I am a Canadian citizen living in Canada and I am marrying a US citizen next year in spring or summer. I want to move to the US to live with him. We don't want to spend any time apart. So what is the best and quickest option for us?

1) The fiance visa?- I head the downside to it is that its got a lot of paper work involved and that I would have to have a wedding in the US and not in CANADA (when all my family and friends are in Canada)

Immigration involves a lot of paperwork....that is a given, regardless of the type of visa you will be applying for. there's even more paperwork when you apply for the green-card, to remove conditions to the green-card (if applicable) and further down the line to become a US citizen, if you so chose. The necessity for a US wedding can be a deal-breaker if you absolutely must have a wedding in Canada because the K-1 is a fiancee visa issued to the foreign fiancee for the express purpose of coming to the US to marry the US citizen fiance and adjust status(apply for a green-card) based upon that marriage.

2) The spousal visa?- How would that work? I enter US on my Canadian passport and we get married in court in the US and then I fly back out to Canada so that he could apply for the spousal visa and I wait in Canada until it is approved?

For the spousal visa, the marriage can occur anywhere, but you must interview for the visa in Canada and only after you're approved can you immigrate to the US. You may only visit during the waiting period, but there is a certain amount of risk involved with that, since once you apply for the spousal visa petition you are basically declaring your intent to immigrate, while the whole premise of 'visiting' implies that you will not immigrate. But even so, for those that have the possibility, visiting while the paperwork was being processed has been an option they've utilized.


3) Is it possible to come to the US on a Canadian passport and get married in the US and stay there and apply for an adjustment of status and I-130?
This is NOT possible because this is illegal. You cannot enter the US with intent to stay. That is termed visa-fraud and a no no.

I am so confused. I don't know what's the best option? What's legal? What's the quickest?

This is not hard, really.

The whole premise of the visa you are seeking for your SO is based upon the both of you being free and eligible to marry. It is a fiancee visa. To that effect, the consulate is seeking to verify that all you have stated in your petition, with regards to both of your eligibility to marry, is true and correct. So they want to see the originals of any marriage & divorce decrees for both of you. (If applicable...of course).

If the petition is no longer at NVC, but at the local consulate, NVC won't do it. I had the same issue during our process, and contacted NVC. They told me to wait until petition is at consulate and contact them directly. I did...consulate replied confiriming the address change, and still sent packet 3 to the old address. wacko.gif

Well its 5:00 pm there now, so you'll not reach them for sure. I don't think the change of address is something that is handled via a phone call. An e-mail with the case # and new address would probably be more useful.

Last I check marijuana is still an illegal substance in the US, and since this is a medical exam that is geared to check a beneficiary's 'fitness,' admiting to its use, regardless of when it was, is tantamount to adminting you've done an illegal thing. That can affect your eligibility for the visa. I agree that a one time use (a long time ago) makes no difference today, and I don't think it should be taken into effect...but because pot is illegal in the US (at least for recreational use) I can understand how this question is on the medical exam.

Unfortunately, what you have experienced is not uncommon. what you have experienced, with receiving incorrect information from both USCIS and the consulate happens all the time...and it is unfortunate that it has happened to you.
Current immigration procedures do not preclude you getting married in the US once you enter as a 'visitor' they just do not allow you have intent to immigrate at the time you enter. You were turned back at the border because by showing up with a car full of your personal belongings you were demonstrating intent to not return...which is a violation of the purpose of a tourist entry.
You now have two options, either have your fiance file the I-129F Fiancee visa petition, wait for it to be approved and interview at the US consulate in Canada for a fiancee visa, enter the US, get married and file for your Adjustment of Status to get your green-card. OR, have your fiancee go to Canada, get married there, he comes back to the US and files the I-130, Petition for Alien spouse...wait for it to get approved and interview in Canada for a spousal visa, which will allow you to come live in the US.

Please take some time and read the GUIDES (link attached) to get an idea of the choices available to you. If you have questions, this site can be an invaluable source of information. Good luck.

Why would you include the reservation from the church showing the set date for the ceremony? The presumption for the K-1 visa is that you will marry w/in 90 days of when your foreign fiance(e) enters the US. It is left up to your discretion to determine when to marry, as long as its within those 90 days, you're fine. The question of when the wedding will occur may come up...and the answer of "within 90 days of entry into the US" is sufficient.

Did you use the VJ guides to assist you in applying for AOS? One of the first statements on the page for "Adjustment of Status for K1, K3 visa holders" page is the following:

And further down the page is the following paragraph: As a note, in an emergency where travel outside of the United States is needed (while a beneficiary's I-485 in still being processed) an Advance Parole can be obtained quickly by scheduling an Info-Pass appointment at your local USCIS office. You must show proof (doctors note, etc) that the travel is a true emergency (such as to see a critically ill relative or other true emergency) and file an I-131 (AP) in person. If approved the AP is likely be issued the same day. Do not attempt to leave the country without an AP as this can result in the beneficiary's I-485 being considered "abandoned" and will require a new Visa to enter the US (and refiling of the I-485).

Please try an Info-Pass appointment as suggested. Before you go, please download and fill out the I-131 Advance Parole form and take it with you for your appointment, and take with you documentation regarding the nature of your emergency. Hopefully that will solve your problem. Good luck.

This is the first letter I've received. It states 'it can not be accepted, as it has not been signed.'

I did sign part D. That's why I'm so confused and worried


Print out the I-129F again, sign w/ a blue pen instead of black. If you can,have someone else look over the application to check everything. (It never hurts to have a fresh pair of eyes double-check everything). Once you're assured that all Ts are crossed and I's dotted, just , re-package and re-send. You should be fine. Sometimes USCIS mistakenly rejects an application, based on such a thing as a missing signtaure (even though signature is present) or incorrect filing fee (even though the correct amount is included). Here's an idea, don't know if it counts, but you might want to sign up with a temporary job service and then have them sign a paper saying that you work for them at a certain rate per hour, that might add on just enough money to get you to pass, and then work temporary part-time on a second job.


What does illegal immigration have to do with the subject of this thread?
They really are correct in considering kids 'living somewhere else' as a full dependent, because they are.

K-1 visa beneficiaries are not work authorized until they receive an EAD, which at the minimum is a 90 day period. Unemployment woes being what they are, realistically the immigrant may be without a job for several more months after arrival. The consulate is quite right to ensure that the sponsoring USC has sufficient means of supporting the immigrant so there is no burden on the government to do so.

There is nothing 'unfair' in this.

Were you denied? Or you received an RFE? Was the divorce final BEFORE you filed the petition initially. Also you are very vague in your description. "Last March" when is this? Exactly. March 2009? march 2008? And what does "last September" mean? 2009? 2008? And what does "accomplished all the requirements" mean. It sounds to me like you did NOT accomplish all the requirements. I also do not belive you waited for 5 months to receive the NOA1. Do you mean the NOA2? Was the PETITION denied or was the visa denied? Did you have an interview?

And please state exactly the date the peition was filed and exactly the reason it was denied.


Yes the petition was denied but we were given option. yes the divorce was final before we filed the petition.
We filed the Petition last march 27, 2009. Received RFE last August. Submitted all the requirements first week of sept .
on the third week of september received notice of denial.


What exactly did the RFE request and what did you provide? Are you sure you provided everything requested? Did you mail your 'requirements' back as requested, with the RFE form attached on top?

Petitions rarely get denied right from the get-go if all eligibility and documentary requirements are met. In your case an RFE was issued and you say you complied w/ the requirements. I wonder if you may have missed something?

Yes, it's difficult to give definitive answers without complete information. From what we see, it looks like the passport style photo's got lost as the staff was building the file. I always suggest putting each photo in its own sandwich bag and stapling the bag to a full sheet of paper. This keeps them from falling out and getting lost.

For RFE's you do exactly as instructed. So far, we don't see the full set of instructions.

So, I should just submit new photos and the accompanied I-797E form? Or do i need to submit a copy of my original I-128F submission as well?

Isn't that enough?


for your I-129F petition your should concentrate on proving that you and your fiance have physically met at least once w/in the past two years. The child's birth certificate and paternity you can mention in your "how we met letter," but I would keep until the interview stage. I would include more proof that you spent extended time in mexico and try to include documentary proof that puts you and your fiance in the same location. (i.e. plane tickets, hotel receipts, stamp in you passport...the like.) smile.gif

I have my artinerary, my hotel receipt in Manizales and pictures together. I have reciepts from restuarants but they do not say the name of the city. My strongest evidence outside of the pictures is my hotel reciept. It is in spanish but it shows the name of the hotel and my name and the name of the city . Does this need to be translated ( the hotel reciept)?


I some kind of way lost my little parts of my boarding pass. I have one boarding pass from houston to miami and then miami to bogota. But I don't have the boarding passes to bogota to manizales. My fiance lives in that city. I do have the luggage labels that shows my luggage went to Manizales. Do you think they will accept this?

Does it seem like I have enough evidence?

Do you all think I need to send ewvidence of an ongoing relationship?


Any documents not in English do need to be translated...but it does not have to be an 'official' translation. You can have someone you know, who speaks Spanish do the translation and certify (with their signature) that the translation is true and accurate (to the best of their knowledge).

You can use what you have, along with the stamps in your passport(showing entry into your fiancee's country) to document physical meeting for the purposes of filing the I-129F.

You can bring your 'fiancee' to the US with you, if she interviews and receives a tourist visa. Though having married, and having a spousal visa petition being processed, it will be a little tough to prove 'non-immigrant' intent, which is a key factor in being approved for a tourist visa.

On the G-325A do I need to put her address, name of her job , and her job title in english or not. It's in spanish but it is her address. I am thinking like if I were to put it in english , if they mail something to her she would never get it.

There is a place at the bottom to sign and then a box that says print your name there.

Do I fill in that section for my G-325A?


Can she sign now ? Because I am going to see her next week.

What you are looking at (upper right hand corner of the form) is not its expiration date, it is the OMB date (long story, but it's not the expiration date). Technically the revision/edition date on I-129f is 07/30/2007 (bottom right corder of form) and no new version/revision has been propagated so it is still the most recent and accepted version.

Bottom line - not to worry. good.gif

I had her to sign her name on the signature part which was not a problem, but the bottom box with the heavy border , she printed her name last, first, and then middle but I just learned to night that it should be both last names together and then her first name and leave the middle name blank.

I brought extra copies of G325A with me and had her to sign a few blank ones. She signed her name how it supposed to be in the signature part but we were confused by the bottom box. She printed it out as like she had a middle name. Do you think there will be a problem with that? I am filling it out like your post shows on the blank copy with her signature but in the box that says print it written in already as she has a middle name.
