The I-134 is not legally binding, but carries a coverage duration (my phrase) of 90 days, the dates on the I-94.

The I-864 IS legally binding..

 

so, maybe Dad could help out on the I-134, once you explain the I-134 isn't legally binding.

So here's my story....  my name is Justin,   I'm from Illinois,  a lil over a year ago I met the girl I want to spend the rest of my life with,  we just knew from the first time we chatted online that we were perfect for each other.   Her name is Pitcha,   she lives in Bangkok.   We chat online all day, every day,  yahoo cam, send each other gifts,  occasionally call,  and so on.       About 6 months ago we tried to get a tourist visa so she could come here and we could meet and see where it goes.   We did not know much about the visa process and the high percentage of tourist visas getting denied at the time,   so of course we got denied.  After she got denied I decided to go her.  My first time leaving the US and first time ever being on a plane.   After my 25 hr journey to the other side of the world,   we finally meet,   and spend 2 weeks falling more in love than we were before.   Was the most amazing experience of my life.   The only bad part of my trip was having to leave her standing in the airport with tears pouring from her eyes as she watched me leave,   not knowing how long it will be before we meet again.                                                                                                                                                                                                 Ok so now my question.......she is separated from her husband,   but not legally divorced.   They have a daughter and he still takes care of her and her daughter.  They remain friendly and civil to each other for the sake of their daughter and their home.   They are able to live in an apartment of his workplace since they are still legally married.   Here is where it gets complicated..........he knows me and her are happy together and want to marry.    but if they legalize the divorce,   then he will no longer support her and she will be forced to move and will create problems for her and her daughter.    I know the visa process takes a lot of time,     so my question is......Can we start the K1 process while she is still married as long as she gets divorced sometime during the process?   I just worry that she gets divorced and our K1 visa process takes up to a year and she is having a tough time there for a year.   Any info helping our situation would be much appreciated.   Thanks for reading.attachicon.gifme and Pitcha.jpgattachicon.gifme and Pitcha.jpg

errata:

1. VWP/ESTA is not a tourist visa. Have him check his eligibility this weekend.
2. K-3 route mostly dead. Please not mention it again, or your punishment will be to watch Monkey King: Journey to the East, in Cantonese for 11 hours.
3. If you live in Italy with him, 6 months or more, you qualify to file the I-130 in Napoli, chasing after a CR-1 or IR-1 visa. The Tag is 'DCF', or 'Direct Consular Filing' - none of that mamby pamby doc intake to the lockbox in Chicago, and it takes 2 to 4 months before a visa is put into the passport. No NVC involvement, either.

[I really miss Perugia and Spoleto]

New Plan - Have him come into the USA on a VWP/ESTA thingie,
then get married in SF,
then he leaves (or the two of you leave together) before the 90 days.

No K-1 visa chasing necessary, unless he is barred/banned from utilising VWP/ESTA.

Years Pass. Tempus Fugit. The two of you wish to return to USA, with him immigrating for good. File an I-130 to the US Consulate in Napoli, chase the DCF path. Forget a K-3, forget a K-1 - if'n you file the I-130 later, is great possibility he qualifies for a 10 year green card, IR-1 designation.

Nigerian Passport Holder, going to school in Italy, wrapping up a Masters degree at Perugia, has a solid work offer and sponsership there after graduation.

Can't get into the USA on VWP/ESTA, so a K-1 Visa gets him into the USA.

There's no rule that says he has to stay and adjust status in the USA, after marriage. Only a rule about marrying within the 90 days when coming in on a K-1 visa.

It's perfectly fine to leave after marriage in USA, without chasing any AOS in the USA, as long as he leaves within that same 90 day period.

Has anyone successfully lobbied an embassy to re-issue a K-1 visa?  My French fiancee came on a K-1 in July, but had to leave in October because of her parents' health.  We didn't get married.  I've emailed the embassy in Paris, but they say they can't re-issue the visa because we didn't get married.  For reasons of which you're all acutely aware, we really don't want to go through the I-129F process again!!!


Yet the 'reasons' are still there. Won't go away.

K-1 visa, I-134 affadavit of support - not legally binding, is 'in force' during the 90-day I-94 duration after arrival in the USA.

AOS from K-1 visa, chasing a greencard - I-864 affadavit of support - legally binding, is 'in force' for (pick 1)
1. 40 quarters of work (roughly 10 years or more) of the greencard holder or
2. greencard holder becomes a USCitizen or
3. greencard holder abandons USA Residency or
4. sponser dies

(I think that's right)

now, time and timings....

K-1 visa - file when you return, I-134 not needed until interview day in Guangzhou, approx 9 to 14 months after filing. If you get a decent job after you return, I think no joint-sponser needed, you handle it. Do you think you can get a decent job after you return, and hold on to it, for 9 to 14 months? I think you can, your parents think you can, etc etc.

AOS/Greencard - I-864 needed when filing. Can delay filing AOS up to 2 years after marriage, but if delay further, must to file I-130 with the big AOS set. So, not need to file immediately after marriage, if you think you can swing the big job for a years duration, then file after that, if you not want a joint-sponser to carry her.

as for sponsering, it's a contract between the sponser and the usgovernment to repay the usgovernment if means-tested benefits are utilized by the greencard holder (food stamps that are NOT emergency, medicaid/care that is NOT emergency, section 8 housing ) but most means-tested benefits are not available to green card holders until after 5 years of Legal Residency status.

Firstly, the government will come after you, as you are the primary sponser. I not know what the joint-sponsers responsibilities are, sorry.

We've been waiting since Aug15 for our case #,but we noticed immediately that they used a "W" instead of "M" when listing beneficiary middle intial on the NOA2.We've sent 2 emails  to inquirynvc@state.gov,attaching a copy of her passport and the NOA2 per the NVC request to solve this problem but have not received a reply.Of course we immediately upon noticing this went thru all forms in our duplicate I-129F packet and no where did we make this mistake,this is strictly their mistake/typo.When explained this over the phone stressing how this could be a big problem if its not corrected before they create her visa or can cost us many more mths wait time if they say they need to send it back to processing and then we receive another NOA2 and have to begin our case # wait allover again.On the phone they don't seem to think its a  big deal,saying just tell them at the interview and they will correct it but.....just wish they would reply and instruct us or tell us officially not to do anything until the interview.

Any one ease our worry or share ideas please.Thankyou-

 

Your Visa will be issued from the Immigration Visa application you bring to the interview. No need to worry about NVC . Also that is the wrong email thats why no response from them.

 

Just make sure its correct on your application (I believe the DS-230 or you do DS-260 not sure ) but thats the actual Visa application. No one send you back to the beginning over an initial dear.

It really isn't about your age difference but you showing a bonafide relationship.

 

  1. You said you visited 3 times. Over how long a period?
  2. You meet how long ago?
  3. Your 3 visits were how long in duration?
  4. You meet his family and friends and have their support and Blessing?

Honestly your chances are so much greater for a possible approval if you marry like  mentioned above. No not a guarantee but it shows you are committed towards each other. Sometimes with much older younger a K1 couple shows the CO that they aren't sure (may not be the case but heck why not marry).

 

Great you love each other and all that but the CO at embassy doesn't know you. If I was a CO and a 40 years older woman's profile showed up on my desk with engaged I would wonder why the hold up why not just get married. Especially if you have known each other over sometime.

I would like to ask if a previous B2 (Tourist Visa) denial 5 yrs ago and a previous K1 visa (Cancelled) 4 yrs ago will affect my K1 visa now?

The problem is i cant remember  the exact date when i had the interview i only had the month and year.. Is it ok to leave it blank?

 

No you do not leave back you put the month and year.

 

The other Visa just be able to answer their questions. Long as it wasn't a big issue and they don't think you are just fishing to come to the US you should be fine. But You may just have some extra questioning. Long as previous petition was withdrawn and all clear you should be okay. And its been a while so thats good also.

One of the biggest issue i have seen when there's a big age gap also is with K1 visa's. It seems like to the CO you are showing you aren't that serious of the relationship. And what if he comes over and doesn't marry in 90 days. Seems to thjem maybe once you reach a certain age you just marry. Like being engaged is for youngish folk.

 

I haven't seen lately ANY nigerian couples with age gaps even at 10 years that have been approved for K1. They end up marrying and file the CR1/IR1.

 

Go through the reviews and Nigerian post you will see a pattern of denials..

Why did they tell you to go back to your country of residence, are you not a permit to be in Barbados ?

Some embassies will not issue a visa if you have no legal permit to be in the country and some overlook it.


 

 

That's what I thought until the "it's expired, marry and file again" part.

It also sounds weird that they told him to return to his country of residence, why not issue the visa right there in Barbados.

When I had the first interview the consular officer gave me a 221g form requested a joint interview with the petitioner. My fiancée and I attended the second interview and we were interviewed separately. After the stroke interview consular told us that we APPROVED and that I should mail back my passport to them as soon as I returned back to the country of my residence which I did. My fiancée email the consulate about 10days of mailing out my passport to confirm if they received my passport because our case status has not change from "Ready" to nothing. The response we received from the consulate was the visa is in review and they are expect to unable to issue the visa but the final determination as simply yet not been made. And that they realized that the K-1 visa time frame is running out. You will need to petition for your spouse after you married.

Doesn't sound like a denial. Sounds like you are in AP.

The I-134 is for interview. And yes it must be an original given to CO at embassy interview. No scanned. Anything signed must be original.

it was marijuana the doctor called him and told exactly what it was

 

One thing that I have noticed and maybe why people haven't mentioned is. I don't think every applicant is asked these questions about drugs at the interview.

 

Seems too make sense you come up dirty and they ask to see if you will be honest or not. Cuz obviously if its in their urine or blood its recent (I believe what 60 days if in blood, 30 if in urine).

 

All you can do is prepare for the next year, and file again in a years either as a fiance' or married couple.I am

Also OP you have to look at the totality of your whole case. You are asking immigration to grant your  man a Visa to come to the US to MEET you. yet you have evidence that you have submitted to them you really can't go anywhere. that you are basically tethered to your job and a nursing facility as primary person to someone who depends solely on you.

 

Immigration has to be thinking But they haven't meet and you have 90 days to meet and marry. can you see what a tight squeeze all this is. Just trying to paint a picture of even if you get past USCIS the likelihood getting through Ghana Embassy (even people who have lived together get denied there). It is no easy thing that embassy.

 

Can I ask how long has this relationship be going on? When did you meet? Obviously online and that can be another red flag? was it a specific site? All this has much to play into an approval or denial.and your.

It asks in the all about me if I filed for anyone previously and name of that person and when I filed and then it says town.

It says town and state which indicates to me it would be my town and state BUT they goofed up 

the new form already by having a US format to fill in phone numbers for foreign numbers which is ridiculous

In the I-129F question 14 which is yes and going to 14f :

 

Which town do I enter ?

 

I entered my town but am second guessing myself a bit on that one.

 

Which address do they want ? Petitioner's or beneficiary's ?

 

My address is already listed on the form.

That Part one is all about you the petitioner. Part 2 is all about the Alien Fiance'.

 

Also that section is only if you answered Yes. So if you are a naturalized US citizen they you fill all that out otherwise it doesn't apply to you.

But the determination of whether an affidavit is sufficient does not depend on those tax returns. It depends only on current income, which is a separate question on the form. If you read the instructions, you prove current income by pay stubs and/or employer letter.

 

If you didn't work in the past and now have enough income, then you qualify. Conversely, if you had tons of income in the past, but stopped working recently, you have no income and do not qualify.

 

This is try for all embassies or all CO's. many have been denied for having current income above but previous below. Remember you are showing an employment earning history and if it looks shaky they can and will deny.

 

OP I would do as suggested tell husband to get employment letter together and also write letter of explanation of why he didn't earn what he usually does. If he is still at job the earning is there and he has a good verified reason.

 

Try getting that to the embassy CO and see if maybe they will reconsider you.

 

Also check around your forum about your embassy and how they weight on K1's and past and current income. Get a better feel how things are for your country.
