K-1 Fiance(e) Visa Process & ProceduresHelp please
Its the normal procedure for Casa. It can take anywhere from a few days to a few monts to process the security checks. See the posts in the MENA forum. There is even a sample 221g posted so you can compare it to yours

ETA: there are many people in MENA who have had long waits and they can give you good advice if your wait turns out to be a little longer than you hoped for.

K-1 Fiance(e) Visa Process & ProceduresWhats the point?

I've not heard of this before. Whats the reason for the wait after the interview? I thought thats what the interview was for - because processing was completed. With the exception to a waiver of ineligibility - what would be the reason for two more months of waiting??

Following Sept 11, new security proceedures were put in place. Everyone getting a visa must go through a series of security checks. Most people get through the checks very quickly. Some get false name hits that need to be verified the names are not the same as the beneficiary. the more false name hits , the longer it can take to sort through the checks. A few people here on VJ have been waiting more than a year to clear. It's rare to see it from the European countries, but it does happen.

Oh Alexander, I am so sorry to hear you are still waiting!. Stay strong in your faith. You didn't let Clara down. I know the wedding plans are turned upside down, but you two will have a whole life together.

Clara or Clara can call the Department of State and check on the security checks. The DOS will be able to tell her when they are complete and you can then get on the the consulate about issueing the visa. I hope its quickly finished now. Don't start borrowing truble that it could last mroe than a year. Yes that sometimes happens and if it happens to you, you and Clara will deal with it. But more often, it lasts a couple of months.

Right now there is nothing you can do, but wait. Be strong, Pray. Be a support to Clara and let me know if i can do anythign for either of you. BTW- How is Clara's dad doing?

K-1 Fiance(e) Visa Process & Proceduresso many touches but still same status???

I dont think it's worth me calling. my touches were 2 weeks ago and surely I would have heard something by now.... even by snail mail

From looking at your time line, your touches seem to be related to the cashing of the check and arrival processing. The usual (if you can say that about anything with USCIS) is some early touches after submission and then some final touches before approval.
mybackpagesFemaleMorocco2007-03-07 11:54:00
K-1 Fiance(e) Visa Process & Proceduresso many touches but still same status???
This happened to me. At or about day 89 waiting for the NOA2 I was touched two days in a row. I had a few NOA1 buddies getting touched at the same time and after the second touch, everyone got approvals. I got two touches and nothing.

I had read on a previous thread herer at VJ, calling CSC will get you only support staff/coustomer reps to tell you the same thing as you can see on your screen (and they are not usualy in CSC at all). BUT if you call to inquire about a RFE, you get sent to a rep in CSC itself.

A week after not seeing any status change and all the people around me get approved, i called CSC, pushed the right prompts to get the RFE line. I told the operation who answered a little white lie. I said my online case showed a RFE was sent, but then it was now showing case still pending. could I get clarification? ...she put me on hold and came back and told me I had been approved a week before (on the day of the touches), but no NOA2 was sent out.

later that night I got 3 emails telling me I was approved. A couple of days later I received the NOA2 in teh mail and a letter from NVC saying my case was already on the way to the consulate. So not getting the approval notice, didn't slow my petition down at all.

a common pattern seems to be Tuesdays and Fridays for NOA2 for K1 and the e-mails (when they come) seem to be in the evenings. At least that was the pattern when we were waiting.

This is the time it gets really hard to be patient. don;t be too hard on yourself. USCIS does process in the order recieved, but some petitions take longer to process than others. Each case is unique. I hope you do get an answer very soon. Once you get the NOA2 things will start to move more quickly. (F)

K-1 Fiance(e) Visa Process & ProceduresTanslations

Hello,

Does police report and birth certificate MUST be translated by professionals?
I had my friend translating our emails and cards but I was wondering if documents such as police report and birth certificate must be translated by someone certified or anyone can do it with a signature on it?
Can I translate them myself if i am fluent in both languages?

Thanks.

No, Police reports, birth certificates, etc. do not need to be translated.

It depends on which consulate. Some require translations. Some require the translation be from translators officially recognized by the Consulate. Best to confirm what the country specific consulate wants either by contacting the consulate itself or discussing it with someone on VJ who has recently interviewed with your consulate.

Congratulations!

My SO just came through Houston as the POE last month. He was one of the first in line and it took just under an hour for the planes wheels to touch down-pass through immigration, get te baggage, go through customs and walk out the door were I was waiting. The immigration part was easy, though my SO laughed and said they asked a lot of questions- kind like the interview all over again.

Have a safe trip back home! (F)

K-1 Fiance(e) Visa Process & ProceduresNo hurry for our approval !!!
JUst to add info for your time line. Going through CSC without any problems on the peition, will talke three months. Add another 2-3 months for the interview and visa. Then you can wait up to 6 months for the visa before you use it. You can slow down the process once London has the approved petition by not sending in your package 3 as quickly.

perhaps waiting until it eaches the consulate stage is your best option, you will know more of where you stand with your treatment by that point.

I wish you and your fiance the best. There are such excellent treatments these days. (F)

Thanks A LOT Turboguy for your swift response, but in the example provided by the website, they used different answers to the question "this form is submitted in connection with an application for?" while I think the answer should always be "I-129F petition", what do you think?

Your SO will complete another set of the G-325a when he files for AOS. It's used for several types of petitions.

Well, l hope we don't break any of those records. I just found it odd since the Manila Embassy says they have the petition, and I have a case number. Thanks for the replies.

The DOS checks are different from the USCIS checks that occur when the peition is still stateside. DOS checks start when the consulate has the petition. Hopefully they will be finished by the time the interview occurs. If not, it is standard to issue a 221g stating the visa will be processed upon completion of security checks.

K-1 Fiance(e) Visa Process & ProceduresDelay for security clearance
DOS checks are the norm for everyone, but some take more time than others usually because of false name hits. The more hits the more time to sort through everything. Hang in there, its frustrating becuase its something you have no control over, but eventally the checks will be completed!

K-1 Fiance(e) Visa Process & Proceduresbirth certificate - foreign fiance - why?
There are some checks on the the benecificary on this side of the petition- you provide a bio sheet. A birth certificate can be asked for to further verify information about the beneficiary. I do not know if it is something specific that triggers it (name hit, travel to the US etc) or is simply at the discretion of the ajudicating officer to determine which evidence is needed to approve the case.

he propsed me there in States..not since im here...we have evidence of keeping our relationship since i moved back but im kinda worried about the evidences that we had relationship..i have only my visa and pictures..that would be enough?

Since you were living in the US at the time of your meeting, what about afidavits from friends who knew the two of you together. The evidence you subit needs to compliment the explaination of how you met on question 18 as well as meet the burden of proof that you have met in person within the last 2 years.

All other evidence can be used to prove the validity of your relationship at the interview.

Good luck!

K-1 Fiance(e) Visa Process & ProceduresWhen to ask for help from Congressmen / women
Normally if you are outside the processing dates for your service center (6 months for K-1) or if you have some other problem that arises and can not get USCIS to resolve the matter.

I agree, mailing it anywhere other than the address USCIS tells you to is likely to cause you more headaches. CSC will process the K-1 not the local office. It just might linger in the local office for months before anyone bothers with doing somthing with it.

K-1 Fiance(e) Visa Process & ProceduresProof of relationship on K1 visa app.

I believe the medical exam is good for 1 year. I could be wrong, though. The doctor was very helpful, as she only brought 4 of the 5 required medical exam forms, and the doctor provided the missing one. If we have to redo the medical ... no big deal.

The medical is good for one year. Hope your journey is as smooth as you hope. It could be- depending on wait times in sydney for an interview, the possibility of security check false hits so many things can slow you down.

You may or may not get a RFE for more evidence of meeting within the last two years. How you answered Quest 18 and the evidence you provided need to satisfy the ajudicator. Not sure if plane tickets (as yor only primary evidence) and photos (as secondary evidence) will do that, but maybe.

K-1 Fiance(e) Visa Process & ProceduresK1 Preparing to file - A few questions

My fiance is 18 years younger than me(He is 22 and I turn 40 in May). I was told it shouldn't be a problem if we have all of the relevant documentation and there are no other red flags, but it would most likely be brought up in the interview and he should definitely be prepared to address the issue. Since your age gap is not as big, maybe it won't even be mentioned, but I would prepere for it to be brought up, anyway.

We're prepared to address the age gap issue if they should ask during the interview at the consulate. Thanks everyone for the replies! I'll be mailing the K-1 visa application to the Texas Service Center as instructed. :)

K-1 Fiance(e) Visa Process & ProceduresK1 Preparing to file - A few questions

They can deny a visa for any darn reason they want.
I've never heard of someone being denied BECAUSE of an age difference solely. What I have heard of is that an age difference contributing to the consulate questing the legitimacy of the relationship.

How large is the age gap? Is this normal for both of your culture/societies? How do your respective families feel about it? How do you feel about it? Do you have things in common?

:star: Cass (bebop the great)

I just wonder if they can legally deny a K1 visa because of an age difference?

The age difference is 8 years (I'm 30, he's 22). We're not concerned about the difference in our ages, neither and it is a non-issue with family and friends. We're both ethnically Hungarian, and there is greater no social stigma for age differences in a relationship in that culture than there is here in the US for example. (Though it seems to be common for the age difference to be the other way, with the man being older and the woman being younger.) Thanks for the explanation on this issue.

I have thought of another question. If the Texas Service Center is no longer handing I-129F applications, why are we still instructed on the forms to mail the application there? Or do I just get the address for the California Service center and mail the application there?

K-1 Fiance(e) Visa Process & ProceduresK1 Preparing to file - A few questions
Hi everyone!

I've been browsing this site, and it is a great fountain of information. I am preparing to file the paperwork for a K1 visa for my fiancee and I'm just trying to gather as much information as I can to make sure I get everything right. I have a couple of questions that are specific to my case and I haven't been able to get specific information on.

My fiance is a Romanian citizen, but he is living and working(legally) in Hungary. Once the K1 application is processed here, will the packet be sent to the American Consulate in Budapest, Hungary(where he currently resides legally) or to Romania (the country of his nationality)?

There is an age difference between the two of us, (I am older, he is younger) can this be a reason for denial of visa? We have all the necessary proof of a valid relationship (i.e. statement that we intend to marry w/in the stated 90 days, we have met in person during the past two years and have proof of that, etc.) I just wonder if they can legally deny a K1 visa because of an age difference?

Does anyone have an updated timeline for K1 visa (from application to visa in hand) processing and approval with Hungary with me filing the application with the California Service Center? I've been looking on the timelines, but I don't see any information that is recent. From what I see it takes about 6 months, am I wrong in this?

Any information/replies would be greatly appreciated.
Thanks,
P

K-1 Fiance(e) Visa Process & ProceduresMaling I-129F today, One question

First you have met the proof of meeting, just explain next steps and include what you have. Explain family already being there, hopefully you did have some pictures and receipts to verify.

Yes, I have photos(dated) which I have included as part of "proof". Its just that since the time I spent w/ my fiance was in two countries, I need to document both. I'm trying to avoid an RFE. (I'm using my passport to prove my citizenship, and as per instructions I've copied ALL the pages of my passport, which has all my entry/exit stamps. I do not want to get an RFE because they're confused.)

Thanks for the advice.

K-1 Fiance(e) Visa Process & ProceduresMaling I-129F today, One question
I'm ready to mail my application but I have one last thing that I need some advice on please.
The time I spent w/ my fiancee occured in two countries, so my question is regarding the proof of meeting needed for the I-129F petition. Here's my story: (...and I'm ticking to it! )
We initally met in Hungary (and this is what my "Describe how you met" paragraph) but traveled separately to Romania where we spent time together. I have all the proof that I traveled to Hungary (e-ticket itinerary, boarding passes, copy of page from my passport showing arrival to Hungary stamp) but because we then left Hungary and went to Romania, I need further documentary proof right? The town/village in Romania where we stayed is our "hometown" (he was born there, and that is where my grandmother lives) therefore we did not stay in hotels....he stayed w/ his parents and I w/ my grandmother . I copied the page in my passport showing the stamp into Romania, and I also have the corresponding page from my fiance's passport. I also have my bank statement showing money withdrawal in Romania and Hungary. I've also written a few lines of explanation on a separate sheet of paper.

Is this OK, or should leave all of this out, and just send the proof that I have for visiting Hungary?

Please advise!

Thanks!

Thanks all for the advice! K-1 Fiance(e) Visa Process & ProceduresForgot to send form FC-029 w/ petition
:help:Help, I'm freaking out right now!!!! I mailed my petition on Friday (waiting for delivery confirmation from USPS, website tracking states they attempted dellivery, but nobody to sign so a "notice was left").
Now I realize that I forgot to print out and sign the FC-029 form attesting that I'm sending copies of documents and have the originals to present if necessary.

Will USCIS send my I-129F petition back to me because of this, even before they begin processing? How crucial is this form?
I could just kick myself. My cover letter does state that "copies of documents submitted are exact photocopies of unaltered documents etc...." and I did sign the cover letter. So if I have this paragraph in my cover letter, does that take the place of the FC-029 form? Any advice or words of wisdom would be greatly appreciated. And if I'm just second guessing myself obsessively, anyone is welcome to tell me to chill!!

Thanks in advance.

K-1 Fiance(e) Visa Process & ProceduresProblem with "Ongoing Relationship" Supporting Evidence for fiance's interview
You can check on the partner airline, or the main airline's website and request that they send you a travel verification record. You are registered on that particular flight because you checked in. There is a fee associated with this (its $20 with Lufthansa), but you should get this record from the airline in a few weeks (about 4). I thought I had a similar problem (for me it was missing boarding passes from the first leg of my trip) and I was able to request this from the airline. I'm sure the airline you flew with has the same service. If your fiance paid for the ticket, he may need to do this, since they may ask for information such as the method of payment used to purchase the ticket. I'm not sure, I think it depends on the airline.

Hope it works. :star:

Hi Everyone,

There was a thread a few days ago that concerned a possible error made by USCIS. The OP stated that he/she logged in to USCIS website, after getting their case # from the back of the check and under Case Status, it stated that the petition was approved. I remember that the discussion was, that this could be a mistake because the OP's petition was going through CSC, and he/she was just at the "waiting for my NOA1" stage. I'm curious to see if and how that was resolved, but I can't find the thread anymore. Anyone have an update, or can you give me the link to the thread? I've tried searching w/ various keywords, but I've had no luck.

Thanks,
