Nope that's nit true... Spouse visa and fiance visa has same timeline... Call the uscis and ask what happened with your papers.. You need to follow up it all the time coz its way too long already..

The spousal visa and the fiance visa are NOT on the same timeline. Fiance visas are being processed much, much faster. That being said, she is way outside of normal processing times and should really contact them and make sure that they didn't lose her case.

Me and my wife used the K-1 process, please, VJ"ers, all should pursue this avenue of immigration, IF possible, a I-130 is so un-predictable, you just never know, yes, some sacrifices have to be made toward each others family regards, BUT, the K-1 IF possible is the way to go, even though it took our's
10 months and 4 days, (Sputum Farce).,.,., but we are happily married now.

My heart felt feelings go to I-130 people, as there is NO.., reasoning to what is going on now!!!


Been married 7 1/2 years. And, I got married in the US. K1 was not possible for us.

We filed I-130 Last year May 2012, until now we're still waiting for the approval...our second wedding anniversary is on February 16, so we loss hope about our case. Some friends told me that spouse visa takes longer to be approve than fiance visa...sad.png

Holy cow... Have you called and requested a service request? You're way outside of the normal processing time. You should probably call the USCIS tomorrow and get them working on it and find out what the problem is!

I filed for both my daughters, and found the process incredibly easy. They had their passport in under a week after we applied. (Edit: However, this was not in Jordan, but the Netherlands, so it may be different there.)

Ok, first off, you should give more details. That petition is not going to get any signatures with that wording.  Also, you need to give more details. Then you need to use a spell checker.

 

If you're an American Citizen, and the father/mother of the child, then why didn't you file for a CRBA? (Consular Report of Birth Abroad) Depending on what country your child is in, it may still be possible to file for one. If you get one of those, then you will also get an American passport for your child. Then you don't need to file an I130, because they can enter the US freely as a citizen.  Perhaps you are being denied by the USCIS because your child has a claim to citizenship that doesn't actually require an I130? 

 

Can you please fill in some details so maybe we can help you?

Are you sure it's actually *in* Newark?  Just wondering.  You are outside of regular processing times and can call the regular number, escalate to a Tier 2, and ask them to open a service request.  And ask them exactly where your case is and what is happening with it.

All the ones we were seeing before were expedites, too. I'm not saying that they're not picking up speed. But anything looks like progress when previously you were completely stopped. Even creeping forward is something. It's just nowhere near where it needs to be.  

 

But as far as the Timeline on here being accurate? It's only as good as the information people put in, and even then, it's only an educated guess. The more data, in theory, the more accurate it will become.

the prediction part is on the actual timeline itself.

If you look on the bottom, it tells you when to expect a decision on your application. I think that's what they talking about.

It updates over time. I'm currently on my 4th or 5th prediction, because I still haven't gotten my NOA2.

You should be able to call and talk to a Tier 2 or go on the USCIS website and open a service request now. If I were you, I'd do that and see what comes of it.

Senators/congressmen won't do ####### in most instances based on a phone call.  You must put this in writing.  Then they are held to a higher standard...there is evidence that they were contacted by you. I would sent it via USPS Return Receipt mail.  This way they can't say they never received it.

I have done this. Twice. All the Senator did was file an inquiry. Which is obviously not thoroughly taken into consideration because I received the same letter from Newark stating there is no information available at this time. I have called the Senators office three times today, I get tranferred and the call drops. Newark New Jersey, for lack of better more politically correct verbiage, is a hellhole. Thank you dear.

Oh, our congressmen and Senators are less than useless. I get more accurate and up to date information by myself than they've given me. It seems like some from other states will really go to bat for their constituents. We are not among those lucky people. :(

Look it up.  I've actually read on a particular lawyer's blog that this may be an option (allbeit an expensive and long one, but whatever, it's not like we're getting our petitions processed quickly anyway.) especially in light of how the USCIS has been treating the K3 visa.

If these people were targeting 5 months, and they're averaging 8 months, shouldn't something be done about that metric?!! If we're PAYING for the service and they're NOT subject to the stupid Congress' partisan bickering and shutdowns, why can't they work to improve?! 

 

Yes I'm feeling frustrated because I won't be able to have my wife here for almost a year...

Or more. Again, I'm just about at the 9 month mark, and no approval yet. That means it will be over a year before I see my husband again.

 

And I agree with you. We've been doing everything we can to try to make some kind of a positive impact on the system. Maybe you can join in on the next email/fax campaign. (As I have a feeling we're going to need to do another one.) 


well done on keeping it all going whilst being apart. it is interesting to see the different processes each country has for immigration.

 

we know we are on very limited time with mom, it would be worth my checking to see if we can have anything done after already sending it off. my poor dad is doing such a great job as a caretaker and always asks "how long do you think you'll have to wait"? we just had to put our dog of 13 yrs down last week and I think that is why I am not thinking too clearly on the whole immigration processing!! I even forgot to make copies of our application and hope that doesn't come back to bite us in the bum!

AP is Administrative Processing. As far as I understand it, it's done by the embassy/consulate.

Immigrating to NL sucked too, but at least I got to wait with him there while they let my case gather dust on the desk of someone who was on a perpetual vacation. I waited over 2 years for the equivalent of an adjustment of status. 

 

Lucky for us, we had a long distance relationship for 2 years before we decided to have me move over there. So we have some mad coping skillz. We just miss each other very much. But we built a life together over the past 8 years, and we both are definitely feeling the separation.

 

We didn't file from NL because we didn't think it was available to us, btw. But if DCF was available to you, I understand that those petitions go through pretty fast. I don't know if there's any way to change over to DCF if you started through a lockbox though.

I really really feel for those that are apart from their spouses, I hope it makes your relationship stronger. I told my parents (married 56 yrs) what some people have to do to come into the country legally and they get really irate, with my dad pointing out the 9 million illegals plus. I have told them that we will have to wait our turn too, maybe even longer as we are already married. My mom overseas has terminal cancer and I wonder now if I should have tried dcf. I hope that we don't have longer than 7-9 months.

 

 I think I will lobby harder on immigration when I am actually back in the USA.

We just saw someone get an expedite based on their father having terminal cancer. Maybe you should try for an expedite?  As far as I'm concerned, that kind of thing is why they have the ability to expedite. 

 

As far as the processing times, well, we get our info from the USCIS. Which means that you get a different answer every time you contact them. ;)  No, really. The average processing time on the dashboard is currently showing as 7.4 months until your I130 approval. If you got your I130 approval at about that time, and everything went smoothly with the NVC and the Embassy/Consulate, then about a year until visa in hand is probably about right, as long as you don't get stuck in AP.  14 months is pretty close to 1 year.  It's really hard to tell what's going on at any given time because the USCIS honestly is giving out tons of conflicting information. The Processing times over the past (nearly) 9 months went from 8-9 months total processing time (from what I've read on here) and it ballooned up to 16.6 months, then it was 13 months, 8, 11, now 7.4. And they're saying that they think processing time averages will come down to the goal of 5 months again by next May.  So your guess is as good as mine. I'm almost at 9 months, and no inkling of when they're going to dust off my case and take a look at it.

They say that by May, they expect it to be back to the normal 5 month time frame. But I wouldn't hold my breath for that. In April, they told AILA that they were processing applications in a reasonable time frame and wouldn't be re-evaluating their use of the K3 visa. They had already stopped adjudicating new files.  So they are perfectly happy to speak out of both sides of their mouth.

You act like your spouse has a right to be in the USA.   According to the laws of the USA, they don't.   You have to petition for the right for them to even apply for a visa.  You have to let the government decide if they want another person in your country and if that person can be your spouse.  You don't like it... So do something.  I can't; I'm merely an immigrant.  The ONLY reason I am in the USA is because my husband has his dream job and I want to support him because I love him that much.  Trust me, I'd much rather be back in my homeland, as cold as it is there right now.   Should we ever not work out, I will not be one of those people that stay.  We've already talked about retiring in BC. 

 

I'm on this board to help people get through the process, to make sure they dot their i's and cross their t's because the US government controls the population, which they do, in their opinion, for the best of the whole.  Every government does this of course to a certain degree.  But the only people who can change it are the citizens.  If you think you're really a customer, then act like one.  You wouldn't allow a company to treat you like so; you'd write a letter, make a petition, make a noise, or would you?

 

This government is controlled by people you elected... Or did you?  Think about it a while.  

 

In the end the petitions are adjudicated by a human being.  One who is likely just as overworked as the rest of the people.  The Department of Homeland Security is obviously trying to help out by moving petitions around so they can be adjudicated by someone with less of a workload.  They seem to want to get the ball rolling.  The timeline has dropped from 16 months to 8 in the last 2+ months.  

 

JMHO, take it or not for what my 2 cents are worth.

I act like I have a right to have my petition adjudicated in a timely manner, which is what I'm asking for. If they're going to deny my petition arbitrarily, it doesn't take nearly 9 months for that. The rules governing who can immigrate here are very clear for my spouse. As long as we meet the requirements, they have no basis to reject my husband's visa here. If they do, I can appeal it, and take them to court and fight it out there. Someone else explained it much better and I'll find that post for you when I have another free moment.

 

I'm glad that you're here to help. And yes, I've already been through the immigration process in the Netherlands, so I'm well aware that this insanity isn't limited to the US. 

 

I've written letter, made phone calls, contacted our representatives and media, gotten the word out via social media, and taken part in the last mass emailing/faxing and am helping with the writing and compiling of information for the next one that we're doing, which I will also take part in. I'm making as much noise as possible and doing my part to fix this problem. 

 

No, I didn't elect the people who are currently representing me. I lived in the Netherlands for the past 8 years. But they still represent me, and if they don't do their job, I will vote against them, and urge my entire social network to do the same.   

 

The timeline has gone down because they were gaming the processing times. We have proof of this and it is part of the next letter that we will be sending out. We have found several sources from the USCIS that show that they basically stopped adjudicating the I130's for months at a time. That they're now playing catch up (but still gaming the processing times) does not make me grateful. It make me angry that they lied to us for months and are continuing to keep us away from our family members, despite their claims of family unity being a priority. It makes me angry that they did not continue to ship the petitions to the field, but instead sent them to collect dust in a centralized adjudication unit that was not yet staffed or operational. It makes me angry that they refused to make the K3 available and lied in their conference to AILA when they knew that they weren't meeting their processing time goal even then and had stopped adjudicating IR/CR standalone petitions.  I'm doing my part to get the facts and attempt to fix this, as stated above. But happy that they're trying to keep us quiet by throwing us a bone and changing the processing times is not going to work. Even after I've gotten my approval, I'm going to continue to work to make sure that the people who petitioned after me don't get stuck in this mess in the future.  

 

They have a monopoly and basically absolute power over these petitions. If they can't wield it responsibly, then they need to have their power curtailed.

 

My husband is coming here for me. (And ultimately, our children.) I went to Europe for him, and could not handle it, ultimately. I want to stay married to him, so we're going to try it here. We were expecting to wait. But when I filed, the total process was taking about 8-9 months. We're now at nearly 9 months and aren't even through the first step in our process, and that, to me, is unacceptable.

It's the government.  The USCIS isn't a business.    Don't get me wrong, a government has to make money so they can spend it on things the people need, but you're not their customer. 

You're wrong there. We are the customer. We are their customer in every way. We have paid, and we require a service from them.   We paid for a service that they are not delivering. The only reason we don't go elsewhere for the service is because they have a monopoly. I'm sure that there are plenty of people who could not stand the wait and went to their spouses country instead. (I've considered moving back to NL, even.)

I called immigration a few weeks ago and was passed to a level 2 operator who said there were notes in the computer that my file was recently worked on Sept. 11 which would be the i-130 I filed in March of this year.  Now, on the website it says they are working on cases of October of last year?!!! 

 

PLEASE SOMEBODY tell me that they have gotten approved this year and submitted this year.  This has put so much strain on our relationship and caused so many fights.  I don't want to wait anymore.
