Once the petition is approved and AT the US Embassy/Consulate, the foreign fiance is allowed to APPLY for a VISA.

90 days 'starts' once yer fiance is in the USA.

did she look you up in the SAVE database ?

If not - go back, try again.

Usually, you can be found on or after Day 14 past yer POE date, unless is some weird/strange issues at the POE with the CBP folk.

Go back this week, ask to be looked up in the SAVE DATABASE in yer VISA NAME. If the clerk sputters about SAVE, ask for a supervisor.

DO NOT 'let them' go through 'DHS/USCIS Electronic Verification' on you, that takes 30 to 45 days, and is just a waste of time.

Come back every few days, get looked up in SAVE in VISA name, until they can find you.

re: married name - sure - can change LATER, not a problem, but try to get it first IN yer visa name.

I don't want to marry this guy. I can't trust him. I think he is using me. I already sent in all of the K-1 Visa package. I'm not sure, but I don't think it was approved yet. What if he is using me? We have been through hell lately. Manipulation and deceitfulness are included. He has been using vulnerable women in various countries to go and visit. I think he may have a mental problem. Can I cancel the K-1 Visa if it isn't approved yet?


Any news? Did you withdraw the petition at USCIS ?

Sure ya can - is no 'federal' law about it - each state makes it's own requirements for ID.
Many states not require SSN for ONE of the ppl, some not need for BOTH, but MANY require it for both, as well.

Easiest Way to Know ? Check in with yer county clerk's office - they know everything about ID requirements. Did you try the search, as I suggested?

How'd it go ? Anything new you might have learned ?

Yup - just make sure your local address is shown on the G-325A and the I-129F.
There's a spot on the form, as well for 'which country/embassy'.

No need to return to South Africa, just remember that you'll need police clearance certificate from there, also any other country you've lived more than 6 months.

that duplex is no one's primary residence - it's a rental property - so the appraised value could be used.
Usually this income and assets come in, evaluated, on the SPONSER, which is the USC, the petitioner.

In some cases, is possible to include the intending immigrant's assets as well - I think you have a good chance with that since the asset is IN the USA.

Also - on YOUR income (the foreign fiance) - if that income is sustainable after you arrive in the USA - ie - you still receive 24K in income once you've jumped the pond, then it ALSO MIGHT BE POSSIBLE to include that income, as a 'self-sponser'.

Self-sponsering varies by US Embassy - for example - London allowed for it, for some period of time.

You should check with the Embassy where you will interview (I assume it's not the Netherlands) - and ASK THEM if it is possible for YOU to SELF SPONSER on the I-134. The answer to that question SHOULD REMOVE a lot of doubt and ambiguity.

re: assets computation for the I-134 - use the instructions from the I-864 - as the VO will use the same math, from those instructions, for evaluating what's ON the I-134.

under her VISA name (not married name)

then if they find her, and the DOB isn't really the issue, apply !

I-129Fs are adjudicated elsewhere on 'emergency situation' basis, rarely, if ever, starting with a national processing office.
Those counts, elsewhere, are infintesmally low, as 'that office' is not set up to adjudicate them.

Houston doesn't process I-129F's - to the best of my knowledge, that 'shove off' was to Lewisville, mid May, 2010. I think ya need to dig around some more, forget about Texas Field Offices - you want a 'Texas National Office', instead. Houston is not it.

IMO, Lewisville stats won't be available for another 2 months, if at all, as the 'shunting to Lewisville' - the operations are still cloudy - for what they're actually doing with the casefile (notice receipts vs adjudicating).

The data for the charts you've found (GREAT JOB, BTW) stops at May,2010. Lewisville shunting started in Mid-May, so hopefully will have trackable data in a few more months?

Someone here pointed out that we should be able to use my personal assets towards the K-1, given that it is all in the U.S.


That was ME, in another topic, with the caveat that YOU should check in with the EMBASSY IV Unit, ask if they ALLOW SELF-SPONSERING on an I-134 for a K-1 visa. I never said 'should be able' - I was adamant that you inquire.

You really should do that, ya know. Should clear up a lot of silliness.

Going forward, if you ARE allowed to self-sponser, then you've overcome even more silliness.

IMO, the K-1 visa process is faster than the CR-1 Visa process, even if by a few months.

I suggest you not stop the I-129F petition for the K-1 visa, at all.

Suggest you study up on how to 'show' these SSDI payments as income, instead. Sure, is not taxable W-2 income, but it IS income.

re: go the K-3 route and just get married here in the U.S. You are confused about the K-3 process, in it's entirety. Stop for a coupla days, read the guides section here again. (train yer eyes UP, click on GUIDES, and READ. please?)

I think the congressman's office , or rather - the USE of - should work out for you - but - give it 20 to 30 days before any answer or resolution.

'self-generate' a 'Packet 3' - that means to download, fill out, print, sign, and send in all documents that a Packet 3 requires.

Usually, Packet 3 and 4 are a collection of forms hinged around the VISA (K-2) application.

so that's the DS-230 Part I (only), the Nonimmigrant Fiancé(e) Visa Application (DS-156K) and (DS-156)

For a K-2 Follow-to-Join Case, usually it's enough to write a cover letter, and include the DS-230 Part I , AND MAIL IT IN to the Immigration Visa Unit at the Embassy. Then on interview day, hand over the DS-156K and DS-156 with proof of payment.

I feel yer pain, that Warsaw sent the casefile back - but - IMO - sending off that DS-230 and cover letter SHOULD FORCE THEM to retrieve the K-1 casefile. It may take a bit, but they have electronic copy of all, stored in SAFEFILE system, and it is retrievable, by a Consular Officer with God Access on that computer system. It would really, truly, suck - if you had to remind that ConOff that he is able to retrieve all via SAFEFILE, as 'that concept' should be a no-brainer, to a properly trained ConOff.

IMO, you haven't properly 'pierced' the veil, at Warsaw, still not gotten to the 'right person'.

K-2 FTJ 'stuff' is changing up worldwide, seemingly - so what worked (exactly) 1 year ago isn't so clear - but

SEND IN THAT PACKET asap !

IF it gets to the right desk, the first time, should get some speed.

Are you communicating with a US Citizen worker at that Embassy, or a Foreign National ? FN workers, IMO, always shunt away these types of inquiries.

IMO, to say 'no record of the son' is BS - as he does exist in the SAFEFILE version of the casefile, and any Consular Official can pull that up in SafeFile.

You slipped past the 'hold queue' between 'NVC OUT' and 'P3 sent'. 6 days for you, 120 days for others.

IMO, that Packet 3 should have been 'complete'.

If EMS does, indeed, get it back to her, please make a complete Packet 3 submittal, per that OF-169.

Otherwise, make a new set of everything from Packet 3 , send it all in again . Packet 3 docs for download at

Might as well tell her to prep new packet NOW, send if off NOW, not wait for EMS retrieval, at all.
There's no fees to submit on Packet 3 'return', and no civil documents (at this point), it's just the DS-230 Part I, the signed checklist, the copy of the passport BIO page, and the EMS label, prefilled out. She can easily recreate this on Saturday Morning, send it all in via EMS before lunchtime.

Just received my RFE hard copy at 12:30 today. They're asking for a supplement to the old version of a form that was used, to explain the first K-1 that I file for over 2 years ago. I'm thinking that apparently my attorney used an out dated form or "waiver" last April when my current fiancé and I started this process. Anyway, I thought we had ample time to get this done, but USCIS is giving us only until August 19th to get it back to them. When my attorney mentioned that they can file for an extension if necessary, I flipped the I-797E over, and on the back it states that "if there is a certain date, and we do not reply by that date, they will make a decision based on the evidence that they have. No extensions will be granted." So we have to get things in on time! or it could lead to a denial down the line.


I suggest you respond to the RFE, do not allow lawyer to prep anything.

Sure, get his input, but don't let him/her do more than eyeball the letter.

Lawyers love to 'do extra things' - is always fun for them, to add more billable time for your account.

If you 'flipped the I-797E' in front of yer attorney, then hopefully you trained him up, a bit. Otherwise, start thinking about chargebacks to the attorney. Using outdated forms is a sure sign of 'don't give a sh|t'.
