After reading a few forums I noticed that after aos the green card comes next. Shouldn't that be enought for her to go back and forth as she pleases as long as she has the Greene card? Or even with a green card she will need to fill out forms to go on vacation?

mumfer - I am gonna step out on your topic -
I don't have enough background knowledge on an instance such as yours,
with 3 prior 'adjustment of status' cases and 3 divorces from women that came in as tourists.

Sure, it was 20 years ago, but I understand USCIS looks for these exact types of patterns in their fraud units.

Perhaps someone else will step in and give you some advice, or you could study a bit over at http://immigrate2us.net as that site handles 'tougher' cases. IMO, though, you will have a tough case because of the fraud pattern.

I received my Fiance's signed G-325A today and I am going over everything and double checking. I just now noticed the very last thing it asks, to "print name and alien registration number in the box outlined by heavy border below". I did not fill this in and my Fiance's form does not have it filled in. I originally thought it was only for people with an alien registration number, which we don't have. After looking at the example in the K1 guide on this site, I see they have it filled in but don't have an alien registration number. Should this be filled in, and if so, is there a way I can add it to my Fiance's form?


If you don't have an alien number why would you fill it in. just put None. so nothing is left blank.

I'm not 100% sure what you are asking about with 1099 and 1040 but for two people in almost all states, the poverty limit is $15,130, so I guess as long as you are over that you are ok.
I imagine it is something to do with total and then taxable income.

Hi guys was wondering if priority dates play a vital role. What I mean is..my priority date is February 13th 2012 and we are still stuck with the "NVC CHECKLIST" stage. What I wanna knw is if NVC are done with the checklist say anytime this month, are my likely to get an interview date anytime before Christmas? Also would my priority date put me ahead of those with priority date after mine? even though I'm stuck along the line. For IR1/CR1 the priority date (really its the receipt date) will come in to play in the interview pool when scheduling. Like I plan to be done by end of the month lets say u r done now and i finsh in 3 weeks. If I filed before you my receipt day will put me ahead of you for an interview. They do not go by first finished at NVC gets interview.


To be in December poll make sure you are complete by end of October. They may start schedulin early like they did for november interviews. They started the 2nd. <ast month for October interviews they didn't start until like the 14th.



I am praying for a Dec. 20th or Dec 21st interview for husband.

My fiance, the beneficiary is in USA visiting me, he bought a ticket for 3 months and entered the USA using his tourist visa.

When he was entering the USA, they stamped his passport saying he is allowed 6 months (even though his ticket is for 3)

Our NOA2 hasn't arrived so we want him to stay for longer.

Would it be ok if we postponed his flight another 1-2 months, until we receieve NOA2?

Is it legal?

Of course its legal for him to change ticket. He's here legally. Just don;t over stay and you will be fine. If interview comes within that 6 months he'll have to return for that. But enjoy your time (keep that evidence coming. ) :)

Hey I (USC) just came across this topic and had a question regarding it. I just graduated from college, and started working (I have been at my job for 6 months). My current salary does meet the requirements (125% above the poverty line). For the affidavit, I will be sending in proof of work, etc. I will also be sending in my W2s from the past three years. Where I was a student, I was earning lower than the poverty line (working part-time jobs). Would that pose a problem for my fiance and I, when he goes for his visa appointment?


If your salary currently doesn't meet the guidelines you have to have a co-sponsor. You still have to provide your financial information but your co-sponsor will have to show the same.

Hello, I was born in Algeria but I have lived in CA since I was 4. I met my fiance when I went to Algeria in the summer of 2008. We got engaged in the summer of 2011. I filed for the i129F in June 2012 and received and approval notice in September 2012. I received another notice that our petition was sent to the consulate. Can anyone tell me about how long it was between the time an approved petition is sent tot he consulate and when you receive your "packet"? Also who receives the packet? me or my fiance in Algeria? It's all via email. Call NVC get your case# make sure they have both your email address. When you are recieved at embassy they send email of instructions for your packets

USCIS and the consulates are getting more mercenary about this. There is NO requirement that anyone be sent an RFE. That is a courtesy and nothing more.

The more petitioners whine and cry about their petitions for a lifetime commitment taking "too long" (a time frame they would gladly wait to rent a reception hall in most localities) the more the USCIS has to work to reduce being tied up on stupid errors. If the consulate sends it back it means that someone at USCIS has to review AGAIN an invalid petition that should never have been sent to begin with and legitimate petitioners already waited in line behind once.

USCIS has taken to simply issuing denials when there is "no clear petitionable benefit" In other words, if your petition is lacking TOO much, they just deny rather than send an RFE for multiple items.

I say "Good on them". Why should we all be waiting in line for people filing petitions that are not eligible, being so ignorant as to file only an I-129f and nothing else (read the instructions! That's why they have a form AND instructions!) It mens we are waiting in line behnd people that should not even be IN the line.

This is the direct result of petitioners demanding faster service.

Because this is Lagos they may think you are already married deny and tell you to go and get married. Hopefully they will let you explain I doubt it or they may not even care. Just be ready. They may ask did u have traditional wedding, did ur fiance' pay a dowry all kinds of things. So be ready for why you are calling each other this.
I know with Nigerian men it really is normal my husband was calling me wife and wifey long before we were married.

On the age difference one thing i have read and seen is long as your evidence shows a genuine relationship you should be dine. However be prepared for questions that may or may not come up. Be prepared for "why you married someone so much older than you", "Can she still have children" yes they may ask.

As to the affidavits its more important to use from your fiance's side since they have seen you both together in person. A letter from his mom saying she approved and even addresses your age difference can speak volumes. i know my mum in law wrote a really beautiful story I am 21 years older than my husband same age as his mother. I lived with him in his mothers house 6 1/2 months that takes care of my red flag.

Notarized isn't asked for required but you say you already have the letters. It's too late for them to be notarized. You would have yo redo the letters and they sign the letters in-front of the notary. Or have they not be signed yet?

If you want them notarized go to courthouse I guess ask around ask that person the letter is from to come with and sign. But again not necessary. The pictures mean more.

You are looking at about 5 months to approval at USCIS. Than a quick stop at NVC and off to the Embassy for more processing and interview maybe 6 to 8 months total.

But it's all dependent on may factors like what service center you get sent to VSC or CSC. Backgroud checks. Your country there may be more scrutiny and well how behind the service centers are. So brace for the long time anything else is a blessing. :)

The first and foremost thing is to ask your finance what was asked and how they answered. This will surely help t determine why you were denied. Sometimes they state it clearly on the form given sometimes not.

Try your best to get a 2nd interview than you can attend it when you go in December. Call your congressmen if you do not know the specifics. let me add as of late Lagos has been really going after people with ex's and women with children with ex's and your financials.

So go over that interview line by line and see if there are things that need to be addressed. And by all means you must get back for another visit thats vital.

I met my fiance on September 5th 2011. He came for a visit on November 26th 2011 - December 10th 2011. Filed for a K1 visa on January 24th 2012. Did not hear anything for months. I called frequently. I checked on the website for updates. Finally on September 20th 2012 I received a letter stating my case was denied for lack of evidence. I called them to say that I never received anything via e-mail, via phone or on their website. And now had to file a 129B form. Processed on September 24th 2012. Still waiting for an answer on that which they said could take up to 6 more months. So my fiance and I decided he would come for another visit while waiting. So I booked a flight for him for October 24th 2012. He arrived in Boston as scheduled. I waited and waited and kept asking questions why he was not coming out. They just kept telling me to wait that customs takes time. Ok so I wait. And frequently asked again and again. They said if they need you they will come out and find you. Ok so I wait. Now going on 5 hours. Finally I went back to the customs office. I asked them if he was still in there and they said that he was sent home. Omg are you kidding me. They said he did not have a return ticket and the wrong visa. I said I am the one who booked his flight and he did have a return date. They said well he didn't have the proof. They would not tell me what flight he was on or anything. So I had to wait from 8:30 Wednesday evening until finally he arrived back in Greece on Thursday at 1 in the afternoon. Talk about feeling like you can't do anything but wait and not worry. So after talking with my fiance. The customs department at Logan airport were not very nice to him. He asked them many times if he could talk to me. They said no. He asked if he could show him the ticket info on face book that I had sent him in a message. They said no. He asked them if they could go out and talk to me. They said no. And all the time when I kept asking if there was a problem how would I know. And they would just say to wait and they would come out. Ok and at what time were you going to tell me he was sent back home. Talk about heart breaking. I have been crying for 2 days. They had him handcuffed for 3 hours. Gave him no water when he asked. They treated him like a criminal. They had no intention of letting him in. My fiance asked if they could call British airways to see the return ticket. They said no. Everything he asked they said no to. The visa he came here with is a esta visa. They told him he need to get a b1 b2 visa. And they stamped his pass port with Refused Ina section 217 R04047. I have no clue what that means. I tried to call USCIS and ask them. They told me to go on the website for customs with no luck there. It is very frustrating to try and get answers from anyone. Can he still use the esta visa or does he need to get the b1b2 visa? Any help or advice would be much appreciated :D

He wouldn't be inadmissible for the esta, however they would look at the reason for the refusal and see if it's likely to reoccur. His previous visit did he overstay? How long was the stamp good for? Also because you were denied K1 that is in the system and they may have figured he was a immigration flight risk. When he travels he has to have all his papers with him. They don't have time to look up facebook and stuff. And they won't come out and get you also.

Why wouldn't he have at least a return itierary? he has to show strong ties and the ability to return.

Like the VWP, it's no guarantee of entry and it's up to the officers at the port of entry to decide how many months out of the 6 he would be allowed, if any at all. Right now though, I'd say his chances of obtaining a B2 are fairly slim, for exactly the reason he was refused entry this last time.

Now to your K1 denial. What exactly did you send in? Did you send all required forms and documents? Letter of intent from both of you. G325A. Evidence to show you meet within the last 2 years, pics, stamps in passport, receitts?

She has gotten her citizenship already that's y she filed the papers. We have both waited patiently till she got her citizenship june dis year.

One thing you have to realize. If by chance it gets approved through USCIS (One case recently did) . It will be denied at the Embassy because they look deeper and will see you have not seen each other in over 4 years.

How long since you got your NOA2 from USCIS? Usually its no more than a few days you sit at NVC long enough to get your case# have you called NVC to get your case number and ask them when they sent your Case to Embassy? Once you know that you can email the embassy with case# and Beneficiaries name and ask for interview date and they will start the ball rolling. I believe for K1 the embassy will also ask for you and Beneficiary's email. Nothing comes in the mail.

Hi VJ'ers. We are now past the date range that VJ estimates for our I129F processing time. At the bottom of our Timeline page on VJ, it says "If this date range has passed or your application is past due per USCIS processing times then you should consider calling the USCIS to inquire on your petition." But we are not sure about which number to call. I tried calling the number on the NOA1 letter, but all I get there is a recorded status that is exactly the same message as our USCIS account status on the web.

Can anyone here recommend a different number to call?
Has anyone actually gotten through to a live person before?
Ideas on how to navigate through the voice prompts to get to a live rep?
Will the USCIS rep will even be able to give out any information beyond the standard "our processing time target is 5 months" anyway?

You stopped at the status prompt. When it ask to enter receipt number and tells you the most recent status. It will than ask you more you press 3 for problems with your case.
When the operator comes online (this may be a long hold) ask for a tier 2 operator to find out if anything. The orginal oiperator is just that someone answering the phone and will just parrot words. So ask for tier 2.
Because VSC is so slow you probably will not get anything. they are at 6 to 8 months and what times you get on VJ doesn't mean nothing to them.

We filed the petition and were denied. They will not let him come to visit now, because if we are to file a visitors visa, the will deny it because of the denied K-1. They will deny any petition we file, except for a spouse, or K-1, and those are not guaranteed.



Honestly even without ever applying for a Tourist or student visa to USA he would have 99% been denied. Unless you are very very rich and can show some pretty strong ties to Nigeria Nigerians are denied these Visas.

Although you had a waiver and USCIS approved you have to show he can't travel to you at all. There's Mexico, Canada, and all the other places NigeriaorBust mentioned.

You are dealing with a high fraud country and not meeting well I have yet to see EVER that approved. Sorry for all you are going through. Please hurry and meet and refile preferable as a married couple not K1..

Also just about a week ago, a CO got furious because the beneficiary showed a picture of her and her Fiance taken in front (ish) of the embassy? It's a freaking government building that belongs to the tax paters for the love of God.


Because its against the law and its clearly stated in front of the building no photography. I know we may all be innocent law abiding people. But we have had our embassies blown up. Everybody standing in front of an American embassy isn't there to immigrant there are many plotting and planning all over this earth. Yes its to bad that happened. Everybody said it all. People don't realize the delivery in your answers are so important. If I was a CO and someone said to work so she can retire and I take care of her. Sounds like a setup. Not a love connection. You do not have to mention "she can't have kids or she doesn't want them" are you kidding.
You said adopt, if "what are your plans for children" we plan to have children in the future. You probably talked way too much off the path and distracted from the facts.

And dear nigerians are denied everyday for having a traditional wedding because the enbassy consideres that Married. "Mock wedding" what is that?

Let me amplify one thing cuz sadly many overlook this or forget . Please , please include your supporting evidence (letter of intent, and specifically answering that "circumstances under how you meet" and also really showing the evidence of the required "meet in last 2 years".) and all the other stuff mentioned.

You don't have your countries flag so have no idea if you are coming through a okay easy embassy or high-fraud. Do go to your countries forums and read the interview reviews and look around as how others prepared.

Some embassies you need to front-load like crazy ,( i.e. Lagos for me). You will be okay. Read and read again until you feel comfortable about your packet.

Dear All, I am trying to kill time while we wait our NOA2, gathering the evidence of ongoing relationship. Do I have to include the pictures I already sent with I129F?? or I only need to add the new ones?! Also, regarding boarding passes and emails.. Do I have to collect everything all over again? We forgot to make a copy of package. Thank you so much! I am the beneficiary, applying at Venezuela.


Well you should have whatever u presented to USCIS in your hand to prepare for interview. But for interview sure you want everything after you filed for the interview. Nothing wrong with that depending on how much evidence you submitted u may not be asked for anything at interview.

I am praying that VSC picks up :( Never really understood how we can have the same NOA1 date and get adjucated months apart......It should really be balanced. Some people with the same NOA1 have already recieved thier NOA2.......:crying:



It could be because one caes need firther background checking ad another blow right through. Some countries documents need further checking. Or the adjudicator could be new, not kno (like sending a RFE on something that is legitmate and they know it).
Also each service center has their own set of work priorities. All during the earlier part of 2011 VSC was working hard on the Syrian Refugee applications and everyting stopped there. This time last year people were crying about CSC and wanted to be at VSC. Thanit flipped about February. Than well August 15th happened. Now those who are blessed to be transferred to the NBC are getting 60 to 90 day pprvals. It's about workload. Do you see bow much they are processing 47000 at VSC, 54,000 at CSC. It's mind numbing but hang on.

Ok when i first apply for my k1 visa i know i have to send in the i-129f, and two g-325 forums. But i have heard things about approval of income. Do i need to send this form in with the i-129f, and g-325 and the other stuff described in the packet on this site? Or do i send the form regarding income in later? Thanks for the help in advance. I met my fiancee this summer why she was on J1 visa at the beach and i am going to visit her for a few months at the end of December. So i would really like to finish my visa before i go. As it looks like i will also be working in her country while we wait for visa approval if everything works out...


The I-129F is your Petition and yes you send that in with the G325A and other evidence. The affidavit of income you will be asked for that after you have been approved by USCIS than go to embassy you will have to supply that meeting guidelines or get co-sponsor

Notice Of Intent To Deny, or NOID. It's bad news.

The consulate officer didn't believe your relationship was real. They believed it was an attempt to circumvent immigration law. The consular officer sent the petition back to the USCIS with the recommendation that the approval of the petition be revoked. In the consular officer's mind, it should never have been approved.

The reason this letter is bad news is because USCIS apparently agrees with the consular officer, and now they're intending to revoke the approval of your petition. What's worse is that it was the California Service Center. They usually don't readjudicate returned petitions. They just let them expire and let the petitioner file another one. The fact that they're sending a NOID without you having first tried to submit another petition means the consular officer's evidence must have been very convincing.

Here's the rough part...

By returning the petition, the consular officer has made an accusation against your fiancee. The accusation is that she made a material misrepresentation by applying for a visa based on an invalid relationship. That resulted in your petition being flagged. Marc Ellis, an attorney who sometimes posts on this board, calls this a "P6C marker", where "P6C" refers to section 212(a), paragraph 6C, of the Immigration and Nationality Act. That particular paragraph deals with immigration fraud.

In a nutshell, the consular officer has accused your fiancee of fraud. If USCIS concurs by revoking the approval of the petition then that accusation becomes a finding of fact. In the eyes of the US government your fiancee will be guilty of immigration fraud. No future visa application will ever be approved for her unless she can get an I-601 waiver for the fraud charge. Those waivers are difficult to get, and usually require an experienced (and expensive) attorney.

What I suggest you do is contact a good immigration attorney now. When you get the NOID letter you will have a limited amount of time to respond to it, usually about 30 days. If you don't respond forcefully and with tons of evidence then they'll revoke the approval of the petition, your fiancee will be guilty of fraud, and it will be much more difficult to get a visa in the future. Your main objective now is to stop USCIS from revoking the approval of that petition.
