. Many more months before this is finished. :)  Besides, I want to be around to help you guys out if I can. You've all been such a giant help to me this entire time, and I've learned so much, it's crazy. :P  And I really do want to see if there is something we can do to prevent this from happening to people in the future.  I have my doubts as to whether or not it will be useful for anyone who currently has been waiting, but it would be nice to know that some kind of positive change was made in this system.

Mine ends in 309. I've been checking the ones around me regularly and watching them slowly come down from 320 over the past month or so, but I didn't check the ones around me today because I was too excited and forgot to. I'll go check them now and let you know what I found out.

Thank you all so much! I'm overwhelmed! It's been pretty crazy here as I've been explaining to my grandparents what happens next, and trying to explain to the girls what's going on. My husband was jumping up and down and yelling "YES!" when I told him. Now, to put the finishing touches on our NVC stuff. :P 

 

I sincerely hope that they clear out the rest of us who have been waiting for so long quickly now. I'll be watching for approvals tonight, and hope that we're seeing more than just 1 a day. They're never going to clear this up if we're seeing so little movement.  For those who are approaching their 60 day date, I would strongly advise sending an email to the service center that has your case. They have 21 days then to respond to you, and if they don't you can contact the Service Center HQ's. And my understanding is that they actually respond to emails fairly quickly. (At least they did months ago when I wrote them and they couldn't help me. :P)

I don't think we were. I'm so sorry for those of you still waiting. But I'll help as much as I can to help you, and I truly want to make it so that this can't happen to other people in the future.  I'm thinking legislatively. If they're going to be talking about immigration reform, then we should make sure that our concerns are addressed just like the other immigrant classes.

Hi, there was recently (maybe yesterday) a thread that had an email in it for contacting USCIS to get a case status update. I cannot find it for the life of me but my 60 days are nearly up and I am about to get on their butts! Can someone please point me in the direction of the thread that had that email or the email address itself?

You guys have helped me so much, and it's definitely been a learning experience. I can't thank all of you enough.  I'm not going anywhere fast. tongue.png This entire situation has had me thinking about how we can prevent this kind of thing in the future. I've been working on some ideas in my head. I'll be posting about them later, because I haven't had enough coffee to formulate coherent sentences. tongue.png  It took me about 3 minutes to write that last one. tongue.png

Have you tried sending them an email? I emailed the service center a day or two ago stating that it was almost 60 days, and could I please get an update on my petition. I don't know if it had any kind of an impact, but I really don't think it hurts.

If I got mine, I'm certain that the people who got transferred around me are going to be dealt with. They know they're butting up against the 60 days.  If you guys still need help, please let me know. I'll send you the email lists, and ideas I was working on. :)
