ok... how's this for a huge BUMMER..

I was told Case complete on June 2nd. I called yesterday and was told the same thing.  I even called early this morning and it was complete.  I called just now and I was told my case is NOT complete and he didn't now why I was told that.. I ask to speak to a supervisor. She looks at my case and told me there is conflicting information.   ( needless to say I am freaking out)   she said she will correct this and call me back this afternoon. Her goal is to fix this by today.  She told me they are finished the first round of July interviews as of June 2nd so I might not make a JULY interview... #######???   so as of right now I am not inline for an interview.      I swear... this is the most EFFF'd up process....

WHAT?!!! OH NO i'd be pissed too.   And I'm going to call in awhile and find out about July interviews too.

You can just request to speak with a supervisor. But, looking at timelines of others in DR, it's usually a month to get the interview date assigned from case complete date. I'm guess yours will be invoiced very soon, possibly this week or next.

lol honestly you've just calmed me down. I know a lot of people will agree with me on this, YOU know A LOT more than NVC.  I had to explain to my husband about this site, how it's not official US Immigration people, but it's  WAYYYYYYYYYYYYYYYY more useful and informative.  Thanks Saylin! I can't imagine how frustrating and difficult this is for you and your kids (and husband) to be apart for the first time for Christmas.  I hope that you all are able to have a happy day and find a way to make this year special. heart.gif

We're just trying to keep busy. Not difficult to do this time of year. Like I said, it's the quiet times that are a problem. Having the time to sit here and think sucks. Then I have time to dwell. Then I get either angry, or very depressed. Not good when I need to be taking care of my kids emotional health as well as my own. I'm very lucky that my extended family has been very supportive. 

 

Hang in there, I know its hard but we have to keep positive. I do the same thing as you go through the numbers smile.png hopefully soon we will get our gifts ?

I really hope that we can all get our approvals soon. That would help make next year a happy one.

Hey LovemyTico, I was transferred Nov 6 from NBC to NSC.

Updated the spreadsheet with your info.


I hope this helps it look like NSC is working on Transfers they received on 11/5 does not matter what your application date. There is a March spread sheet that sort of show trend. CSC seems to be the quickest I think they even processed April filers. TSC is the slowest but has jumped ahead some time I think to make there record look better. TSC seem to be sending RFE to a lot of people. I hope you get your approval

not very effective since you are still within the "processing window" which is Feb 13, 2013. Once that day moves past March 1, 2013, you will be able to have an effective service request.

He's an F2. I think that he may have more success than the rest of us. I would try to put in a service request, if I were him.

Before #304 and After #311 pretty much all have either approval/denial/or RFE (Except #312 &313 those are just saying transfer, but that could also be a glitch.)  

 

Over the past week or so, it's looked like they were slowly going backwards from #320. Yesterday they did #311. But obviously, no idea where these cases are sitting. *sigh*

 

I know, it's crazy work. But it's better than actually sitting with the quiet time at night after the kids go to bed. This is the first Christmas in 9 years we've been apart. When we spoke the other day, he sounded very upset, which usually doesn't happen.  

 

I really hope that my kids don't wake up tomorrow expecting their dad to be here. They've been crying a lot lately, and both asked Santa repeatedly for their Daddy back. It's the one thing that is out of my hands and I can't fix, even though they know I've been working on it, and trying everything I can. 

 

Anyway, I've gotta keep it together for the next two days. Thanks for listening to me ramble. I sincerely hope that you all have a great holiday (if you celebrate, and a great day if you don't.) and that we all get done with this step of the process in the next few weeks.

Thank God. We didn't receive any RFE's. We submitted also original documents from the very beginning.

Lucybelle- i agree with you! That dummie at the call center said for me not to worry about other March filers and to just worry about my own petition because i kept asking him how is it that they are currently working on Feb 13, 2013 petitions yet other March filers hve gotten approvals. He could not answer the question and thats y he told me that! Ugghh i was about to blow up so i said ty and hung up! He said for me to just keep waiting! And it was from Tier 2.

Yet me guess.. Guy was really hard to understand? Kept interrupting you?

I'm sure they are lying and just being plain lazy, but im going to wait out my husband's full 60 days from our transfer date. If nothing happens then I will start trying to contact anybody and everybody. He said I could not even make a service request. Im new to this site so I honestly do not know which direction to go?! Anybodys advice would be greatly appreciated.


 

I hope to hear something by the beginning of next year at least.


My last call to the USCIS indicated that probably was not going to happen.

My priority date is March 20, 2013, case was transferred to Nebraska Service Center Nov 6 2013 as well. As of December 19, 2013 I have not had an approval.

Oh yes, they are spreading the I130's around to other service centers. That way, our cases can collect dust in a completely new office.
 
Processing times over the past two years have gone from 5 months and through the stratosphere. I have taken the time to compile the processing times over the past two years into a chart showing this: http://www.visajourn...scis/?p=6694704 You can go through the AILA's archived information and verify that info if you're so inclined. I used their archive to compile it. 
 
The biggest processing average we were given in the past six months was a horrifying 16.6 months.  Currently, the USCIS is showing a 7.4 month processing average. But don't let that fool you. They've accomplished it by processing a few newer applications in a very short amount of time to attain that change. If you want to see something very depressing, go and view the dashboard information:
 
http://dashboard.usc...e=4&charttype=1 - That's the National Trend Chart. You will note that they are currently processing about half as many petitions as they were in March. You'll also notice the yellow line creeping upwards, after they sent the I130's to a National Benefits center that was not operational to collect dust for half a year. The Volume Chart shows equally paltry numbers: http://dashboard.uscis.gov/index.cfm?formtype=4&office=4&charttype=2  Seriously, do some research and check out the numbers coming from the service centers. They're horrifying to an I130 petitioner. 
 
Now, for my ancedata: I've been waiting for 9 months for an answer on my husband's petition. I don't expect instant gratification, but I do expect to have some kind of a time frame, something that the USCIS is currently unable to give me. Believe it or not, this impacts my life in a very big, and very real way. I've been married for 8 years. We have two small children together. I lived in the Netherlands with him for 8 years, married him here in NJ, and we decided last year to move back to the US. My children and I arrived earlier this year and my husband is waiting in the Netherlands. We did not file overseas because it did not seem a viable option to us. When we filed, the average time from beginning to the end of the process was 8-9 months total. This seemed reasonable to us, and we planned accordingly, with some leeway in our calculations for unforeseen circumstances. We did not, and could not factor in the fact that they would send our petition somewhere to collect dust for months at a time. Until we are finished with this process, our lives are basically on hold. 
 
And my story is not unique. There are a large number of petitioners stuck in this backlog. And we are getting no clear guidance as to when we will be done with this part of the process.  That is unacceptable.

Agreed, it's unusual for them not to update the numbers on the same day. There's often a lag of several hours as they get all the data up, but for nothing to have happened by today is strange, possibly suspicious. I'll probably check those pages about 30 times today. And speaking of USCIS not posting information in a timely manner, the Oct 31 NBC-AILA meeting notes are still nowhere to be found. No response to my email inquiry asking when they'll be published, either.

 

 

I found something similar once in the Adjudicator?s Field Manual when I was searching for ANY ounce of logic that might be guiding these people. They list out a few factors that may cause them to process cases out of order... it was a total load. 

 

Edit: This right here. First item talks about statutory requirements that mandate processing for certain visa types with specified timeframes. Sure would be nice if they'd pass one for spousal filers!

Oh, I've got something funny for you to read, btw.  It's where the USCIS says that they have a "first in, first out" policy, but those pesky RFE's screw it up and make it seem like they're processing out of turn. And sometimes it's just not possible to process things in turn, because: REASONS. Gotta find out where I read it.

Well, usually they update the processing times at the same time that they update their dashboard, and they didn't do that this month, either. So the question, then, is do we draft a quick letter and send it directly to the Ombudsman? I know I posted the charts all over my FB page, and after hearing the response from that tier 2 agent, a bunch of my friend and family are pissed off. Seeing those numbers only makes them more angry.  They're asking me how they can help and who they can contact. :)

They've started posting October data. So far just the volume & trends page is updated... everyone keep an eye out for new processing times.

Ugh, the numbers for Nebraska are just pathetic. Texas is also sad.  Working diligently my butt. These numbers prove that their statements in their letter to the stakeholders was a load of bull.

Kaylara- it sounds like you spoke with the same jerk off as I did!  He told me they were still working on Feb 2013 cases and I said I knew various cases from March, April, and May which had been approved.  He said "no, they're working on Feb cases"  I said "well national average is at 7.4 months and I'm at 9" he told me "you're wrong"  *sigh*  I was also told that *if* I do have an RFE (this was the one who told me I don't have one) it won't get sent out until after Dec 26.  I was like "after Dec 26?  So what, April, June, another year?"  He says "there's no way to tell, you just have to wait" dry.png

 

Anyways, my main point is you need to get Skype.  Calls to 1-800 numbers are FREE!  Even from international numbers.  I know I'd be in debt by now making these two hour phone calls internationally.  With Skype, they're free.

Oh, I've had skype for about 10 years now. We used it extensively while we were dating back in the day. :P But I also wound up spending a small fortune on international calling. :P 

 

Right now, my husband calls me every day at 11am. He's got an unlimited plan through Skype which was like 50 euros per year. 

 

Luckily, 800#'s are free. Which means that I'm only costing them money by waiting on hold. 

 

Was your Officer really hard to understand? Mine was. I didn't even get his officer # because I couldn't, for the life of me, understand what he said at that point. He also interrupted me constantly

I was pretty pissed off before. Now I've reached a zen-like calm. I think I'll call back tomorrow. I wonder how much money I can waste in phone calls before I get an approval. 

 

I wonder how much I've wasted already? I mean, if they just gave out real and/or accurate information in the first place, they'd probably save themselves a lot of pissed off phone calls.

And of course they're delaying the updating of their processing times. One of the geniuses I spoke to today said that was because they were still processing Feb. 12, 2013 filers. *headdesk* I can't even with these people...

 

I finally got a Tier 2 call back, and got a nearly 10 minute lecture about how I was over-reacting, and should not have even been calling to check up on my case yet, or have contacted my congressmen or representatives. After this was done he informed me I might get an answer by the end of January, or possibly February, or March. He really didn't know. It could even take more than a year. But I should just "enjoy the ride". (OMG, I seriously wish I were joking.)

 

He also told me to be happy because I didn't have an RFE because that would delay the process further. I said "I'd welcome an RFE, because it would have meant that someone has actually looked at my case. I have no indication that anyone has even LOOKED at my case since it was transferred." Him: "But it would delay it!" Me: "I've already been waiting 9 months. Delay is really a relative term at this point, isn't it?" 

 

Then he asked me if I was going to spend Christmas with my husband, you know, he comes here, or I go there.  I responded with: "Well, he's not coming here because he'd probably get turned away at the border, with my I130 petition still pending." He goes "Oh yes, that *IS* true" (No ######, Sherlock.) "And I have two small children, which means the cost of travel is prohibitive, not to mention how traumatized my kids are going to be when we have to leave Daddy behind again and come home."  Him: "Yeah. Well, Merry Christmas."

I'm in. I probably won't even been approved at that point. And knowing them, they won't update their processing dates until sometime next January to avoid having to deal with the service requests.

Today: Called Tier 1's twice. Because the first one hung up on me instead of answering my questions. The second one was a bit confused, and then decided that what I was asking her was, thankfully, not her job. So now I'm waiting for a Tier 2 call back. Huzzah. Callback system tells me 116 minutes of wait time.

Just got a quick response from congressman- he got another reply from TSC that said 

 

"Thank you for your letter, regarding [my name].  The request for additional evidence has not been sent yet.  It should be going out within the next 14 business days. "

 

So awesome.  I have to wait 14 BUSINESS days before they even send the damn thing out.  *sigh*

But that doesn't make sense if the USCIS is not even showing that you HAVE an RFE.

Btw, my Congressman and Senators are entirely useless.

 

Senator Cory Booker's site has been screwed up for weeks so I can't even submit a request for help. (Going to call his office today.)

 

Senator Menendez has had my case since the beginning of November. I gave them the requested 14-21 days to respond, and nothing. I've called and left messages for their Immigration Liaison repeatedly this month and have not gotten a call back. Finally got her on the phone today, and she tried getting me to resubmit my privacy waiver and information until I interrupted her and told her that she's had my case for nearly 2 months already. She put me on hold, then came back with "It looks like we sent an inquiry to the USCIS on Nov. 19th and haven't gotten an answer back from them yet. Is there anything else I can do for you today?" OMG Are you for real, lady? If I don't hear an answer from her by Friday, I'll be calling her again, and making sure that she actually followed up on my case. 

 

And Congressman Chris Smith is even less than useless. I contacted them repeatedly in November. Even trying to get the privacy release from them took 2 weeks and constant prodding. Once I sent it out, I couldn't confirm that it had gotten there for over a week because one person was out sick, and no one else checked the mail, or something.  I got an answer rather quickly from them after they confirmed that they had it. (Under a week.) This is probably because they called the same line that we call and spoke to a tier 1. At least, that's what I'm assuming based on their answer that "It was transferred to Nebraska on Nov. 7th, 2013. Call back if you don't have an answer by March."   

 

I did contact them after that because of the confusing processing times, and received the following response in the mail:

 

Dear Mrs. Kaylara,

 

I contact the USCIS per your request by telephone concerning your I130 application and was informed in order to expedite your case, it was transferred from the NBC to the NSC on November 11, 2013. The typical weight times are five months; although I was informed they are trying to process cases within three months.

 

I will continue to monitor your case in the meantime and just as soon as I have additional information, I will notify you. If there is anything else I can be doing for you, regarding this or any other federal matter.

(Please note, I abbreviated the Service Centers and USCIS's name. But the rest of it is exactly what was sent to me.)

 

*head desk* So, if you're in NJ, save yourself some time and effort unless you're beyond posted processing times. Because these people are probably not going to help you unless you have some kind of massive emergency. And even their help, if you can call it that, sucks.

Oh, I don't doubt that is the case. I think they're processing the newer cases to bring the average down and leaving a large hunk of the older cases back in the meantime.  The problem is that they show the average processing time, and not the mean processing time.  I would love to know what the mode or median was with our cases. That would probably be much more illuminating.

I just sent a email asking about my case to NSC. its been over 30 days to be exact 40days since my files were transferred. Course they have not answered typical. I wish there was a way to make accountable.

I sent one last week for a similar reason. 


on the notice of transfer..they mentioned if your case doesn't have approval after 60 days of transferred you can contact them.. they put on the letter we should have result within 60 days... 

People who applied after me and got their cases transferred after me and who aren't from the Philippines have been getting their approvals already. I don't care what their letter said. The people who got transferred there first and who have earlier PD's (and who aren't from the Philippines) should be dealt with first.

I do hope so. We've all been waiting way too long, and I fear that if we don't get an answer this week, then we probably won't get one until sometime in January.
