if the casefile is still at NVC, is possible to get it rehomed to Ireland, but ya gotta move fast, use a telephone, get a supervisor, 

explain all to the supervisor, asking specifically: 

 

Please rehome the casefile from Paris to Dublin .  Please have the casefile yanked out of it's current processing queue, and re-assigned to Dublin.  

 

You may or may not be given additional instructions. 

 

Good On Ya for catching this with a phone call - it may be that you're successful in getting it rehomed whilst it's at NVC. 

 

If that's not possible or yer not successful, you're in for a longer wait as the casefile winds it's way to Paris, waits there till it gets it's place in queue, then a human sees the transfer request, then a human acts on the transfer request, then the case goes out to Dublin, then there's more queues in Dublin till the K-1 visa portion is ready for more intake. 

 

I really hope you are successful on the telephone tomorrow.

once installed, you now have a new printer device. 

 

set that new print device as default, 

then print inside yer pdf reader program

instead of saving it - 

suggest you 'print to pdf' instead. 

 

so, get a pdf print driver.  I like CutePDF very much - is easy to install and use. See http://www.cutepdf.c...epdf/writer.asp

 

When you are finished with the I-130, filling it out, print it to PDF file , then you can email the pdf file ... 

 

The thing bigdog mentioned about print and scan, IMO, is a waste of paper and electricity, and really smacks of low-tech.

the entire exam is not avoided - 

but - there's a modified exam performed, 

and 

it may be there's a medical tag put into the K-1 visa when it's printed. 

 

She'll know more during the medical exam (tell her to go and ask for extra stuff about the chest x-ray, possibly avoided that one bit altogether) 

and tell her to remind the nurses and doctor that she's pregnant. 

 

Stuff she may not get at the medical exam: 

1.  some shots that are age appropriate for her and 

2.  a chest x-ray 

and that's ok. 

 

No worries there - usually the med crew code up the exam results in a particular way that the IV staff know how to respond to - and 

usually the response is a particular coding in the K-1 visa 

 

but even then - that coding just means - can't take certain shots or chest x-ray - Medical Waiver Granted with some special code in the visa. 

 

In the end, when she goes in for a medical in the USA, as part of the I-693, the civil surgeon is supposed to interpret that coding in the visa, and finish up with the remainder of 'the stuff' she missed in Mexico, 

 

and 

 

her medical file will be marked complete with the extra stuff done in the USA, 

and

 

it's up to the two of you to chase this down, in real time, with the civil surgeon.   YOU DO NOT want to get an RFE for this stuff AFTER the AOS packet it submitted, so pay attention, just a bit.   Usually, it suffices to ask the civil surgeon in the USA to 'bring her current now that the pregnancy is completed'...

No its not prohibited or illegal. many of us have love ones in countries that getting a visitor Visa even before we file is near to impossible.

Many people from VWP countries or those that use ESTA's usually have no issues with good documentation at border. Sometimes they just get passed through. It's all about the country the love one is coming from.

Thanks, and that has always been my response and feelings on it...but its interesting to hear some topics say with "authority" that its a ceremony and perfectly fine. Wish they had a direct statement on it on USCIS.


The thing is they can't give a definitive statement on it because what would stop one from after the civil ceremony registering the ceremony. Many do in many countries and waala they are married. So engagement parties yes and they are versed in what one looks like also. I have seen denials because the engagement party was too elaborate and "looked" like a wedding party.

This is my first post, so forgive me if this has been answered directly by someone with more authority than I have seen out there.

I have seen many conflicting posts about having a non-legal ceremony in the foreign country of my fiance prior to us receiving the K-1 Fiance Visa. My fiance's family has been adamant on us having this ceremony before she moves to the US to become married. This is for cultural and religious reasons....and of course they very much want to see her have this ceremony since most cannot travel to the US.

There have seen many opinions out there where they believe USCIS will consider that fraud for having any indication or representation of marriage outside the US and/or before the K-1 has been issued. And that it could delay and/or highly jeopardize the K-1 acceptance.

Also, out there are opinions that if its just a ceremony and is not considered legal in the foreign country, that it is not a problem with USCIS. I would think this would be directly stated on their site, but its not (unless I have missed it after hours and hours of reading).

Her and I would love to have a ceremony with her friends and family on the beach during these long months of waiting. Being apart is really hard. This would satisfy their cultural concerns and allow me to actually stay at her house when I visit monthly...saving me money on hotels (I'm already paying for flights and other things while I'm there) and of course allowing me to enjoy the comfort of staying with her without her family becoming upset with us.

USCIS at the VSC received our I-129F on January 15, 2013.

It seems like this "ceremony" in the eyes of friends and especially family makes you married. I mean if parents are allowing after ceremony for you to "be" together and all that.

I know for Nigeria many have had a Traditional wedding. No registry no papers its really a party and presentation and all that and the embassy said nope you are married.

Seems like a BIG "WHAT IF". I would check around the forum here for Mexico and see what others have been through. Read the interview reviews

Ok so, my fiancee has been sent to a village basically and is stranded there forced to live with no electricity *at all* no running water, no kitchen and means to prepare food, very limited funds, no sleeping arrangments. Im worried sick and i just want to know if we shuld file for an expedite? I understand we can at any time, but the success rate is BLAH and to me this is an emergency to get him home but wether or not the USCIS gives a crud is another issue.. my question is, if i request and expedite and send supporting documents, will it slow my case down if its denied? USCIS says no, but i dont trust everything they say lol I would love the response of somebody that has had an approved expedite and their circumstances shared would be greatly appreciated!

 

You have to understand to expedite you have to show his live is in dangered. Like he will die kind of thing. Or show some humanitariarian reason he can not live in village.

 

Seeing they know about Nigerian and milliosn live like this just fine daily you would be hard press to prove.

 

But nothing is stopping you from filing. Now you want to know adverse action if you file. No one knows if your file will end up at a bottom of a shelf cuz you pissed off a supervisor with your expedite request.

 

All you can do is wait in line and pray for the best. Sorry.

Change all incorrect information ASAP or it may cause problems later, Floricel. You don't know why they assumed his address was somewhere else. It could be a simple typo, or there might be some other reason. If they run an FBI name check on him, it will be run on his name and residence. Don't risk delay by making them do it twice; correct it now as quick as you can.

I read somewhere that US passport sized photos are only needed for the interview at the embassy, but then I've heard about people getting RFEs for wrong sizes with the package. It probably depends on the mood of the person looking at your application.

I sent a UK sized photo with ours, so I don't know whether to expect an RFE or not.

Yeah i was thinkin of puttin a lil description of it all on the back of a photo...but what about them dates then...what can i do??? they all were taken with an iPhone so idk what i can possibly do....i guess if u open up photo details it tells u when the pic was taken...do u think i could maybe take a pic of the photo deatails and attach it to a certain photo?OR besides priting photos out, put them all on a CD and tell them to look into details and see the date..haha idk what to do


haha yeah i guess you can put them on a CD but for some reason i dont think they'd prefer that method... i have a feeling they'd much prefer the "old school" method... just put the dates on the back of each photo, then if they ever dispute you got the proof so it's all good right! where you from guy?

It poses a potential problem... much better to have dates. I printed about 25 pics from an assortment of places, and am currently labeling them. You want to make sure to put where it took place.

I think having them printed for 20 cents each on photo paper looks more professional, although I don't think it will make or break your case. You can even download your pictures from facebook individually so that you have a digital copy for yourself and you can print them as photos whenever you like. I would send as many as you can.

There are no "originals" unless you have negatives. Just print them out on computer paper or get them done at Walmart for a few dollars.


When I said "originals" i mean actual physical copies on photo paper....

So printed ones are just fine? Cuz they all have the dates anyway...... how many do you guys recommend? I sent 6 wallet-size ones last time (the FAILED fiance visa attempt) bec i remmeber reading sending 6 is fine, but does the embassy weigh more heavily on actual photos on photo-paper as opposed to paper-printed pix?

I know ORIGINALS are best, but we have a ton of FB pics that we uploaded.... and unfortunately only 2 real wallet-size photos and a few 5x7 pix that we'd rather retain for ourselves... so do you think it would be fine if we sent the 2 wallet-size pics in as proof, and many FB photos (black & white) that we print from all different types of occasions/events? Also, are originals (at least 1) REQUIRED by the embassy or could one get away with sending several (10-15+) couple pics from many different events directly printed from FB?

Nevermind, I got the answer. We'll get an RFE. So..... as long as we provide this letter waiver along with our K-1, will it automatically be granted and the rest of our K1 process will go smoothly? is there a chance that they REJECT a waiver only because it didn't workout with that person? On the cover sheet that we must file, what should we title it besides "K1 Waiver"...?

The only waiver I know about concerning a second K1 is in the situation where a petitioner applies for a K1 with someone and it doesn't work out. Then that same petitioner applies for a second (different person) within 2 years.


Okay, and that is what I am going to do, but the other post I read made it seem that there should be a separate "waiver" REQUIRED to fill-out in addition to the regular K-1 visa packet I must send already.... so is there no specific "waiver" for someone in my position?
