Dears,

 

Our case was approved on January 3rd.  Called NVC today and asked whether our case was received at NVC from USCIS.

The operator informed me that they received the packet at their building on 14th January and when asked about the case number, he said it will take at least 15-20 days to get the case number.

Usually does it take this many days to get the case number, i mean more than a month? 

 

Just curious to know, if I receive both the case number and invoice Id from the NVC operator, what would be the next step that i need to start?

Mine was also approved Jan. 3. Sent out Jan. 6 from NYC. Still haven't gotten it. Where did yours get approved at?

i have just called the NVC right now and i was told by them that the system is down right now and they cant answer any questions and i can call later to check...i just want to share you by these news guys smile.png

HAHAHAHA, omg. I just called them a few minutes ago as well. And when they answered and my agent was busy answering my question, some guy in the background started yelling "NO, NO, NO, NO! REBOOT! REBOOT! REBOOT! REBOOT! REBOOT! REBOOT! REBOOT! REBOOT! REBOOT! REBOOT! ... (pause)... REBOOT! REBOOT! REBOOOOOOOT!" The agent I was talking to was like "it's okay, calm down. It'll come back up in a minute." 

 

I fix computers all the time. I understand that level of frustration. I felt very bad for them.

 

Someone get these guys a decent IT person, STAT!

I completely agree with you. All of this is so unfair to families. I have been married for 5 years and my husband and I have two, kids also. Neither of us was married before or had any other children. The real kicker for us is that my husband was a U.S. legal permanent resident 20 years ago (went to high school and 1 year of college here) and was also a U.S. Marine for a few years. My husband made the decision to return to the his country after his younger brother died suddenly. He was never deported but returned his green card because he was moving home for good. When I went to an INFOPASS sereval months ago and I mentioned that my husband was a former Marine, USCIS could care less. I have contacted my senator's offices and they make inquiries on our behalf but I think a lot of people do this so it has no real impact. A friend of a friend has a daughter that works in one senator's office as an unpaid intern and during the furlough she was asked not to come to work so that may be why you haven't received any replies from congressional workers. Other offices may have asked even the unpaid, volunteer staff not to work. Hang in there...we'll all get through this.

I can understand why they haven't responded during the shutdown, but I initially wrote them almost a month before it. Like I said, I'm calling today again. I don't know if it will help, but it shouldn't hurt my case.

I have an easy case as well... Just like you, never married before, same color and religion etc... no red flags at all. Plus we even had a son before our marriage. No RFE so far but no interview and while many july filers like me already got their interview i strongly believe i am an interview waived case... So i am at about 3 months wait right now and i am expecting at least another 3/4 months... or more. I hate how some cases got an interview so fast they already have their GC and us? We wait....


 

Maybe your senators and congressman are not really efficient, try again and again. The purpose of all of this is that they receive so many inquiries on so many people's cases that they may consider changing something....


Oh, I agree. Which is why I'm also having my family members and friends send letters as well. I'm going to call the Senators and Congressman again today and try to get some actual attention on my case. :)

Actually, the immigrant/non-immigrant thing makes some sense.  USCIS is investigating spousal visa recipients for permanent residency before they are forwarded to the DoS and consulates for visa interviews.  The K-1s will get that level of scrutiny during AOS and, I imagine, that part of the process for them is being affected by DACA as well.  My wife and I went the K-1 route and it was frustrating for us to watch some other I-129Fs who filed 2, 3 or even 4 months after us fly through in as little as 8 days while we waited 6 months to get to her visa interview.  Even a lot of people who filed later and received RFEs got their approvals before we did (and we had no RFEs.)  Every case is different and every adjudicator/office works at their own pace.  I gave up trying to second guess what they do at USCIS.

 

That said, it's not quite as simple to come to the U.S. to get married as you say it is, even if you have no intention of staying and living in the U.S.  VWP countries are the exception not the rule and most people from the rest of the world would most certainly need a fiance(e) visa even if they had no intention of living in the U.S. after marriage.  Even with a valid (and usually difficult to obtain) tourist visa in hand, the risk of planning a U.S. wedding is too great because if the border patrol officer suspects that you might have the intent to adjust status from a tourist visa, you have a very good chance of being turned back at the border.  Having the K-1 takes "immigrant intent" off the table as a reason to deny U.S. entry.

I can see your point, but understand, I lived over in the Netherlands with my husband for close to 8 years. We already went through the background checks, etc, and I'm certain that the government still has the results of those checks somewhere. We have two kids together. My husband is not from a high fraud country.  The people who are coming over on the K1 visa get to stay in the country, with their prospective spouses, until they either get married and can do the AOS, or decide to leave (possibly within 90 days, but then again, maybe not.)  My husband can't even come *VISIT* us. That's bullcrap. 

 

I don't think you're correct about the fiance visa, as it specifically states that it's for people who intend to stay in the US after marriage. If you don't plan on staying in the US, you don't get the visa. And from what I understand, AOS from a tourist visa is extremely difficult to accomplish. Having the K1 proves that you have intention to move to the US. And as far as I understand, an immigrant or tourist can be denied entry at any time and for any reason and they have little recourse.

Do what you want. I was becoming almost insane after over 6/7 months of waiting and seeing that it was not getting any better...

Instead of sitting there i tried to help myself, contacted senators and congressman, cis ombudsman... maybe it helped maybe it did not but at least i had the feeling that i was helping getting things moved on...

I'm at the 7 month mark and have been contacting everyone I can think of for the past month, and I haven't gotten a response from any of them. Not my senators, nor my congressman, or the CIS ombudsman.  All I'm getting is the feeling that no one gives a #######. So, um, yay? :)

The K3 is a non-immigrant visa.  You have to adjust your status once you're here.

I agree. And I mean no disrespect, but my husband and I have been married for 7 1/2 years. It makes no sense to me that I am now at the 7 month mark and no word about when we're going to be able to move to the next step, and yet, we're seeing fiance visas go through in 19 days. Someone explained to me that's because our IR is an immigrant visa, and the fiance is a non-immigrant visa. But that doesn't make sense to me, because if you're not intending to stay in the US, then you don't need to bother to get the fiance visa in order to get married in the US. (I know, because that's exactly how my husband and I did it.)  

 

It's very irritating and upsetting that my marriage years is put at a lower priority than a fiance visa.

Yes, it was actually a later date when I applied on March 20th. Then the website said they were processing Oct. 22, 2012. Now it says Oct. 1, 2012. Apparently they haven't processed anything in the 7+ months I've been waiting, and in fact have gone backwards. When I asked a tier 2 about this last week, he had no explanation at all for it.

Yeah, that doesn't make any sense. We already had a bunch of background checks done when I immigrated over to his country. I honestly think that my case should be pretty straight-forward. That people who are in line after me are getting their NOA2's is a slap in the face. Order in which they were received, my butt. There are plenty of people ahead of me as well who haven't gotten an answer back yet. And they should get their answers either for an approval or an RFE before me.

Good luck, I've been asking for them to open a service request for weeks. They refuse. Maybe they're trying to figure out why your case won't come up online, but I doubt it. Sounds like you're in line a bit ahead of me. So, you know, at least there's that.

I know that a lot of people never could see any information on their case online, but it's better to err on the side of caution and just confirm that they haven't actually lost it.

You assume that an immigrant visa for a beneficiary from Nigeria is the same as a non-immgrant visa petition.  It is not.  You then assume that the difference is because there is "something wrong with USCIS"  There is not.

 

K-1s are not immigrant visas and do not grant permanent residency.  For a K-1 that is a separate process which is done after the marriage in the USA. CR-1s grant permanent residency upon issuance.  A K-1 is only "half done" when they arrive, a CR-1 completes the Permanent Residency process before entering the US.  

 

You had a choice of visas, of immigration paths, and you chose the one which takes longer to get a person into the USA.  Why did you choose the route which takes longer for your spouse to arrive?  There are benefits to it, so I presume you made that decision based on the benefits offered by the CR-1.

I had no choice of visas or immigration paths. I'm not a CR, I'm an IR. And they don't appear to be processing K3s.

If you are not planning on bringing your fiance to live with you in the US, then you don't have to file for a fiance visa. They are for those who want to immigrate to the US. If your state lets you marry foreigners, then you can legally get married. If you are not immigrating, then there's no fraud involved.

I'm going to throw my .02 into this...

   Entering the US on tourist visa to get married ect...  Visa fraud for tourist visa would be entering the country for any other aspects other than being a tourist!  Intent may be to immigrate later... or immigrate right then but either way the intent is still to move to the US.  So is getting married in the US then leaving the country and applying for permanent residence visa fraud?  It is how everyone views it.  The "trip" to get married and leave is not visa fraud because intent was to go back home and wait.  But "overall intentions" for the visit is visa fraud because the overall intent is to immigrate to the US.  Is visiting your spouse on a tourist visa in the US visa fraud?  The "trip" to the US if you return home is not visa fraud but overall you did enter the country on a tourist visa with plans to immigrate to the country which is visa fraud.  Since I can not find a really hard core true stance from immigration on this then it really all depends on who is looking at it because it falls under personal opinion.  My personal opinion is it does not really matter.  Your going to live here either today or tomorrow so who really cares at this point?

At the point that I married my husband here, I had no intention of moving back to the US.

The only real difference between a K-1 and a CR-1 is "these people will be married in a few months" vs "these people already ran off and did it."  No practical difference that would necessitate any sort of priority.  

 

I suppose so far as I see it I'll put my 4 year relationship that's never faltered who some here erroneously think should be of a lesser priority up against any one of these who are "damaged by the wait" any day when it comes to relevance.

And the IRs?  Not trying to be obnoxious, but we're leaving out a whole group in this.  I think that someone who has been married many years should practically FLY through the process. If for no other reason than the numbers of fraudulent cases involved must be extremely small. 

 

My point here is that we can all justify to ourselves why we should be first in line or not having to go through this. But we're not the ones setting the priorities, nor are we capable to saying that one relationship is more valid than another and we're also not capable of doing anything constructive to speed the process up. But we'll do it because we're frustrated at a third party who doesn't seem to actually care that they're hurting real people. 

 

Honestly, you may think that people are not damaged by the wait and are just having histrionics. But you know what, my marriage is solid, and this still hurts my husband and I. We're not fighting, screaming, etc. Our marriage isn't in danger of falling apart because of it. But I feel the void where my husband has been in my life all day, every day. We miss each other. We've been together nearly 9 years total, and the first two were long distance. We know how to deal with this. But it sucks really, really bad. We direct our stress at the agency that's causing it, not each other.  

 

And that's what we, as a group here, need to do as well. Sniping at each other does absolutely nothing constructive to fix the situation. We should complain, on a regular basis to the USCIS. And the media. And anyone who will listen.  There are plenty of people I know IRL who are completely horrified by my situation and are willing to write and complain and ask others to do so as well to try to help fix this broken system so others won't have to go through this in the future. (And possibly to force them to clear this backlog.)

There is no visa for that. You just come in on a tourist visa and get married. It's not fraud. She is mistaken.

Its easy for someone from a privileged country to judge, quite a narrow view I might say. The purpose of the Tourist Visa is to visit and go home, while the K-1 is for immigration into the country, quite different purposes. 

 

Many, many others here on VJ have followed the K-1 route and are now living happy lives. I don't know why anyone would want to deny them this right. 

That's exactly what I said. Perhaps we are misunderstanding each other. I said that you can get married in the US on a tourist visa if you don't plan on staying in the US after the wedding.  The K1 is for immigration purposes only. 

 

I don't want to deny them that right. I don't know where you're getting that from. That 'privileged' country is the one who we're working on getting my husband into, and are being made to wait way longer than we should be with no information. That is the country that we're discussing the laws for. I don't think that it's a narrow view when we're talking specific countries. I did say some others might not allow it in their country. I think you may be misunderstanding me.
