Actually, the DOS Call Center will know all about her case.

So, give DOS a call, ask about the case - but... ask for:

1. current status, with date/time stamp
2. last 3 status change items, with date/time stamp.

IT MAY BE that she's in either 'Additional Processing' or 'Administrative Review' ... But you won't know UNTIL you talk with the DOS Call Center.

Also - she filled out an EMS label on interview day - did she write down the EMS tracking number? If so - she can track the shipment at

Is slight possibility, for K-1 petitions going off to Guangzhou, China, that they MIGHT SOLELY get transmitted from NVC to GUZ via SAFEFILE.

For other consulates, other IV units - I've no idea.

IMO, your attorney was just giving opinion - there's no wide-spread use of 'electronic filing' for K-1 petitions.

Some consulates are replacing a paper DS-156/DS-157 with the OF-160, but it's a pilot program, and usage varies by Embassy.

Unless something was announced today, NO - there is no 'original submittal' of a K-1 petition, electronically.

This is called an evolution of relationship letter, and it's ALWAYS done by the PETITIONER (USC, usually YOU ) . It will be looked at , with scrutiny, by a VO on Interview Day (if supplied on Interview Day ) or doing the casefile review process at GUZ, prior to interview day, IFF you supplied it with the petition submittal.

If you don't include it with initial petition submittal , at least have it ready for interview day.

Some folk go into the GUZ Consulate Office for ACS, have the EOR letter NOTARIZED in GUZ. Many times the ConOff doing the notary work will be the IO on the interview day.

Beneficiary's birth certificate - as I recall - a COPY is sufficient. She'll need to supply you with a Chinese/English Notarial Translation of the b/c - usually called a WHITE BOOK. At this stage, petition submittal, a COPY is fine. The original will be gathered up on Interview Day by a Document Screener.

record of phone conversations - eh - not the transcribed to text versions - but CALL DETAIL RECORDS from your phone service provider. These are optional, and are used to prove that you've remained in contact with her. Other things work, also - chat logs, chat history logs, emails, postal mails.


Ask her if she's reading through the 001 forum. If that's the case, don't sweat it - about 80 percent of the info there is 2nd hand, 3rd party, rumour, mixed with innuendo... The other 20 percent is usually 'direct experience' and 'cold hard facts'.

1. have yer lass DELAY returning the packet 3 to the Embassy AFTER she receives it FROM the embassy, from 2 to 3 months from the date that she RECEIVES it. This buys you some time, and you need this time to finish up the fall semester, and get a 30K job.
2. na - get the big job after fall term ends. Forget about 'amt of money made since hired' and focus on 'annual salary amount', instead. Seriously - get that 30K/yr job right after the fall term ends. Skip the spring term or take 2 or 3 night classes, work during the day, get away from the resturant work. It doesn't matter the AMOUNT OF MONEY MADE from the time you start the job to the time of interview day - what MATTERS is the annual salary that you are HIRED at, which will be reflected in the EMPLOYMENT letter that the HR department will make for you. Whilst yer still on campus, hit the uni job / career office, dig through the employment offer books and the online portals that the uni has. Talk with the uni career counselors about finding that 30K /year job. They are there to help you, part of your fees pay part of their salaries.
3. send out the employment letter to your lass, along with the I-134, two weeks before the interview day.
4. calling USCIS is a waste of time on this matter. All the data you need is available online, you'll get much better (and focused ) opinions here on VJ.
5. re-read all of my posts in your thread, here, 3 times. I was succinct and to the point when writing - but yer missing my points (your questions are indicative that you've just skimmed ). Map out what I've written on a calendar, make a flowchart even. Big paper, green crayon.

Note - I never suggested anything 'idealistic' but always 'realistic' for you. If you can make it happen, you'll be out of the danger zone for the I-134 income requirements.

Later, when she comes into the USA, marry and file AOS immediately. Then when the next full semester comes around, she can work full time whilst YOU are back in school. Keep that up until you FINISH the degree, then get out there and get The Regular Job ™.

If my list seems too much, or tedious - ask your mom to read all of my stuff here, get her INPUT.

It's a TIMING THING, see...

If you have in hand, an employment letter on a 30K/year job, for the I-134, it will trump all of the prior low-income issues that you have.

You can return to school for the summer.

If you can't get a 30K year job in the next 2 to 3 months, can you get 90K in cash, sock it into a saving account? If so, you can use that INSTEAD of income - as an ASSET.

He will probably need police certificates from China AND the Dominican Republic?as well as any other country where he's lived for six months or more after his 16th birthday.



ya - 'white books' is slang for translated/notarized:
1. police certificate
2. birth certificate
3. divorce certificate
4. proof of 'single'

Sorry I was using slang last night wink.gif It's a collection of original documents, translated into English, and notarized by a Translation Office in China (usually referred to as a Notarial Office ) . Each translated document is a bound white book, between 2 to 11 pages (depending on what it is), on A4 sized paper.

The Chinese Fiance (in the DR ) doesn't need to show up in China to get these IF he has a family member that is listed in the hukuo book (family registration book ) . Of course, BOTH of these people must be in the hukuo book.

your foreign fiance has a couple of things that CAN be done, to delay an interview date:

1 . NOT return P3 documents immediately, wait a few months and
2. when send in P3 documents, ASK for 'later' appointment date , in a cover letter.

The I-134 (affadavit of support ) is PRESENTED on INTERVIEW DAY, so - you need to think about ways to extend the interview date.


But hey - dig around here at VJ - you'll see some folk with the same , or nearly same, scenario, with a need to delay a bit.. Reasons for delay varied (sick mother, school term, etc ) ..

You can LEAVE anytime, but you cannot RETURN until you have an AP (I-131) or green card. APs are generally received within 90 days of application. The AP is free if filed with the AOS. So get married and file the AOS with an I-131 and you will be able to travel in about 90 days (my wife got hers within 60 days).

If there is some family emergency, you can apply for an I-131 at your local office and it can be sent to a foreign consulate, but you need your NOA1 from the AOS filing, so get that done ASAP



Semantics, I know, but the bolded is not quite phrased correctly either. It is advisable not to leave once you've 'activated' the K-1 (i.e. entered the US) until you've applied for AOS and have at least the AP approved. Once can be considered to have abandoned your adjustment of status if they leave before it is adjudicated....that is why AP is necessary, to have USCIS 'approve' your re-entry to the states. Without that they may constitute your exit from the US as abandoning of the AOS.
The best course of action is to follow through with the requirements of the visa issued to you....enter the US w/ your K-1, marry your fiance(e) and apply to adjust your status as soon as possible. With your AOS applicaiton, send off the additional AP (I-131) application. Luckily it gets approved quite quickly so you should be good to travel within about 90 days of applying for it.

If you do no have the boarding passes for for a flight taken, you may contact the airline and have them issue something attesting that you did take the flight in question, on the date in question. I've had to do this for frequent flyer miles that I wanted added, but did not have the boarding passes. There was a charge, I think $35 for this, and it was with Lufthanza. I'm not sure if any other airlines offer this, but its worth a shot.

For the spousal visa, the marriage can occur anywhere, but you must interview for the visa in Canada and only after you're approved can you immigrate to the US. You may only visit during the waiting period, but there is a certain amount of risk involved with that, since once you apply for the spousal visa petition you are basically declaring your intent to immigrate, while the whole premise of 'visiting' implies that you will not immigrate. But even so, for those that have the possibility, visiting while the paperwork was being processed has been an option they've utilized.


3) Is it possible to come to the US on a Canadian passport and get married in the US and stay there and apply for an adjustment of status and I-130?
This is NOT possible because this is illegal. You cannot enter the US with intent to stay. That is termed visa-fraud and a no no.

I am so confused. I don't know what's the best option? What's legal? What's the quickest?
