K-1 Fiance(e) Visa Process & ProceduresFilipino applicants?

There is a link in my signature for the complete K-1 process in Manila

No you do not need to wait.

Please to read Hank_ 's complete handy dandy guide to Getting a K-1 visa for Manila.

It's complete, and chock full of all the info you need.  However, there are links you must click and

plan on reading all for about 4 days, twice.

K-1 Fiance(e) Visa Process & ProceduresCertified Police Report(s) required by Guangzhou US Consulate

ya, with her hukuo book in hand, she can get stuff in her hukuo city/district/county,

specifically:

1. birth certificate

2. certificate of single status

3. police clearance certificate

then, these things (plus any divorce documents if she is divorced already) must be made into a 'white book', a notarial translation document, translated from chinese into English.  it's rather involved, each document, but Guangzhou IV expects to see white books..

That's 1 white book per thing.

I highly recommend you tell her to get 4 or 5 birth certificates, as she'll need them in the USA for other stuff, later on, even years later.

1 police clearance certificate covers all of china, but must be obtained in the city/district/county where her hukuo is current.

That's it, that's all, there's nothing more.

well, of course, must to get white book, notarial translation of the pcc, but hei !

well, i'd say it's d@mn near impossible to do any queue jumping whilst at CSC for I-129F petition adjudication,

however...

if'n you want some speed whilst chasing a K-1 visa at Manila IV -

find and study Hank_ 's handy-dandy neeto keen (yet spiffy) complete guide to going fast at Manila IV for K-1 visa chasers.

It's complete, dense, chock full of all the stuff you need to 'go fast' once the casefile has left NVC.

Required Reading™, IMO.   Since it's so dense, prepare to block 2 weeks for the revision.

K-1 Fiance(e) Visa Process & ProceduresAdobe reader question

sorry, if you are using a recent OS, is quite possible the security settings for downloads is totally out of whack.

please check the file attributes of the pdf file you are trying to edit - if it is marked 'read-only' - flip the bit and remove that attribute.  Then try a quick edit.

If you are editing the file inside of a web-browser - I don't know what to tell you.  I refuse to 'do that' almost 10 years now.   It's evil, wicked, mean and nasty and I gave it up for Lent almost 10 years now.

Good Luck !

Ya, the Vice Consul will void the B-2 on interview day with a special stamp, if the Vice Consul approves the K-1 visa application.

ya, once it hits the door at NVC, it's 2 days to 2 weeks turn-around time, depending on queue and size of queue.

You could keep in touch with DoS Hotline now, see what's what.

Your noa-2 date is 2013-05-08

I suggest waiting 3 weeks, minimum, before contacting NVC about your Consular Casefile Number.

Doubtful. Call NVC each day till you get it.

Then shift to calling DoS for further casefile status.

Another question I'm filling out the DS-230, part 2 questions 43a and 43b are asking about whether or not my fiancee wants to apply for a SSN.............correct me if I'm wrong........but a SSN is necessary for getting married, right?

Apologies if I answered this before,

but

Part I of the DS-230 is for K-1 visa chasers.

Part II is filled out by folk chasing immigrant visas (IR-1,2,4,5 or CR-1,2) so I really worry about where you are reading instructions for chasing a K-1 visa.

It's ok, though - it's a natural worry I have, based on what you've been writing here.

K-1 visa chasers only fill out Part I of the DS-230.  Part II is for folk chasing a CR-1/2, IR-1/2/4/5

Disregard the IV Set, that's for DCF filers chasing a CR-1/2, IR-1/2/4/5 . That's not you, at all.

the I-134 is not legally binding as enforcement of support.

However, it is legally binding as a legal document, that's YOUR signature on it , and when you sign, you are declaring all things to be true.

I just meant, we haven't been told that we can set up the interview yet. We have to wait till we receive the packet first in order to set up the interview, as far as I know.

My understanding is a bit different.
Once you have the GUZ #, set up an account at the ustraveldocs website,
and study.

There's a payment thing to do - once you pay and have the receipt #, you enter the receipt # and it's this action that triggers the next step, to schedule the interview.

Sure, there's some biodata to do, entered at the website, but if you don't pay? you can't schedule the interview yerself.

Mitch and Darnell,

So I just got the packet from GZ.  There is not much in there other than a forms checklist, a copy of our original application and a document that states our case number.

I checked the guides and what not, its not very clear what the next step is.
The next step is get the police report, document stating she is single, and copy of birth certificate (is that necessary? she says she doesn't think she was ever issued one)
All that translated and notarized
Then need to complete the DS-230 AND Affid. of support
correct?

Another member showed me this, recently.
http://photos.state....on GSS 2013.pdf
It was cross-linked at the ustraveldocs website. Since you know the GUZ #, you should set up an account and study ..
see http://www.visajourn...ost&pid=6200946 for how to do.

Things have changed at GUZ IV - you must make account at ustraveldocs

See http://www.visajourn...dpost&p=6216968

re: hukuo -
must show hukuo book to get:
1. birth certificate
2. police clearance report
3. certificate of no marry, single status

then once those 3 things are got, must go elsewhere to get the notarial translation made, the white books.

I know a bit about white books, yes.
a white book is a notarial translation (chinese to english) of a chinese civil document.
it consists of :
1. outside label
2. certified copy of the chinese document
3. notary's statement in chinese that the copy is accurate , in chinese
4. english translation
5. notary's statement in english that the english translation is accurate
6. notary's statement in english that the chinese copy is accurate.
7. notary's statement of who he/she is in english
8. notary's statement of who he/she is, in chinese

one pays some bucks for white books.

white books for a K-1 visa are presented to the IV Unit on Interview Day
white books for a CR-1 visa are presented to NVC during document collection and/or to the IV Unit on Interview Day.

hukuo not needed at interview.

hukuo is needed to generate:
1. birth certificate
2. single status certificate
3. police clearance certificate

then these 3 docs are translated into english ...

FWIW, it's great for her to have YOUR PASSPORT in her hand - with a 'folded-lengthwise' evolution of relationship letter inside of it. Hand it over to the ViceConsul during the first 20 seconds of the interview, at the window.

you are required to fill out the I-134 - there is no waiver thingie for you NOT to do this.

I say fill it out, showing you are unemployed in the USA (employment in China not matter for this evaluation)

and your father is the joint sponser, so he needs a full set of his own I-134.

I-134 count = 2, 1 on you, 1 on yer father.

IMO,  you won't be up at GUZ IV till 18 June 2013  for packet 3 stuff.

Can I have my dad fax the I-134 to me with his signature on it?

We want the ceremony/wedding to be in China first, Bayareaguy

That I-134 must be original, with his original signature on it.

A FAX will not suffice at the IV unit, sorry.

Technically, you are unemployed in the USA for 2013.  I suggest you fill out the I-134 to reflect that.

I-134 must have original signature.

I am referring to 9FAM ..

http://www.state.gov...regs/fam/09fam/

Apologies - it has a real name, but I rarely use the real name.   It's the Foreign Affairs Manual that all Consulate staff use.

The link above handles the sections that covers adjudication of visas, and the K-1 adjudication regs/rules/guidelines are in there.

There's nothing in 9FAM that states she HAS to adjust status.

The only reg in 9FAM about the K-1, is that she has to marry within 90 days of arrival.

And that's it.

IMO, the loophole hinges around -> if no adjustment of status, domicile requirements in the I-864 won't matter.

---

There's some guidelines on I-134 usage on YOU, but you have reviewed those already (I think)

Darnell, not only is a Chinese university my future employer, but they are my current employer too. I've been working for them for 8 months and will continue during the coming years.

Does that make any difference to you in the advice you gave me? Why would my parents be helpful as a co-sponsor?

What I've written about the joint sponser actually applies in your particular situation.   You have no sustainable income in the USA, and must obtain a joint sponser to have a successful K-1 interview at the IV Unit in Guangzhou.  You won't qualify by yourself.

as to 'why your parents' - it doesn't have to be your parents - it could be anyone in the USA, a LPR or USCitizen, that you know, that meets the requirements for sponsership.

You'd fill out the I-134, a joint sponser would fill out a 2nd I-134 - both are submitted to the IV Unit on/around interview day.
