*BIG HUGS* I know. Right in that 8-9 month mark, I had a period of being very, very down.  The best thing I can tell you is try to ride it out, and then pick yourself up and start fighting again.  I know it's not much of a consolation. I really do. I had a few days of pretty much total breakdown.  But after I did that, I got angry. Really angry. And that gave me the motivation for continuing. 

 

I'm not going to tell you it gets better. It doesn't. But after I got my approval letter, it was like a giant weight had been lifted off my shoulders. I sincerely hope that you can feel that relief soon.

The numbers that they're showing now would reflect the number of cases the service center had 2 months ago. The I130's at the VSC that were being transferred were F2A's, not regular IR1/CR1 cases. And they aren't transferring all the DACA cases to Nebraska. Just some of them. I'll go look up what stats I can find on it.

I am seriously thinking that we need to be emailing every one we can get the emails of, and calling/faxing every day until they do something about it. We have the weekend now, perhaps we should take the time to write a few letters regarding the situation. Oh, and I seriously am going to go through Judicial Watch's FOIA releases and pull every single name mentioned in those documents. I'll try to have that list up late tonight.

Don't worry, even if your date was March 20th, they'll tell you some kind of bullshit answer. Like they have 5 months from the date of receipt of your petition, despite a letter from the USCIS specifically stating the opposite.

They mean two weeks from the USCIS shipping the case out until the NVC gets it.  Mileage may vary though. My case went from Nebraska. Other service centers are notorious for saying that they've shipped the case out to the NVC while actually holding on to it.  I'd say if your case isn't at the NVC within 2 weeks, you start chasing down where your petition physically is. (I was actually on the cusp of this, and had starting the USCIS trying to find out where it was, then it showed up the next day at the NVC.)

According to the press release from the USCIS on October 21, 2013.

 

"USCIS recently began transferring some casework from the National Benefits Center to the Nebraska, Texas and California Service Centers to balance overall operational workload. The affected casework includes the following form:

If your case was transferred, USCIS will send you a notice listing the transfer date and where your case will be processed. Your original receipt number will not change and this will not further delay the processing of your case."

What you are telling me is that the press release that I got, as well as the supplemental letter stating my case would be processed within 60 days were all lies? This certainly constitutes a further delay in my case, if I'm expected to wait a further 5 months. 5 months is the target processing time of the USCIS for a stand-alone I130 case for a spouse. You are telling me that I'm actually expected to wait close to 15 months for you to process my case? The National Average processing time is now 8.9 months, which I am past, and the Processing date at your service center is now March 20. My priority date is March 19. I am therefore outside of normal processing times.  You have had my case for 310 days. If my case needed additional processing, you have already had ample time to complete it. 

Claiming that my case is under extended review because you have failed to process it in the 10 months you as an agency have had it is unconscionable.   I can see in my case update that my case has not even been looked at since ____________.  I will be contacting my Congressman and Senators and the Ombudsman, as well as Service Center HQ regarding this.  And I will continue to escalate this matter as necessary until you process my case, as you should have done months ago. 

I hope that you understand my position on this matter. This is my Husband/Wife and our future life together. You must understand that any further delays are entirely unacceptable, and I will do whatever I have to do to get you to finish processing my case. My Husband/Wife is important. Our lives are important. And I will continue to fight for that.

If you got an RFE for the beneficiary's birth certificate, I strongly suggest that you inform the Ombudsman of this. That would be considered an improper RFE, and they ARE tracking those to help improve the system.

Well, now we know what company they use for their email systems.  I'm going to conjecture that either they've gotten enough response that they've tried to kill off the email addresses for a while hoping it would stop, they changed the email addresses, they're having actual DNS problems, or problems with their email program or server. OR your email provider has gotten blacklisted.  Can you try with a different email address?

They did complete 101 petitions in Dec 2011 but that from that point they started going down  and down & were only able to complete 9 petitions in  entire month  of May 2013  

 

Should they not be getting in to guinness book of world records on such an achievement 

 

Several months, they completed 0 despite having cases that were still pending. This is part of the reason why I believe that they're just not devoting appropriate resources to this backlog, are not taking it seriously, and will just manipulate the data to reach that 5 month mark, if they bother attempting to meet it at all.

Just thinking out loud here regarding the 60 day supplemental notices that were sent out.

 

We know Tier 1 and Tier 2, given day and time, their mood will give a different answer.  The fact remains they sent written notices out saying they have to process within 60 days and this was part of their effort to reduce workloads and process faster.  We also are seeing that emailing the individual service centers does nothing especially when there is no service request number which of course you can't get because Tier 1 and 2 go by the Feb 13 processing dates...So was wondering if there could be a mass effort to complain from those pending 60 days or more....

 

I am wondering if we can email SCOPSSCATA@dhs.org collectively stating the following:  This is the email addy mentioned on USCIS if you can't get a response from the service center...

 

Dear Sir/Madam,

 

My I130 case (Receipt Number -------) was transferred to ____ (Name of service center) on __________ (date).  I received a supplemental notice with my transfer stating that due to USCIS diligent efforts to reduce processing times, the case was transferred and USCIS will process within 60 days and I would hear something.  I request that my case be looked into as it has been pending for _____ days.

 

I understand the requirement is to have a service request number by having called the National Customer Service and having placed a service request.  I was unable to do so as Tier 1 and Tier 2 representatives refuse to place one stating the case is outside processing time of Feb 13, 2013.  This is unacceptable as it's double standards on part of USCIS.  If USCIS is allowed to go by it's written information stated on it's website stating they are processing Feb 13, 2013 or before petitions (which by the way I disagree with), then we, the stakeholders, are also allowed to go by USCIS's written notice stating that our transferred case is to receive some processing within 60 days.

 

I urge you to look into this matter at your earliest.  It is unacceptable that cases are pending for so long when the national average time when we filed was stated to be 6 months.

Wow wow can't belive this, Today I called their phone number and after entering my receipt number the general recording said that " your petition had been transferred and it will take 180 days from date of transfer to process"  

I want to know if all of you are getting these 180 day  thing or is it just me? 
 
 

 

I had gotten that too, when I called. Ignore it. You've got the supplemental letter that says 60 days. Go by that.

 How do Requests for Evidence (RFEs) or Notices of Intent to Deny (NOIDs) impact the calculation of processing times that are posted on the website?  Would the calculation of processing times stop when an RFE or NOID is issued and then resume when the petitioner submits the requested documentation? 

USCIS Response: Processing times are calculated based on the volume of active pending cases at each office or center. Cases on which a Request for Evidence (RFE) or Notice of Intent to Deny (NOID) has been issued are removed from the active pending totals and put into abeyance awaiting response from the customer. Once the requested information is received from the customer the case is reinserted into the adjudication workflow and becomes part of the active pending volume that is used to calculate processing times. It is pertinent to note that processing times are calculated based on the total volume of cases at an office or center rather than on specific applications/petitions. Therefore, published processing times may not reflect the elapsed time for any one particular applicant/petitioner.

So basically, if they issue an RFE to you, even if your case doesn't actually require it, they get additional free time to process your case, which does not contribute to the total processing dates.  That time that they were dealing with your RFE does not count towards the total processing time of your case, nor towards the average processing time listed. 

Gee, I wonder why they're issuing stupid RFE's.

I believe the RFE takes the file out of the pipeline and makes the adjudicator's numbers look better. I agree with you... If you're gonna pick up the file, why not just approve it? Why do you want to look at it again?  and why ask for stupid items that weren't even required in the first place?   

 

 

Well, its Thursday again...   TSC hasn't gotten back from vacation I guess. 

If you get an RFE, your priority date and case no longer counts towards the total averaged processing time. I'll see if I can find a link to the document that says as much.

It means that it got shipped to the NVC. But I would hold off on calling, there's no way they got your case on the same day it was shipped to them.  Go check the first post in the NVC thread and you'll get all the info you need for the next step! Congrats!

wow ..... really .... thats almost a month. I thought they should update/respond within a week. I feel like that when they need more time they just issue RFEs ..... even if it snot necessary. I remember sending USCIS emails, talking to tier2 officers and also my senator's office sent in an inquiry. In response to that after couple of days i got RFE and now again I am waiting.

That's my theory, and past Ombudsman Reports seem to confirm that this is a tactic that they've used in the past at AT LEAST one service center.  I'll quote the relevant documents if you'd like.

It might be, or might not. But it probably won't hurt.  If you want, you can send another reply stating that you are unable to complete a service request due to the current processing date in the system being Feb. 13, 2013, but your date on the transfer notice states that you will have an answer within 60 days. (Hence the email.) 

 

I honestly don't know if it will have any positive effect. But I do know that several other people who emailed the service centers around the time that their 60 days were up have gotten approvals within a few days of sending the email, so it can't hurt.

I asked about that and the Congressman's office said there are very specific criteria for expedites...i dont think i can get one just based on extended processing time. The Congressman's person I spoke to did call directly to TSC and they said that "it is under review with an officer" so should I then assume that It is assigned? They also said that my case is "pending background check clearance"....that should take 2 days at most...I think they are just stalling for time..

 

I strongly suggest writing an email to the TSC with your details and stating that it's been 60 days, and asking when it will be adjudicated/what is the time frame now.

Yeah, I would file for it now. No guarantees that you won't have to get another one, but when you get your approval, hopefully your certificate will still be good at that point.

 

We didn't get a police certificate because there was a bunch of outdated information online where it states that the Consulate will get it for us. I contacted them directly to ask about it, and they responded immediately and pointed me in the right direction for my husband to request it. So we did, and now we're waiting to get it from the Dutch Government. That's okay, because we'll probably be waiting a while to get to that point with the NVC.

Called the Senator's office and spoke to the rep who has been inquiring for me.  She basically told me ( and not in a nice way) You got a pretty detailed repsonse. I have some cases that haven't been approved and they filed in 2012. I stated that they probably aren't USC's and in her "not so nice voice"  Actually, they are!!!  

 

She told me she can submit an expedite if I don't get an approval or RFE within 30 BUSNINESS days. ( from Dec 30th)  Because they gave a specific time frame... I asked what about the 6 month statement they gave a long time ago? . I am sure I passed that timeframe...  She wasn't happy that I kept asking questions.   ####### do these people really do anyway?  I don't really deserve to be treated the way she treated me. I was nice as pie...  It is her JOB to serve the community.  So I guess with the HoLIDAY on January 20th... That puts me in the second week in Feb.  #######????????  and that is just the date I can inquire for an expedite....  This whole process is  a joke 

She's got people who applied in 2012 still? Obviously, she works hard. I wouldn't be advertising to other callers just how entirely useless I was at *MY* job.  Oh, that quote that was due weeks ago? Yeah, I'll get to it. Maybe. In like, two weeks. Maybe more. Don't call me for like a month. You should be happy, I have people who have been waiting for quotes for like 6 months. Oh, your customer really needs the quote? Well, that's very sad for them, but I won't be moving any faster.

That's because that processing date, averages, and times are not supposed to be used to judge individual cases, according to them. They, however, have no problem quoting those figures when dealing with individual cases.

Someone from May (05/23/2013) got approved at TSC yesterday. How can this be when a bunch of March and April filers are still waiting?

Because they're attempting to improve their processing time without having to actually do the work to process the files that they backlogged in a timely manner. TSC is also sending out crazy RFE's. Probably because when you get an RFE, your case no longer counts towards the processing time statistics.

I think I'll start keeping a log of everyone I speak to when I call USCIS. To include name and agent number. When I have called in the past I have always demanded to speak with a Tier 2 and I have always gotten transfered even though sometimes they dont want to. Hope we get our approvals soon otherwise it wont be a good time at the call center lol. So far I've been patient but now its almost time to start raising a little hell.

I've been doing that since I started calling. I have a note book filled with dates/times/phone numbers and notes on the conversation. Except for that last tier 2, because I couldn't understand what he said his name was, nor what his agent number was, and after the conversation started, I could barely get a word in edgewise.

Hi Kaylara. Did you by any chance get time to call Senator Booker's office? Also just wondering how can we by pass tier 1 representatives ..... I mean if they dont transfer our calls to tier 2, we are pretty much stuck with whatever they are saying. I mean I spoke to Tier 1 on the 31st and she was nice enough to take down my information and give ma reference number but then I really dont know how much is that going to help my cause. 

Didn't get through to Bookers office, but things got crazy today. (Ah, life with small children.)  If they don't want to transfer them, you have to insist. Or act so confused by the information that you're getting that they have no idea how to answer the questions you're asking. The last time I got a tier 2, I quoted all of the possible processing times, and asked them which one was correct.

 

(Oh yeah? Even with the letter that I got saying that it would be 60 days, and the message I just heard that said 180 days? But then the processing average on the dashboard says 8.7 months, and I'm at 9 1/2 months. And the date in the system is February 13, 2013, but that's not even close to 8.7 months. Which one is it? What is my actual Priority date? The transfer notice didn't have one listed, but had the date of March 21, 2013 which is one day later. What is my actual priority date? Are you sure? Why does it say March 21 then? Can you confirm that my file is actually physically at the service center, because I'm concerned that it's been lost. I know several people who filed after me and were transferred there after me, who aren't expedites and aren't from the Philippines have already gotten either an RFE or approval on their cases. I know that you process in a first in first out kind of way, so I am honestly concerned that my case file has been lost or sent somewhere else.) The CSR's always sound so relieved to pass me onto a tier 2. 

 

Not that that was always the case. When I first started calling at about the 6 month mark, I had a few who refused to transfer me. After that, the absolute confusion/hard questions route seemed to get me transferred really fast.

Yeah, we're in the same situation. I have a feeling that the next few months are going to be a very unpleasant time to be a USCIS Tier 2 call center person.

No, the last touch was Dec 3rd which I am pretty sure that is when it was scanned in at the TSC.  Thats why I have to laugh because they are all full of ######.   Time and Time again they give answers they think will satisfy us.  Its insulting. 

 

I wish I knew what the process was for assigning a case to an officer.  Do they split the files up by date ?  Are the files sent to different file rooms where different officers have access to them, which means that my files is assigned?  Which really means its sitting in a slightly smaller black hole? 

 

I hate my job, so a state of emergency is a happy thing !!!   The schools are already closed for tomorrow so it would be nice to get up and workout and not have to leave the house.  My kids don't go outside in the snow anymore. The 2 that are still home are 13 and 17.  One usually sleeps and the other texts and reads all day.  I'll have to insist that my youngest makes cookies...  LOL 

 

 

I agree... an RFE would be fine with me. At least you know when they receive the ####### they asked for, your approval is close.  Not knowing anything really sucks.     The idiots who answer the phones have no clue what is good or bad.. 

 

I can't wait to take my husband sledding next year. He has seen snow when he was here for 3 years BUT he never went out to play in it !! 

The information on this site given by the former adjudicator is very helpful in understanding how they *used* to work down in Nebraska.

 

My husband is not big on snow, but I know that he loved taking our oldest out to make snowmen. And it snows a lot more and a lot more often here, so it'll be a change for him. Also, having the sun going over head during the winter and actually seeing the sun on a regular basis is going to take some getting used to here. :P The Netherlands averages about 23 sunny days a year and during the winter, the sun swings around the horizon. It looks like it's about 9 am all day for several months there. Very weird when you're not used to it.

Oh, I most definitely will. And I appreciate it and will do the same for anyone else who is going to send out a letter for themselves as well.

Did you get a touch on your file when they "assigned" it?  Because mine hasn't been touched at all since it got scanned into NSC.  I am extremely doubtful that I will get an answer by Monday. Unless they decide to try to give themselves more time by sending me an RFE for something I undoubtedly have already sent them. But whatever, I'll take an RFE at this point if it means someone's actually dealing with my case. (When I told that last tier 2 that, he was horrified. Oh, no, RFE's are very bad. ####### EVER. RFE means someone's looked at my case. Besides, how is a possible 90 day delay any different than your answer of "You might be waiting over a year total." *%^*^$^%$@@#$%^&**~!)

 

I looked outside, and it's pretty snowy. Hurray? I'm not sure. The kids weren't real keen on it last time. It took about 5 minutes before my youngest declared that she was cold and didn't like the snow. LOL

Yeah, but after the last call and lecture from them, I could give a ####### less. Monday is their deadline for me. Then they're getting calls, and emails, and letters, and faxes, and more contacts with the Congressman, and Senators, and Ombudsman, and I'm going to raise more than a little hell because this is bullshit.
