K-1 Fiance(e) Visa Process & ProceduresCherry Blossoms
My question is this:

On the I-129F application FORM, the question 19 states "Did you meet your fiance(e) or spouse through the services of an international marriage broker?

From the " Instructions for Form I-129F, Petition for Alien Fiance(e), Step 2. General requirements

1) Compliance with the International Marriage Broker Regualation ACT (IMBRA)

If you met your fiance(e) or spouse through the services of an international marrige broker, you must notify USCIS of that fact by answering Question 19 on this form. The term "international marrage broker means a corporation, partnership, buisness, individual, or other leagal entity, whether or not organized under any law of the US, that charges fees for providing dating, matrimonial, matchmaking services, or SOCIAL REFERALS between US Citizes or national or aliens lawfully admitted to the US as lawful permanent residents and foreign national clients by providing personal contact information or otherwise facilitation communications between individuals.

The term "international marriage broker" DOES NOT include:

B. Entities that provide dating services if their principal business is NOT to provide international dating services between US citizens or US residents and foreign national and CHARGE comparable rates and offers comparable services to all individuals it serves regardless of the individuals gender or country of citizenship.

So how would you answer this question ? YES or NO

Thank you for your help.

K-1 Fiance(e) Visa Process & ProceduresWhere to find the info Bout how many visas are approved each month/day?

Theres this http://dashboard.uscis.gov/ but it just shows number processed per month, not approvals.

You can see California has dropped to approving about 1/4 of what they receive in a month as of December 2012, also good to see they finally updated their data.

K-1 Fiance(e) Visa Process & ProceduresMistake on G-325A

You will not get an RFE, no issue. Parent information is optional.

I had no idea parental information was option, that's good to know now we have nothing to worry about, thanks!

K-1 Fiance(e) Visa Process & ProceduresMistake on G-325A
Hi all, my fiance and I just realized two months after NOA1 that we forgot to put her mothers date of birth on the G-325A form. My question is, should we contact USCIS now and ask them to amend the mistake, would this cause to many problems like our file being brought up and lost by some fool, or should we wait and notify the interviewing officer come interview time? Is this kind of thing likely to cause an RFE?

Thanks for any advice!

K-1 Fiance(e) Visa Process & ProceduresLiving abroad, K1 application

Hey, guys... Hope someone can help me!

As I'm living with my fiancé abroad in Spain, I'm extremely curious as to what address I have to put on the applications. I have an address I could use in the US, but I'd prefer my address here. Also, how do I explain my current situation (living abroad) do I write a letter and put it behind the cover letter or what?

We filed from Australia and encountered no issues using an overseas address, they will send everything to you, just add an extra week or so for the mail to arrive.
Alex&AmyMaleAustralia2013-02-23 23:23:00
K-1 Fiance(e) Visa Process & ProceduresIf you are the alien fiance(e) and have lived in other countries, read this.
Just to clarify I'v also lived abroad in the US for over 12 months, I shouldn't need a criminal record check for that as well as one from Australia right?
Alex&AmyMaleAustralia2013-02-27 01:28:00
K-1 Fiance(e) Visa Process & ProceduresWorried about "proof of ongoing relationship"
I have a question about how much evidence you need to send in to avoid an RFE. We actually live together now and have done in the US and Australia, so we provided copies of leases with both of us on it, tax office letters with us both at the same address, bank statements with us both at same place and copies of the visas to the US and then Australia, plus about 6 photos of us together in both countries. Is that enough or do you really need to provide more? Like I really dont know how much more evidence you can have that you have met, but it sounds like you need an insane amount of evidence. We will also both be attending the interview come interview time.

K-1 Fiance(e) Visa Process & ProceduresAustralia to US, anyone with experience?
She could come on a J-1 and stay a year, as an Australian there is basically no issues getting visas to the US, you can get multiple VWP but you would need to leave the country and come back. As for time range I don't really think coming from Australia has much to do with it, other than maybe it takes little time to do research on someones background because both governments have open information sharing, Australia also isnt a high visa fraud, crime or terrorism country which I suppose is a bonus, but i doubt makes much difference to anything. You will most likely be waiting around 7-12 months if you file at the moment until your fiance will be able to come on their K-1. If they do come before their visa is approved, they have to return to Australia for their interview, probably medical and police check's too.

K-1 Fiance(e) Visa Process & ProceduresTourist visa AOS to Fiance visa
I'v often considered recently using the VWP to go back to the US get married then file for a CR-1 and cancel the K-1, at present it seems likely that K-1's through CSC will take 9 months to a year minimum not to mention all the stuffing around waiting for it to get through NVC and your consulate. Also being a spouse of an US citizen and being there illegally seems to be they way to get through the system quickly these days anyway.

K-1 Fiance(e) Visa Process & ProceduresIf you plan on writing your congressperson...
Thanks for that, hopefully it works! Seems ridiculous that we need to be writing just to get our cases looked at and possibly even approved, but either way you have to do whatever it takes to get this process to work.

August 6th filers going through Vermont. I know there are millions of "NOA2! now what?!" so I'll go look at them but....wait a week and call the NVC? Go ahead and get some documents together right? What exactly do I send to my fiancé now? Is it too early to send the I-134 with the supporting evidence? How important is the letter from my employer? or are recent pay stubs and 2012 tax returns enough?

K-1 Fiance(e) Visa Process & ProceduresI29F may be adjudicated

I just found the place on this website where I can put in my dates and get an estimated time line. On the bottom is says "Based on timeline data, your I129f may be adjudicated between May 9, 2013 and May 19, 2013*." I am not sure what this means? Adjudicated means "settled". Is this the estimated time for us to receive our NOA2 or for the visa to be granted. I hope this isn't a stupid question. Thank you for your help.

Must be for NOA2

K-1 Fiance(e) Visa Process & ProceduresNeed help on the income requierements for fiance visa
hi! I had my interview jan. 28, 2013... My fiancee made 18,900$ year 2011... But on 2012 he made 20,300$, however, during the interview, the consul only took the 2011 W2 and 1040, employment letter and paystubs. I was so worried. I have my fiancee's w2 of 2012 that time but he said he just need the 2011. But thankfully we got approved. I do think that we got approved because my fiancee was with me during the interview, and the employment letter says he made 20,300$ for 2012...

So, i think you need to gather all your paystubs, and employment letter which supports your current income. AND COME TO THE INTERVIEW WITH YOUR FIANCEE if she gets a second interview

K-1 Fiance(e) Visa Process & ProceduresNOA1 Hard copy
Hi fellow VJ members. My fiance just received the hard copy of NOA1.He said that the in the portion of benefiary the country of birth is unknown hence I checked my biographic data that I submitted and my country of birth is written as a matter of it is completely filled up.

I want to ask to those who received the hard copy of NOA1 if it is just normal to put unknown in the beneficiary's country of birth/plaace of birth.

My NOA1 also has this despite the information being clearly stated on my paperwork. If you call the uscis hotline they will correct it over the phone in about 5 minutes. A tip to make your phone call go slightly faster is have a copy of your NOA1 on you when you call as you will need some of the information on it. Good luck with your journey.

Thank you so much.

K-1 Fiance(e) Visa Process & ProceduresSO CALLED RED FLAGS Im worried about

Fiancée has relatives or friends in the U.S. who seem to be taking too large a role in match-making - He was introduced by my uncle who is his close friend at work.

Couple hasn?t spent enough time together in person- When he came here, we were only friends, or has the so-called Mutual understanding then I realized I am starting to love him each day of his short vacation in May, We were introduced sometime in April, First week. So we've been talking on Skype right before he decided to travel half way across the world just to meet me.

Very large age difference between the couple- he is 27 years older than me to be exact, I didn't know til I realized I am so in love with this man. It didn't bother me at all since he looks so charming and looks good to me.First time I saw him, I liked him and realized why not give me a chance to know him more

Can you guys help me see the real picture of our love story? I know its real, but of course the CO wouldn't really know how exactly how it feels. I am bothered with all this stuffs I saw on other internet websites where it says the three things I listed above are RED FLAGS?

I have seen some who got same story and got approved. but of course I also know that it is a case to case basis.

THANKS

It would not be a problem as long you are honest to your self and to your fiance.I have a friend who is married now to an American and they have 20 years age gap yet they never had a problem with her K1 visa. The process was even fast. What is important is that you have all of the requirements. Good luck!

K-1 Fiance(e) Visa Process & ProceduresIssue with USCIS and fiance VISA
[quote name='dtug1701d' timestamp='1360404569' post='5969536']
Hi everyone in Visa Journey My fiancé and I are having problems with our paper works. We don?t know what to do anymore or where to ask. I saw this site and maybe one of you had an encounter similar to what we are going through. First off, my fiancée filed the petition on March of 2012 and it was approved on July of the same year. When my fiancé called the NVC to ask about the manila case, they said the papers was sent back to USCIS for review. Calling USCIS, they told us to wait another 180 days, so we waited patiently. This February 2013 my fiancée went to USCIS in Honolulu to talk with someone about the issues with our case. At this point, the 180 days lapsed and we never heard anything from them.
Unfortunately we received bad news and was shocked that our case was terminated. Asking the USCIS agent the reason for the termination, they could only respond with ?I DON?T KNOW?. They gave my fiancé an MPU number whatever that is, and told him to wait another 3 weeks to receive results in the mail. My fiancé asked several times, and all he got was an ?IDON?T KNOW?. Why is it that we follow all the steps and do everything according to instructions and we get the short end of the stick? Could the reason why NVC terminated the paperwork?s would be because my status of being married in the Philippines had not yet been annulled, though my marriage has been legally divorced through Guam. Currently my ex husband is now married to another women. That?s the only thing we can think about; Waiting has taken a toll on our relationship, and has been a very frustrating journey for both of us. I hope someone has an answer to this dilemma we are having. Anything would help. Thank you very much.
[/quoWhat you can do is to register the divorce decision in the Philippines. There is a process for that. You can ask a lawyer.

K-1 Fiance(e) Visa Process & ProceduresTHESE TWO THINGS ARE IMPORTANT FOR ANYBODY CONSIDERING K1 VISA!! MUST READ

GET MARRIED AS SOON AS SPOUSE ARRIVES IN USA!!!! I DO NOT UNDERSTAND WHY THIS IS SO HARD FOR PEOPLE TO COMPREHEND!
DO NOT PLAN WEDDING CERAMONEY UNTIL SPOUSE ARRIVES IN USA! AGAIN, I DON'T UNDERSTAND WHY PEOPLE PLAN WEDDING CARAMONY BEFORE SPOUSE ARRIVES OR BEFORE SPOUSE HAS ARRIVAL DATE AND THEN COMPLAIN THAT THE PAPERWORK IS TAKING TOO LONG!
IF YOUR SPOUSE HAS TO LEAVE THE COUNTRY BECAUSE YOU DIDN'T GET MARRIED WITHEN THE 90 DAYS, IT IS YOUR OWN FAULT. 90 DAYS IS MOR THAN ENOUGH TIME TO GET MARRIED!
IF YOU PLANNED A HUGE CERAMONY AND ARE UPSET THAT YOUR SPOUSE WON’T BE HERE WHEN YOU HAD PLANNED, AGAIN..YOUR OWN FAULT! DON'T MAKE PLANS UNTIL THINGS ARE SET IN STONE!
JUST TRYING TO HELP PEOPLE BEFORE THEY REGRET THEIR DESCIONS.

You are right. I guess it is just a matter of common sense and being realistic. With the process to consider we should not set everything beforehand because we don't control the flow of the process. Getting married as soon as the fiancee or fiance arrives is a good thing.

K-1 Fiance(e) Visa Process & ProceduresDoes my girlfriend need a K-1 visa?

My girlfriend is from Hong Kong and we intend to get married in the USA. Does she need a K-1 or can she come over on a regular visa? I have heard of stories where people from countries that can enter the USA easily, doing it this way instead of going through a K-1 visa. Anyone with experience doing it without a K-1 visa?

Since you want to marry her in USA, you have to let your girlfriend come to USA through K1 visa.
