if i were in your shoes i'd be down at the embassy during american citizen services time, and 

ask a lot of pointed questions, talking with the Vice Consul in charge of the IV unit, and 

suggesting to that fella that the CO doing the interview has made a big mistake.

Guangzhou likes to see W-2 income - it's always an 'easy pass' when they can see that. 

it's my understanding that student aid, loans, grants are not even viewed as income.   

 

as a backup, I strongly suggest you seek a co-sponser , a human you know that DOES have W-2 income.

civil documents, the white book notarial translation versions, are presented on interview day at Guangzhou IV as part of the DS-230 Part I. 

birth certificate, affadavit of single status, police clearance certificate.

Guanzhou IV, on the other hand, for her CIVIL documents, wants a very formalized translation set.

for uscis - it doesn't have to be as official as a notarial translation, white book document, that GUZ IV wants to see  - so that's a plus. 

 

However, there must be a translator's attestation paragraph in the translated page. 

 

Most chinese grad students in USA will do it for 20 bucks.   Personal services IN China? No clue - but if'n you gots a buddy there, that's sufficient.

if later - that's called 'follow to join' and it's best if the IV Unit knows about the children on the fiance's interview day so they'll be expecting the visa application documents later.

the receipt notice (way back when) , NOA-1, formletter I-797C, listed an address for correspondence. 

 

It's best to use that address,  The Petitioner sends off a postal letter (with signature delivery confirmation) and includes a copy of the NOA-1. 

 

That's it, really. 

 

Sorry yer fiance had issues on the phone with USCIS Hotline - the folk that answer the phone are contractors from SERCO and mostly make up sh|t most of the time.

sure, yer filing the I-129F now that you are legally 'free to marry' but IMO, with such a short difference in time, a letter of attestation is useful - as the Vice-Consul would see that prior to the interview date.

Since yer filing so close to the official divorce date, I suggest you include a letter of attestation that covers the seperation period on you and yer ex.

fast forward to Manila IV document intake, and she has to submit several different forms for HER visa application.  One of those will be the certified copy of the divorce decree.

What you say does not make sense at all because it contradicts what NVC puts on their letter. If they electronically transfer all files to the embassy (which they don't because that would require painstakingly scanning every physical copy of your petition information they receive from USCIS, which would slow the process dramatically) then it would make no sense for them to say they will forward your case to the respective embassy because whether it is electronically transferred or physically transferred forwarding can apply to both cases. Also, if you were correct then the NVC really case no function at all apart from simply forwarding the information to the embassy, which USCIS could do anyway. If you are so adamant about being correct and chose to be rude in the process then I'd invite you to show where it states on any government site that the embassy generates the number and not NVC - my position follows from the obvious fact of what NVC states on their letter (which contradicts everything you say) and what their function must be in the process. 

Apologies, regardless of what you've written, 

the I-129F is scanned at NVC, a record is made into the electronic SAFEFILE system. 

 

There's also another namecheck performed at NVC. 

 

Yes, the Consular Casefile number is generated at NVC - that's one of their functions. 

 

There have been scant reports (some) over the past 6 months where USCIS screwed up in shipping the casefile, either going to NRC or straight to the Embassy.  NRC movement creates a huge lag, and when it arrives at the Embassy straight from USCIS, the Embassy sends the casefile back to NVC.  

 

Apologies for stepping into the middle of an argument here - I do note that the 'wording on the letter' has changed over time, and recently it's been really confusing (that wording).  I chalk it up to the contracting company handling this stuff - they simply got it wrong and it's carried over..

Yup, understand the I-864 has different requirements.

 

Where does USEM state for the I-134 its uses the I-864 requirements?  I would like to add the link.

 

I know for some additional support evidence USEM lists it as required in the instructions letter.

I did not say requirements, per se - But I'm writing of the math utilized for asset computation.  It's known that assets are ok to use on the I-134, but there's no hard-core instructions on how to compute the math in the I-134 instructions.  OTOH, it IS in the I-864 instructions, and most IV Units (I'm making a gross generalization here, thinking that Manila IV uses the same process) use the I-864 'math for assets' on the I-134.

ok - so the petition was denied because you two had not met prior to filing. 

 

IMO, an appeal would be useless. 

 

Since he's seen you already within a 2 year span, is best he prep a new casefile with new evidence and lots of new stuff this weekend, 

and file it monday.  

 

He doesn't have to wait for the denial  letter, at all.  Pay attention to the block about 'have you filed for someone before' in the I-129F and fill it out properly.
