Hang In There !!! You can 'get the expedite without fee' , using the stuff I mentioned, above, and JimBoy's NVC step. Supervisor Sue, at NVC, apparently handles all expedite requests.

Hello:

I called a Washington D.C. Visa Service number 202-663-1225. They mentioned the I 907 Premium Expedited Processing
service for filing a new I 130 for my infant son. Cost is $1000.


On this - I would call back, and VERIFY that this is possible for an I-130 petition for a CR-2 visa. Ask them that, specifically.

Good Luck with that phone call ! Also note - you'll get different answers, depending on WHO you talk to. I'd suggest calling 3 times, 3 different humans, note all of the answers, and THEN, call back - get a supervisor, and ask again.

Service Center Employees are trained to listen for certain buzzwords and ignore others - yer buzzword here was 'expedite' and I'm not so certain that they heard 'I-130' at all.

Anywhere from 5 to 13 months, depending on many things:

--which service center gets the I-130 petition (CSC is usually faster)
--use NVC Electronic Processing or not (shaves off waiting time between 'NVC OUT' to 'GUZ OPEN CASEFILE')
--any RFEs
--Successful Expedite Approval on the I-130 initial submission. THIS CAN BE DONE without paying a fee, btw.
--caseload at USCIS
--caseload at NVC

IMO, this I-130 for a CR-2 petition SHOULD GO FASTER through the system, even without the expedite, as background checks on you and the mother have already occurred.

You'll need to prep a paragraph on expediting in the cover letter for the submittal, and also a seperate letter requesting expedite as well. (IMO)

Oh - I'm around - I've NO Experience with paying for premium processing - I thought premium processing was NOT available for any I-130 petition for spouse or child. I wrote up a lot on his prior topic - so

I'm hoping someone who DOES have experience paying this premium fee, will chime in.
IMO, the I-907 is for work visas - but I'm solely basing that on http://www.uscis.gov...00048f3d6a1RCRD

If the OP is certain about this type of petition being eligible, then I've no real input about it.

In other errata - IF the OP is the biological father, and was a USC for 5 years prior, when the child was born, all of this is moot - he can file CRBA instead.

Yup - time to file new I-130 for the child.

I've posted a bunch of info and links already - have a longish read, pay particular attention to the 'expedite' thing that I mentioned.

What's the interview date at GUZ? You can request the interview date be postponed, as well.

I've run into this situation, for a Guanghzou-bound petition.

I know - it sucks - you've already waited this long.

If the K-4 was handled properly, you were supposed to have filed a 2nd I-130 for the child - most people do that at the same time the spouse's I-130 was filed.

If you did not file a 2nd I-130 for the child, with the 1st I-130 -
Now you have to file new I-130 for the child.

You can get some expedite done when you file the new I-130, though, if you reference
'EXPEDITE, APPROVED I-130 Petition for Mother, USCIS # XXX-2010xx0032' in:
1. the coverletter
2. the top page of the I-130
3. the top page of the G-325
4. the outside of the envelope (omit case #)
and write that 'expedite' phrase in red ink, for 2,3,4.

Other things -

--You need to do NVC Processing on each I-130 casefile. see

re: 'our son' - If you were a USC when the son was born, and if this is your biological son, then instead of needing a K4 visa, or a CR-1 visa - you need to file a 'Consulate Record of Birth Abroad', CRBA, at the 'homed' US Consulate/Embassy in China, and apply for US Passport. IF the child is yours, and you meet USC requirements, no need to file any further petition for the child.

If applying at NVC for a VISA with the DS-230 submitted to NVC, then, IMO, yes, do so.

IF applying at a US Embassy/Consulate IV unit with the DS-230 for an actual K-3 visa, then no, not do it - anything added in will be tossed by the document screeners.

IF applying at a US Embassy/Consulate IV unit with the DS-230 for an IR-1/CR-1 visa filed via Direct Consular Filing, then sure - do so ... the docs are not tossed by the IV workers.

The IR-1 visa isn't 'single entry, single use' but
the dates printed on it in Guangzhou are the dates she's allowed to
FIRST TRAVEL to the USA.

ONCE she makes it into the USA, there are more stamps in the passport -
and
she's got a TEMP I-551 document stamp there, that validates her VISA to be used as a temporary green card, which,
she can use to:
--travel in and out of USA, for about 1 year
--show up at SSA office, apply for a SSN.

at some point, within 45 days of her POE date, the green card should arrive, unless YOUR address has changed.

1. letter of attestation
2. cover letter from local authority (city, county, province) stating there is no record of divorce on you, official looking on local authority letterhead.

send both back to the address listed on the RFE.

alternatively, you could try to sway an ISO (see http://www.dhs.gov/x...37986181.shtm#5 ) over the telephone, but - you'll need to convince the ISO that the current adjudicator is missing the reading process, and that you have not been married prior. If/When the ISO is convinced, he/she MAY be able to convince the adjudicator to perform a 2nd 'eyeball review' of the casefile documents, and proceed without further documentation and without waiting on response from you on the RFE. MAYBE....

call in to NVC tomorrow, ask for the IIN , tell them you lost the AOS FEE BILL email - they MIGHT give you the IIN over the phone.

MEP #, or in this case the NVC Casefile #, means NOTHING to the USCIS web portal, sorry...

USCIS web portal and NVC online payment portal are different beasties - NVC data ain't on the USCIS portal.

This is just your NOA1, where USCIS acknowledges receipt of your petition(s) and lets you know that further communication re. further instructions and/or processing will be forthcoming. In a couple of weeks, or so, you'll receive another such notice instructing you when and where to go have your fingerprints taken. From then on, you wait, for an interview notice, or RFE notice or approval letter(s). good luck.
