I wanted to inquire about a K-1 visa process. My boyfriend and I have been talking about getting married but have yet to meet. I had been unemployed and have been the primary caregiver for my mother (who has dementia-like complications) from 2012-2013, and had just started working at the end of 2013, so we tried to bring him in on a visitor visa just ti satisfy the requirement but he was denied. So now I am trying to work on getting things rearranged in order to go to Nigeria just to get the meeting requirements of meeting out of the way. I may try to stay for a week but no more than 2 due to my mom's separation and health issues, I am not sure how long of a meeting they are requiring but with all that being said:

 

1. Will meeting once and spending nearly two weeks together (be favorably looked upon) in the K-1 process?

2. Will his denied visa visitor visa have any bearing or weight on our K-1 approval?

 

I say he keeps trying for his tourist visa, until he gets it.

Thanks. This is very helpful. Just needed to know if we could start the application process here. I am hoping we get an interview date within 6 months, theat way she only has to return to the Philippines for a short time.

Does anyone know if a hardship waiver might apply in this case. I am a disabled vet and her leaving for an extended period of time will be an extreme hardship for me.

first, no, you cannot apply for a k-1 in the usa.

however, you can file a petition, an I-129F, anytime, her location not matter.

 

Once the I-129F is approved, the casefile is sent on to NVC then on to Manila IV, and once it's there, she has to pay in the PI and then self-schedule the appointment for a k-1 visa interview.  Once the I-129F is approved, there are visa application forms that she needs to fill out. 

 

Regardless, if she has overstayed past the last date in her I-94, she is subject to a 'bar from entry' into the USA, and the length of the bar varies by her duration in the USA after the I-94 expires.

 

Have a bar? Need a waiver.  Wait anywhere from 2 months to 18 months for the waiver to get approved. 

 

I suggest you refactor your plan, you are putting her at risk and you are in need of more information, then refactor your calendar based on the new info you receive. or get. or find yourself. 

 

Sure, there might be one plan that works without worrying about an overstay, and that's for her to get the heck back to the PI on Tuesday and you file the I-129F nowish.  Hard to be certain, as you are hesitant to give over a pertinent fact (when the I-94 expired).

I was approved by the USCIS (Feburary 5th) and I am still waiting to hear from the NVC. We already have arranged a wedding for July 5th and are unable to push it back with our vendors. Are we able to have a civil marriage and then have a religious wedding once we are approved?

For a K-1 visa chaser,

there is nothing to 'hear back' from NVC,

although you could call them and find out when:

--casefile hit their door

--casefile left their dock

--Consular Casefile # assigned.

 

Since it's February, and you've a plan in July,

given duration between timeticks in a timeline for a K-1 visa chaser,

 

 

I think you two would be OK simply waiting it out.

 

Whilst yer waiting, for the 'hear from NVC' bits,

I suggest you study how to do stuff with London IV [there's a how-to posted in the UK forum - have a read, when yer able] as it will help you gain a few weeks after the casefile leaves NVC.

Hi, so my fiancé and I got engaged over the holidays, and we want to have our wedding in Brazil where most of our family members live (including my fiancé....for now).  We've already booked the church and reception, and it needs to be during that time of the year for me to be able to get away from work. I almost have all of our paperwork to send in the I-129F petition for K-1 fiancé visa.  

 

Anyway, we were planning on getting the civil wedding done as soon as he gets here to begin the process of adjusting his status so that he can work/study.  The wedding is in late December in Brazil.  I assume that with the petition and visa processes he will only be able to come to the United States in September at the absolute earliest.  Would he be able to go to Brazil for the wedding and come back to the US if his status has not been adjusted yet?  Should we just do the religious ceremony first and get the civil part handled after the December wedding?

Here's a thought, instead.

 

get the civil done NOW in Brasil, since the two of you are still there,

and then file the I-130 into the lockbox/Chicago address,

chasing a CR-1 visa.

 

Sure, it means you get married THIS WEEK in a civil ceremony, but if'n you file on Friday, there's a chance of a different calendar.

The wedding date is December 26th.  I guess what I want to know is if it will still be possible to get the petition approved, get the visa, have my fiancé travel here and get married before December, go back to Brazil for the religious ceremony, and both of us return to the United States. 

 

I am not sure what the processing time is for the petition to get approved as I can't get the links from USCIS to open, but acquaintances that have gone through this process told me it took them 4 months to get the approval.

a Tier 2 Human™.  When the first human answers the phone, that's a CSR, a Tier 1 person,

and mostly, they are useless.

 

When the petitioner gets the first human on the phone, ask to be transferred to an ISO.  Tis not an easy thing, but an ISO has higher access in the system, the same level of access that anyone at a local USCIS office has.

 

CSRs are a waste of space, IMO, as they can only see what you can see online.

Here is the promised update ! My fiance finally went to his appointment with the USCIS in Atlanta this morning. He came back very very happy and satisfied :-) Until today we never received the RFE, the officer in Atlanta looked it up on her computer and said, yes, the RFE is in Texas and so many things can have gone wrong. And it would even for her be a hassle to get it. So she started telling my fiance about the I 290 form to reopen the case etc.....He told her that we already lost so much time now and can't effort to lose more. So she asked him when we wanted to get married. And he said : yesterday ;-) ok, she says , then here is your other option : Your fiance enters the US on her Visa Waiver along with her daughter, you get married and file immediately the I 130 ( Family based adjustment ) . People do that all the time. 

Those were her words, she gave him a copy of all the forms you need to fill out on a Family based adjustment and that was it. 

Now: I know that is possible but so far I thought you can only do that when you spontaneously decide to get married. We want to get married and I want to stay there and not having to leave again. I am a bit confused about this but we got this suggestion direct from a USCIS officer. 

Now I am thinking : why did we go through the K1 process in the first place ? 

Any thoughts or experience anyone ?

other option - unsure if anyone has suggested it yet:

 

call into USCIS, get an ISO.

Once the petitioner has the ISO on the phone,

ask:  "Do you have any returned mail pieces on me?"  

If the answer is yes, give over the correct address to the ISO, and ask that the returned mail pieces be resent.

 

Also tell the ISO that the RFE never arrived at your address via postal mail, and there was NOT any email notification about it and there was NOT any change in the online USCIS web porta about it either,

then ask the ISO to 'ping' the office that has the casefile, telling them the RFE never arrived, and ask for another attempt to answer the RFE.  

 

Then call back in 4 days, get an ISO again, and ask what the result was of that ping. 

 

Failing that, is best to get an Immigration Liason Staffer (this is a human that works at a Congressman's Office, usually in constituent out-reach) involved - is quite possible they can fix 'this' and get you a new time window to answer the RFE.

 

IMO, the infopass appointment was a waste of time and you needed a supervisor to go over the RFE stuff, instead of what actually happened.

Very positive experience so far. Very helpful, answers questions promptly, after-work hours to phone in case of emergency is available. He's done all the paperwork right. Sent our I-129F via Express. We got our NOA1 in Dec 30th. Waiting on NOA2 now. : )

 

Good to see that your lawyer forgot stuff and now you've an RFE to handle.

 

'Good' in a 'speed up process by getting a lawyer' -negative sort-of-way.

Once you have the GUZ #, study at CEAC website - when status changes to 'administrative processing',

that's the sign the consulate has the casefile, logged the casefile and has opened the casefile.

 

Once the casefile is opened by GUZ IV,

you and her can then set up an account at

ustraveldocs.com/cn

and handle the rest there, paying at a CITIC bank, then scheduling the interview.

   I'm writing this to gain your opinions of what I should do given our situation. My fiance and I received a, I-797 NOA in October of 2013 and we wish to renew our visa. Our deadline is the 2nd of February 2014 and we mailed a renewal statement via usps standard-mail to the Frankfurt office today. My fiance is in Germany right now and with the fast approaching deadline I am wondering if I should print a second renewal statement, sign it, and then  overnight-ship it to make sure that the document arrives before the deadline. Would it be worth it? 

 

 

There?s nothing you have to renew. Your petition is processing it automatically gets extended wherever it is in the system  while processing.

So no need to send a letter to anyone.

I am quite upset with my fiancé. He finally received his documents to come to the US on the K-1 visa. In his excitement, he accidentally ripped the envelope (the very important not to open one) on the side a little. I am attaching a photo (the plastic isn't important...just the tear on the envelope. Do you think he can enter with this envelope or do we need to get a new one....

 

He has a ticket for Feb 18th. I am hoping he can still come. I don't even know what the process is for getting the documents put into a new envelope but I have heard it costs something like 400$.

 

Any info or input on this would be greatly appreciated.

Honestly for Lagos you need 125%. Because when you get here and Adjust status you will need 125% and Lagos sees that.

 

I have seen some at 100% and asked to get a co-sponsor. So go with 125% to be safe. And its current and past also they will look at not just current.

This would be in China.  I looked up the China marriage act.  they require the marriage to be registered to be binding.  So am I safe then if I don't register?

 

See the issue is you really are married minus the paperwork. But you did the ceremony everything.

 

Like in Nigeria doing a traditional wedding you are considered actually more married than the formal "white wedding" at the church. It's all about customs and also what the CO thinks is up.

 

How is doing a ceremony walking down the isle having a reception accept you just didn't file the papers make you any less married.

 

And you ask "how will immigration know?" you would be surprised how many post on Facebook and send in their "wedding pics" or just in interview question say husband or wife when trying to get a K1. You aren't dealing with rookies here.

 

It's best to caution not to. Have a party a reception no ceremony. Just to be sure.

By any chance did you write a cover letter with your petition to withdraw the previous petition (just so that it's in their file). I wouldn't worry about it. I think you are find Canada is a pretty forgiving place ya know.

 

Just be ready at interview to explain good your have screen shoyts of conversation.

 

And for what its worth you are a brave woman to know a problem head on. I am glad you are posting about a happy new beginning instead of the other kind of post "Help I married my boyfriend who is trying to kill me he has PTSD". So good for you. Stay positive and it will all be well.

Hi everyone!

 

Our approved K1 petition has been sent to the Paris embassy but we wrote we wanted it sent to the London embassy. We half expected this to happen because at the time I was between homes so had to put my mums French address down, as that?s where I was temporarily living. I now live back in England. It would be no real inconvenience for me to have my interview in Paris as i could stay at my mums and this would save us the hassle of transferring our case to London.

 

Is it ok for me as a UK citizen to have my interview in Paris? And if so how does this effect things like my police check (do I get this from the UK still)? Would the medical take place in France too or England?

Thats why they sent it to Paris because you put a french address. They go by whats on the form. You can contact the embassy and try to have them send all of your casefile but be warned this has been tried many times and you are looking at months of delays and I do mean months.

It's not that INFOPASS is a magic thing. It's just a service request that you get to talk and see a live person.

You may get results you nay not. Hopefully you can address what the RFE is and maybe just maybe get a sympathetic supervisor hopefully that will give you leeway. Doubtful but you never know.

I would tell them everything you stated in your other thread about the tier 2 said they never sent out the RFE and to this day you have no idea what it is.

I would ask has there been any return mail for you in the system.

This is going to sound silly but what is this packet 3 everyone is talking about after the NVC? What is packet 1 and 2?

You are a K1 once you get case# NVC is done with you everything going forward is you and the embassy.

Since you have incorrect information (Unless you really are interviewing in Armenia) and no one knows your country I can't direct you too your countries portal here on VJ so you can see whats in the packet 3. There is no #1 and #2.

$3 is all your forms you need to complete some embassies have you return to them some you bring to interview. Packet for is the interview letter but you select your own interview.

i suggest you go look tat your countries info.

Please have correct embassy info on profile and timeline it really helps us direct you to proper places.

Ok so I worked three different jobs last year. I only work one job now which is a very-good paying job that greatly exceeds the 125% requirement. Here's my concern for two months last year I worked at a McDonalds (before I got my good job) so thats what i put on my job history. Well I went to get the tax return form for it and its listed by its Franchise name and not McDonalds. Will this screw things up?


Long as you have tax transcripts and its your name and ss#. I am a software engineer and a contractor so I work for Software Consulting , Inc. (they cut the check) but they contract me out to say Mcdonalds. McDonalds will never be on my check. But I have them listed on my resume and job history. You can always write a coverletter to explain. But it should be of no issue.

Like i said your tax transcripts will have all the information they need.

Are you talking about a police certificate? You won't need that until the interview stage, and the beneficiary is the only one who will need to have one.

 

Criminal report of beneficiary will be given at the interview. The  petitioners background check is done when you submit your application.

My fiancee will be coming to the U.S. on the k1 visa from China.  She already has her k1 visa in hand.   Prior to U.S. entry, we would like to go on a honeymoon to a few countries in Europe.  Rather than have to wait 3 months for Advanced parole to travel.  Would this cause any problems?

About a 99% denial with a active petition in system. But that's about anywhere but the VWP countries.

 

You can always apply it won't negatively impact your petition. Just be honest who you are visiting. Show strong ties to Nigeria and bring the NOA1 letter to show you are doing it the right way.

However, I was under the impression that only Deportations carry the consequence of waiting out a time-ban before re-entry? Am I wrong? My fiance was not deported. 

 

Overstays are only forgiven when you are married and the immigrant didn't leave the country. If you had married and he stayed and you filed there would have been no issue.

 

Of course it all depends also on how he entered the US. Was it legal with inspection and he overstayed. And if so for how long?

 

Let me get some expert people on this thread. One sec.

First time post-er here! 

 

I am the petitioner in currently pending K-1 Fiance Visa case. My petition was accepted to USCIS on October 31, 2013. Since then, I have been checking the status daily and have not yet received any notification for any Requests for Evidence.

With that being said, my questions are fairly straightforward and I will be FOREVER grateful to anyone and everyone who can help me answer them based on your similar experiences. 

 

 

 

1) Assuming,(and hoping and praying) that there are no unexpected delays or Requests for Evidence, are the USCIS estimated wait times (5 mo.) fairly accurate? This month will be 4 months since the acceptance of our petition. 

 

No. It's an average. I have two friends who filed last month and got NOA2 others filed last summer and still waiting.

 

2) Once USCIS has approved the petition and then sends it to NVC, how much longer can we expect to wait before my fiance is notified by the Nicaraguan Embassy for an interview appointment? (**Also, HOW are we notified about all of this? The mail/address system in Nicaragua is extremely unreliable, and I have dealt with plenty of lost and very delayed letters that I have sent to my fiance in Nicaragua. Therefore, I need to know if I will also receive any notices that are mailed out/ emailed/ etc.)

 

I would suggest you go to your countries portal on VJ and look around and look at others timelines.

 

3) Is there any possible way to go ahead and find out what specific documents, vaccinations, fees, etc. that my fiance will need to have ready on the day of his interview? It is my understanding that we (or maybe just he) will receive a packet from the embassy stating all documents that he will need. But i was just wondering if we can go ahead and start working on all of this, including having the money ready for any unexpected fees, in order to attempt to avoid being rushed to get all of these documents in order.

4) My fiance and I have been dating for almost 2 years, but we met in the United States. He was here illegally, but was NOT deported. He left on his own good will to return to Nicaragua and to start the process of getting legal permission to be in the US. That being said, we were honest in our petition about how (and where) we met. Will his previous unlawful presence in the United States disqualify us for this visa? I would like to go ahead and know this now, instead of getting all my hopes up and being extremely disappointed later. 

 

Yes he will have to serve out a ban it could be 5 years it could be 10 years and than you will have to have a waiver. I would seek a lawyer now.

 

I believe these are all my questions...again thank you to whoever is taking the time to read this! I am a little frantic and overwhelmed with all of this. And just want to make sure I do everything right in order to avoid careless mistakes and a denial for any of my filing errors.
