wait for the hard copy. I heard of  a few operators tell people they were transferred to a local office but they really don't know what they are talking about. They are reading a screen.  The hard copy will be the notice you will go with.

You've gotta talk to a tier 2. The tier 1's will tell you it's at the local office, because they don't know jack squat.

No, I was talking to Christeen. When I get my approval, then it's another 4-6 months before my husband gets his visa. Even now, that puts me at over a year before I get to see my husband again.  I don't get to relax after this is done, I've got a lot more work to do. 

 

When did you file?

Oh . That's really a long time does any of u have a criminal history or smth that can make the "USCIS" doubt ur relationship 

Because why u didn't apply 8 years ago . That's so weird why would u wait 8 years to submit ur application while u could have submited ur visa a long time ago and u will be now with ur husband ??? 

 

Do u bother them by calling every time or not ? 

No, we don't have a criminal background or any reason for being delayed other than the fact that they stopped adjudication on CR/IR visas for 6 or 7 months (except expedites) so they could process the DACA applications. 

 

Why didn't I apply 8 years ago? Because I was living in my husband's country, and planned on continuing to live there at that point. Why would I need a visa for my husband when we weren't planning on living in the US? 

 

And yes, I've been calling them constantly. No dice.

Yes, there are extra REASONS why we are all still waiting, and it has nothing to do with our actual cases.  My case hasn't even been looked at except for when they transferred it. Been waiting for over 9 months here. 

 

I sent in plenty of proof of my 10 year relationship, and close to 8 years of marriage to my husband. I lived with him over there for the majority of our relationship, so there was a lot of it. My husband is Dutch, so not a high fraud country. We have two kids together. We got married in the US, and I also provided close to 20 affidavits from friends and family stating that they knew we were married, were at the wedding, etc. (Every one of them was notarized as well.) Photos over the years, and documents up the wazoo. I have an extremely straight-forward case. And I am *STILL* waiting.

 

Unless they are very, very lucky, they are going to have to wait a long time too. There are close to 500,000 in line ahead of them. The USCIS has stated that they're trying to clear this backlog, but I think it got bigger than they expected, and they're going to have a very hard time fixing the problems that they created.

So, I guess that means that they're not sending the files straight to the NBC anymore. Most of us who filed this year got MSC #'s.

It means that someone has actually looked at your case, and once you send in the information that they request, you will probably be approved in short order. In theory, it could be 60-90 days of delay (Someone please correct me if I'm wrong here.) but we've been seeing fairly quick approvals after the RFE was answered appropriately as of late.

It was also my understanding (from that former adjudicator's post) that they have a non-governmental subcontractor that would do that kind of stuff and the staging at night. Who knows what the employment situation is there, though.

Actually, I believe that the USCIS was discussing trying to bring back former adjudicators to help when they were gearing up to deal with DACA. I think it was buried in that FOIA release that we found at judicialwatch. I don't remember if that was on a temp basis or for good, though. People who had already been trained to do adjudications would be qualified to do so despite it being a temp position, if that were the case.

Have you written again to the service center? How long has it been since you wrote them initially? You might be able to escalate it to Service Center HQ if it's been more than 21 days with no response.

If you contacted the National Customer Service Center with a case-related inquiry and more than 30 days have passed and you have not received a response, you may email the appropriate USCIS Service Center with your inquiry:

If you do not receive a response within 21 days of contacting the Service Center, you may contact the USCIS Headquarters Office of Service Center Operations by email at SCOPSSCATA@dhs.gov.

 

Although, I believe that Nebraska is sending out emails saying that their email is no longer operational. But they give you the new email to send it to. I'd send an inquiry to both, at least until they decide to update their website information. I sent it to this email address about a week ago, so it must be a change that happened within the past few days. (Possibly because people have been emailing them because they're past 60 days.)   I'd email them, and then they have 21 days to respond before you can write to the HQ about it.

They're not working today. But I'd call first thing tomorrow and try to put in a service request, at the very least. If I don't get some kind of movement on my case by Monday, I'm going to work on recontacting everyone, Senators, Ombudsman, Service Center (again) Service Center HQ, etc. etc. etc. And I swear, if I hear that I need to be patient one more time from them, I'm going to lose a head gasket.

You're not being transferred to a local office, you're being transferred to a service center. You can expect 2 more transfer emails. We don't know why we're all getting three emails, it seems to be some kind of a glitch.

 

If you don't want to wait for the hardcopy to come in the mail, you can call and get transferred to a tier 2 and ask where it was transferred to. 

 

How long it takes from transfer to approval depends on which service center you're going to, and a bit of plain, old, dumb luck. They don't appear to be processing the files in any kind of order, so when you'll get approval is anyone's guess.


You don't worry, after transfer in 60 days they will make a decision. My approval after transfer about 2 weeks from NBC to NSC

Meanwhile, I'm still waiting. If they don't approval or send an RFE for my case shortly, I will be at the 60 day mark.

Oh right I have another question since I'm all new to this whole immigration process for bring a spouse over.  I've noticed on this website some people are being transferred after already being at a service center.  Since mines was sent to Nebraska and I filed Dec 12, 2013, will I later on also be transferred or has USCIS straightened some issues out and I'll be processed at Nebraska before I hit NVC?

Here's the basic gist of things... Service Centers got backlogged, so they started sending the I130's out to the local offices in late 2012. They kept that up until the very beginning of 2013 when they started transferring all of the cases to the National Benefits Center (people at the National Benefits center had a case number that started with MSC) Now, the NBC is in Lee's Summit, Missouri. But there's supposed to be a unit dedicated to adjudicating I130's at Overland Park, Kansas. (Division 8? I forget.) Anyways, as far as I've been able to tell, they were calling both places the National Benefits Center. So, they send the cases there and... Nothing. The Overland Park office does not start processing cases like it was supposed to, and Lee's Summit wasn't doing anything either. So most of the cases from January-August (is that about right?) sit there and collect dust, except for expedites. They start transferring cases to other service centers at some point, but it doesn't appear to be a lot of them. Mass transfers start to happen at the end of Oct. beginning of Nov. They're currently up to the beginning of July, and I believe we've had some people actually get approvals from Overland Park as well. If I'm not mistaken, end of Nov. filers and December filers were sent directly to the Service Centers, and are not getting MSC case numbers anymore. Chances are, if you've been sent directly to a service center, that they're not going to transfer you again, unless that service center gets hideously backlogged and then they might move your case again.

 

Did I get that right? Feel free to correct me if I got something wrong.

Anyways, that's what it looks like has happened and is currently happening.

How is it risky? Are we to fear retaliation from our own government? Is that what America's about these days???

Yep. Because we all know that we don't have the freedom of speech, nor the freedom of protest, or press, or to criticize the government in any way in this country.  

 

If we meet all the requirements (we do) then they have no reason to deny us a visa. If they do in retaliation for speaking out about them, I have several options open to me. 

 

I refuse to live in fear from my own government. If we've gotten that bad, then the future of this country is pretty bleak.

I do understand that they'd all gotten their NOA2's already in the other threads.  But why would it be in the "Records" department in Newark? The only time I've heard of a Records department was in those threads where people's files were sent to the wrong place. If they can send it to the wrong place after NOA2, I'm sure that they can send it to the wrong place before NOA2.  I think it would behoove the OP to find out exactly where their case is.

Just working on a hunch, here. I could be entirely wrong, but it's something to look into because if your case got sent to the NRC, you're going to continue not getting an answer on it.

Ok, did they say that it was in the Record's Department at that office, or the NRC?  (National Records Center) If you don't know, you need to call and find out where your case physically is (or do another infopass, and talk to a supervisor.) Darnell has written on here the exact kinds of questions that you need to ask to get the appropriate answers somewhere. I'll see if I can look it up in a bit.
