Thanks for all your advice. I won't be able to pay off the back child support for almost a couple of years so "waiting" any longer is not an option. I have proof of home ownership, joint taxes, years and years of messages and phonecalls, money transfers etc. I will do my best to explain my situation and provide evidence. I plan on probably hiring an attorney for my wife to help her through the process on that end.

Thanks for the advice on item 2. I will put in the wording actually as you suggested.

I get a monthly pension for over $20.845 which qualifies (125% of poverty line) for the I-864. So wouldn't it be correct to put retired at the top since it looks better then unemployed and I will be listing my pension as income?


That income qualifies @125% of poverty line if your household is 2 people (you and your wife), but does not if your household size includes (as it must) any dependent children under the age of 21 (regardless of where they live) and any previous immigrant sponsored with an I-864 form.

For what purpose are you wishing to use your pregnancy to prove the bonafides of your marriage...for the I-130, for the visa interview, for adjusting status, or removing conditions? We could offer more concrete suggestions if we knew which stage of the process you're in. Generally, USCIS or the consulates are looking for documentary proof that you and your husband are co-existing as any other married couple...so proof of co-habitation, co-mingling of finances is usually the way to go. Strictly speaking (and no offense intended), having a child together is proof that a couple had sex...it does not prove that they are living in a bona-fide marriage. This is not to say that including evidence of the pregnancy should not be done...but it should not be the only 'proof' offered.

Your husband has to be a legal resident in the country in which he will be interviewing for the visa....

The situation you describe is not so much a severe financial loss as it is a severe inconvenience...and that's not a reason to expedite your petition approval. Also, an expedite will just speed up the approval of your petition, it will do nothing to speed up your NVC and interview process.

No everything was via email. I got my first one in January itself and then second one on Feb 2 which was dated Feb1 2009. I dont know why i got two but it had same interview date and information. Just waiting for the interview really. I am 99% sure you will get your interview in March itself. but keep calling them.

you should receive it soon. i got first letter Jan 25, and then another Feb 1. you might have gotten it today or else monday. call nvc and check also no harm in doing that.

I guess I'll get an interview date sometime mid to late March since you had your case complete exactly 15 days before mine... :thumbs:

Here's the painful part.

Back when you filed, the K-3 visa was a viable option.

NOW, it's not so viable for you and your family anymore.

But there's good news !

You'll need to finish up with the IR-1 visa for the wife, and IR-2 visas for the step-children.

and figure out where you are in the process.

I'd definitely try to expedite in this case. There was a thread some time ago and their case was expedited just by explaining that the wife is pregnant and she needed the loving care of her husband. :)
There is really nothing that can go wrong with an inquiry except that it can be denied.
You could argue that you're afraid the visa will be granted right around the time where you're not allowed to fly anymore. That would cause great problems.

Be prepared to send in a letter from your doc confirming the pregnancy. Sometimes written evidence is require. Other times it's not. All depends on the person you talk to.
Oh and only the US Citizen can request this.

I agree to what you said but can you advise me I send only few documents with my !-130 petition, marriage certificate, rent agreement (But now she is in USA and I am in London and rent agreement was for London Flat) Affidavit from my Wifes mom, dad and one friend who attended our wedding, my wifes birth certificate, social security and forms thats it.

so can they request for more evidence. our was a complete arrange wedding.


Specific advice, to yer casefile? Alas, no...

But - a flat rental agreement in both names is useful. I assume you will be interviewing at the London US Embassy, and no where in India, yes? That's a good thing, and a bad thing. A good thing, in that London US Embassy is more civilized for handling immigration visas, and a bad thing, in that you'll still need to get all of the police clearance certificates from all the countries you've resided for the NVC processing stage. Is also a good thing, in that you don't have to muck about with VFS.

re: arranged marriage -that is looked at, sure, but as long as it wasn't some proxy marriage stuff, and the marriage has been consummated, yer golden.

just remember that yer 'evidence pile' grows over time. Review the instructions in the I-130 again, start collecting more evidence over time - there's 6 different types of evidence for you two to generate and collect. I know it's hard, when ya live apart, but it is do-able. I would suggest, if you are 'UK Passport Holder' - to get into USA sometime soonish, set up joint bank accounts with her in the USA.

Hey - calm down a bit, the lot of ya ;)

Remember, You should really have some sense of that Embassy, prior to making the I-130 submittal, and of the two of you.

For example -
Canadian n American, young couple under 30, no previous marriages or children, interviewing in Montreal - HEY ! not need so much, as Montreal isn't considered a high fraud interview post.

or
Morroccan male, age 25, and American female, age 45 with prior divorce and 2 kids, interviewing in CasaBlanca - WHOOSH ! they 'fit the profile' for closer evaluation, this 'type of Union' gets super-scrutiny at CasaBlanca, sometimes to include Foreign Spouse 'house visits' and 'telephone interviews with his family and friends' and a mini-stokes interview on interview day.

So, the 'relationship pile' really is relative , both to YER BACKGROUND and WHERE THE INTERVIEW will be. There are other permutations, sure, there are other red flags that can pop up - but HEI ! Be Aware !!

Also remember - yer 'bonafide marriage evidence' pile is a 'living document' - it grows over time, ya?
So what you have 'available' on I-130 submittal day, is not the same amount that you have on 'Interview Day at the Embassy', which is not the same amount that you have for yer pile submitted for the 'Removal of Conditions' filing. WHEW !

if you are trying to OPT IN for NVC Electronic Processing (China/Guangzhou bound filers can do this, BTW)
then
that DS-3032 form must be filled out and signed by the BENEFICIARY (not the petitioner), then re-scanned/converted back to PDF format,
and then
attached to an email, sent in (with the right body of the email, in ascii text) to nvcelectronic@state.gov

don't use the one that might have shown in in an email, with a barcode in it - it's the wrong one to use (it's outdated)

since there's 'that status' on the web portal -

and since the I-130 is NOT approved yet -

it MAY be that the Petitioner in the USA
is pegged for a local USCIS office interview OR local intake for Biometrics.
It's rare, sure, but it happens.

This is not about YOU, the beneficiary, it's about THE PETITIONER -
you won't be interviewed in yer country, because of this, but the PETITIONER MIGHT BE interviewed in USA.

The way to know, to be certain,
is for the PETITIONER to call into USCIS, get a Tier 2 Human,
and inquire - see http://www.dhs.gov/x...37986181.shtm#5 for a description of Tier 1 vs Tier 2, and get a Tier 2 Human,
ask

--Will the Petitioner be interviewed at a local USCIS office, or is this a local intake for biometrics on the petitioner, or is this a data error in the portal?

as express mail usually has some 'signature confirmation'

the PO Box address doesn't do 'signature sheets' same day.

Don't worry, this bit is a common blunder -
the USPS mail carrier and the USCIS mailroom clerk will 'sync up'
in a coupla days - it'll all be 'accepted' - I'm betting by Wednesday.

re: the mis-type on the G-325A - hard to say, hard to know - I'm betting something will 'kick in', not be any RFE.
Hard to swing an IR-1 at that age.

But - if the entire case is denied, hey - it'll come back within a month (or 6 weeks) - don't sweat it.

Captain we have a problem. Some how there were multiple entries found, Please contact an admin to resolve this. and the only way to get that fixed, is to contact The Site Owner, Capn Ewok, and ask/beg for it to get fixed.

Side note /question - did you include the G-1145 in the I-130 submittal ?

as to 'not approve the visa' - you won't know, until the DS-230 is filed and the interview occurs.

For DCF cases, 'evidence' can be

--bills in both names in Egypt
--lease in both names in Egypt
--Payable on Death Instructions
--Life Insurance showing USCitizen Spouse is beneficiary
--Medical Insurance with you as the primary account holder, your USCitizen Spouse as the secondary account holder.

and then
USCitizen MUST show either
--proof of domicile in USA or
--proof of action done to re-establish USA domicile.

That embassy is lagged, because of the Embassy's official notice (about 7 months ago)
to suspend further processing on Immigrant Visas.

Ya, yer case type is for an Immigrant Visa. I'm sorry.

You Must Wait™

The best you can do, for now -
is
to ask your USCitizen Spouse, to
keep calling in, to NVC, about
once every two weeks, and
inquire about casefile status..

Yer waiting on 'interview scheduled' timetick.
Once the interview has been scheduled (usually 6 to 8 weeks forward)
then
get the medical done. Don't get the medical exam done prior -
wait for the notice from your USCitizen Spouse -
He/She will get an 'appointment letter email'
Once that comes in? Yer USCitizen Spouse can forward the email to you
and then
you can print it out,
and then go get the medical exam done.

Good Luck !!! Prepare to wait another 5 to 11 months, from today.

ya, can 'de-enroll' the attorney -
but
I suggest you do it right after you've paid the AOS and IV fees ONLINE

One small benefit of having an attorney file the G-28 with the initial I-130 submittal
is that
the fee bills show up at the same time in the online web portal.

Once you've paid the fees ONLINE contact NVC to 'de-tach' the attorney from yer casefile.

/end of Suggestion™.
