IMO, 'going the married route with an I-130' has no 'issues' after first POE with a CR-1 visa.

a K-1 visa holder, OTOH, will have issues after first POE with a K-1 visa - ie - that 2nd entry attempt will be viewed as abandonment of any AOS status.

where IF the interview is on or PAST June 4th, and you already paid the 131 USD prior to June 4th,

you MUST pay the difference, prior to the interview.

No, not at all.

Push mentioned There is no deadline for filing to adjust status and that's the correct answer.

I'm not trying to beat you up about this, really - but if you give wrong information, and someone else uses it here, then gets into trouble because they followed your advice, who's to blame? This is a web portal for DIY immigration-related issues, and if you are giving the wrong information, it can be detrimental to the reader. I know, you want to be helpful - I get that - I was guilty of the same thing, ages past, as well.

The ONLY REG is that the K-1 visa holder MUST be married within 90 days of the POE date. 99 percent of the time this is also tied to the I-94 expiration date. There is no REG to file for AOS within 90 days of POE date, or even a REG for WHEN to file AOS. Most people that file within 6 months AFTER the I-94, have no issues whatsoever. Some people even wait up to 1 year before filing for AOS, mostly without any problems.

There is no REG for 'when to file to AOS'. USCIS will always say, 'The sooner the better', and IMO, it's good to file as soon as humanly possible, as there is a dead zone of 'status' between I-94 expiration date and the NOA-1 receipt date on the AOS submittal.

If an I-130, each child needs seperate I-130 filed also.

Initial I-129F - just one fee, for the fiancee.

Then other fees for the VISA APPLICATION, 350 each person- each person pays 350 in Mexico (fiancee, kid1, kid2, etc)

I'll suggest a coupla things, maybe (maybe...) help you to decide whether you need an attorney or not.

a. read the VJ guides. map the steps out on paper and pencil. See if anything doesn't make sense to you.
b. Read the USCIS web portal about the forms. Map out the steps on paper and pencil. See if anything doesn't make sense to you.
c. Practice filling out the forms, at least 5 times. See if anything still doesn't make sense to you.
d. Have any red flags? Practice writing up attestation letters about each red flag.

Now, after doing (with major emphasis on DOING ) all of the above, if you do NOT understand the forms and the process and potential red flags for your petition,

then I'd suggest getting a good IMMIGRATION lawyer.

Sorry, ya never, ever, turn in an I-129F petition INTO a field office.

Please read the instructions on the form for 'where to mail'.

At some point, you'll need to decide what address you will use for receiving USCIS notices.
Many students use their parent's address for that (since the parents rarely move).

NO - cash in the bank is an ASSET, and the 'amount' computed is 3 times the 'income differential' for the I-864, for a 'cash asset'.

Keep reading those instructions though - I think yer on the right track (but read my longish reply to you, as well, MAKE the calendar).

I know you've gotten some GREAT ANSWERS already - but - let me throw this at you.

Since yer original question was about the I-134, I have to assume yer filing the I-129F petition for a fiance.

Take out a calendar, put yer graduation date on that.
Then put the 'AOS FILING DATE' for the I-485 (guesstimate that date)

then try to figure out how much money you'll accumlate between yer graduation date and the AOS Filing Date. Accumulate. IF IT's OVER 60,000 USD, then you can use that as CASH ASSETS (monies in a bank account) for personal prove up on the I-864 filed with the AOS package.

In addition, it's always better to have a high paying job after graduation - so hei ! The pressure is ON, if you do NOT want to use a co-sponser for the I-864 on AOS filing.

So - if that 'duration' between graduation date and AOS Filing Date is enough to forecast boocoo pile o cash - you'll be OK. Otherwise, expect to have a co-sponser for the I-864 for AOS filing.

There are students here who HAVE SUCCESSFULLY come through 'the system' - so you are NOT treading through virgin territory. But - you really need to plan this out, and then execute yer plan. Money is important here, accumulation of money even more important.

It kinda depends.

Do you have call in letter, or no ?

If call in letter -
ya bring in the 'stuff from the list' - hand it over to a human - then it's about 1 to 5 weeks till 'review', then 1 week on mailing visa packet back to beneficiary.

If it's mailed in - figure about 2 weeks once it hits the mailroom, then another 1 to 5 weeks till 'review, then 1 week on mailing visa packet back to beneficiary.

I suggest , after you know it's been delivered (use EMS? get tracking # ? )
then call DOS Hotline (# in my profile), get a Human™, and inquire for case status. At some point, a DoS Human™ will tell you 'visa packet sent out'... They might tell you 'RFE Material received', as well - but that's a cr@p shoot.

If you were IN GUZ, and YOU (the USC) handed it in, across a counter - to a human - figure 2 weeks before mailout, as it bypasses a lot of queues.

Did GUZ keep the passport, or no ?

If no, add in 1 to 2 more months, and expect a 'call in letter' to drop off the passport.

I've never seen them extend the validity of a visa. Your situation appears to be one where a reissue of the visa would be in order, so that it is issued with the correct expiration date. If they made an error, they will fix it. If they had a valid reason for the expiration date given, they'll most likely tell you what it was and refuse to grant an extension.


Ya, he had some medical slippage time because of TB test results. There's been some issues about that with MNL casefiles, as well.

It's my understanding that a Permanent Resident of the USA CANNOT file an I-129F petition, to culminate in a K-1 visa.

OTOH, there is nothing stopping the two of you from getting married - P.R.'s are allowed to file the I-130 petition.

What's more important, the marriage and subsequent life together, or the citizenship status?

If you'd like to come over on an entreprenuer visa, though - we'd welcome you on Friday Morning ;)

How many days in total is your fiancee wanting to take off? It sounds like 2 multilple day vacations in the space of about a month is not acceptable. (It is within a span of about 30 days, if you think about it....the 4 days at the end of May, and the [few] days he's wanting to request for your marriage at the end of June.) He's been employed with the company for not yet a year, and he's making two separate vacation requests back to back? Unfortunately, regardless of time accruals and vacation entitlement, it does sound excessive if you take it out of he context of why he's requesting the time.
Unfortunately, the granting of employee time off is rarely a given and if the employee really wants to keep his/her job it is an unfortunate circumstance that must be borne. As you and others have stated, this manager does not seem reasonable....but while she is in charge, she is in a position to make your fiance's work life rather uncomfortable. If keeping his job is a priority, I wouldn't rock the boat about the vacation time to help you fly over. Remember, that once you're married and the AOS process begins, there may be more instances in which your fiance would want to request or time off (like for your medical-exam is you need is, or biometrics, or the interview). If he's gotten on the wrong side of his manager's good graces, she may summarily deny those days off and that would cause further problems.

He is dual Swedish-Lebanese (100% Lebanese, but he spent the vast majority of his life in Sweden and will be applying through the Lebanese embassy with his Swedish passport). I would think that the Western European citizenship/passport should allay any concerns they might have about the bona fides, but I still would prefer to do a little front loading just in case. I'll update my profile to include the proper consulate country.

I'm about to mail off my K-1 app and am debating whether to include a copy of my lease for an apartment here in the US that I signed with my fiance. He was in and out on a visitor visa, but when he was here (for a period of about 5 months with a couple of short trips outside of the US as a business visitor), he stayed at the apartment we signed a lease on and he has continued to pay rent on it when he hasn't been here. Would it seem odd or become problematic that he'd signed a lease for an apartment in the US when he was just in B (business visitor) status? Do you think that it would negatively or positively affect the I-129F petition? This is the apartment we will be living in once he is approved for the K-1.

The filing requirements for a K-1 petition require only that you prove (with documentary evidence) that you and your fiance have met at least once in the two years leading up to the point that you file said petition. If you are able to satisfy that pre-requisite with other documents, then it is not necessary to include the joint-lease as well. That said, there are some cases in which having proof of a joint-lease does help in asserting the bona-fides of the underlying relationship, which forms the basis of the I-129F filing. With some petitions (it seems to depend on the country where you fiance will eventually be applying for the visa, once the I-129F is approved) it is advised to 'front-load' the petition, in which case something like a joint-lease would come in handy. Your profile does not state, what country is your fiance in?
