K-1 Fiance(e) Visa Process & ProceduresFluctuating income I-134

I am confused about the same thing, my fiance i paid per hour, and made enought all of the years, but wasn't working full last year so he made around 25 000 instead of around 35 000. should i put income as calculated hour rate x 40 hours x 52 weeks, or just what he earned last year??  And how to put up a employer letter, how should i state annual income???

K-1 Fiance(e) Visa Process & ProceduresI-134 for 2013 - only letters and space

i have this form filled out, but the form on VJ is older version, i downloaded new version, and for example Annual income you can't put 56,700 but only numbers 56700. And I can't out N/A. That is what is confusing me.

K-1 Fiance(e) Visa Process & ProceduresI-134 for 2013 - only letters and space

I started filling another affidavit of support since there is this new version since 12/17/2012. And in the for example Middle name i should put N/A and it is not allowed, for State also, for annual income only numbers (example 55700). Should i put only numbers like that 55700 or what, and leave middle name and state blank?

K-1 Fiance(e) Visa Process & ProceduresForm I-129F / OMB No. 1615-001; Expires 06/30/2013

Greetings All,

Does anyone know if USCIS is accepting the I-129F form with expiration date of 06/30/13.

Here is the link to the I-129F PDF Form on USCIS.GOV

http://www.uscis.gov...form/i-129f.pdf

It still has the form on there that has the expiration date of 06/30/13.

Any insight on this?

I ask this because I see a time line for a member on here who shows this:

Aug 3, 2006 Sent I-129f in to CSC

Aug 15, 2006 They sent I-129F back saying form is outdated

Aug 15, 2006 Sent in updated I-129f

Aug 23, 2006 NOA1

K-1 Fiance(e) Visa Process & ProceduresI-797C, Notice of Action (Different Format)

Has anyone notice that the I-797C, Notice of Action is coming in a different format then previous document.

The previous document was a 4 color embossed stationary.

The new document is simply black / white printed document. It's hard to tell it's even an ORIGNAL document.

On another subject, I am using file binders to secure all my documents. I use a 2 hole punch at the top of the document and then place in the binder.

My question is, can you use a 2 hole punch on the ORIGNAL black / white printed document? It this permissable?

Thank you in advance for your replies.

altonbebeMalePhilippines2013-07-18 01:05:00
K-1 Fiance(e) Visa Process & Procedureswhere to place I-129 packet?

Do not hole punch or bind your entry.

USCIS has their own protocol for binding documents in their folders.

I deal with U.S. Customs on a daily basis for exportation of vehicles and rolling stock. The things that really upsets them are 1) submitting more copies then they ask for, 2) notarized copies in leau of ORIGINAL documents they request, 3) documents stapled together with a MILLION staples, 4) documents that have been hole punched to a different setting then the one they use.

Just simply put your documents in the envelope. Follow the guide lines found on VJ. (they are actually pretty good). USCIS will disect your document entry, retain what they want, trash the rest, and will bind in thier binder.

Hope this helps.

Stay away from Translation Software. It is ####### translation.

If your concerned, goto to http://www.atanet.org

At that site, you will find ATA Certified translators.

K-1 Fiance(e) Visa Process & ProceduresDs-156k question quick one

This is country specific, plenty of countries do not require any evidence of relationship in packet 3 and will only request it in packet 4 if needed on day of interview. You should ask this question in the Philippines forum.

Alex&AmyMaleAustralia2013-06-21 22:52:00
K-1 Fiance(e) Visa Process & ProceduresInterview tomorrow but I can't work out how to pay the $240 fee!

You should pay at the post office its easier, just print the payment info you get in packet 4 and take it to the post office and keep the receipt they give you . I'v never done a K-1 interivew at sydney but I have done other visa's there and usually you pay a fee at the post office and once you get approved on the day they do actually charge you a smaller fee for the visa which you can pay there. It usually works out to be about $240 at post office and $110 at the consulate.

I'd let them know when you return your packet 3 you have a wedding planned, it may or may not help speed it up, but it is on Sydney's list of reasons to need an urgent interview. There was at least one person from this site that got their interview 5 days from their packet 4 date.

You can file overseas it is not a problem, there are no requirements that you live in the USA, all the paper work will be mailed to your foreign address it will just take 5-10 days longer to receive it.

K-1 Fiance(e) Visa Process & ProceduresIs the Hep B Vaccine Required?

The rules are country specific also, most developed nations don't require things like the Hep shots. You can also get a waiver for a lot of the shots if you come from a country that doesn't have high levels of the particular virus.

That's some very helpful information - thank you!  I was wondering why some people included more or less than others.  And why in certain cases the x-rays were discounted entirely.  I've got mine.  I'll take them.  If they don't want them, so be it.  It was reassuring to read that they looked "normal".

We did include an envelope with some evidence of our ongoing relationship, but we kept it fairly basic and offered to bring more to the interview if required.  Finding the checklist on page 7 of the DSL-1076 actually answered a lot of questions.  When you are dealing with a large amount of paper, it's easy to miss.

In their email reply the Consulate also instructed me to open the sealed envelope that Kinetic Health had given me at my medical examination.  Inside the envelope was the x-rays, some details of the results and a second sealed envelope. We left that sealed and included it in Packet 3 as per the checklist.

We included my original birth certificate, a colour photocopy of my passport, my original police clearance and certified copies as and where required for other items.  The supporting evidence for the I-134 was probably the largest chunk of paper, but all I all I am pretty sure we got it right.

Thanks for the replies everyone!

- Jonathan

You should probably get your checklist for day of interview/packet 4 early next week, (the Sydney Consulate seems to be working quite quickly at the moment!) that will tell you if they want anything else for the interview, but by the sounds of it you've provided everything! Good luck!

Just so you know in Australia it is not required to submit evidence of relationship. You also must include originals of your birth certificate and police check, you won't need the x-ray probably ever seeing as they have never had a case of tuberculosis from an Australian immigrant, but take it on the plane with you incase they ask to see it at your port of entry, the consulate don't care about it though.

K-1 Fiance(e) Visa Process & ProceduresCustody Child for K1 visa

If you don't have custody you normally need a notarized consent form from the father stating it is okay for the child to move to the USA.  This will depend greatly on how they determine custody in your country.  If the father isn't on the birth certificate it can often mean the  mother has sole custody, but again, this is different for some countries.

Make sure you apply for the visa for your daughter.  While she is a derivative of the I-129F she will need her own K2 visa in her passport.

the problem is, since her 1 years old, the father just leaving us, never see her and support her until now,

and on 2007, i apply divorce to court and that only need one trial, the judge gave the decision on that time..we divorced..

and now 6 year later, i just found out about custody child as i need it to take my child to State and some of my friends have been ask by officer about custody child, and some of them not..

now has been 11 years, i never know where is he or he still alive or not..i have no idea..thats mean i cant get the statement from her father stating his okay if i take my child to USA...

i do apply her K2 visa as is derivatives our petition i-129F, thats why im so affraid if the officer will ask me about the custody child....

K-1 Fiance(e) Visa Process & ProceduresQuestion Regarding bank statements

First things first.  For the Philippines bank statements are NOT required if you income is adequate to meet and/or exceed the I-864P Poverty guidelines.

The Manila embassy instructions letter states MAY, not required...  Can you include them?   Sure.  Will it make a difference?  No, not really, being your income meets the requirements on its own.  What the embassy does want is your most recent tax return, with supporting documents of your; W-2s and recent pay stubs... and you MAY include a letter from your employer... MAY.

For the complete process in Manila click the link in my signature below this posting.   It covers everything from NVC to NAIA (airport) when your fiancée flies "home".

To access your timeline, click the TIMELINE in your profile from any post your made.  From there look for a shaded box near the top, it will have EDIT/ADD MY ENTRY, click that and you can update details of what country, dates for your NOA1, NOA2 and so on....

All the Best,

Thanks for the help!

I have my W-2 from 2010-2012 in hand and ready to be sent

Recent Paystubs I can print from work
and I already requested a letter from my HR department

again thank you!

K-1 Fiance(e) Visa Process & ProceduresQuestion Regarding bank statements

Your profile is incomplete regarding country and your timeline is blank so not sure where your fiancée is from.

If the embassy in the country you are petitioning states they require bank statements then you give them what they want... always keep the embassy happy.

But I am betting in the instructions letter from the embassy it states "MAY be included"

"Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis. "

But not required, whereas the tax return is required.

The bank statements are only a couple sheets of paper, so not a big deal to add to the "stack" for the interview.

Sorry about the timeline. I don't know how to make one

Fiancée is from the Philippines.

K-1 Fiance(e) Visa Process & ProceduresQuestion Regarding bank statements

If you income stated on your tax return meets or exceeds the I-864P Poverty Guidelines then you only need to provide your most recent tax return with supporting documents (W2, pay stubs, employer letter),  you do not need any to send bank statements or lists of other assets.

My annual income is above the poverty guidelines. It's just that the attorney I hired said I should include bank statements and it also says in the requirements.

I also have my W-2 in the past 3 years in hand and recent pay stubs the past 3 months. I'm just checking here to see what others have done. Thanks!

K-1 Fiance(e) Visa Process & ProceduresHelp with Form DS-160

I know some people here are beneficiaries from the Philippines is there a way we can download a copy of the DS-160 so we can have like a rough draft so our attorney can look over so all our information is correct or is it only available to be filled out online?

Second question would be regarding the forms, I read somewhere in this forums that people who went to US embassy in manila had the DS 155,156,157 forms with them and not the DS-160 BUT what my lawyer is having us do is fill out the DS160 form.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of support form I-134 question #11
My fiancé is filling out the affidavit of support form I-134.

We have a question in regards to #11, "if you intend to make specific contributions to the support of persons named (myself, the beneficiary) indicate the exact nature and duration of the contribution."

He intends to support me with groceries, rent etc given I will be living with him and becoming his wife. What would be the best amount and duration to list? This question has made us confused because he wants to support me for the rest of our lives or until I can get my work visa and help with expenses.
