Bull. It may not be a conspiracy but this has been a problem since at least 2006. At least according to the Ombudsman's annual report. I haven't had time to read prior to 2006 yet. I'll do that later tonight if possible. (Reading through all the years from 2006 to 2013 takes time. Each is a rather large document to read through.) Statements like this one does actually make you think that they are doing it to extend the amount of time they have to deal with an application.

 

From the Ombudsman's report from 2006: 

Finally, the Ombudsman learned in March 2006 that at least one service center was 
issuing blanket RFEs for certain long pending I-130s regardless of the completeness of the file. 
As a consequence, USCIS spent additional resources to respond to inquiring customers who did 
not understand the nature and requirements of these RFEs and sent in duplicate documents. 
 
 
There are mentions of the problems with RFE's across the different immigrant classes in every single Ombudsman's report since then.  Including several where they report that family based visas had an RFE rate of 50-67%  
 
In fact, if you search through the following documents for "RFE" 'Requests for Evidence' or "Request for evidence" it becomes very clear that this is a serious problem that they've been very much aware of for years. Despite a "focus" on fixing the RFE problem, and various programs to attempt to fix the issues, here we still sit, 7 years (almost 8!) later, with similar problems which shows that they did not fix the problem at all.

Wow. That means if it does take 60 days my petitions would be at the USCIS for more than eight months! Isn't that longer than normal? Or is there a normal? 

Nothing about their processing last year was "normal". 

 

But yeah, I waited 9 1/2 months for my NOA2. I hope you don't have to wait that long.

Your right to free speech doesn't apply to a private website. Which I'm certain that is. Or at least it's considered as such. 

 

If we don't behave the correct way they WILL dismiss us as trolls. I've done website administration. There's no way I would react positively towards that kind of behavior, no matter what kind of merit the argument had, because it would encourage MORE people behaving like that.

Only 939 for VSC!!!!!!!!!!!!!!! That's pathetic!!!!!!!!!!!!!! VSC has as many as the CSC but it's not adjudicating at 1/7 of the rate! That's 14 months for an NOA2! WHAT THE ######

Wow, no one ever told me certified copies of a marriage certificate were required. Great, just great. Now we're for sure going to get an RFE. All I sent was a photocopy of it. sad.png

 

I feel for you and wish it was going better. Sorry. sad.png Hang in there. 

They're not required. Most people send in photocopies (I did!).  I'm convinced that TSC sent her an RFE because it would extend the amount of time they had to process her case while at the same time removing her from the processing date queue so that even if they take another month or two to get to her case, it won't count against them. 

 

It's not like that's a new tactic from them.

My understanding is that a Writ of Mandamus before 1 year and without having contacted Senators, Congresspeople, USCIS itself via email, phone, and infopass, and Ombudsman will result in a denial. If you've been waiting a year, and have done everything in your power to find out what the problem is to no avail, then most times they will adjudicate it after getting the letter that states your intent to file a Writ of Mandamus against them.  

 

Mari, if you'd like, I'll try to find the information I was looking at and post it here for you. Like I said, you can also read up on what Gogo went through with his wife (it's in his signature).

There are other members on here (Gogo and at least one other whose name currently escapes me.) who have filed one with a positive result.  My understanding is that it doesn't make sense before you've been waiting a year at least. (Before a year it will just get you denied.) But after a year, it's definitely an option.

Ok, here's some questions: Have you done an infopass and put in a service request? Have you attempted to contact the ombudsman? If you've done these, as well as contacted the senators and congresspeople (and yes, I know how useless they are. I'm from NJ too.) you may want to consider spending the money to hire an attorney and file a Writ of Mandamus. Even the threat of it might be enough to get your case finally pushed through.

Your husband needs to get on the ball and work for you. There are a number of things that he can be doing to move your case along, but it doesn't sound like he's done anything besides call (does he speak to a tier 1 or tier 2? Tier 1's are entirely useless.) and have an infopass appt?  What, exactly, has he done, and whom has he spoken to?  And what, exactly, did they say in response. You need to be contacting everyone and their brother on this.  You're way, way, way past normal processing times.

Wow! You filed in 2011! The way the USCIS is handling your case is UNACCEPTABLE!

Your husband (or whoever the petitioner is) needs to file an e-request, ASAP!  Go here: https://egov.uscis.g...equest/Intro.do

Click on the link and follow the e-request. They are supposed to get back to you in a relatively short time (< 30 days.. they got back to me that quick) since you are well past the processing time!

Also, make sure that the petitioner contacts his / her local congressman/woman!!! 

They should act on your case QUICKLY.

Yeah, you're way outside of normal processing times. You should have your husband contact them and talk to a Tier 2 on the phone. Do an Infopass, etc.

I would like to send an email to the HQ of service centers, as well as the public engagement section regarding the email that people from Nebraska have been getting, stating that they have 5 months to process that application (basically starting the clock over again, how nice.) despite the transfer letters stating 60 days, and the public statement specifically stating that the transfers would not further delay the cases.  

 

I also want to put more information up on our I130 blog. Including the letters, and our take on what's happening right now. Is anyone else interested in working on that kind of a project with me?

Oh, I've been on there tweeting for months, and have managed to get several news outlets following me. I post the graphics from the dashboards as well. I know that others have also been using the hashtag #FamilyUnity.  If anyone else has Twitter, let's flood it with tweets about the situation. Also, seriously, FB is a great place to discuss this issue because you can actually explain things. I go into every Meme/discussion on there that I can find about the immigration situation and put my two sense in. I also go into every article I can find about the immigration situation and comment. I don't even need to embellish things, I just tell my story and that I'm one of hundreds of thousands. Get the word out, believe me, even most people who are opposed to immigration think our situation is deplorable.

 

Aside from that, I'm strongly advocating a legislative fix for this situation. It's clear that we can't let the USCIS self regulate these things. We need to remove their ability to behave in this way. We are in a good situation for identifying the ways in which the USCIS behaves and wording that would be needed to avoid it in the future. This, I think, would be the best option for actually fixing the situation permanently instead of just having them shift it to another immigrant class. I think that we should include the K1's in this, as they are the most likely to be similarly effected, and if they shift the workload to us, they will probably do so by backlogging the K1's. That's not okay with me.

I sent recent faxes and snail mail letters to my congress and senators in Texas that included the dismal processing numbers and facts for USCIS, including John Cornyn, Kay Granger, Ted Cruz. I just got a reply back from Cornyn last week saying that he will take the concerns into consideration as the 113th Congress is coming up soon.

 

 

Excellent! I think that we all need to contact our state representatives regarding this.  Let's see if we can come up with a good letter stating our cases. Let's make it detailed, focused, and articulate.

Dears,

 

Our case was approved on January 3rd.  Called NVC today and asked whether our case was received at NVC from USCIS.

The operator informed me that they received the packet at their building on 14th January and when asked about the case number, he said it will take at least 15-20 days to get the case number.

Usually does it take this many days to get the case number, i mean more than a month? 

 

Just curious to know, if I receive both the case number and invoice Id from the NVC operator, what would be the next step that i need to start?
