K-1 Fiance(e) Visa Process & Procedures	Does Government Treat Green Card holders via K-1 route differently?	She keeps telling me women have complained about processes taking longer to complete, in situations of premature death the Green Card holding spouse would not receive the estate of the recently deceased the government would take their assests, and various other legal issues. This is true. There's been recent FEDERAL legislation to overcome this bit. Estate law is at the state-level - each state is different in it's application of stuff after death - this FEDERAL Legislation leveled the field, in an attempt for a green card holder (gotten after arriving in USA on a K-1 visa) to inherit properly. Regardless, a well-written will can trump much of that silliness. Much, but not all, as there was still some issue on taxation, which that Federal Legislation also sought to refactor. Ask her to study the K-1 flowchart here at VJ, then go over the K-1 flowchart with you. IMO, that's one of the better things to do when one isn't working - STUDY the flow of process, understand the steps, and understand about what a Visa Applicant can do in actually filling out the Visa Application Forms. Great and accurate stuff, but it doesn't apply. the TOPIC - When can alien fiance cut ties from financial sponsor? smacks of the Affadavit of Support presented at a K-1 interview at the IV Unit, on interview day. That particular Affadavit of Support is the I-134, and is NOT legally binding. IMO (and others) it truly expires when one of two things happen: 1. foreign fiance gets married to the US Citizen or 2. the I-94 issued at the POE expires. so, to the OP - remember..... Short on Cash? You are not in a rush to file the Adjustment of Status after marriage - so take yer time, build up yer financial portfolio - heck - even file a year later when your financial position improves after marriage. There is no regulation for WHEN you must file the Adjustment of Status for your WIFE after marriage, but you must marry within 90 days of her arrival in the USA (there's a regulation about that one bit) . OTOH, the I-864 used with the Adjustment of Status that you may be filing after marriage - that beastie is binding and has some rules to it for when/how it isn't in effect anymore. Then have her get the white books within 3 weeks of sending off the OF-169. and then when the interview date is set, do the medical and go to the interview. Remember - she has up to 6 months to come into the USA AFTER the interview date - so bear that in mind with her planning. Indeed, share that tidbit with her. So, really, in summation - DO IT NOW. K-1 Fiance(e) Visa Process & Procedures	Looking for Job while K1 Visa on Process. is it good or bad?	i got a question, if the beneficiary come into the USA and finds a job that just pays cash , almost like a under the table/once awhile job , can that be a bad thing if found out by the gov?? define bad? just assume that the beneficiary has no intentions of remaining in the usa. the cash earned would be quickly used for the return ticket. why to think this way? well, working without a ssn and ead/gc is really bad when attempting to adjust from a K-1 visa. get caught? can't adjust status, must to leave or face deportation or even an immigration judge's ruling.
