I have the NOA1. How will I know when its aproved ?



Have you gone to the USCIS.gov website and registered your receipt # (thats the EAC XXXXXXX). There you can sign up for email and text notification. Thats how you will know you are approved about 5 to 7 months from now. And of course the hardcopy notification in the mail at that point. Afetr that approval than you can call away to NVC.

Also you have to realize the adjudication dates are estimates here on VJ based on people who do file in timelines. So everytime someone inputs a NOA1 dates get pushed. BUt you still have a good wait ahead be patient.

Please Please Please what ever you do DO NOT omit any information that is asked. Time does not negate the fact. And you sure wouldn't want a RFE or be at interview and they pulled the information you omitted and ask you what about wife 1 and 2. No attach the extra page. Call, look up the vital information you forgot and be very thorough and honest.

Sorry, it didn't let me continue...

There are other traits to be taken into consideration such as:
religious differences?
finances?
educational level?
if the beneficiary has family or friends in the US?
if the petitioner transfers money constantly to the beneficiary?

and other common characteristics that may come into play. In fact, there's a petitioner from Egypt who went through all the process only to be a victim not only of fraud, but of domestic violence within 2 months of his arrival in the US. While putting her case together, she found out about the 20something y/o ladies he was already lining up.
This is NOT an isolated case. Unfortunately, it's more common than we think.

I do not mean to be intrusive but, is your 23 year old a female? If yes, be very ready for the CO to ask your fiance: how come you'll marry a lady who has a daughter your age? Rehearse, rehearse and rehearse.

you don't know that. plenty of women have given birth at the age of 45 and after. i understand the point you were trying to make, but you didn't make it correctly.

op - it is possible that the embassy will question your fiance's motives, considering that culturally speaking it is important that males are capable of having children with their wives. but this is only one potential part of the age difference issues that face MENA couples..they are obstacles that can be overcome with substantial evidence of a committed relationship such as multiple visits.


we have three visits and i am planning another before the end of the year. I dont know what we will do if this is denied, its so painful being apart and living by messenger , emails and the phone... traveling is so expensive and hard with my work schedule.. but even harder to be separated for so long. Its been seven months and I am just miserable without him.

Fab as you may be, you cant have kids anymore and that will be a MAJOR red flag.



My god how informative that was , the enlgish translation was excellent. I am half middle eastern and half american and I know the children issue is huge. we dont have an answer for this one. Just sad really as I would love to have his baby.

In MENA countries a larger age gap will often invite more scrutiny than in other parts of the world. And it seems that when the USC petitioner is a female and older it's even truer.

OP, do some reading in the regional forum to learn from other members who have married younger men in the region.

He has no children and I have four ages 23, 15 , 13 and 9. I know the scrutiny will be tough and I worry about him being nervous thru the interview but my evidence is completely rock solid. Will just keep praying.

I have. 19 years gap with my fiancé and it doesnt feel like it too. You're fine!! Yay! Congrats!!

Praying for a miracle and hoping someone out there has been in our shoes..

My love and i have been together for a year , madly in love does not even come close to what we feel. I have traveled to see him 3 times in the last 11 months , the first time in Oct 2011 for 5 days , than november 2011 for 10 days and February 2012 for 3 weeks. I have all the proof of relationship , pictures, emails ,receipts everything and anything. Our only issue is there is a 20 year age difference, god just writing that seems so odd becuase it really doesnt matter between us - he is very mature and i am in fabulous shape. Age is just a number and anyone in our company would be able to tell within seconds that its real and we just want to be together..... he is 25 and i am 45.

I would appreciate any feedback out there....

Was he actually arrested and convicted for the "weed" possession? If not, it won't show up, if yes, it will - as far as I know the best thing to do if "yes" he needs to be honest about it for one, and needs to get the court documents that show what happened after the conviction.

The speed fine does not count. I completed my police check 4 months ago, I had 3 points and £60 for speeding - which I indicated on the police check form - and my police check came back "no trace".

There is a two year rule but it applies to IR-1 Visa's, You must be married at least two years upon her entry to the USA. Then there is no AOS needed and her Green Card (10 yr.) and SSAN will be sent to her within 2 weeks or so. If you are married less then 2 years upon her entry to the USA you apply for a CR-1 (Conditional) and a AOS will need to be done at the appropriate time. I believ the Green Card is only 2 years under these visa's.

I'll suggest a coupla things, maybe (maybe...) help you to decide whether you need an attorney or not.

a. read the VJ guides. map the steps out on paper and pencil. See if anything doesn't make sense to you.
b. Read the USCIS web portal about the forms. Map out the steps on paper and pencil. See if anything doesn't make sense to you.
c. Practice filling out the forms, at least 5 times. See if anything still doesn't make sense to you.
d. Have any red flags? Practice writing up attestation letters about each red flag.

Now, after doing (with major emphasis on DOING ) all of the above, if you do NOT understand the forms and the process and potential red flags for your petition,

then I'd suggest getting a good IMMIGRATION lawyer. You are concerned with time, I am concerned with your 'knowledge acquisition', as knowledge is power. You can have 'it' good, fast or cheap - pick 2.

My petition was sent back to VSC, and it has been more than 120 days since they got it back to reaffirm my petition, my US fiancee is living with me in my country and we have been waiting on USCIS online status which is same as it was on 10th Jan 2012 my fiancee mom has called them twice this month and we were advised to wait it may take a bit longer and they will update us soon , confusing :S:S:S:S:S::S:S

Alas, a postal letter will be sent to the USCitizen petitioner, to the address listed in the I-129F paperwork.

So, have the mail checked, and have the USCitizen Petitioner call into USCIS and talk with a Tier 2 human (see ISO - http://www.dhs.gov/f...5658440339.shtm ) and ask:

1. any postal mail returned pieces?
2. what is status of the casefile ?
3. will I be sent the NOIR or NOID letter?
4. When is my 'rebuttal' window?
5. What are my active dates for submitting new evidence?
6. Will new evidence be required, or will USCIS be able to re-affirm the petition without additional evidence?


These are fishing questions, in order to determine the exact status of the casefile.

Do that phone convo exactly as I've written? She'll learn more about the casefile status.

Don't do it exactly as I've written? It's a wasted phone call.

whoa, OP - you need to refactor yer plan, much.

to be able to leave the usa and come back, one needs a green card or AP document.
to get either, one files the big 'adjustment of status' packet.
to be eligible to file the big 'adjustment of status' packet, one needs to be married in the usa
to be eligible to marry in the usa, one needs to cross via the k-1 visa and (optional) obtain a SSN.

so, with all that in mind, you've some thinking to do.

Lets get the terminology straight.

Alimony is when one spouse gives money to another upon a divorce and that typically ends when the receiving person gets married again.

A pension is money paid to a person, typically from the company he/she worked for, as retirement money, and typically lasts for their lifetime. It can only be given to the person who worked for that company.It cannot be transferred.

Social Security or SS is government money and is given only to the individual who worked here, and is based upon age, prior years of employment and is only given to the person who retires. It cannot be transferred.

It sounds like, and I could be wrong, that this person is receiving alimony and this was the arrangement from the divorce and will last for 6 more years, then it will end. If this is the case however, then once he got married it should end in any event.


I think, in the divorce decree, the husband was awarded a portion of the wife's retirement pension, to be paid out :
1. when the man reaches retirement age and
2. he maintains his 'not married ' status.

You've got the terms right, but IMO there is not any alimony - just a financial settlement in the divorce decree covering the disbursement and percentage of the retirement pension, to be paid AFTER the man reaches retirement age.

I could, of course, be wrong.

No, not at all . There will be no response to your initial email.

Instead, you must make a new email with the proper 'subject' line, referenced above, then send it off, and wait a day.

We was told we was approved and welcome to the UNITED STATES, I asked if they needed my other paper work and he said no, we had a great interview, he took her passport and told her in will me ready in 5-7 days to go pay domex (FEDEX) for delivery of the visa. They took the 1 copy of ds-156, ds-230 a & b, her passport, her ID, birth cert, police report, and the 2 photos.

I still have 1 copy of the ds-156, ds-156k & I-134

This report is exceptionally different that what you've written in post #1.

Almost , well @#$ck it, it IS diametrically opposed to what you wrote prior, 180 degrees of difference.

She keeps telling me women have complained about processes taking longer to complete, in situations of premature death the Green Card holding spouse would not receive the estate of the recently deceased the government would take their assests, and various other legal issues.

This is true. There's been recent FEDERAL legislation to overcome this bit. Estate law is at the state-level - each state is different in it's application of stuff after death - this FEDERAL Legislation leveled the field, in an attempt for a green card holder (gotten after arriving in USA on a K-1 visa) to inherit properly.

Regardless, a well-written will can trump much of that silliness. Much, but not all, as there was still some issue on taxation, which that Federal Legislation also sought to refactor. I wish I had the exact references on the law, though - that might help yer lass a bit.
