1-129f was submitted last december 05,2012 but untill now feb.1 2013 no notice of action received.. what to do? usually how long should i wait to received the noa1? its been 8 weeks but no NOA receive..what to do?

Like what the others said what has so far happened.
Also where exactly did u send your petition?
Have you called USCIS to inquire?

By now you should have known day petition was received by ur mailing tracking.
The day your check or money order was cashed.

Is the address on petition in the US or abroad?

Did you attach G1145 to get text and email? (Not that this guarantees a text or email)

So I was just curious. When it comes to where you actually file the K-1, does it change regularly? I see people who put theirs in Nebraska, etc. On the site (USCIS) currently it's saying to file to Texas. I just want to make sure I don't get a packet back because I sent it to the wrong place!

No the filing stays the same Texas for a K1. Where they send varies.

Well I received the denial letter today. No surprise... basically it says I did not provide the proof needed. The attachment lists a few paragraphs and parts that say what is required to prove a relationship that I did not fulfill. It says I can appeal for $630, and it also included a I-290B form. Now my question is, should I appeal and provide all the info, or just refile with all the info??? What path would be quicker?


Appeal what? And why would u pay twice the price when u can just refile and be on ur way. IMHO

Ok....I will be the oddball here. I see everybody is addressing the I-129F petition and that is good. My concern is that the OP mentioned that his fiancee is in 3rd year college, and he would like to see her finish college here in USA.

I am certainly not judging, nor offering any advice....just want the OP to think about maybe his fiancee will nearly be starting college all over again. How many of her credits are going to transfer from Pinas to a University here? Just something to think about.

Well Mike it will be okay. You have gotten great advice here. Be real clear on the circumstances of your meeting. I have read quite often now people getting RFE because they didn't do that or didn't explain in more detail (this K1 seems more indepth than the spousal Visa goodness).
And keep this on your mind and in your heart, because this process is long and requires alot of patience.

the lady just gave him a paper that said the request for your visa was denied n highlighted no 5a: "there is no familiar relationship between us"and gave him all the papers since we 1st started the process.


can I ask how was your I-134? Did you need a co-sponsor? if so what is the policy at your embassy about co-sponsors do you have to be related?

Alright, called DOS and they said K1 DOES NOT pay the new Immigrant Fee...so thanks to the embassy once again for making me wonder and worry by sending me tht lovely note saying to pay it. (They did something similar at the interview and I worried for an hour that something was missing until the next person said, oh yeah you don't actually need that for K1...grrr)

Anyway....flights are full this weekend so I am leaving monday! YAY

I filed the I-129F petition in July and I was just wondering, since we havent had an RFE yet after all this time is it unlikely that we're going to get one of those? Or can you get a RFE at anytime, even 7 or 8 months after filing?


Of course. You get the RFE when they adjudicate your case. I have a friend she filed in June just got an RFE last week. Thats why even though we aren't happy when we get RFE we know though it means someone finally is looking at your case.

I am really worried about being able to "prove" an ongoing relationship. I have been to see my boyfriend twice and hopefully will be able to go once more (mostly because I never kept any of my previous boarding passes, and I would like to have some to send in to minimize any complications). I stayed in his little farming town pretty far away from any central areas, and we didn't go anywhere together besides hiking around the forest and mountains, which you don't get receipts for. :P We have a few photos together. Mostly what I am worried about is that while he is there and I am in the U.S., we mostly communicate via phone/email. It's a little complicated to explain. He only has internet available on his cell phone, so via gmail he is able to send short "emails" to my verizon phone which I receive as a text message. We can only sent about 160 characters at a time. So we have A LOT of messages like that, but like I said they are short and if that is all the "proof" we have for an ongoing relationship I feel like it is not very believable. We do talk on the phone once or twice a week, but I use a calling card and the destination phone number does not show up on my calling history, it just says "unavailable." What do I do? He comes from a very impoverished area, so we don't have a lot of good options. Snail mail is a big hassle because the nearest post office is hours away from where he lives.


Well here's a list I compiled over the last 2 years from various sources and folk here on VJ. Maybe this will help stir up some ideas. Do you get a stamp in your passport when you go to Costa Rica? That is your proof of your visits. well here you go.

Examples from VJ members

  • Include phone records, chat messages, email, snail mail etc.
  • Be careful of the emails/letters that you submit, and only use those that show you guys in the best light (Do not submit documents with the information blacked out (unless it is a social security number).
  • Anything that shows you are a normal loving couple, that you discuss the things that most couples discuss (i.e. work, family, future plans, etc.) is good to submit. If you've been corresponding with his family, and they've been corresponding with other members of your family, submit this as well. You want to show depth and real family ties.
  • You have to go into this thinking that they think your marriage is a fraud, unless you prove them otherwise.
  • If you can get a letter from his family stating that they are aware of the age difference and give their approval this will be a big help as well.
  • Financial support: If money is being sent keep track of it - be it western union, paypal world debit, credit card with the spouses name on it (you do not need a social security card to add a spouse to your credit card and get them a card).
  • Ongoing Communication - Talking on the internet every day? Make sure you are logging it.. Telephone bills, etc..
  • Personal Meetings - Make sure these are documented, photos, passport stamps, hotel bills, etc.
  • I would organize your information with a timeline of your relationships and then bullet those three items..
  • Page one is a cover sheet describing the relationship and the evidence, then the timeline of the relationship, then the evidence as laid out in the cover sheet.
  • Each piece of evidence I have also explains what it covers with a small header.. For example I organize internet chats by month ?
  • I only show the log that shows that we talked/chatted each day (a screenshot) and above have one paragraph explaining why we talked more or less that month and general things we talked about (ie: we did not talk June 24-28th because her internet was down, the heavy usage days the first week were because we were planning my upcoming trip, the heavy Wed and Fri days are because we go over new English word from her class, etc)...
  • If you do it month to month the time it takes is not great and shows an ongoing relationship evolving over time..

What documents are necessary to determine a bona fide marriage?

  • Photographs that show both spouses together and with family and friends. These photographs can be taken at the wedding, at other functions or events, and throughout their relationship.
  • Letters between the couple before the marriage, with their postmarked envelope.
  • Evidence of trips the couple has taken together, including bills and receipts reflecting hotel stays, car rental, plane tickets, postcards sent to family members while on the trip.
  • Birth certificates of children of the marriage.
  • Copies of joint income tax returns.
  • Evidence of joint checking or savings accounts.
  • Photo ID cards of both spouses with a new card for the wife showing her married name.
  • Driver's licenses, credit cards, check cashing cards, employment ID cards, video club memberships, etc. for both parties.
  • Real property deeds showing joint tenancy.
  • Apartment lease or a letter from the landlord indicating that both spouses live at the apartment or copies of rent receipts showing both parties' names.
  • Letter from an employer showing a change in records to reflect the spouses' new marital status.
  • Letter from an employer showing designation of the spouse as the person to be notified in event of accident, sickness, or other emergency.
  • Evidence of life insurance policies where the spouse is named as beneficiary.
  • Evidence of medical or health insurance plans, which name the spouse as a member or beneficiary.
  • Evidence of correspondence between parties, including letters, birthday and holiday cards, telephone calls, and other correspondence addressed to the parties.
  • Religious marriage certificates if the couple had a church wedding.
  • Copies of gas, electric, telephone and other utility bills.
  • Evidence of joint ownership of an automobile.
  • Evidence of all major purchases made together, such as stereo, television, refrigerator, washer, dryer, etc.
  • Pictures of spouse and family.

The advantage of being married already makes it easier to get here after the NOA2 has been issued and the NVC has processed the paperwork for the interview. The CO does not have as much power on CR1 visa's after the NVC has approved the visa. The only way the CO can deny the visa is prove that whatever was previously provided to the NVC was not truthful. The CO has to be able to prove it based on info provided at the interview. The CO then has to send the reason and proof back to the NVC. The NVC will make the final decision.
I have read so many cases where the CO is in a bad mood and denies the K1 visa based on the CO's feelings on the interview with little or no valid reason.


What are you talking about? The NVC doesn't approve anything especially a Visa. You are really confusing things here.

Interesting. So I got the details: It was a "package" deal for $2000, which includes the application fees, lawyers fees, etc. This explains why "her" lawyer is completely unresponsive when she emails to ask questions.

For all the naysayers questioning why somebody would pay for something like this: Try working 6 days/nights per week in a neo-natal ICU for $300 per month and you might begin to understand. When your other choices are to sit home, do nothing and live off your family's business income, or go to Dubai, or be in a loveless marriage, $2000 to live and work in Vermont doesn't sound so bad, even if it takes years to get there.

Something about walking a mile in another (wo)man's shoes...


I have read right here on these forums nurses from the Philippines talking hospitals in Dubai and other places just using them. Almost looks to me like white slavery. So sad.

Well for what its worth I see no issue with what she did. Goodness she didn't scam, she did a legitimate thing to get employment. I wish you all the best.

then would make the rest little easier then file k1 as after k1 visa have to file aos soon after and not as if time apart is not a problem ? then mostly only need proof of have lived together ie rental papers and household bills

no docs???? when I started f129f the first step over 20 pages of stuff was sent along with over 12 photos then again emely you can read the form yourself and see what has to be sent with the forms
also he would have gotten the receipt not long after everything been accepted also in your profile says you files for an e visa this a mistake?

i had always bought round trip tickets as they cheaper and after talking with delta and klm reps there advice was buy round trip as fee is lower if for some reason need the return ( unforseen problem once married/living together the visa holder has a way back home ) sveta return part of her ticket from last dec was march however everything is going good so it will be a ( no show ) loose the miles but I keep sveta ;)

ps. nearly all airlines has people in standby should a seat become open for this reason

Andrea&Henry nearly 100% of the times I search for tickets one way was nearly 50% more then round trip. I have in past 2 years flew 6 time round trip to Ukraine and always check see if 2 one way be cheaper as thought maybe i would stay longer and yes i checked for sveta ticket however I found this be interesting should you go airlines website as from visa holders country ( in sveta's case ) same flight to usa was little cheaper even when the money exchange rate

during the time svta was being interviewed I contacted my senator and with their contacts I was able find out more infomation then embassy was giving and in our case I like think they was able to push embassy to get us the visa by a deadline we had. also keep in mind if the public never inform their senators how ins/dhs/and so forth how they know just how bad the problem is with that sid make sure the senator has strong feelings about ins/dhs ect. I first ried the state rep for my district and after first call they NEVER returned calls or emails then again it was the donkey party rep

welcome Mike as for sveta and I we met on www.russianlovematch.com and had no problems per-say to get her visa only thing was she forgot to take her legal birth record to interview and this caused a 2 month delay with that said mid dec she was in houston and 10 days later we married and jan sent papers for green card travel doc and work docs, as for wedding she come texas we got married and plan return ukraine in may for a wedding/party for her family

Yes, it should be. You only need 3 times the shortcoming in your income, and $80k more than covers that. Provide your last 3 years of complete tax returns. It may help to show the prior years you earned more. Provide the last 6 months of bank statements to show the money in your account was not just deposited in a lump sum recently to try and use for the affidavit of support. If you can, get a letter from your bank that states when your account was opened, current and average balance.


Where does it say we need 3x the shortcoming of our incoming? I haven't read that anywhere before.

Also, since they say 2 of the 4 are required on the instructional form, how will that work out since the bank acct is only 1 of those 4 since I dont meet the required amount currently... thanks

Philippines generally does not accept co-sponsors for K-1 applicants. Be mindful of this.

Well, you could have your parents fill out the same form. You need proof that you are making more than the poverty rate, bank deposits etc. If I were you, I'd have your parents fill out the form too as a co-sponsor if needed.

So the USCIS would look at not only my info, but also my parents and take the sum total of that? Because my parents alone make leaps and bounds more than enough without even looking at my bank acct balance...

I had a question about this form... I know we must demonstrate that we make at least 125% above the current poverty rate in the U.S., which is around $18K for 2 people last I checked... and I understand we must use at least 2 of the 4 points in "supporting evidence" on the instruction sheet, but was wondering if I dont actually have proof that I'm making at least 125% of poverty rate, but can show them I have more than enough money in the bank (close to 80K+), but my "self-employment" position I do have proof for totals less than 18K for a year, is this going to adversely affect my chances of proving I am more than financially stable even though I got money in the bank? For years previous to 2012, I have proof that shows I made much more than 18K but not last year.

If so, was planning on using my parents as a co-sponsor, but would like to know what form to fill out if I went that route... want to know what's my best course of action, thanks.
