then send it usps priority mail - purchase postage online and you get free tracking at usps.com   - you want to purchase signature confirmation as well - so keep that in mind.

IMO - is useless to list them - as they are not using the same immigrant benefit and not holding the same visa type as yer lass.

if you want to fret - get on the plane already and have a buddy or relative get the long form version - scan it - and email it around,

as

the IV unit will take a copy of this - not need to see the petitioner's original birth certificate.

 

But - if USCIS already approved the I-129F petition - I say it's a moot issue, as you've already proved up yer USCitizenship status with them, prior, some way, some how. And They Liked You !

My mother makes, $45000+/year and my stepfather makes $41000+. On the I-864, she put herself, my stepdad, and my two siblings and of course, my boyfriend, 'cause that's pretty much all there is to it. My other brother lives with us, but is independent in terms of financially. Well, he barely lives with us.
 

 

This is the problem. You said she just listed 4. She forgot the uncle and cousin they will be counted in the household for immigration purposes for the next 10 years. So thats 7 people she needed to total up to. Your steofather doesn't meet the guideline and she is barely over the guideline. They need to combine their incomes to meet the guideline.

But, she wasn't even the primary sponsor, she was just a secondary sponsor just to have on paper that they will not be public charge. They're not even here in ATL, they're in LA. There's only 4 of them that she put on the I-864, that's living in the house. My brother and I just live there, we're independents. My brother barely lives in the house. She doesn't declare me or my child on her taxes.

 

But how come, my stepdad? Since we submitted separate forms for him as a co-sponsor, how come they didn't take him?
 

Okay I count 7.Am I wrong.? And you are the primary sponsor anyway.

 

You said Mom, Stepdad, 2 siblings, than there's cousin and uncle and fiance' thats 7. The guideline is $44512. So I think this is the issue. Mom is barely over the limit and stepdad doesn't have enough. Or did they combine their incomes?

 

Did you use both their incomes or just mom?

We were looking at the 125%, I didn't know there was a 100% guideline? We submitted my mom's and stepdad's, and they both meet the 125% guideline. We also submitted I864's for both of them. I just don't understand. We all put everything out already.

WOW I am at a lost than. Do they meet the guidelines for current and last year? I know CO's can be picky with this. In Nigeria they deny all the time if co-sponsors didn't meet guidelines last year but are cool currently. Go figure.

 

Can you maybe go to embassy and see if you can talk to a CO and get some clarity? I am sorry..

So, I got an email from my fiance's mother this morning saying that I need to call her husband ASAP.

 

I called and I couldn't understand why he was proposing to me that we (my son and I) need to go back home to the Philippines. So I called my fiance's mother and ask. Apparently, they got an email two days ago saying that the visa is refused again, and on the document, the one that is checked is, "You have not established an adequate financial blah blah blah", when I have sent a letter, and pay stubs from my second employer this time around. Included my mother and stepfather's I-864 and I-134, tax papers and pay stubs.

 

My question is, is it even possible for them to refuse the Visa without putting it on AP/AR? Because ever since we submitted more docs, I have been checking the status to see if it has been updated, and on the 15th, it was updated again to Refused, but I thought someone just touched it, not reviewed it.

 

What would be the possible reason why we keep getting refused, when there are others who are getting approved under SS, or no annual income and stuff like that?

 

Since we're refused, it is possible to apply for IR1/CR1 right? But I am really getting discouraged. I don't wanna apply if we're gonna go thru this one more time. The wait is long, the money doesn't just grow on trees. #######?!?!  cray5ol.gif cray5ol.gif  cray5ol.gif

 

 

Let me ask your co-sponsors do they meet the 100% guideline or the 125% guideline? I hear that for many they want to see co-sponsors meet 125% and it helps to have not just I-134 but also a I-864 which is a contract and binding. Maybe that will help.

It's very very unusual to be engaged (I know they do a big ceremony in Pakistan for that) or even marry without you even meeting the family first. That there is a big red flag.

I know someone there man has been a user for over 20 years and just quit before medical. Doctor said no issue no problem. Now we will see if interview flies. And this is an avid user who said he quit because he is immigrating.

Its very subjective with certain countries just more strict. No one knows what the CO is writing in the notes either. They may tell you anything and say all is fine and it well maybe but CO has final authority.

If found out you would be denied then have to start the whole process over filing a CR1/IR1 which is taking well over a year.

If my (parent's) permanent address on the I-129F is in Florida, but I have very firm plans of moving to California once we have approval, is there a way of letting the immigration officers know that so we can ensure it's processed in the California facility and benefit from the faster overall processing times? e.g. Can I just write a 1 paragraph note and attach it to the form to let them know our intent to move to California if approved?

 

Or is this out of our control?

My fiance and I are in a bind. Our financial situation is not good. I am a college student about to graduate with a Bachelor of Science in May and finding a full time job will be very hard to do. I could work a few years in fast food and hope I am good enough to get a manager position at full time but I really don't want to wait so long for us to be together. Everything else in our application looks great. My dad refuses to sign the affadavit of support as a cosponsor. My uncle might sign and I have a friend who will sign for sure. But I don't think that a friend looks that great? 

 

So here is my problem. If I cannot find a full time job, I will be enrolled in a Master's program where I can take out loans for living expenses, as my tuition will be free because I did well in my undergraduate studies. With these loans I will have more than enough money to support my fiance and I but it just doesnt show that on paper, as I will not have a full time job to show for. I will only have a cosponsor as a friend. My fiance is in Egypt by the way. 

What are the chances for our denial and what can I do? I don't want to wait my life away getting a master, finding a job and after 10 years finally being with my husband. :(

 

You can't qualify on loans. Loans are not income. If you have a friend that will sign by all means go for it.  It's a I-134 and not binding anyway. It's when you file your AOS (Adjustment of Status) after you marry you will need someone to meet the guidelines and they will be committed for 10 years, or 40 quarters of work or until they become a citizen.

Hey everybody, this is really four questions, if you have an answer, that'd be great :) our I129F has just been approved, what's next?

 

1. Will the petitioner received a package that he has to submit (our read that somewhere....but then I couldn't find where, so maybe I was just dreaming) or will the petition just go to NVC and then the embassy?
 

2. How can we follow our petition now and check where we are?? Will updates be posted on USCIS.gov??? 

 

3. Anybody from Germany, after your I129F was approved, how long did it take to get to the embassy? Our I129F took 5 months already...can't wait to move on.

 

4. How do we even know our petition arrived at NVC? Do they send an email or something? We haven't received email when I129F was approved, that was exactly a week ago.

Okay asking for a friend. Long story short interview today was late and they  wouldn't let them in. Now getting mixed explanation on what to do.

 

Here it is:

 

The manager at the embassy said that they have two option.

 
  1. One is he can wait for the embassy to give him a date which can be anywhere from this week to two months out its at there discretion. And once its given it can't be chanced period. So no going on the computer and upping the date if there is none closer or
  2. Or we can pay the fee again and get the date on the computer and if a date comes closer then we will be able to change it.
  3. Now were told that the money we paid would be good for one year and can be used for his interview date. But I was also told that we have to wait for the CO in Lagos to release the docs before we can schedule and pay for a new date.
  4. Which conflicts with what he was told at the embassy.
 

So does anyone know the protocol of missing a scheduled K1 interview and how to go about it?

 

Do you have to pay the fee again or what?

Hiiii!!! My fiance was married to this woman, and they were legit, the only thing is that she was older than him and she had tried to file a petition for someone else before him but it was discovered that she did it for immigration purposes therefore SHE, the USC was redflagged at the embassy.  Then she married him (my fiance) after a few years and this time it was for real, not a scam marriage. Well, they went to the interview and were asked a few questions and it seems like they were approved but then, they asked her about his daughter, mind you, she dislikes the little girl< for what reasons, I have no idea, so she never had any contact with her so she knew nothing about her.  To make a long story short, he didn't get the visa that day and they sent an intent to deny letter asking for more proof of a bonafide relationship.  After this,he found out his wife had been living with another man here in the U.S. for months while making him believe she was by herself here and he decided to end it with her and cut off all ties (then I met him! he was still married but hadnt seen her for over a year :) ) but she submitted the request for more evidence, but they still didn't get approved and his I-130 got revoked, good thing he didnt get any fraud in his file, just a revocation of the I-130 that was previously approved...Also, I was married before for a little less than 5 years, I got my ex husband his greencard, but after a few months of getting his permanent card, the 10yr, he started changing with me, treating me bad, and cheating, so I decided to leave him.  Do you think I'm going to have a problem now that I filed for fiance?  I filed for his k-1 and got receipt date of April 1st, 2014 at the TX service center... PLEASE HELPPPPP!!!! Im also hoping for a fast approval at TSC, I have seen people get approved in like 45 days!.  Our relationship is definitely legitimate, I been to DR since March 2012, 6 times to see him and he has met my family, I have met his family, his daughter, he's met my daughter, we tango, whatsapp, and talk on the phone 24/7 we have millions of pictures, i mean we know everything about each other but I dont want that previous petition to cause us any problems! Please guys, let me know what you think!!! oh, by the way, our embassy is Dominican Republic, yeah I know a high fraud country... :(

 

I would seriously have a consult with a very good attorney that knows DR. I know you work for one but to have fraud markers on both sides and he being revoked just last year man doesn't look good at all.

 

And the way DR questions both parties just be ready. Good go easy or hard but be very prepared for sure. I be abit worried to say the least.

This is my take. The Immigration process is really about paperwork and patience and time. Lawyers by and large DO NOT do paperwork. The paralegals and legal assistants in the office do. And yes they make more mistake then the average person.

 

For some reason people think because a lawyer went to law school and took a immigration class or is even a immigration lawyer they know the process. A immigration lawyer is about the law. This process we are in is administrative at best (unless the law is involved, waivers, criminal records, etc..).

 

Wish we could get a lawyer to make it faster more "legal. And by that I mean like a embassy in Lagos that you will be going through many get denied and do you know those denials are totally illegal. But we just take it up the a$$ every time. Do you know when you are denied a Visa at interview a CO is suppose to give concrete verifiable proof of fraud or misrepresentation.Not "I have a feeling', or "I don't think you have proven a bonafide relationship or marriage". :ranting: :protest:

 

Some people have been blessed and have had good lawyers that keep them posted and take the stress and strain off them (How being less stressed not knowing what the heck is going on is cool for you. Go for it).

 

The problem I see with most lawyers dealing with a Lagos, or other difficult embassies is they are clueless to the embassy. A embassy in Montreal or London is not Lagos. Far from it and most lawyers will be dumb enough to say you need not submit evidence with your petition. They say bring to an interview. OMG for real!! :bonk: :bonk:

 

Most lawyers do not stay on top of current changes. NVC has changed forms and policies twice last year and caught alot of people off guard. But those on VJ were on it, read up kept in touch and were able to avoid alot of issues.

 

So that's my PSA. And no I am not bashing lawyers I am starting Law school myself in the fall to be the best immigration lawyer in the world.

 

But know this, be aware and know, no one cares more about your case than you.

 

Yes it takes tenacity, and much diligence and patience (and prayer). But research, reading, FOLLOWING INSTRUCTIONS is all that is needed to get through this process which is 25% paperwork the rest following direction, waiting, waiting, patience and  prayer. Did I say waiting and patience. :rofl:

Interesting. The specific advice from the London Embassy was that I could not book a B2 interview whilst my K1 interview appointment was pending. My medical is next week and readiness is done so I expect an interview by early June at the latest.

In any case with the likelihood of getting a B2 whilst in 'immigrant intent' status under the K1 appears low,I am probably looking at a waste of money. All I can think is: my fiancé is worth it.

Yes,I have visited her twice now under VWP although I now realise I have answered those questions incorrectly. I have that to answer for at any visa interview,I imagine.



 

One thing I would also add is when you do get your interview date you can always request an earlier date. London is pretty accommodating and you may get it.

 

One of the people on my thread had a May 28th and requested earlier and got May 5th so that is an option when you get to that point.

 

And also why not apply you may get a B2. It doesn't effect your K1 so why not go for it. If you just can't wait.

No you can't fill out until you have been approved USCIS. Sent to NVC for case# than off to your Embassy for processing. But you can prepare. And get ready and sure download the form and have it ready. Things you could gather now.

What are instances that a K1 application gets denied?

 

 

  1. Petitioner doesn't qualify to file (criminal record, etc).
  2. Previous filing of petitions was not withdraw.
  3. Exceeded the 2 K1 filing limit.
  4. Couple didn't meet within the 2 years of filing.
  5. One of the parting not free to marry at time of filing.

Hi, I am from Ghana but I live in Greece. I use to have legal papers with which I live in Greece but right now I do have my papers but my passport only. Can my fiancee who hail from the United States, file a petition for me to join her in the united states; will I be issued a visa to join her despite the fact I do not have legal documents to live in Greece? We have met three times in person and I want to know if she can go ahead and apply for the fiancee visa petition. 

 

Sure she can go ahead and file for you now. But you must use your Ghana addresses you will not be able to interview in Greece because you have no legal right to do so. So when the time comes for interview you will have to return to Ghana.

 

Your illegal status in Greece has no baring on whether the US will grant you a Visa to come or not.

That's really all that matters so when asked if asked at interview all is well. I see no issue really.
