hi bob, no i did not get instructions as to when to submit the taxes, they only gave me the blue paper and told me to go to their website when i have

Your lawyer was wrong.

Here's my input -

since the husband, USCitizen is self-employed, he has no W-2 income - so he doesn't have a 'job'. No Employer.

Some Embassies want to see 3 years, but is never a requirement, heck it's not even a guideline -
the VO's are trained to look for W-2 income. Your husband has none.

So - is concept of 'sustainable/sustained' income for your husband -- he needs to show a pattern of 3 years of sustained income, so you do not become a public charge.

3 years of tax returns will show this - 3 years of 'AUDITED INCOME STATEMTENTS' from a CPA will also suffice.

you have not been denied - they are giving you a chance to submit more information - the information supplied (by your husband and attorney) was scant for the I-864. Suggest to your husband that he ask for a partial refund of fees from the attorney, at least 1/6th, to 1/4th, of the total fees that he's assessed so far.

ok - a bit of smoke clearing here.

IRS sends some notice to US Treasury to issue the refund 'check' and
IF ELECTRONIC ACH payment to be made to you, for the refund -

the names on the check must match the names on the account.
IF there is not a match, the ACH notice is kicked back by US Treasury, eventually a paper check will be cut , sent out to you.
It's not enough that there is ONE name that matches on the bank account - it MUST BE BOTH.

Your banker is wrong, SHE can be added to the account without physical presence, must handle 8BEN form. Get form W-8BEN from the IRS website, study it, handle the documentation requirments,
and then make sure your banker GETS TRAINED on how to accept this form, soonish. Then, again soonish, have yer wife added to your bank account via the W-8BEN form.

Ain't training bankers fun? Thankfully, they are a bit smarter than SSA employees, and mostly, are trainable.

you can call into NVC, check the AVR anytime with your USCIS receipt number.

NB - if the petitioner is not a US Citizen , expect a wait. at this point - the USCitizen Spouse must call NVC and get this sorted, as something is really wonky.
NVC closes at 11:59 PM EST (UTC-5) so you have some time.

hmmm - this is troublesome - I not read any mention of payment to the online payment portal.

USUALLY - you (USC Spouse) will first recieve (via email)
an AOS Fee Bill, containing the casefile number and the IIN.
With both, you can log in to the online payment portal, pay stuff.

About 2 to 4 days after a thing is paid, it's marked 'paid' in the portal,
and THEN you download the coversheet for each 'thing' (AOS or IV, depending).

You include the pdf coversheet with the pdf output files that you gen'd for each thing (AOS set, IV set), is different coversheet for each thing.

You mention the DS-260 - but you still have to get those DS-230 and I-864 into the MEP emailbox.

re: resending - yes, it happens - usually the OPT IN email address wasn't linked in with the casefile, so any email coming in via yer email addresses, isn't really noticed.

Strongly suggest to resend (if not recently), then have USC Spouse talk with NVC, get a Human™, inquire for casefile status.

Usually, if the coversheets aren't included with each 'thing', and IF the OPT IN email address isn't 'set' - then anything you send in will mostly just sit there, no action.

Finally - not all TeleReps at NVC are trained for Electronic Processing, much less the special Mexico Electronic Processing (MEP) system. You'll need to remind the TeleRep, often, that this is for Mexico Electronic Processing, and remind the TeleRep that yer happy to be on hold whilst he/she looks up the procedures for dealing with MEP casefiles. If the TeleRep is still clueless, ask for a Supervisor, and start over with the litany about MEP.

just because the casefile made it to nvc -
doesn't mean you have to give them stuff, immediately.

You have about a year to get in 'stuff' to NVC -
suggest you get back to the USA after NOA-2, get that job,
and then sock away enough cash to make up the difference that you'll have
or

go through with nvc processing in 'real time'
use yer house as major asset with some letter of employment for the next job in usa.

ultimately, all is re-evaluated again on Interview Day -
so if you have major differences in the I-864 between NVC Submittal and Interview Day - it's OK ! Just have accurate, better numbers with a new I-864 handed in on interview day (emphasis on accurate, here)

If the interview date is past the 18th, expect her to hand over a 'CURRENT' I-864, with CURRENT tax documents.
IMO, I think it's worth the risk, really, to not file now, unless you've had a significant change in income.
