Taking cash dollars are fine but check your travel insurance to see how much you are covered for loss of actual cash. I would still suggest you take copies of bank statements to show that you can support yourself independently for 16 days. Unless, of course, your bank statements don't back that up! I know what it's like. Obviously, I stay in our apartment in the US whilst I'm there so there is not the expenditure of a hotel. My fiance pays for everything whilst I'm there and it's a struggle sometimes to get him to allow me to pay for anything. Once our funds are combined, then it will be easier.

Yes to a copy of your registration documents. In fact, out of all the things you've stated, that is the thing which shows that you have a tie to the UK still.

What kind of figures are they likely to be looking for, for a 16 day stay?
As you mentioned I will be staying in his apartment so won't have any hotel costs either, and I think I will have a tough time getting my fiance let me pay for anything too. Will they take into account that I won't need a hotel or would I need to cover that too?

Also, my bank is very against paper statements, I'm only allowed two paper copies per year unless I pay extra and I've used those two up for the K1 package. Would I be okay to just screenshot my online page (making sure it has my details in view)?

You're right that no one can tell you for certain. However, as this is your first visit to the US, you are unlikely to have problems.

I would also consider taking copies of bank statements showing that you have sufficient funds to cover your 16 days. They aren't interested in available funds on credit cards. Remember to print out a copy of your ESTA. The website says you don't need it but someone here had a problem when the US system didn't show up her ESTA and they took her off to look it up.

Is you car owned outright or is there a finance agreement on it? I don't own a car in the UK so don't know the process but can you copy something that shows you own it?

I just rent a room in a flat, so have a similar problem to you. I took photos of my room just before I left for the airport, so they could see how much stuff was left. They were timestamped. My fiance did point out to me that it could have been any room, not mine and I just moved my cases in there to look like my room. But it made me feel better at the time,


It's actually my second visit, I went on a 2 week family holiday to Florida back in 2007. I'm assuming as it was 6 years ago now and was only for 2 weeks, it will have no effect on this visit.

I was thinking about just taking cash dollars rather than using a bank, as I'm sure mine charges stupid amounts for withdrawals abroad. Would this be just as good?

And I own the car. I have the Registration Documents to prove this, should I throw in a copy of that too?

I posted in here a week or so ago, when I was thinking about visiting my fiance in Texas. We have now booked the flights, so I though I'd pop back in here to check if what I have for ties is enough.

I'll be going for a 16 day visit under VWP, to Houston, but my POE will be Hartsfield–Jackson Atlanta as I'm getting a connecting flight from there. (Anyone have any experience entering there?)

I'm rather nervous as it will be my first time flying such a long distance alone. I've only ever gone around Europe on my own, which I'm sure must be quite different.


I don't have a job in the UK and I'm living with my parents.

So this is what I'm thinking of taking for my ties to return:

Travel Insurance matching flight dates
Certificate of Car Insurance
Phone Contract
Copy of NOA1


I know nobody can tell for certain, but does that sound enough or am I likely to have problems?

Reading this thread makes me paranoid of getting an RFE, We sent in a lease of our apartment in the US with both of us and our social numbers on it,letters from the Tax Office with both our names on it to the same address, Travel Itinerary to and from the US and to Australia, Bank statements to both of us, Photos and Passport stamps and Visa stamps to each country. Do you think that is enough for evidence of having met?

  • i'll head over in November for two weeks on the VWP, have an engagement party and return home
  • when the visa does come through i'll head over and get married

or

  • head over on the VWP(im a bit iffy about this-any ideas??) and get married
  • return home and apply for CR1

i'm extremely reluctant to post the November event as my fiance and both families will be gutted

 

Wow. A lot of people have been pretty judgmental on here and for that, I apologize. Not everyone was lucky enough to find VJ before they started this process, and I was one of them.

 

I was in your shoes. We had thousands of dollars on the line for a wedding the end of July 2013, and from looking at processing times back in late 2012 on various other sites for a complete petition to visa timeline, it looked pretty feasible to apply in January and be set to go by the end of July. Same timeline as you - 7 months. Well, as you can see in my signature, that didn't work out too well for us, and we had to forget the K1 and we got married anyway and then reapplied for a CR-1 (so far with no problems! *fingers crossed*) and essentially start all over again.

 

My husband came over on the VWP and brought sufficient evidence proving he would go back to the UK after the wedding, and was prepared to tell the truth about getting married if asked, but luckily, he had no problems coming through. My advice is go with your second plan if your K1 doesn't come in time. And lucky you, the processing times are dramatically faster than they were when we applied. Yes, it would be gut wrenching to spend practically the entire first year of your marriage apart, but alas, we're almost towards the end of this process since we started with the K1 in Jan 2013 and filed a CR-1 in Sept 2013.

 

Keep shooting for your original date, but be ready to change plans if you don't get approved through USCIS within the next few months. Wishing you the best of luck. I wouldn't wish what happened to us on anyone. :)

Is that typical?  I didn't get mine notarized; I don't remember seeing that requirement.

 

my NOA1 on 11 March 2013 and got RFE on 28 June 2013, actually the mailed said "need affidavit letter of intent" but our lawyer  told us to notarize the Letter of Intent to marry by notary public, and just send it back on 15 July but until now, our status on web still "RFE" ..not change yet...

Welcome!  You do not need a lawyer.  There is so much helpful information on this site and many people here who've successfully done it themselves.  The VJ guides will tell you everything you need to know and as long as you follow them step by step you should have no problem!  Many of the people on here who have had lawyers have paid ridiculous amounts of money for them to do nothing.  It's just paperwork, it's not that hard and it's definitely not worth spending thousands of dollars on, the process is expensive enough!

I was under the impression that I didn't have to worry about that until I recieved a NOA2. What is the correct requrement? will I get an RFE for not submitting the affidavit of support at the petetion phase?

I'm not an expert at all, but I will tell you what I did and why.  I am the petitioner in the USA.  Because the instruction packet from the embassy in Malaysia said "...An original signed notarized Affidavit of Support (Form I-134) must be provided...."  I took that as exactly what It said and I filled out the I-134, signed it and had it notarized, and I sent it by FedEx along with other original documents (signed G325, tax returns, original letter from my employer, etc.) to my fiancee in Malaysia.  I almost missed the "notarized" part and saw it just before I was getting ready to FedEx the documents.  I would hate to have them reject or delay us on a technicality like this, so I'm trying very hard to do everything perfectly correct.  It is very nerve wracking and I worry every step of the way about accidental errors.

I just got the answer by email from the embassy in Malaysia.  They absolutely DO require a certified copy of BOTH the petitioner and beneficiary prior marriage certificate.

 

Something else to note is that although there is no place printed on the I-134 Affidavit of Support for a Notary Public to sign and seal, the instructions from the US embassy in KL say that the I-134 must be notarized.  The notary I took it to completed a form to add to the two page I-134 stating the notarization with its seal.

The embassy in Malaysia sent the checklist to my fiancee' there (beneficiary).  It says she needs to bring original marriage certificate and divorce decree to the interview.  She has her divorce decree -- no problem, and is trying to get her hands on the original marriage certificate from her first marriage.  She's having a hard time getting it, but she is trying.

 

Here is my question: will she (beneficiary in Malaysia) be required to give them my original marriage certificate from my first marriage, or are we misunderstanding the instructions?  She does have my divorce decree which ended my first marriage.  Just need to know if I have to get my hands on the marriage certificate for the first (ended) marriage for her to bring to the interview.   ~Thanks

I received a RFE hard copy today for our I-129F and it is requesting evidence for affidavits. The notice states " Please submit additional evidence, such as affidavits to establish that the beneficiary is entitled to the benefit being sought. Affidavits must be sworn to or affirmed under the penalty of perjury by two persons who were living at the time of the event and who have personal knowledge of the event that you are trying to prove. The affidavit should contain the following information regarding the person making the affidavit: his or her full name and address, date and placed of birth, relationship to you; if any; full information concerning the event; and complete details how she acquired knowledge of the event. The persons making the affidavits need not to be US citizens.

 

Has anyone received an RFE such as this and if so how did you rectify the situation?

I was wondering whether I, as the beneficiary, can call USCIS and inquire if everything is OK , or whether we have any RFE pending. We are approaching our 5 month, and I just want to be pro- active. IN under 5 minutes, a spanish speaker will come on the line.

 

let them unwind, then say 'English please' then when they unwind again, the petitioner can ask a question.  However, the CSR that answers the phone can only see what you can see online.

as to relationship evidence between you and the mother - uncertain.   i would certainly show relationship evidence between the mother and son, a collection of photos showing the two of them together from birth until last visit. 

 

might need letter from the father, giving permission to immigrate to USA.

If I were in your shoes - I'd pay the fee then suss out that stuff by trial and error [using the english language version of that portal].

My apologies, I should have stated that I am the petitioner. I am the one that currently is without income. I have not yet submitted the I129 because i am not sure if it will have any chance of being approved. I supplied the quote from the USCIS page because it specifically states that no affidavit of support will be required until AFTER the fiance arrives in the US and adjusts status. It's all a bit confusing and I just don't know what I should do.

Months will pass after submitting the I-129F. 

 

So, you have months to suss out your finances, all the way through to interview day.

1.  not become a USC and still an LPR.  

2.  see 1.  

 

if a USC or gave up gc and go back to china, or is dead,  that person isn't countable.

options: 

1.  marry after 90 days, file I-130 + I-485 set or 

2.  delay your entry into USA - I suggest November, if possible and your visa duration allows - then marry, file the I-485 set without the I-130.

beneficiary in Vietnam? I swear, they now use ustraveldocs.com and file a DS-160 online, so this concept of 'where to send the packet to' , for a beneficiary, ain't a concept anymore.

if petitioner concern about petitioner change of address/moving - that's a whole nother kettle of fish, address change between NOA-1 and NOA-2.
