Did he declare the child with you in his last application? If not, he could be hit with misrepresentation and that is a lifetime ban. So, you need to find out what was filed and what was disclosed before you start this process. Wish you all the best!

 

Yes this is very key if he listed said child on his application. If he didn't you may have an uphill battle. And also prepare to be there for the interview. DR doesn't play and they want to see you both.

 

You would have more credibility as a committed couple if you married and filed the I-130. Fiance after an affair (and yes if he was married it was an affair no sex or otherwise), a child 3 years old.

 

Why engaged? That looks like you guys don't know what you want after all this (Thinking like a CO now).

 

So when was the last time you saw each other?

Harpa is correct. Reapply with better evidence. You must have really screwed up though. It is pretty hard to not have the right info for a 90 day K-1.

Did you have an RFE even before the interview? There must have been a red flag or two or completely missing information that you didn't reply to.

 

If you can't conjure up the evidence then yes, get a real marriage and go for a spousal visa.

 

The embassy thinks they are related. Is reason for denial.

It's really just in the wording. Consular/embassies do not "Deny" anything. We always say that. They "Refuse" to issue you a Visa. Only USCIS can Deny. If that is the wording they are getting ready to send your petition off to USCIS where as stated it will expire if it hasn't already in 2 days as you say.

AP is what it says "Administrative Processing" They are finishing up their report to add on to your petition.

 

Since they think you are family. I would imagine what cousins sister- brother you need to be sure to have DNA/Bloodtest test something to refute so when or if you reapply you have evidence. Getting married will not fix a "we think you are related". Did they actually say that or is that something you think. What did they say at interview?

 

Most definitely get a lawyer.

Really its just a change in venue. I mean read all over VJ and you see women, men flying all over the world to meet and marry first visit (Yes I did it). So how is that different the beneficiary coming here and marrying first visit?. It's same thing but different venue.

K-1 Fiance Visa Waiver: Extreme Hardship

The K-1 visa allows for a foreign national fiance(e) of a U.S. citizen to come to the United States and marry.  Once married, the couple can apply for the foreign national?s adjustment of status, work authorization and advanced parole.  Applying for these benefits will enable the foreign national to become a green card holder (lawful permanent resident) and, eventually, a U.S. citizen.  The K-1 fiancee visa is the starting point of the process.

 

To start the K-1 process, a k-1 couple must file a petition with the USCIS and demonstrate that they intend to marry and that they have personally met during the two years immediately preceding the application.  The meeting requirement is vigorously enforced and can only be waived in two distinct circumstances.  The first circumstance is if the meeting requirement would cause extreme hardship to the petitioner.

 

What does extreme hardship mean?  Good question.  Hopefully the following will provide a better understanding.   First, it should be noted that the extreme hardship must be on the U.S. citizen.  Unfortunately, the hardship felt by the beneficiary is not important to the USCIS in determining a k-1 couple?s eligibility for this waiver.

 

Determining whether a U.S. citizen will suffer extreme hardship is a discretionary decision made by USCIS and will be determined based on the facts presented in each specific case. After much review of many USCIS decisions on this matter and founding some pattern in the USCIS?s determination of extreme hardship.

 

Many would-be applicants have claimed that their financial position causes them extreme hardship in meeting the requirement.  The USCIS does not accept this argument.  USCIS most often determines that extreme hardship occurs to the petitioner if the k-1 petitioner is suffering from a medical condition.   However, the petitioner must thoroughly demonstrate that the medical condition places the petitioner in extreme hardship if he or she were to travel.  Often, it is necessary to demonstrate that a beneficiary cannot fulfill the meeting requirement by coming to the United States to visit the petitioner (and then return to the home country to await the filing of the K-1 visa).

 

The waiver to the K-1 visa application is often very difficult to obtain.  Nonetheless, if you think you are eligible for a waiver, it is very important to consult with a k-1 visa lawyer who can help you compile a sound argument for the waiver.  Failing to obtain a lawyer?s assistance will probably greatly increase the possibility of a failed k-1 application.

Thank you so much everyone for the tremendous response though it made me extremely sad but it's okay. My fiance is on peritoneal dialysis set up at home and it is done everyday for 12 hours like I mentioned earlier. Noway I can apply for visitor visa now as we have already filled a petition for k1 and received noa1 but all I can do now is wait and see what happens still I'm hoping for the best. I need prayers and good wishes. I was too busy with medical school past few years couldn't think how difficult it would be for me and now I guess my marriage is an impossible thing sad.png I'm not hiding anything as per fiances medical condition he is on transplant list but waiting for years sad.png idk wish me luck

 

Honestly I say keep hope alive. If you search VJ there are two people who submitted waivers of not meeting and were approved. One I believe just last year. Seems to me your situation is the kind of thing the waiver was designed for. Why else have a way to have a waiver if no one qualifies. Just be positive and also think of a backup plan just on case.

Like I said there is no 90 day requirement to file Adjustment of status for a K1 or anyone else. You should file soon as you marry but there are no requirements. Many have waited 1 to 2 years (or even longer).

 

Yes you are out of status once that 90 days is up. But marrying a US citizen makes all that forgiven.

We married 2 months after her arrival.  We filed our AOS (I 485) one week after being married.  Both were done prior to the 90 day USCIS requirement.

 

Our I 485 AOS is still pending (well over one year from filing).

 

I am a natural born US citizen.

 

Why is a I 130 Petition even in the mix?

Well first there is no 90 day requirement to file anything. Just 90 days of arrival you have to marry. Why a I-130 interview? Have no idea.

 

What else did you file with I-485?

 

I-765 EAD

 

I-131 Advance Parole (to travel)

 

Did she leave the US since her arrival?

My Fiancé in Vietnam wants me to get pregnant on my next visit because she believes that it will speed up the process. She has a friend that did it and got a faster interview, but she says she has 2 other friends that are not pregnant that are waiting, and she said that the wait can be over 2 years for an interview if she is not. I don't think this is a great idea for several reasons.

 

My questions are: Would this do any good at all? Could this make things more complicated? Are there other and better ways that can help her to get a faster interview? Thanks in advance for your help.

 

Considering Vietnam is a tough embassy and more tough on K1's ask your fiance' what if you get denied. Than what? What is plan B and maybe C.

If the Filipina cannot get to the US, then how can this poor same-sex couple get married?  The Philippines will certainly not marry them.  For both parties to get visas to a country where they COULD marry (and it looks like Brazil is the only current option) is difficult and expensive.  And, the possibilities for a USC to bring a same-sex partner to the US is only one year old.

 

If they've been together for 10 years, it might still be hard to prove this, as they might not have been able to do anything (legally) together in the Philippines to prove they are together. 

 

Also - I myself COULD have gotten married to my Australian partner three years prior to DOMA's demise, but my immigration attorney said NOT to - as it would affect my partner's safety in trying to enter the US on the Visa Waiver Program.

 

So...go easy on this couple for not marrying.  They have had the option denied them in the US until last year, and then when they tried, it blew up in their faces.

 

OP - please tell me that your immigration attorney is a SPECIALIST in same-sex cases in the US...

The spouse will not be able to work for at least 6 months upon arrival in the U.S. With that and along with all the other expenses that a new spouse will generate, your beans better be in order.

 

I hate seeing couples trying to build a marriage on 30,000.00 USD petitioner salary.

 

Are you serious? I make way more than that and there are times where it is tough for me and my non-working wife.

When you say k-1 abandoned, do you mean that you sent in a formal letter of withdrawal?
How did you get married in the United States?

 

Yes, but according to them when I last checked, it was still open but closed based on non-activity. They're useless. Hubby came over on the Visa Waiver Program (VWP) and we got married, plain and simple. He went back to the UK after our honeymoon and I filed the I-130 once I received our Marriage Certificate in the mail, which took a MONTH. He visited every few months after we applied, but remained residing in the UK. I'll also say that they ask if you've filed for a visa for anyone before on the I-130, and I put yes, and included the NOA2 from our I-129F since I was applying for the same person.

Don't spend money on a wedding if that's not what you want.  Getting married at the court or JP gives you the same marriage certificate that anyone who has a big wedding has which is what you need for AOS!  Save your $ for the AOS packet :)  You can invite people and take pictures at the court and there's your proof.

Like other posters have said, it does not change anything. It might come to question though during the medical exams. If she is for sure pregnant then you will have to send her with a formal consent that you are aware of it. If you don't, the medicals will report it to the embassy and it will come in question during her interview. They may want to contact you after the interview to find out if you know about it (some people have had *outside pregnancies which their fiancee were not aware of).
So, if you have a written consent with her during the IV interview then it won't be necessary to have additional time to contact you.

You have to feel comfortable with the process.  Everyone has an opinion on this, including myself.  Ultimately, your choice.

 

Now...my opinion:  Keep your money.  Use the guides.  You should have no problem completing everything utilizing this site.  I did and many others have, too.  I never saw, or read about, a legal advantage when utilizing a lawyer, or paralegal, in this process.  They have as much pull as you and I do with the service centers and immigration as a whole!

 

Good luck!  Take your time and double and triple check!  You will do just fine!

Another question about the I-134 Affidavit of Support.  My income is well above the required amount to qualify, and I have a letter from my employer stating that I have been and am a permanent employee for 36 years.  I also have a copy of my 2013 tax return and my W-2s and 1099s.  Since I have the above listed documentation, do I also need to show in section 7 my bank balance with supporting documentation, an estimate of personal property, stocks and bonds, life insurance, etc.?  I believe I read somewhere that as long as I show proof of employment (the letter from employer) and proof of income (tax return and check stubs), the rest of the items are not necessary.  Anyone know for sure?

Our I129f petition (filed in February 2014) has been approved and forwarded by the National Visa Center to the embassy in Malaysia.  I have confirmed that they (embassy in Malaysia) have indeed received the electronic file and are expecting the hard copy anytime now.  When I filed the I129f petition, I included a completed I-134 with all requested supporting financial documentation including W-2s and 1099 tax forms.  I also included a letter from my employer, a letter from my bank, and various other proof (bank statements, retirement account, etc.).  My question is this; will we be required to provide a NEW I-134 that is current to this month (September 2014, as the interview will likely be in October), along with a more currently dated letter from my employer, or will the I-134 along with the evidence I sent in the February I129f application be sufficient?  Evidently, the documentation I provided in February was satisfactory -- will that same February documentation still be current enough for them?

Well...this is even more confusing now.  The online form gives three choices: IV Address Registration, Immigrant Visa and Nonimmigrant Visa.  Simple so far...   When I select Nonimmigrant Visa I must then select a category: Business/Tourism, Study in the USA, Working in the USA, Crew (Airline, etc) or All other Visas.  When I select All Other Visas, the next page wants me to choose Treaty Trader or Treaty Investor (E1 or E2 visa) or E3, NAFTA, or Victims of Human Trafficking.  None of these apply.  So I go back and select Business and Pleasure and get the options of B1 or B2 visitor visas for business, pleasure or medical.  None of these apply.

 

So I went back and selected immigrant visa instead of nonimmigrant and continued...where it took me to a long list of visa types where the K! visa IS listed.  So I selected it and continued.  Everything was looking good until it got to the page where I had to fill in our DS-160 Confirmation Number.  Well how can I do that if I am still in the process of trying to fill out the darn DS-160 form?  By the way, NO WHERE does it have a selection that says D-160.  So I am stuck in a catch 22 situation.  I have NO idea what to do now.  I cannot fill out either Immigrant or Nonimmigrant.  What do I do?

My fiancee received her instruction packet from the embassy in Malaysia for our K1 fiancee visa.  The instructions say she must fill out the DS-160 new (nonimmigrant visa application) at the website http://ceac.stage.gov .   When we logged into the website and created her account/profile, it asks if she wants to fill out an immigrant or a non-immigrant application.  Since we are trying to get a K1 fiancee visa, I thought it would be an immigrant visa -- NOT a NON-immigrant visa.  I am confused because the letter says to fill out Form DS-160 online NONimmigrant Visa.  Does she fill out the immigrant or the non-immigrant online?  I assume we should follow what the letter says, even though it logically is wrong.

It might useful for the folks with a fiancee in Malaysia to know that we just found out there has apparently been a change in the way you obtain your police report (Certificate of Good Conduct) in Malaysia.  When my fiancee checked a few months ago, she was told to go to the department (I don't recall the name of the place) in KL and she would receive it the same day.  When she called today to arrange to go there on Monday, she was told that the procedure has changed in the last few weeks.  Now you must go online to www.lkn.gov.my  create an account and then fill out the application online.  The website said it will take 1 to 3 months!!!  However, the officer that she spoke with over the phone told her it typically takes from one to three weeks.  After filling out the application online, she was able to download and print the Acknowledgement of Application for Certificate of Good Conduct.  The document says she can go to the website and log in (using her user ID and password) to check on the progress.  She will call them on Monday to see if there is any way to speed up the process because we are hoping for an interview mid-October to the first week in November (hope hope hope).

 

Regarding scheduling the interview, I was informed by email by the embassy in KL that they only schedule these appointments for Tuesdays and Thursdays.

 

To avoid delays, I would suggest that you think about applying for the police certificate further in advance once you know that the NVC in the USA has sent your packet to KL.  The embassy in KL is moving quickly on our case.  I know that they first received the electronic file around September 8, the hard copy on September 10, and mailed the instruction packet on the same day (September 10).

 

I hope this helps someone...and if anyone knows of a faster way to get the police certificate in KL, I would sure like to know.

Well, as of 9:15 pm this evening (Oct 30) we officially got electronic notice of our NOA2 (approved!) after submitting our RFE response!!!

 

They acknowledged receipt of our RFE response on Oct 3, so it took them 27 days to approve it... not the best turn around time but we're thrilled we are moving on to the next step!!

 

For those of you who have been asking about whether to revise one letter or two letters of intent (i.e. which state you intend to marry in), I made the decision to just send one (mine, the petitioner). The RFE was addressed to me as the petitioner and asked (me) to declare which state we are marrying in, so I didn't see any reason to re-send both... just gave them what they requested, and finally moving forward again!

 Congratz! I have just sent mine, (just one letter as well coming from me, the petitioner). They received my RFE on October 31, so I'm guess it should be approved by Nov 27? hopefully won't be that long. :)

we received our RFE hard copy, they are asking from us in which state we are planing to celebrate our marriage and they want copy of the law of the relevant state where it says same sex marriage is legal
