I'm not certain about what will fly with your embassy, but I can tell you the options my embassy accepts. Maybe it can give you an idea.

For the embassy in Thailand, there are three options:
-- A statement from the other parent giving permission for the child to live in the US permanently.
-- Court documentation stating that the beneficiary has the sole authority to move the child out of the country.
-- Proof that the other parent cannot be contacted

The proof in option 3 includes newspaper ads, letters sent to the other parent's last known address returned undeliverable, statements from the other parent's relatives that they do not know the other parent's whereabouts, and other things along these lines.

I know it's not exactly what you're looking for, but perhaps you can call the embassy and ask if this type of proof is acceptable. If it is, it shouldn't take 10 months to collect.

Gracey had the same issue. In our case the court decree stating that you have sole custody was all we needed, but it's best you call to make sure so that there are no surprises later. Best of luck!

I have found out the place to start the process of getting the court document. (Bienestar Familiar) But it will take up to like 14 months or like 10 months with a local attorney in Colombia. Does anybody know what I can do to get this done faster? What will DAS accept?

Before I sent the petition my fiance told me that there was not going to be any problems getting the father to give permision. Well he commited a crime, and it was reported and now he is on the run from the police. I really do not want to have to leave her son there while we are waiting for the document.

I am still waiting on my NOA 2. I recieved my NOA 1 December 7.

Yes you need the permission letter/court order before the interview or the K2 cannot be issued. FYI for other VJ members. This is something to be cared about before you file the petition. DO NOT start down this road without clearing all the hurdles, if children are involved this needs to be taken care of FIRST.

A court order of sole custody will substitute but the order must include transport rights for the mother.
The permission letter needs to state clearly that the father gives permission for the mother to relocate the child PERMANENTLY to the UNITED STATES. It must be notarized and you must have a copy of the father's passport (or other government ID) photo and signature page (if other ID is used it must bear a photo and signature)

Hi,

I read that there needs to be permission form the other parent to get a k2 visa.

My question is what happens if the father can't be found , and the police doesn't know his whereabouts. He hasn't seen his child since he was 3 months and now his almost 14.

I read that court can give you some type of document. But the court where my fiance lives will not give her the document until she has the visa in her hand.


Do we need that document for the interview? Or when leaving the country?

What should we do?

My Chinese fiance speaks some English and can easily memorize answers to likely questions, but I feel may have trouble understanding other questions. So if everything else was equal, does experience indicate a higher likelihood of success requesting an English interview? Thanks.

I've no idea how it's done in UK, but this 'letter of intent to marry' is turned in, signed, at the GUZ consulate on interview day - ie - it's not turned in with the original I-129F petition inside the 'filing packet'.

It's something that IS covered for the P3, for a K-1, is the UK consulate asking for this letter to be sent in? Did you receive a P3 packet???

There's an IV UNIT email form on the GUZ website - if the petition has left NVC, I suggest you use the GUZ website email form thingie, and give them notice of the new address... .

1. if you haven't submitted the I-129F packet yet - then no, it doesn't have to be notarized. Try to limit to 2 pages (max), deal with facts, and not emotions. Sometimes this is also called an EOR - 'Evolution of Relationship' letter - you can find examples here and at http://www.chinafamilyvisa.com
2. If you have already filed and haven't included it - then it makes sense to have it notarized - you can have it notarized at a bank in the USA, or at American Citizen Services at the Consulate in GUZ. Try to get it done PRIOR to her interview day (YOU) .
3. A Chinese Notary might be able to do it, but GUZ won't accept it - as the Chinese Notarial Office isn't accepted at GUZ for 'english only' documents.

Hey - that's great news.

IMO - For now - wait 12 days, then call NVC. Find out WHEN the casefile LEFT NVC on it's way to GUZ.
After it leaves, tell yer lass to get her original documents - ie - the Police Certificate, Certificate of Single Person, Divorce Decree, Birth Certificate (all official, and then translated into English at a Chinese Notarial Office, usually called a 'white book' - have her purchase 3 sets of the Birth Certificate White Book - this will be necessary later in the USA.

GUZ sets it's own appointments - she'll be sent a P3 letter with forms to fill out. The P3 letter has specific instructions on what they want, what to do . It's mindless drivel, really, but the timetick of 'NVC SENT' is a great time to start gathering up the Original Documents in China.

I suggest you call NVC, speak to a human.
IIRC, NVC NEVER has your info, for a K-1, on any automated system - ya gotta catch a human.

Ask for 'case status', or 'where's the casefile'

IMO - for a K-1 - the Petitioner's address change after 'nvc sent' is not so useful - ONLY BECAUSE there is NOTHING to be sent to the PETITIONER once the casefile has left NVC.

Once the visa stamp is in the beneficiary's passport, and ya gets into the USA - USCIS ain't gonna mail you anything - you have to MAIL IN THE AOS package - so that 'mail in' is the first time a 'change of address' will be useful / noted. FWIW, the USC spouse has to list his former addresses in the AOS package ANYWAY, so if no address change is done TODAY, then the addresses will get tracked LATER in the AOS packet.

Are you HKG citizen or resident? Buried somewhere in the I-130 instructions (this applies for K-1 also ) is the police certificate requirement - you MIGHT have to get some from your home country (and/or other countries where you've lived ).

What shipping company?

Once the package is cleared at customs, it will be shipped somehow. If you used Fedex/dhl/ups - its possible to capture the package once it clears customs (as a private employee for the shipping company will be handling the package ).

but if you sent via ems, then the USPS will be picking it up out of us customs, pushing it along to its final destination - and it's difficult with dealing with usps.

If usps can 'capture it ' for you - I suggest getting it done - start with www.usps.com - enter the ems tracking number, check current status, then 'GET A HUMAN' and inquire.

Sorry, I don't have exact answer for ya on USPS sad.gif

Sending 'additiona' stuff' to USCIS is gonna be difficult - if the concept is for 'the new stuff' to catch up with the original casefile. That casefile will be 'in a black box' until it gets to an adjudicator's desk - and then , even, it's really not updateable.

There are 'first screeners' at USCIS who look at the documents, check for completeness - if they mark it 'incomplete' and send it back to you - IMO - that's gonna be the best thing for ya, if you can't get the package stopped prior to final delivery.

Hey - mostly I'm echoing the posters above me, but...

1. file yer tax returns asap.
2. make sure you can prove up the domicile in the usa by 'interview day' time tick. bring all evidence of us domicile to the interview. a letter from yer parents stating 'they can live with us' is not sufficient - you need at least a rental agreement.
3. review the I-130 instructions - there's 6 areas of proving up a bonafide marriage - pay attention to those as you go through the process of getting married, gather evidence along the way, to add to your current pile. I've got a list over at http://www.chinafami...mp;showentry=14

B2 visas for China are either EASY, or a PITA.

It depends.

It depends on the applicant's ties to China.

First and foremost, the US Government, and hence the Interview Officer at the Consulate/Embassy that she'll interview at -
ASSUME FIRSTLY that she's trying to immigrate to the USA. Fair or unfair - doesn't matter (well, it does, meh ) - but...

It's ON HER HEAD to prove that she has enough ties to China to return China after she's finished up her tourist trip.

This is gonna be hard.

IF her parents are GOLD COLLAR workers (ask yer lass what this means )
then there is a possibility that yer lass can paint a financial 'landscape' that will prove strong-enough ties to return.

Otherwise - forget it...

These 'ties' will vary by age and family ties.. ie ...

A mother, age 52, with a daughter married to a USC who's IN the US, can prove up home ownership, have a largish bank account, a LONG TERM JOB that isn't migratory, and FAMILY ties in China - MIGHT be approved...

Yer lass is college age... So her AGE is a first-strike against her.
Sure - the compelling reason to return to UNI is a good one, but ...
If she doesn't have a substantial financial portfolio, IMO, she's gonna be sh_t-out-of-luck.

If her parents are GOLD COLLAR WORKERS - she might have that financial portfolio.

But hei - all is really conjecture, at this point.
The Consulate/Embassy will assume she's gonna migrate, and it's up to HER to prove that she has STRONG TIES to China.

ON ANOTHER NOTE.

FWIW, IF the NOA-2 was just approved -
1. call NVC every day for about 2 weeks - ask for case status -
2. pay particular attention to HOW the casefile was transferred to GUZ from NVC...
a. If it was sent via DHL - expect a 2 to 4 month lag time or
b. If it was sent SOLELY VIA the SAFEFILE system - then you have a small chance that the P3 packet will be sent out within 10 days of of 'NVC OUT to GUZ' date.
3. Once NVC states it's gone - call DOS every day for 2 weeks, asking for case status. If you have a 'P3 sent' status within those 2 weeks - have a read -> http://www.visajourn...GUZ_P3_Shortcut the two of you can shave off 2 to 3 weeks of waiting time whilst the P3 is shipped around China.

So - it may be possible that she has an interview date before December 31st of this year, if the casefile is sent SOLELY VIA SafeFile.

If that's the case - what are ya gonna do then?

Seriously - it's easier for yer parents to come to China with you, then for her to get a B2 visa.

If you want to assist her in painting a rosy financial landscape, so the Interviewing Consular Officer might pass her - send me a PM. I'll 'splain to ya how to do it.

it's a largish envelope.

Inside is 1) the passport, 2) a letter , 3) a large envelope that she's not to open.

The passport should have the visa stamp on it.
The letter contains info specific to her visa.
The large envelope contains the medical stuff, the I-129F, and all notes from various fed workers.
Sometimes the large envelope has a slash in one corner. Don't sweat the slash...

Some people have actually received other stuff' in the postal mail - like:

2. a denial letter

Sorry to hear this. Did you ask about the prior 3 status type changes??? FWIW, 'namecheck not finished' can be a plausible reason for the hold up.
