usually that form is listing K-2 eligible children. IF they are over the age of 21 on the K-1 interview day, what's there won't matter, as the children are ineligible for K-2 status.

So, further down the road, the children will come in based on the foreign spouse's status in the USA, and not anything on the K-1 form.

How 'good' friends are these? If they are the ladies from the 001 BBS, disregard advice from there.

Maybe as soon as 7 months, as well.

Sorry yer just learning of the timelines, though.

AFTER she has VISA in the passport, she has up to 6 months to come into the USA -
so can she go to Nigeria prior to coming to USA, after VISA interview? Absolutely !

Suggest you review the P3 shortcut also at http://www.visajourn...GUZ_P3_Shortcut as it shaves off about 3 weeks of dead time.

Exactly by calling them and providing the USCIS generated case number. When the case gets to the Consulate... you can call them.. or email them to ask if the case is there. There is a way to TRACK the case when it is sent from the NVC to the consulate.


Do not call the Consulate - they are useless, and unable to reach via telephone - with an email lag of about 6 weeks.

This is a grown up conversation!
So I have noticed that some fiance' visa applicants are asked about having sex with their partners and are asked to produce intimate photos. While some folks do have sex, others think its bad form to have sex before marriage. This doesn't seem to vary by nation but more perhaps by religious proclivity.

How can consular officers ask about or expect that those of us in Fiance' relationships will have had sex???
And honestly my sex life is none of their business, but I'll answer the questions if it gets my fiance here. I think it borders on cruel and unusual punishment.


OK - I've read the link. That couple underwent a mini-stokes interview, because something was found during the background investigation.

When a stokes interview, or a mini-stokes interview is started - these types of questions are not only allowed, but are a 'given' - expect some harsh stuff.

The anomoly is that it was a mini-stokes interview at a US Embassy for a K-1 visa - many times, instead - these are done at a local USCIS office in the USA for any 'adjustment of status' or 'removal of conditions' interview.

IMO, something was wonky with that casefile, and the background checks found something untoward.

Do you fit the profile of that OP? If so, expect same treatment. If not, don't worry about this stuff.

Finally, to wrap up - THEY WEREN'T ASKED FOR PHOTOS of INTIMATE MOMENTS - they were asked about the intimate moments, instead.

well i spoke to a couple of ppl at my job that works for immigration and they said the stokes interview is for ppl that are married. and the reason ewhy they want the petitioner there is to see how we react with each other in the waiting room and to see if we are actually willing to travel on such short notice for the one we love. They also said they do ask questions but its basically regular questions UNLESS they think its fraud. which i doubt because they didnt even ask him any questions when he was there. and also i noticed that everyone who did the 129f in HAITI was called back. so ill just wait and see. i love my mr enough to be patient. and i will not hesitate to ask for a super visor if there are any problems.

Usually it's the 'signature confirmation' that trips em up,
not 'delivery confirmation' (which requires no signature)

Unsure how Ghana works -
but for CHINA -
The interview isn't scheduled until a piece of packet 3 is returned to the IV Unit, usually OF-169.

That's the visual clue for the IV unit that the Visa Applicant is ready to be scheduled for an interview.

Without it, no scheduling.

Perhaps Ghana works the same? Suggest your K-1 beneficiary scan all pages, email to you, you review the main instruction sheet on 'what to do'.

Sorry - K-1 visa holders cannot directly participate in Electronic Processing.

GUZ-bound casefiles, for K-1 visa types - about HALF are transmitetd SOLELY VIA SAFEFILE (the e-transport system used for CR-1 EP processing) but you have no input, at NVC, over whether or not your casefile will get tagged for SAFEFILE SOLELY or not.

The 'other half' get sent in via DHL - expect a 2 to 5 month wait.

About the only speed you can hope for is via the P3 shortcut - see http://www.visajourn...GUZ_P3_Shortcut

and set up yer phone calling patterns - see http://www.visajourn...he-nvc-and-dos/ - Dodi's posted how to call and who, further down, I've posted what you can get, and when.

The problem with the AVR at NVC, is that it never holds the NVC casefile numbers for K-1 visas - you'll have to call in, get a Human, inquire for casefile status with the USCIS receipt # - they can give you the GUZ casefile number - so call in, Get a Human™.

As long as she's in the USA prior to the visa expiration date, she's OK for ENTRY.

Once she's ENTERED - she has to pay attention to the dates on the I-94 document, not the VISA stamp.

ya, when you send in the son's paperwork (prolly now with a new version of the MOMs)
ask for expedite - use words 'K-2 potential age out - PLEASE EXPEDITE'
in red letters across the top and bottom of all of the forms that you send back to GUZ IV (from the P-3 packet)

Also put that wording on the outside of the envelope, in RED letters.

GUZ IV will actually move along faster, with that phrase everywhere, and YOU ask for earlier interview date via email, as well.

find out exactly the casefile status between NVC and DoS.

IF GUZ IV has opened the casefile, you've a shred of hope.
If GUZ IV has not yet opened the casefile, then there is good chance that the casefile was NOT sent over solely via SAFEFILE, but - instead, was sent out via DHL, and expect a 2 to 4 month wait for the casefile to get opened at GUZ IV (there's a China Customs Clearing issue, slows down all paper files going into GUZ IV by 2 to 4 months - it's not NVC doing it, it's the China Government)

There may be some shred of hope if/when DoS hotline tells you 'P3 sent out' - you can then use my P3 shortcut over at http://www.visajourn...GUZ_P3_Shortcut

but even then - that AOS has to be filed as soon as yer married in the USA - can get some speed at USCIS if you write 'K-2 POTENTIAL AGE OUT - please EXPEDITE' - USCIS is pretty good about handling this type of expedite, IFF (IF and ONLY IF) you mark the outside of the envelope in red marker, and cover this issue in the 'cover letter', asking for the expedite.

So, on Monday, call NVC and DOS, find out the casefile status.

Then post back here - I hope you have some joyous news (P3 sent out).

re: attornies - hey ! Welcome to VisaJourney ! This is a great 'DIY' webportal, for immigration 'stuff', with an emphasis on 'D' and 'Y' - many of us here do not use attornies, feeling that it's enough to read the instrutions on the forms, map everything out, read the VJ Guides, then ask questions here at VJ when stuck. Usually, those that use attornies fall into 1 of 2 camps: 1) felt innundated by the forms, or 2) have serious, real-world 'red flag' issues that a competent immigration attorney could help them overcome in the initial packet submittal. (there's a 3rd category - those who didn't know about VJ and engaged an attorney prior, then found VJ after initial submittal)

re: interview 3 to 5 months away from initial filing - hmmmm - I suggest more like 5 to 11, not 3 to 5. If you filed prior to today, then 3 to 5 months may be a reasonable expectation.

re: income - ya, self-employed, Schedule C people, it's always fun, yes? on the flip side, if you truly wanted to show 'positive income' for prior years - you could file amended returns for prior years, reduce some of those expenses, show positive income (and pay prior tax due) .

I am trying to decide on the best course of action to file a I-129f for my Chinese fiancee. I am a USC, She has a 19yo son who wants a K-2, I am aware of the age out issue, so time is of the essence.
My problem is that I am unemployed and have been since 1/2009. I have read the forums and understand that the UI$ is appropriate to enter on the G325A and later the I-134 (AOS).
I don't want to ask anybody to cosponsor and I don't have the assets for an asset based sponsorship. I know I need to find a job, and I assume I will. My 2007, 2008 tax returns are over 50k income so that's not an issue. 2009 (and later 2010) is over 30k, however its mostly UI$. I assume if I file now, (consulate interview in 2011) the support income basis will be 2010, 2009, 2008.
I don't know if it's a good idea to file (I-129f) and just deal with RFE's and red flags. I want this to be a clean process. I think we have all the other docs/proofs in order.


At this point I have four questions:

1.) If I file the I-129f now, showing currently unemployed on the G325, will the petition be denied stateside before it is sent to the Chinese consulate in GZ?

2.) If the petition gets to GZ will it be denied before an interview is scheduled with my fiancee?

3.) I heard from a knowledgeable member that it is possible to delay the GZ interview for up to 1 year after the petition gets there.
How is this accomplished so as not to raise any red flags?

4.) Assuming I get a decent job, is the 2009 (and 2010) tax return showing mostly UI$ a problem?

I would appreciate answers from people who have dealt with this UI$ issue.

3. ask for it, via email, to http://guangzhou.use...t-question.html - but it must be asked for, in 4 month blocks - ie - first block - when P3 is received by foreign fiancee - ask for it then, do not return I-169 and DS-230, then 4 months later, ask again.
4. no, but - you MUST show the income - it may or may not be reflected in the income tax return, but it is shown on any 'audited income statement' that a CPA might prepare on your behalf.

Basically, I'm suggesting that you file this week, regardless of 'todays income' as
yer current income will be evaluated on interview day, from the I-134, using the guidelines in the I-864 and I-864-P.

IMO, that's anywhere (from filing date) between 6 to 11 months (without asking for extensions at GUZ IV) - SURELY you can get a job, get some income, during that time? If you need to offset income with assets, study the instructions on the I-864 about asset computations, as well. If you feel, on 'packet 3 arrival date' that you won't meet the qualifications - then secure a joint -or- co-sponser.

Good Luck - whatever you decide to do - IMO, that clock is ticking because of the K-2 on the son.

ah - it's not 'NVC to GUZ IV' for the P3 shortcut,
it's
GUZ IV Mailroom tags the casefile as 'P3 sent',
which implies/means

casefile made it to GUZ IV from NVC
and
GUZ IV OPENED THE CASEFILE, prior to any P3 mailroom activities with GUZ IV.

The P3 shortcut is useless UNTIL , after a phonecall into DoS Hotline (get a Human™,la), the TeleOperator mentions 'P3 sent' for casefile status.

IF you send the P3 package in prior to GUZ IV tagging the casefile as 'P3 sent' - I can't begin to guess what might happen, except to say that GUZ IV is NOT waiting on the P3 from you, prior.

Here's the timeticks, as I know them (these could change, also)
NVC sends out casefile to GUZ IV *
GUZ IV receives casefile
GUZ IV OPENS the casefile

If Not, then it goes out via DHL, sits in a bonded warehouse in Guangzhou for some time, then something happens, GUZ IV retrieves the casefile from the bonded warehouse, it gets INTO THE IV unit, and the casefile is officially 'opened'. IF SAFEFILE SOLELY, casefile is transmitted electronically, GUZ IV 'opens' the casefile within a week of 'NVC OUT' date.

(( -> GUZ IV mailroom ops are mostly 'black box', but - the 'P3 sent' tag is made prior to the P3 actually leaving the GUZ IV mailroom. Since the time delay is real, assume is some bundling and printing and insertion, then it sits in the mailroom for a few days after, waiting for EMS delivery truck to pick it up. Expect a 2 to 3 week LAG between 'P3 sent' timetick and the P3 actually arriving in the beneficiary's hands.
