The 'clerk of each court' can handle your request, some have web sites where you can order online and it's mailed to you
or you can find out the proper way to order and pay via postal mail processing via a telephone call.

hindsight is painful:
1. always ask for an interpreter
2. she should have stayed in the 'holding tank' with CBP - at least she would be IN the USA, and the procedural errors could have been fixed the next week, with an easier outcome.
3. the CBP officer 'grilling' her , was out of line. You (and anyone else) can't see this in real time, so keeping her in the country would have been useful to 'fix' this fella's procedural errors and uncover other silliness and stupidity.
4. Her lack of English? that part was taken advantage of, she was quickly sent elsewhere.
5. the airlines were trying to coerce the man into paying for the ticket. Not paying for the ticket would have been a good thing, as it forces more review of all.

I'm truly sorry this happened to your lass.

Trying to figure out if I can apply for a waiver or do I start all over again. They would not let her in and told me they cannot offer me any legal advice on what to do. They told me to go home.


If 'they' = CBP staff, well they are not to offer advice to you. However, you can get a boss there, and find out what happened with HIS STAFF MEMBER, suggesting that his STAFF member needs to be tested for drug usage.

This 'thing' , this occurrence, what happened to your fiance, is not normal. For it to happen, one of several things must have occurred:

1. CBP got some electronic notice from the IV unit that something wasn't right, and did their process to find fraud at the POE, via questioning process.

2. CBP officer that interviewed her was on drugs that day.

3. CBP officer was poorly trained, not knowing squat about K-1 visa intake

4. It was time for a secondary interview - there's some percentage of incoming immigrants that ARE taken to secondary and grilled in this fashion, for no other reason than this is part of the job.

Now, I'm not a lawyer, nor do I play one on TV - but (IMO) somethinng is terribly wrong at CBP POE, nothing was wrong with your fiance. So, have a think, and start to formulate your next steps. At a minimum (again IMO) , you should file a complaint on that CBP POE officer, and you should talk to the boss, and you should ask that the CBP POE officer be immediately tested for drug usage, and the call DoS Hotline and inquire for casefile status on your fiance's case.

In the end, if you can prove up 'procedural error' and quickly, she might be allowed to cross into the USA again. But you've some work to day, on Thursday.

The person interviewing was using scare tactics. He asked her to describe my house. He proceeded to tell her that he was going to send police officers to my home to see if the home description would match. He then asked her if all the information was true in our application. She started to talk and I have no idea what happened but they sent her back.

My fiancee is not fluent in english, so I think that the word police and arrested threw her off the charts.


Everybody has a boss. suggest you contact the assistant boss at the CBP POE and file a formal complaint. This 'fella' was doing it wrong, for entrance into the USA for a K-1 visa holder.

no, no greencard after entry. Nothing automatic like a CR-1 / IR-1 visa holder.

only way to get a greencard is to file the AOS package.

So, lets say she arrives, you live in the mainland, marry in the mainland,
then move to hawaii and file the AOS package from there.

Eventually, the green card will show up , to the address used in the I-485 form.

Now a suggestion. I suspect you both will want to be "back home" as soon as possible, but have you considered taking your time doing this? She will be arriving in NY, one of the greatest cities in the world ( I am a New Yorker :) ) so why not take a day or two to see this city? The ride back to NC passes our Capital, and can be a great time to talk in the car while driving through some beautiful countryside. When will she have the chance to do this again?


Extend it for more than a day - come on - take an entire week and really explore the city ! You may not have time (the OP, rather) once she's actually back in the Carolinas.

ONLY IF you can get into the Super Secure International Arrivals Area in the airport. It's do-able, but you must write a letter to CBP JFK to ask for permission to meet yer lass INSIDE of the International Arrivals Area at the Immigration Lines. You should be able to call in to CBP JFK and inquire the name of the site supervisor - you'll need to address the letter to him.

Then ya wait for his written response. Figure up to 3 weeks for the turn-around, this postal exchange.

Well, I posted a whole interview with a USCIS director which is still pinned at the top of this forum. As mentioned, adjudicators open boxes which are placed in their cubicles and adjudicate petitions. What could prevent a petition from getting to them would be unknown to them. They open boxes and adjudicate. Nothing else. So if I ask them, and I have, what couldsomeone do to SLOW the process, the answer is... :unsure: Except, of course, not having a complete petition.

Country of fiancee generally has little or no effect on the PETITION. It DOES have an effect on visa issuance (Department of State, not USCIS) and this is also covered in my interview (briefly, the man I spoke with is not from DOS). It can also have an effect on the AOS process. High fraud countries are looked at with more scrutiny. He did mention some areas that are considered "high fraud" and why. It is not always what you think.

As for the petition, SOME countries generate more background check "hits" than others and these require a manual background check done by the FBI. Many of these are because of common names. The FBI has a presence in the VSC so their are FBI agents on site to do this, BUT many times information from other countries can be slow in coming.

NO, I do not have a list of which countries have more problems than others. Read the pinned topics at the top of the forum. they are there because VJ thought they were particularly valuable




I read the interview and followup questions (actually read the whole thread from first to last comment. Phew). I guess for someone like me and my husband going through the "#######" embassy in Lagos its just hard to know what to front-load and what to keep. I know the USCIS and NVC could careless about 1200 pages of emails and phone records and IM's but I have read on too many interview reviews people were loaded up going to Lagos Embassy and never ever even asked for a piece of evidence just asked questions and when they ask "would you like to see this or not" refused. So I say load up that baby. But to a point. I don't really think my 759 pages of Facebook emails proves anything except we talk a hell of alot.

And whatever you do people listen to Gary, TBoneTX and many others. They may be tight but they are right. They are not the enemy they are here to help us. Who knew such a priceless site as this existed. It should be required on all forms to have to be a member before you file. Sure could save alot of grief in many cases. There is a tendency on this forum to brag about what little evidence people provided and still managed to get married. If I had a nickle for every time I've read "We only enclosed two photos and a single sentence stating that we met at a bus stop" or whatever, I'd have about 75 cents. Even though the OP's thing is longer than needed, it'd be pointless to revise it to make it shorter. Having it be that long isn't going to hurt him at all. Don't worry about the length of yours.

Amen Mike B so so true. I so wish for Nigeria we just had to show a marriage certificate a picture or two and say give us Visa. We both wrote Letters of Internet (we are married) mine was 4 pages his was 3 pages. Our Relationship Timeline was 3 pages. We did all this by advisement of a lawyer and that is to deflate our red flag which is me (the USC woman) much older than husband.

Well the red flag really is no issue now (yes I am still older LOL) but I stayed with husband 6 weeks before marriage than stayed 6 months in his country.

It is disheartening people telling someone something is too much. Unless you know specifics of the Embassy why would you say that. And worst case they just won't read it. But return to bottom of pile, or throw away. No way.

Do keep to the facts of your timeline meet requirements if you need more room by all means what is wrong with an attachment. Unless you see PLEASE DO NOT ATTACH ADDITIONAL STATEMENTS. do what you need to do. IMO

What I have deduced reading from my regional board and reading thousands of these post. its all embassy specific to front-load. My husband is Nigerian High fraud country means put your best foot forward. I gathered everything that showed we were building a relationship and marriage. 29 pieces of evidence that amounted to 219 pages I sent in.

And although we are married we were advised to both write letters of intent. It doesn't hurt. We got that consulting an attorney and we also wrote a Relationship timeline.

For many of us going through Lagos Embassy in Nigeria they never got a chance to show any extra evidence. They thought front-loading wasn't a good thing. And advised to save extra evidence at interview. The decision was already made before the interview. So why not front-load. If they read all or some great if not at least it was there. It's not like it will hurt if you present extra evidence or write a longer letter than what others did. It's your story you have to tell some couples stories are easier to tell and have a easier path. Just saying.

Can I just caution you that when you read post, remember its there story. Even if there are post that warn you. Otherwise you will start internalizing everything and second guessing yourself and thats not good.

Just hold on to all the WHY's you want to be with your hunni. And you will weather through it all. Thats what so great about VJ here. You will find many friends. People from same country as your husbands that can tell you the in's and outs specific to his country (so helpful trust me).

So buckle up, smile laugh get a hobby and d have fun. Soon you will be the VJ expert people turn to.

The evidence is all couple specific to embassy. Since Nigeria is the visa fraud capital we are all under a BIG microscope. They already are looking at our relationships/marriages as shams to get a visa so we have to show evidence to the contrary. Now be sure to address your red flags if you have any. Listed are a few. If you have these just be able to address them honestly and have proof, evidence to quash it. To raise no doubt what so ever.


1. Significant age difference.

2. Relationships which are less than 1 year old.

3. Discrepencies between the information provide in the forms and that obtained during the interview.

4. Failure of the applicant to demonstrate knowledge of basic information about the petitioner.

5. Recent divorce.

6. infrequent visits

7. Not staying long on visits

8. Marrying first visit than living

9. Not wanting kids.

10. religious difference

The better you know each other, the better. We searched for all the interview questions we could find in various posts about interviews on here and other sites. Each week, we took around 10 or so and each mailed our answers to the questions and then discussed them. To be honest, it was fun and gave us lots to talk about. This prep helped him to answer the questions he did get in his interview without any hesitation whatsoever.

On another note, an international postage stamp from the US is 98 cents. Take the tiny effort to mail things sometimes. Physical evidence is a good thing. Plus it is delightful to get something in the mail. I know very well how easy and modern email/chat is but it is not gonna kill anybody to show some love and spend a buck now and then. (I sleep with his Valentine's card on the table next to my bed every night. Before that, I slept with a different card that he sent. We did this about once a month or so. His cologne is a very nice touch, too. There is nothing romantic to see about a chatlog on display and it is not a very romantic keepsake.)

I provided my fiance with things to make the interview wait time a little less stressful also. In the clear pocket of the notebook, he had some gum (from the US--a subliminal hint that he could only have gotten this from me), some pens, Kleenex tissues, Chapstick, and a tny tube of hand sanitizer. I printed out some trivia about his new country, state, and city to read that might distract him a little. I wish now that I had also written a letter for him to open only during his waiting time in the embassy to tell him how much I love him and believe in him and all that mushy stuff.

Great suggestions but we are dealing with Nigeria postal service and you are lucky if you get mail from Nigeria or get mail to Nigeria. The best way to get things there and here are post cards. Still serves the same purpose just nothing for them to wonder if there's money inside.

We tried at the beginning of our relationship and none of his mail ever made it to me nor his families mail and my letters 4 of them took 8 months to arrive. So email , IM phone text and calls is the only way for most of us dealing with Nigeria.

But love the care package idea on day of interview. That is awesome thank you.

The Visa Petition journey is such a hands on experience with or without an attorney. Even if I had hired an attorney (did consult with one for free and got alot of good information and tips) I would still be sitting in front of this computer looking at everything, waiting, looking up my case number. I think for many having an attorney does give comfort and we would like to believe these attorneys know their "stuff". But too many are about the money and have no clue about the specifics of each and every embassy and that is so key. An immigration lawyer title doesn't mean they know Lagos Embassy, Pakistani, or Dominican Republic (to name some of the tough ones).
And a attorney sure doesn't constitute that love abounds more than those of us who do it alone. But I will say not knowing there's a Visa Journey this task can seem daunting, so for that I can understand those who rather go the lawyer route.
