YUP - don't sweat the NOA-2 validity/expiration date.

GUZ automatically extends these - no letter required.
There's a 2 to 4 month 'dead zone' time period, that you have no control over,
from 'casefile arrive in China'
to 'casefile opened at GUZ'

Well hey - my long term solution would be to move to Singapore, work out of Singapore, become Singapore Citizen. Then you can redo all with yer lass - she'll LOVE living in Singapore with you.

There are different residency requirements for there, but if you are looking for ship officer's gig, Singapore's a great place to work. And Live. And be a Citizen Of.

1. the USC can file the petition to USCIS from anywhere on the planet. Need to use the address for filing based on the USA-domicile address.
2. C1-D and K-1 are different visa types, not related, no waiting needed. But if you're worried about the result of denial - I say - you should still try, as it's NOT the denial of a visa that will kill you, but the DOCUMENTED overstay that will kill you. It MIGHT kill you, it might not - you won't know until you attempt something.

There's some DB service that USCIS/DHS uses to check divorce stuff -

and you can pay a fee to have a search done on the commercial side.

Can't for the life o me remember the name of it, though.

Fee should be less than 200 bucks, iirc.

But - do the search on your name, plus her name, with that service - it'll go CONUS - if yer lucky though - it will be in one of the states where the records are kept. GAG - there's about 12 states where the records are NOT shared, so are not archived into electronic format into 'that' service.

To anyone reading this - hey - what the heck am I talking about ? ya remember the name of the company/service?

practice a bit with this - just a headshot, yer two heads together, with the newspaper under yer chin, showing the date.

Take photos like this , each time you are together. Frame the shot so it's just yer two heads, and the newspaper. He can probably do this with one hand holding the camera out.

Also, suggest you get some photos of the two of you together WITH YOUR parents and other relatives.

Also, when you go out to eat, GET THE RECEIPT !

she can request to get the police certificate, usually through the CONTRACT OFFICE that hired her - an HR person there can assist her to get that clearance, directly with the police office in that country that handles it. Might take some extra paperwork and monies, but is always better to handle it that way, instead of going to that country again, just to get a police certificate.

Hi Nathan - My Name is Darnell - I can't possibly imagine the type of conundrum that you've espoused in your post here.

If money is important to you, get that 55K / year job NOW, then file the K-1 the week after you have the employment letter. Current Work with higher annual salary trumps prior years.

I've read here on VJ that a co-sponser for a K-1 in HCMC is useless.

For Dollar Assets, I suggest 55,000 usd in a savings account, but that's just an arbitrary number.

HOW you communicate with her is looked at , hard, by the VOs.

ONE WAY to 'get across' to a VO - HOW you TWO communicate - is with a paragraph covering this, INSIDE of an 'Evolution of Relationship' Letter.

The USC would write this up, in English, give to the K-1 person, prior to interview day - then

the EOR letter is presented on Interview Day.

It's not so much as 'English' between you two, as it is 'how you communicate' .

It is possible to have the K-1 Visa revalidated if the Embassy/Consulate sees reason to do so (it is under their authority to do so, or not) and it'd certainly be worth a try, but I would not be terribly hopeful (unfortunately).

Has the fee increased been approved? I havent seen anything that its official? Can anyone send a link?

You dont need a new medical if your VISA medical is within a year of your AOS. You do need your vaccines transcribed....but that is no where near $600. Your medical should be in the brown sealed envolope that you hand over at POE. Some people have been having issues- but you just have to write back saying they got it at POE- you can do a new one if you want- but its NOT NEEDED....

One isn't paying for a 'new' medical exam in USA - but paying for the 'updating' at a Civil Surgeon, prior to filing the AOS package.

I still say budget 600 usd for this.

There's also new medical fee in the USA - basically the I-693 - there will be costs associated with the Civil Surgeon that you will see in the USA - that Civil Surgeon does a final review on yer medical file. If you need other vaccinations, can get them at the Civil Surgeons office also, but many choose to do it elsewhere, at a lower price. I can't predict how much for Civil Surgeon fees, but suggest you budget 600 bucks for that (thats the high side, btw) - and then if you have monies left over, hey - use your extra monies for a nice haircut when yer ready to start job hunting. :D

There are policies in IMBRA that deal with multiple K-1 visas (I-129F petition) for the same USC - that 10 year mark - 2 every 10 year period - is actually part of the policy from IMBRA - so if it's MORE than 2 in a 10 year period, well, that USC will be looked at REALLY HARD after the 'next' I-129F submittal.

As I understand it - it's only on I-129F petitions.

An I-130 petition filed for CR-1/IR-1 visa, doesn't 'fall' into the count or even the policy.

usually, for a tourist visa - the applicant (not a USC) has to show strong ties to the country (in this case, PI) - via:

1. showing some employment letter
2. showing holiday time letter from employer
3. showing a lease or mortgage or deed to a house.
4. showing bank accounts with amounts
5. listing all relatives in the PI and 'what they do for money' (but thats mostly optional, useful for a 'university woman' )

The ConOff assumes (via mandate and governing policies, btw) that the intending tourist has the want, need, and desire to IMMIGRATE, and it's up to the applicant (again, not the USC) to prove up that THIS is NOT the case.

For getting on the plane -
the air ticket name must match the passport name

For CBP/POE - it won't matter - the OTHER forms INSIDE of the sealed packet have YOUR NAME spelled correctly. The 'electronic version' of the casefile (stored in SAFEFILE ) has your name spelled properly.

If you do have some concern about it - send HER a scanned NOA-2 document, she can print it out and hand carry on the trip.

you might want to prepare an 'evolution of relationship ' letter, and inside of it - cover EXACTLY how the two of you communicate. Communication has been an issue at GUZ this past year - many white slips because of it - not 'mounds of documentation on content' - but a one to two sentence blurb in a paragraph inside of the EOR letter.

I suggest a 1 to 2 page EOR letter, notarized. She'll present it on interview day.

No and No.

Nota.Bene. You Can Change the NAME on the SSN card after you receive the EAD or GreenCard.

FWIW, if you get a SSN now, you can get joint bank account with yer spouse, also get yer name added to the utility bills - which is great fodder to use for the AOS packet.

The 'normal' K-1 folk never 'receive' a SSN card unless they APPLY for it. Nothing is SENT to you. Ever. You have to apply. In Person.

You are still a 'normal' K-1 person (I-94 not expire yet) and guess what?

When you are within 14 days of I-94 expiration date - YOU CANNOT APPLY. You have to WAIT for EAD or GreenCard, before you can apply for SSN again.

I strongly suggest you find out where the offices are, around you, TODAY, and work up maps from your home . go to http://maps.google.com after you find the SSA offices in your area, print out the map thingies, you and your husband figure out which one to go to, for today.

I am suggesting you apply with your PASSPORT NAME - because YOUR PASSPORT name will be FOUND in the SAVE database (which is what the SSA uses to verify that you are you, also verify your K-1 status ) .

re: applying for AOS - I'll repeat myself - USUALLY, if you file within 6 months after yer I-94 expires, YOU WILL BE OK.

Did you contact the clerk of the court, via telephone, yet, inquire about expediting the marriage certificate? If not, please do so, today.

Thanks, everyone...Well we marry today so d judge said that we will receive the marriage certificate from 4 to 6 weeks and that means that my visa will b already 'out of duty'... So i gatta b 'out of status' and apply for the Green card...That sounds kinda creepy :bonk:


Suggest you contact the judge's office, ask if possible to 'pay' extra for expedite.

Also - did you get yer SSN yet? Go to SSA office immediately, if not.

The 'rule' is to get married within 90 days - but there is no 'rule' on when to file for adjustment of status.

USUALLY there is no problem for up to 6 months after that 90 day window - but try to get it done asap, ya?
