K-1 Fiance(e) Visa Process & Proceduresjust wondering ...

If the k1 applications for NSC and TSC are all going through CSC - how come there is still a shorter processing time for these centres than CSC .. do they get priority over the CSC applications????

If you check the NSC and TSC processing times, you will notice there is nothing listed for fiance visas- becase they no longer process these petitions. so I am unsure where you are getting shorter processing times from?

All applications go by receipt date and your reciept date is given by TSC or NSC when it arrives before being sent to CSC.

K-1 Fiance(e) Visa Process & ProceduresAny in November 2007 recieved NOA2?

Don't mean to burst your bubble but it's gonna take longer than 6 weeks, especially with the holidays. Most people plan on 90-120 days for petition approval/NVC processing to be safe.

I agree, normally it takes 70-90 days , add 2 weeks on to that for the holiday slowdown. This is the really hard part of waiting. hang in there. Once it comes it all fades away like a distant memory.

K-1 Fiance(e) Visa Process & ProceduresWhat to do now????

Hi all,

I sent our packet for the I-129F approval. I am thinking this will take a few months.

Is there anything that I should be doing for the next phase? I've read that my fiancee will get a checklist from the consulate in her country. But if something is needed that I can do now, I prefer to do it, so we can be more efficient with sending the required stuff back promptly.

Any help would be appreciated. Thanks!

Congratulations for getting it in the mail! Doesn't it feel great to have it on its way?

You are likely to have a wait time of 60-90 days (without any RFE or other delays) so there is nothing to start getting ready this early. Keep researching the next step. Get familiar with the particular requirements and timelines for your consulate. Pull up a chair and have fun with us while you wait. Wishing you a speedy journey! (F)

no, it doesn't- just got tired of having my sh** jumped  I am sorry for the confusion, and for going off. :D

and thanks for the point to the latin-american forum. We will proceed as previously planned with the tourist visa and take it from there. :D

your going off means you will fit in right her at VJ like home. We all have lost it at one point or another in this process. Again welcome to the board and good luck!

K-1 Fiance(e) Visa Process & Proceduresmeeting requirement

If he comes here on a tourist visa, and you get married, it's fraudulent.

Just a little clarification here- he can come on a tourist visa and get married. They can get married while he is here on a tourist visa, but he must leave before the visa expires and the USC then files for a spouse visa while he waits in Mexico.

K-1 Fiance(e) Visa Process & Proceduresmeeting requirement

I apologize, my post was going thru before I read yours, or knew that I was not being understood. I had just reached my limit at feeling like I am being personally attacked and having to defend myself while clearly just trying to ask a simple question because the government makes the whole visa process a confusing mess.

Sometimes that happens here on VJ. But we are really just one big family, so welcome and good luck with your visa journey. You might want to post in the latin American forum for advice about getting a tourist visa in Mexico. They are not always approved, but it all depends on how prepared you are to show ties to the country. You will get some good advice specific to the consulate in Mexico.

K-1 Fiance(e) Visa Process & ProceduresVSC vs CSC

I have been patiently waiting for NOA2 for almost two and half month now and there is no response and not even a touch indicated . I have looked at and compared the application processing speed between VSC and CSC, the difference are dramatical. It usually take VSC 1 month or less to get approved. I know all of you aware of this, but did anybody ever questioned why?????????? my cases was transfered from TSC to CSC, if the USCIS considered to merge the cases from TSC and NSC to the other two for whatever reason they think that's beneficial, should they at least do it with a GOOD plan, do they ever consider balancing the work between the two offices, or have noticed that the huge delay and paper piling up in CSC office. CAN'T THEY SEE THE AT LEAST 2 MONTHs OF GAP BETWEEN THE TWO OFFICE??????

this is torture toward many of us who wanted to be with our fiance , husbands/wives so badly. did anybody ever try to complain about this to USCIS, or anybody have any idea how can we fire some actions and make them notice of this?

I try to get through the immigration process by not expecting USCIS to behave efficently or rationally. I need the sanity.

K-1 Fiance(e) Visa Process & ProceduresNebraska does not list the I-129F in its processing times

That's what I was afraid of. I hear bad things about California's service center. Has it improved?

It's not as fast as Vermont, but they are certainly picking up speed after lasst year's IMBRA fiasco. The average wait time for the NOA2 out of CSC is 60-90 days with some taking a little longer. This average is without having any RFEs or other delays.

K-1 Fiance(e) Visa Process & ProceduresNebraska does not list the I-129F in its processing times

do you all believe that because of this the petitioners that are in the nebraska section being sent to california are being delayed in approvals? Its a theory of mine, because i haven't seen anything from the CSC and its getting extremly fustrating..

I know how hard it is to see petitions getting approved when you are waiting. You certainly are due according to the average times here on VJ, but keep in mind some files just take a little longer than others to process. It's the unknown factor that makes it so difficult to keep patient. Hang in there, eventually it will be approved! (F)

K-1 Fiance(e) Visa Process & ProceduresG-325A with I-129F

Hello. I am a US citizen and my fiance is a Japanese citizen. We are starting the application process for a K-1 fiance visa (I-129F).

Reading the instructions for the G-325A it seems that I should fill out a G-325A with my information and she should fill out one with her information. But, looking at the examples on the step-by-step guide from this website, both examples are exactly the same as far as I can tell.

So, should mine be only my information and her's be only her information with our own signatures on our own forms?
Or, should both my and her G-325A forms be only her information and the signatures different?
Or, are both of these incorrect?

I called the ICIS information number and tried to get clarification on this but the only thing she would tell me after much rephrasing of my question is that I am the "Petitioner" and my fiance is the "Applicant", so any place that says "Applicant" should be my fiance's information.

I appreciate any clarification on this. Thanks, Buraian

You are filling out a bio form for you with your information (4 copies) and She is filling our a bio form for her with her information (4 copies) You each sign your own forms.

good luck with the filing. Its a great feeling to finally post it. (F)

K-1 Fiance(e) Visa Process & ProceduresAddressing age difference in K1 Petition

Cool, good to see someone in a similar situation from a similar culture!(some would say same culture but Kumar would not be happy if I said that, Nepal likes to be different...lol  ) I wish you both luck and please keep me posted - I will do the same.

Yes, they are similiar cultures! I will keep you posted. Right now I am trying to have patience waiting for the NOA2- PATIENCE, the biggest thing I guess I learned from my years in India  ...and keeping busy gathering info for the next steps. Good luck for the two of you!

That is so true, if living/traveling in India or Nepal teaches you anything, it's patience... that and adaptability...after you've been there long enough you're prepared for ANYTHING... I can see why K doesn't freak out over all these problems which are keeping me up at night. You'd think I would learn from him but I'm a worrier by nature... :hehe: All I know is by the end of this process Lord Ganapati is going to get tired of my whining and begging, lol

It's true that a large age difference is a red flag for possible fraud. BUT you can not be denied because of an age differnce. The age difference as an isloated fact could be a problem, but take it into consideration of all the other evidence you have abot a legitimate relationship and I am sure you will notice that you will have no problems. The best thing to do is continue to collect evidence to show a strong and legitimate relationship.

K-1 Fiance(e) Visa Process & ProceduresRFE'd

Hi,

About a week ago i posted that we had been updated with a message further documentation/evidence was required ( sentout from csc 30/9) ..well i know you guys and girls like to be kept in the picture - we have received it today - turns out to be a request for both of us to send certified and signed by judge divorce decree....i was puzzled by mine because neither the nisi or the absolute even has a place for anyone to sign..both just have a stamp (official court style)....i guess each countries divorce paperwork differs ...

Nothing else but that required - which is a relief because at least if in doubt we can contact the appropraite courthouses to send for docs...

Good luck to you all

:)

Thanks for the update! Hope its a quick resolution followed by a speedy approval!

K-1 Fiance(e) Visa Process & ProceduresUSPS seems to work for overnight delivery of RFE

From USPS:

Your item was delivered at 9:40 am on October 07, 2006 in LAGUNA NIGUEL, CA 92607. Waiver of signature was exercised at time of delivery.

Still no confirmation of receipt by USCIS though

Bill

PS I had RFE marked all over the thing, so hopefully that will help :)

Oh my gosh...So, I guess I'm the idiot who didn't know to do the waiver of signature...b/c they attempted to deliver mine Friday...my original submission....and nobody was there to sign for it...so they will attempt again...and now with Monday being a holiday...I don't think it will get there till Tuesday. Do you think that someone will go and sign for it or will they send it back to me in 5 days? has anyone else made this mistake before?

Since overnight mail arrives after the time CSC picks up mail, it will be signed for the next day. Very common. Now whether they pick up mail on Saturdays or federal holidays I don't know. BUT they will have it by Tuesday morning when they go in to pick up mail at the latest.

A quick plunge into marriage is a red flag for the consulates, but that's not going to be issue for you. A 3 month courtship may seem short, but this process will add months to your engagement. Send in that petition and start waiting like the rest of us :P

K-1 Fiance(e) Visa Process & ProceduresHow do you qualify to Expedite Case?

Hi Guy's.

I have read on here about people not qualifying for an expidtied servise on their Visa.

So I was wondering if anyone knows how you do qualify, and if you do hwo dotyou go about trying to get this done! Do you write, call, anything?

Also, does calling and hassling people the USCIS help or hinder? Any evidence?

Thanks all.

Having a bad day today, can't get the Visa out of my head, cant sleep, just want it over with!

x Claire

I think there are two ways to use the word expedite here. Officially it refers to the request to expedite the case based on very narrow circumstances that give people a jump in the line to receive a quicker approval. Lke other posters have said, this is very difficult to obtain.

BUT there are other ways to expedite the case (or to use a better word - get USCIS back on track with your case). Looking at your timeline, you are or soon will be past the 60 day timeframe that USCIS gives itself to respond to the RFE right? Oct 11 will mark the 2 month mark since you returned the RFE (I assume it was IMBRA?) if i understood yoru timeline. Contacting your Congressional reps office to look in this is quite reasonable. There are rules USCIS operates under that allow you to seek an answer.

Having not gone through this myself, I am afraid my answer is a little vague. Someone else here (AndyMisiu) wrote a letter at the request of the VSC because he was also outside this 60 day processing case. He recently got his approval. There are some threads here that show his letter and the specifics of his case- of course you might want to avoide the postings that are more drama than of actual help. Hope you hear something soon! We are rooting for you!

K-1 Fiance(e) Visa Process & ProceduresOk I got my RFE

heishe,

It's something that's quite old, actually, quite frequent at the CSC. (Sure enough, our OP is dealing with the CSC.) Frequent enough that not all that long ago it was common to advise that the beneficiary's birth certificate be included with the petition as a preventive measure.

I guess that advice has been forgotten, and should be resurrected.

Yodrak

A lot of people have been getting a beneficiary birth certificate RFE lately.. is this some kinda new rule? A disturbing trend, at least!

YUCK! One more thing to worry about because we did not send in the beneficiary's birth certificate. sigh

Thanks for the update Yodrak!

K-1 Fiance(e) Visa Process & ProceduresOk I got my RFE
I am curious to know if the petitioners who received the RFE for the beneficiary's birth certificate have something in common. For example did the foreign fiance live or work in the US? Were they divorced? Had they petioned for a US visa before?

Maybe I am just grasping at straws, but it seems that since it is not a required peice of evidence, it must be asked for to add further evidecne to something in the original evidence? no?

K-1 Fiance(e) Visa Process & ProceduresPhoto Dilemma

isaacwarsh,

Although I personally like pictures as evidence, conventional wisdom suggests that they are secondary evidence value only. You do not "need" them, in the absolute sense.

Consider the following to overcome the "proof of meeting within two years":

Passport photocopies, with visa and/or entry/exit stamps
Hotel receipts
Airline tickets, boarding pass stubs, airline mileage account statements
Credit card and ATM transaction documentation
Anything else that puts the two of you, in the same place at the same time, within 2 years.

Submission to approval timelines = impossible to project accurately.

Vermont = maybe 15-45 days
California = maybe 30-90 days

This is pure speculation, based upon an uncomplicated case.

This is my first post on this forum. This past summer I met and fell in love with my fiance while in Amman, Jordan. However, she is Sudanese. Sadly our time together was very short. In fact, I did not have a still camera with me at the time, only my video camera. The only images I have of her don't even include me since I am behind the lens. I have been reading over the K-1 requirements and it is recomended to send at least 3-4 pics, I don't even have one!!! How crucial is this requirement?
Also, what is the general time frame, from submission til approval, for the K-1, supposing that I do everything right.
I could really use some help here. The task seems a bit daunting after reading through some of these posts. Any assistance would be deeply appreciated.
Isaac

I agree with William. Photos together are a great piece of evidence but alone do not prove you met within the 2 years. There are support evidence for the primary evidence. Photos together will be much more important in the proof needed to prove te on-going relationship at teh consulate interview.

Why not send in a still photo taken fromt he video if you have that technology of her and o fyou if you are on the video at that shows you both in the same place? the dates and location would match on the back and also match the explaination of how you met when you answer Question 18.

K-1 Fiance(e) Visa Process & ProceduresQuestion about my RFE

I didn't know that they needed my birth certificate for the I-129F ? They got Clara's.
Did i overlook something when we submitted our petition?

If not, then what does it mean that they are asking for this evidence?

On a relieved note, thats the ONLY thing they asked about in the RFE

Alexander- I have seen 2 other posting for the same RFE. At least its an easy piece of evidence to send in after being owrried they wanted something else. right? I did not send on ein either and amm hoping I do not have the same adjudicator! Yikes!

I agree Ecalos, we're due another batch of approvals.

I hope when the next batch is up I'm in it. I know it's selfish but I don't think I could stand to see another wave of August/September approvals! :(

Michelle- It's not selfish, but even if it was, I'd say no one has any more right than you to be a little selfish at this point. I have seen nothing but positive and supportive posting fro you for other petitioners. I hope that last touch in your timeline means something good! (F)
