We sent our petition from overseas around thanksgiving and were routed to the nebraska service center. I believe we got our NOA1 on Dec 5th. We have been living overseas since we got married 7 years ago, with 3 kids, all citizens one of which was born in the US. I am hoping for a quick approval, we need to leave by May.

I hate to tell you, but that's probably not going to happen. I hope that I'm wrong and that they process you quickly because you are overseas. But you're in Saudi Arabia, and that means that you're probably going to have to go through AP even after you're done dealing with the USCIS. That can take a ridiculous amount of time. 

 

You and the kids will have no problem. But your spouses will probably have to wait there for the visa process to be completed.

When you get very close to the 60 days listed in your transfer notice, I would email the service center and inquire as to what is happening with your petition.

That time may vary with the newer filers. We don't know yet. But the filers from earlier last year got a supplemental letter in with our transfer letter, stating that we would have a decision within 60 days of transfer.

It's fine. It will take a bit for them to input your case. No need to panic. It's in the WIKI for the NVC process!!!! 
 

 

There's nothing wrong with the message "this case is in process of termination.." The case number was just literally assigned and they're inputting it into the system..It's a good sign, and no reason to call NVC. This is covered in the WIKI of the NVC process.

Hi Group,

 

Just wanted to say thank you for your support throughout this difficult year with immigration.  After 16 months of this process, today at our interview we were approved.  

 

Our initial interview was scheduled for July 21st at 6:45 am, and we arrived at 5am.  At 6:40 am(40 minutes late) the embassy finally opened where we first gave in all necessary paperwork, followed by an attempt for fingerprints only to learn that the system was down.

 

At 8am the embassy told us ALL INTERVIEWS for the day had been cancelled due to the AC not working and the systems being down.  All they told us was they would reach out to us at a later date via email and phone to reschedule the interviews.  I WAS PISSED!!! My flight was supposed to leave that night and I just thought MORE WAITING.

 

After talking with friends, my husband and I decided just to show up the next day at the embassy hoping that we would be able to get in AND WE DID!!!

 

The following are questions that the Immigration Officer asked us:

 

1.  How and when did you guys meet?  (Through Facebook)

2.  What did he think of me sending him a friend request?

3.  Does he still have Facebook?  (She asked for his email to see his page)

4.  Do we still talk through Facebook?

5.  What phone do I have? Then she asked him in spanish what phone and what phone he had.

6.  How many times did I visit?

7.  She asked him what did he do that made me want to keep coming back.

8.  Do we have kids together?

9.  How old are his kids?

10.  Do they have the same mother?

11.  Was he married before since he had two kids with two different women?

12.  She asked to see our pictures , and asked questions about the wedding.  -  How come my family didn't go, and what did we do afterwards?

13.  If he went to college, or at least finished high school?

14.  What did I study in school, and then she asked him in spanish what I studied in school. (I graduated college way before I met my husband)

15.  I took a binder of bank statements, conversations, and trips, and she asked me to give her anything that would help.

 

The lady was very friendly and the questions were asked almost as though we were having a conversation, you can tell she was trying to make it as comfortable as possible.

 

We were very upset though with how the embassy handled the situation on canceling interviews last minute and not even giving a time frame as to when they might be rescheduled.

Wow I'm glad you guys were able to get in without an appointment. My interview is Aug 6 n I'm sooo anxious!!! What did you tell them in order to get in? Did they mention how long it would take u to get your passport. Can you expedite it? I want my husband to come to NY with me n I wanted to get an estimate as to how long it'll take him to get his passport. Please keep me inform. Thank you sooo much n God bless! Congrats!!!

 

 

We went with our original interview letter from the day before and just got lucky that they didn't see the date on it.  I've been hearing from other people who are waiting on their passports that it has been taking about 2 weeks to get the passport.  Once I get it, I"ll let you know.  I'm not sure if you can expedite, I'm pretty sure you can't, BUT I can be wrong.  At your interview just check with the immigration officer.   And thank you soooo much!!!

That's pretty country specific. He would need to check if DR will allow him to leave with unpaid tickets. US has nothing to do with it.

 

I know there are countries you can't leave with debt. So i guess he needs to check and find out. Can't imagine a transit ticket but every country is different with their own rules.

I'm so happy for you! I hope that your I129F gets through quickly! The NVC is super backlogged right now, I think you have a good chance of it getting to the Embassy well before your I130 gets a case number.  If they don't send either out within two weeks, make sure you're calling them and having the senator's office stay on their butts. Otherwise they might try to hold both for the 6-8 weeks they say it takes just to ship it to the NVC.

I also suggest reading this: http://www.visalaw.c...b3/2feb305.html (I found this on a thread where gogo was talking about his situation. He wound up filing a Writ of Mandamus.)  Personally, I would start getting all your information together that shows that you've been trying to resolve the issues, and start working on a Writ. That way, if it goes past 1 year, you can file immediately. I would also mention to your senator (or congress person)'s liaison that you plan on filing a Writ as soon as it goes beyond 1 year. If nothing else, perhaps a lawsuit or threat of lawsuit will make them move on your petition. 


I think if the people who are still waiting once they hit a year start threatening Lawsuits en masse, they will change their tactics rather quickly.

BS or not, it's what the letter said...

 

We re-interpreted the instructions included for filing to mean that the copy needed to come from the registrar's office, so we are going to get a certified copy long form.

At this point, what else can you do - it's taken over 10 months to get anything at all.

True. Lucybelle had a similar RFE where they said her copy wasn't certified. Which wasn't true. She sent back a copy showing that it was, in fact, certified.  If I were you, I'd notify the Ombudsman that you got this RFE that seems to require something that the I130 instructions do not mention at all.

Letter finally arrived today - stupidest error ever. Husband did not obtain proper copy of birth certificate, just photocopied it himself. It was so clear on the instructions..... we're both very angry with ourselves for overlooking it!!! Too many other things to check and double check.

 

So- ordering it online (since he was born out of current state) will take 25 business days!! Plus shipping time. WHAT. So he is going to drive there and do same day, in person service. Sigh. Something so small. sad.png

 

Fingers crossed for everyone else still waiting!

Um, I photocopied my birth certificate and sent it in and didn't get an RFE. Sounds like BS to me.

I just booked a flight for the end of March to go see my husband. I was supposed to wait til April but the tickets are $1000 in April.  I had enough miles to get a free ticket for March.  SIGH ...  I miss him so much. We are arguing alot and I really think its because of the distance. I feel extremely bad for the waiting . The lawyer told us 6 months when we first filed.  its already double that and still we haven't heard anything. Only lies from everyone I call.  We still have a waiver to file.  I can't take this process anymore.  I feel terrible that it is taking so long.   Its been a rough couple of days for me  cray5ol.gif

I just received a message from an Inquiry I made on JAN 3rd.. and its such ####### because I have 5 service request in and I replied with all of the numbers and the agent numbers  and the tier 2 officer names. I am so sick of the run-around I am getting

I was APPROVED 4 FEB

Only like a week after my Bogus RFE was returned to Texas Seevice Center.
Got the email and text message at about 10:30 PM Texas time.




Please contact the Ombudsman and tell them that you think that they're issuing false RFE's to give themselves more processing time.

I hope that you get a "no file". :) That means that your "extended" background checks are nothing of the sort. If you've got no file, then there's nothing for them to look into. That is an indication that you have no criminal background. That would mean that you could contact your representative with that information and have them call out the USCIS on your behalf.  No idea whether they'd do anything about it, but it's worth a shot. Like I said, I was considering exactly the same thing right at about the point I got my approval.

DVMan and LovemyTico, you can request from the FBI whether or not your case has been researched or your files asked for. You can also request the FOIA on your cases. If those show that nothing has been done on your case, then you can show your representative that the USCIS is lying and see if they can doing anything about it.  

 

I would respond to my congressperson that the security checks they are suggesting are in process could have well been done within the past (nearly) 10 months that they've had your cases. 

 

I'm so sorry that you guys are still waiting. If you want the info on getting your FBI file/what to request, and your USCIS file/what to request, please let me know and I'll look it up for you both.

Before I answer your question, I need to say this because I haven't said it already and I wouldn't want to mislead people. I worked other petitions besides the I-129's or (hunny-bunnies as they were affectionately referred to). But the process is the same, same databases, same checks etc... Everything in the system works the same as far as the processes and the flow of work. If you walked through the NSC it's a maze of cubes and everyone has the same type stuff in their cubes, the same file folders etc.... It's just what's inside the folders that's different.


But everything is scanned and routed around the various Service Centers the same. So, Nebraska does it the same way Vermont does or California or wherever. I can't speak to the District Offices or the Consulates. They may have their own way of doing things, but as an organization/agency there were standard operating procedures for handling and processing cases. We all use basically the same "system" and "tools".


That having been said... I could crank out an "approval" in about 15 minutes depending upon the complexity of the petition. I recall that we'd love to see those large family petitions with the little kids. Why? Because once you clear the mom and dad, the kids went really fast and you could get several "credits" very quickly that way instead of having to do the equal number of "individual" petitions for the same amount of "credits". But you have to be fast and thorough, because its your job to be fast and thorough you might say...

If they (USCIS) did their job properly in the first place, they wouldn't be getting as many congressional inquiries. :)

I'm sure that they're working at some point, otherwise nothing would get done. And CSC has been flying through the majority of petitions.  But that Netflix thing threw me for a loop a few months ago when it came out. Maybe CSC is doing that lean and lite thing that they were talking about doing for the DACA applications? Who really knows what's going on there?  Maybe you'll get an answer just at 60 days? I honestly don't know. It sucks that you're still waiting though.l  :(

Just wondering what could be the reason why a small number of petitions each month get held up with USCIS for an unexplained reason... While almost 90% of the cases go through a sequence and have an answer why is it that a few petitions get held up? Looking at the Feb, March and April spreadsheets tells the story....

 

What could be the reason? Is it because each case is different and requires extended review and additional back ground checks? or is it because some cases are complicated? or is it to do with the beneficiaries nationality? It simply remains a mystery....

 

Any thoughts on this? Just feel sorry for those being left out in the queue........


 

Could previous marriage and divorce be a reason for delay? Or having petitioned for a spouse previously could be a reason for additional checks? Just wondering and don't understand why a small number of petitions from Jan, Feb and March are being held up or by passed........ What could be the reason, because if USCIS needs any additional information they easily send out an RFE and get what is needed.... Just don't understand......


Maybe we can come up with a survey to try to take the different valuables into account? :)

I missed my husband's birthday earlier this past month. Me and the kids sang to him on the phone though. Even the youngest. Who has been running around singing it ever since. But now it's morphed into "Happy Birthday, EVERYBODY!"  :P
