I just got a call back from my Congressman's office on this topic this morning. They told me nothing that I didn't already know, and actually gave me a timeline that is two months longer than the one that I got with my actual transfer notice. Absolute waste of time and resources.

Taxes processing time is in 12 February 2013 

Is that mean that the approval is close bec. We filed i130 in 5 April 

 

And I read about the processing time in taxes 

They don't have large pending cases 

 

So any bady has an idea about the waiting time 

Because um done with waiting 

And I tried to get b1/b2 visa to see my wife 

They told me that I have to wait for i130.

I told them that the uscis have a workload and I have to wait additional 6 month 

They said that : this information is wrong 

And they said to me that I should call the uscis to get my approval because the processing time for our case is over 

 

So nothing to do except waiting

Whoa, it looks like you're way outside normal processing times. They're saying that they're processing Oct. 1, 2012 in all of the service centers except the VSC which is saying Oct. 22, 2012.  If I were you, I'd contact them and put in a service request.

From what I understand, the interview questions are things that most people who are actually married should know about their spouse. But you're getting ahead of yourself. You have to file the I130 and get approval for that first.

This may be me going out on a limb here, but if your SO if from the Philippines, perhaps it is in regards to the situation there and getting your case expedited because of the Typhoon. I really don't have any idea, but am happy to hear that you got an approval. It will certainly be interesting to find out what kind of an interview it was. :)

Nope, I disagree, and many who have been here a while have seen this happen before.  That is the appointment letter.  The bit about a spouse is boilerplate and does not apply to him.  

 

The interview is for the petitioner only,and they have decided it is needed to approve the petition.

 

I could make guesses about what it is about but I don't want to offend the OP.

No, a I-130 interview for the USC can be required in rare instances before the I-130 can be approved.  Something about your case looks off to them, so they want to interview you first.  What are the red flags in your case?

But then if they're waiting to go through the NVC process for the VIsa, why would the USCIS require a beneficiary who is not in the country to attend an interview at an office local to the petitioner?  

 

To me it does sound like a mistake. I would call them (talk to a tier 2) and see if you they can straighten out the mess.

You might want to call them and make sure that they actually sent the letter out. There's another member on here who got an RFE more than a month ago, and was never notified, and they never sent it out.

Okay, a few questions here:

Did you have any intention of staying in the states when you came here this last time? Have you changed your mind, and can stay without having to go back quickly to tie up loose ends? Also, does your wife make enough money for you to not work for a few months, and/or possibly a joint sponsor?

 

If this is the case, then if I'm not mistaken, you can apply for an adjustment of status while you're here. You will not be able to travel abroad for a while, nor work. However, given your circumstances, that would be the quickest way to stay with your wife. You also run the risk that they will think that you were planning immigration fraud, so you should be able to prove that you never intended to stay in the US when you came here. You should submit your paperwork as soon as possible if you want to go this route.

 

If you go the CR1 route, it will probably take about a year. During this time, it will be harder for you to visit her because of the pending I130, and you will need to be able to prove substantial ties to the UK to prove that you're actually going back.

Moushoud, what did you include as proof?  I mean, it's TSC, so they could be looking for literally anything, including things that you've already sent in.  What things specifically did they ask you for in the Hard copy of the RFE?

I wouldn't bother unless they send you a Request for Evidence that asks for more proof. There's too much of a chance that they won't get paired up with your petition and will just get tossed.

Some people in my family were trying to tell me to get a lawyer, too. I keep telling them that I wasn't stuck in a backlog because I didn't have a lawyer, and no, they didn't pay more attention to cases with a lawyer. Then I pointed out several people who have lawyers because their cases are more complicated than mine who were waiting in the backlog just as long as me.  (Or longer.) And the cases where the lawyer screwed up and the petitioners had a serious problem because of it.  That stopped those comments. :)  I've explained the situation in painful detail over and over again to them, but nothing proved my point better than showing them that I was telling the truth about the lawyers.

Ok, I'm a little ahead of you guys. So far, you wait (hopefully) about 2 weeks for them to get your case at the NVC. After a week start calling every day. If they don't get your case at the NVC in about two weeks, contact the USCIS and start trying to find out where your case physically is. 

 

Then you wait about a month (or 10-20 business days) for them to issue you a case number, etc. I'm still waiting on my case number, etc. After that, then you can give them your emails and stuff.  Although, I think some people have had luck getting info before that via email. The DS-3032 is obsolete. You'll now be filling out the DS-261 online. You can fill it out.  No need to sign anything. Also, they just care that the payments for the AOS and the IV come from an American bank account, not whether or not it's yours. You might want to check out the monthly NVC thread posts 1 & 2 as they will answer most of your questions.

The VOG that my husband got was also in Dutch: However, on the bottom of the letter on the front page it states the following:

The State Secretary is therefore hereby pleased to issue this Certificate of Conduct, pursuant to section 28 of the Dutch Judicial Data and Criminal Records Act.

 

 

And the back is in both Dutch and English. So you probably will not need a translation. :)

You're not waiting for your AOS if you just filed your I130. You're waiting for your approval of the I130. After that, your case will be sent to the National Visa Center.  Since your wife is living with you in Australia, you will need to be able to prove her proof of intention to re-establish her domicile in the US.  You will need a co-sponsor in the US who meets the 125% poverty guidelines, as her income in Australia can't be used unless she will continue that income after she comes back to the US.

I'm not entirely sure, but I think you can use one as a mailing address, as he's only there once a week. The other would be his primary address. I think.

 

As for the second question, I don't understand what you're asking. What question # are you having a problem with?  Because you'll provide what kind of classification you are seeking for your fiance in Part 2, Question 1.

CR1 or IR1 same difference for this sampling.

I think if couples remain together past citizenship at approximately 3 years then the chance that it was a scam marriage lessens. Of course there is nothing scientific about this.

What do you think?



Past Citizenship, or past entry/AOS?  IR1 isn't the same thing though, because that would include people who've already been married at least 2 years. I understand that some people will wait it out, just to get that green card, but I have to think that the number of people staying married for that long probably have a very low rate of fraud. It might skew the numbers to include them with the CR1's. (I'd still like to see the numbers, though.)
