Sukie! I received my third notice yesterday and it says the exact same thing like yours: "being processed" and no date. I was thinking the exact same thing like you - maybe it`s on somebodys desk ;-). Mine got transferred to California a week ago.

Well, you're in California, so it probably *is* on someone's desk. :P

 

My transfer letter also said that it was being processed. Monday will be 60 days for me. I guess that it just means that those are the people who will eventually be dealing with your case.

I have some good news for June filers, just got off the phone with uscis they told me our cases should have approvals by mid January to late January if no answer by then to give them a call back. :-)

o_O There are still March and April people waiting. They expect to be finished processing four months of applications in under a month when they haven't even been able to complete a month's worth (they've been increasing the PD a day at a time) in the past several months? They're so full of #######.

 

Don't mean to be negative for you. I hope that they're telling you the truth. But honestly, I haven't gotten the truth out of them in 9 months. I wouldn't trust *ANY* information coming from them. They lie. Constantly.

I feel bad for people from march and April no aproval for them and not all of them have been transferred i feel lucky i wass transferd lets see how they do with us june filler at nebraska

I'm a March filer still stuck at Nebraska. I was very hopeful that the transfer was going to mean there was an actual timeline and that they weren't actually going to take that long to process us, and were going to process us in order. HA!

 

We'll see how they're going to play this. They've only got a few days before me, and the people who were transferred at the same time as me are beyond the 60 days.

My case was transfered to my local office on Dec 27 which would be Detroit.  My priority date is June 20.

They're not transferring to local offices any more. Your petition will be sent to one of the service centers. (Texas, Nebraska, or California.) You should get a transfer notice in the mail that tells you where exactly it will go. (You will probably also get 2 more emails.)  If you can't wait, call them tomorrow, get a Tier 2 officer, and ask them where exactly your case is being transferred to.

Yes, it is. However, I think that it works into the formulas that they're using to calculate the shiny graphs and things.  I'm pretty sure that I screwed up the March sheet by adding people though, so I'm probably not the best person to talk. :P

I keep reading here and meeting transcripts that they stopped transferring cases to local field offices some time ago but the USCIS rhetoric is just not believable. They have continued to show & update local I-130 petition receipt/completion trends all across the nation and these are a few randomly selected "LOCAL" field offices.

As far as I understand it, they sent the I130's where people are also adjusting status to the local offices.  Standalone I130's are being shipped to service centers. Any Standalone I130's that are still being processed in the local offices have probably been waiting there for quite a while.

Today I received another notice that my case was transferred to my "local" office (Chicago). 

The VJ estimator predicts adjudication in February.

 

The journey is easier when you think you can see your destination.  My wife was so happy to hear the news. 

 

We have been apart 7 months now.  Probably everyone here knows what that is like.

 

Your case will not have been transferred to your local office. It was sent to one of the service centers. When you get the hard copy, you will be able to see where it went. If you can't wait, you can call them, ask for a tier 2, and ask them where your case was sent. I hope you got sent to CSC. :)

Yes, it's normal. Sometimes their system works, and sometimes it doesn't. If your husband is concerned, tell him to call and speak to a Tier 2 and ask where your file is and what happened to your notice.

Or was that where we were saying that it would have to be changed to at least April to support their prior claims?  We might find out this week. Unless they decide to take their sweet time rolling out the new processing times. (Wouldn't be the first time this year.)

I don't agree to it. Whole December April filers have been getting approved and may and June transferred. So we should be hoping for a transfer ourself by this month iA if we get lucky otherwise jan smile.png

March flier here. Transferred to NSC on Nov. 7th. No word on my case yet. But it looks like they're just picking random cases as this point, aside from the Philippines.

Unfortunately, my local Congress person is a Republican who was adamantly opposed to same-sex couples (of which I am one) getting rights.  I don't think I'll go local.  But I'll do the letter writing thing, and check with Chuck and Kirsten if nothing has happened by January 1st.

 

I know all of you feel the stress of being apart during the holidays!

There's a list in the NVC thread for this month where you can gauge about how long it might take you.  But to give you an idea, I got my approval on Jan. 3rd, and I haven't gotten my case completed at NVC yet.

USCIS should be ashamed of how long they made you wait after all the years you and your husband have been married.  After the long wait you went through just to get transferred the decent thing they could do is process the rest of the steps as quickly as possible.

There are people who have been married longer than we have who have been waiting just as long as we were and longer. (Which, btw, is also bullshit.)  I don't expect any problems at the consulate level, but getting through the NVC is probably going to take much longer than it needs to.  (Seriously, there's gotta be a way for them to streamline this. My husband is a computer programmer, and I'm certain that he could come up with some kind of program to make this ###### go faster.) For instance, all of the documents that we send to the USCIS are copies, and apparently they're scanned into a computer for processing in the USCIS. Why can't they send the file electronically to the NVC, especially given that we'll be submitting the originals at that stage.  (Or do you think the USCIS is still on a 14.4 modem? ) Why waste time waiting for them to physically ship the files? (And then saying it could be 6-8 weeks?!? I want to know whom they're using to ship those files, because that is a shitty timeline and I never want to use them for anything I ship out.)

I believe last month when they updated the information they wiped out some of the former information that was there. (I don't know how accurate the previous information was anyway, as the information for Nebraska looked like someone had a stroke while updating the information.) 

 

But I don't think they're done putting the info in. The Volume chart there is showing 0's across the board, and we know that's not right.

How did you know transfers are 6 months? I thought most of July was 5 ish?
Regardless, it will be early feb when the transfers start, and I agree with you, they must be
approving us by April if they have a hope in hell of reaching 5 months by May!



Or, conversely, they could just process a whole bunch of newer applications very quickly and bring that average processing time way down without actually touching the bulk of the backlog.  

 

Because the key word there is "average" processing time. 

 

It blows, but we suspect that they're going to do this, or have been working on doing it already. Hence the crazily out of order processing.

Emails, faxes, and phone calls. I think that we'll need to organize it over in the I130 Green Card Petitioners Committee thread. I think we also need to update our blog to show what we've done, what the response was, and all relevant information. (This way we can point people to it if they are interested in finding out more information and want to help.)  As the new numbers should be coming out this week, I think that we should wait until that information is published, and then respond accordingly.

As I said, I will participate again... they do say hope dies last!! lol!

Im eagerly awaiting the new times as well... see if they will try to cram more bull*%^t numbers down our throat...

I'm suggesting a slightly new tactic this time.  I want to contact every single congressperson and senator, as well as the president, vice president, first lady, head of DOS, DHS, USCIS, and then, seriously, anyone in a position of any kind of authority at those agencies. Every service center, and service center HQ. The Ombudsman, Public Engagement, etc. at the USCIS. Every major and minor media outlet we can find. Letters to the Editor and Opinion pieces to every local newspaper. Email the local radio stations. Email the TV stations that do those programs where you can have them try to help you. Email the friggin' Daily Show. Email 20/20, 60 Minutes, and all of those other investigative report kind of programs.  Tweeting regularly, posting all over FB, and any other social media you can think of. 

 

Obviously, these different outlets will require different kinds of letters. And we will need help to accomplish it.  

 

I believe that they now think that if they ignore us, we will go away dejected. We need to show a massive response to them in order to get the movement that we want.  I also think that we should mention that their lack of appropriate behavior towards us has prompted us to begin considering legal options, including lawsuits, and actual federal bills that will FORCE them to behave properly towards us.  I am going to contact some of the federal lawyers who I've been talking to about their thoughts on what kind of a response they think that will get. 

 

In short, we have to become very contentious and really drive home that we're not going away until they fix this #######. And possibly not even then unless the fix is permanent. We need to do our best to let the other I130 petitioners out there what we are doing so they can join in. We should also include the K1 filers, as we definitely do not want them to just switch this backlog back over to them to shut us up.

Ok...i have some weird news.  Not TOO interesting..but just very strange to me.  Opinions welcome obviously smile.png

 

 

So you guys know most of what I've done in the last few months. But Im going to run it down otherwise none of this makes sense and then ya'll will look at me like I have 5 heads...although some days I feel like I do anyway so LOOK AWAY! rofl.gif

 

Obviously I'm pregnant and antsy...and while I KNOW anything these people say as of recent means nothing and I take it all with a grain of salt...I still feel the need to email, write, call whoever I can.

 

To start...I called USCIS tier 1: We dont have your petition here.  Once you get your NOA1 its at that moment out of our hands"  (SUCH BOLOGNA!!)

Call USCIS tier 2, and say what tier 1 said.  Also that I know this not to be true, because if it was in the hands of NVC i would already have an NOA2!: HE SAYS:  Well let me look blah blah.....ok yes.  it's not here...(and the rest of the ####### line that tier 1 gave me...useless big balls of useless information!)

 

Someone suggested I email the embassy in Santo Domingo and my congresswoman.  I did both..around Dec 18 (ish)

No response yet from Congress.  Big help since its almost been a month..theyre SOOOOO concerned!

But from Santo Domingo after asking for my husbands full name,  I received the following response:

 

Good morning,

 

Thank you for the information.

 

We regret to inform you that the case hasn?t been received by us yet. It is possible that it was sent to the National Visa Center, reason why it is no longer at USCIS.

 

Please contact the NVC, nvcinquiry@state.gov in order to find out the current status of your case.  It does happen that when the case is being transfer it doesn?t appear in the systems right away.

 

Do not hesitate to contact us for further follow up.

Ok...PERFECTLY fine..perfectly acceptable response.  Very quick. Very nice. I left it at that.  I felt that was fine and had nothing else to say.  I didn't email back..nada!  (Remember this fact in a few minutes)

WHAT THE HECK IS THAT ABOUT?

 

For ONE thing, although I love getting SOMETHING from these people...i didn't ask again????

For another thing....if you say in the first email..."we regret to inform you"....or.."it is POSSIBLE" etc etc etc....Then youre plainly admitting you have NO idea where my stuff is and ITS NOT WITH YOU....right????  That was MY first impression.

 

Now theyre telling me they know its not misplaced and being processed??  HOW do you know?  What's the 30 day #######?  

Sorry I went so long with this but I wanted to just explain from start to finish so there wouldnt be so much questioning in the end. end rant  Soooooo...how was everyone's day??  goofy.gif 

 

 

 

 

Ok, call and talk to a tier 2 again, ask the physical location of your case. (Make sure that you write down the date, time, name, and agent # of the person you are speaking to at each stage of this.) If they tell you again that after an NOA1 it's out of their hands and that the NVC (make sure it's NVC and not NRC) has it, then tell the Tier 2 that you need a Tier 2 Supervisor.  You have to ask them (nicely) the physical location of your file, tell them the bad information that you've gotten from the Tier 1's and Tier 2's in the past, and ask for the status of your case.

 

Then I would strongly advise you to contact the Ombudsman and report exactly what you were told by the Tier 1 and Tier 2. Ask them to find out where your case is, and why the Tier 1 and Tier 2 seem to think that an UNAPPROVED petition was sent to the NVC already.

I don't get it either. I've never dealt with such chaos from a government agency before. There might actually be a bump that we don't see here, if they're reopening denied petitions that aren't included in these numbers. But to me it doesn't look like it.  Increased numbers of petitions wouldn't have been as much of a problem if they'd actually been processing them appropriately. We'd probably still have seen a bit of a backlog, but nothing like we're seeing due to the combination of their inaction, and the slight increase in petition. (Slight being a relative term. It's not like they doubled.) 

 

I really think that they're holding them for a few weeks because Late July/Early August aren't past 6 months yet. Perhaps they think this will give them a chance to actually adjudicate the files that they already have at the service centers, which may actually be good news for you guys. You may have reduced wait times after you finally do transfer. We'll have a clearer picture once they post their new numbers next week-ish. 

 

I think I also just saw some one from April who *just* got transferred. It's' possible that the NBC is still holding on to batches of petitions prior to July that they aren't going to adjudicate themselves. *head desk*

And we have to remember that the USCIS was actually getting lower numbers of applications for some time prior to that. In the documents I've been reading, I believe they were discussing what effect the lowered number of applications was doing to the USCIS financially. I'll have to look it up later though, as I'm watching my niece today. 3 little girls under the age of 5 = no more computer time until after they're in bed.

There were couples who had previously been denied a visa based on their same-sex status that were added back into the system. Most of these have already been approved, though, as they went through the entire process only to be denied after their interview.  

 

There were the couples who had already got all the paperwork done and literally sent it in as soon as DOMA was struck down - so last week in June, first week in July. 

 

Then there were couples like me and my wife, who waited for the actual decision to be made before getting in touch with a lawyer and starting that process. We got in touch with a lawyer on the Monday following the decision and got our docs out the last week in July. 

 

I'd be of the mind that not only would July be chock-full of these application, August was as well.

It looks like there was a bump in March/April and the number of new case receipts actually went *down* after that.
