Ok, I just made a call to USCIS today and learned my I129f petition is denied. I haven?t gotten the notice yet so, I don?t really know what exactly happen although I could spell based on the scenarios of my petition. 

 

My fiancé and I got to know each other in the past 2 years and we were constantly communicating with each other with all available means.  Originally, both of us are from the same country but I have immigrated to the US a long time ago.  Due to difficulties of me going there and her difficulty of leaving the country, we never got a chance to meet in person in the past two years.  The difficulty is all political related situation in the country. One thing I should add is that my family and hers know our relationship and they took it for granted we are paving our ways into marriage.   After I learned she was able to leave the country, I was excited and I immediately petitioned and asked her to travel to another country so that we could spend time together.  Knowing that she could leave the country, I immediately petitioned for her.   When I filed the petition, I told USCIS we didn?t meet in person because of the difficulty the two of us faced.   Essentially I requested a wavier based on the two conditions provided in the instruction and I truly believed I fall into that category.   The petition was filed and a couple of weeks later I got a chance to meet my fiancé in a neutral country.   On my return, I found an RFE letter demanding evidence for our meeting in the past two years.  I knew USCIS was not convinced with my presentation in the petition.  I know that there was NO way the two of us could have met in person since we started dating but in hindsight though,  all I needed was wait a month and half to have all straighten and then file for petition.  This didn?t happen and I have to face what I should do next.   My understanding is that my petition was rejected b/c I didn?t qualify to petition I129f at the time I petitioned.   Now VJ folks, I seek you advice what I should do next.  Assuming my case was denied based on what I presented above, should I appeal immediately after I receive the notice or should I reapply the petition?  Is there a time delay b/n consecutive i129f petitioning in which case the first one is literally denied based on applicants mistake.  Please give me your advice where I could advance my case in the shortest period of time possible.  Also, I would like to hear if anyone had done a similar mistake like myself.

Be sure you thoroughly show you meet and was in the same place at the same time. You don't want to mess this up. More than just stamps and receipts. You need pictures and I pray you have pictures of you at landmarks or places easily identifiable in pic.

They would have to be married to go that route. And really its not a Visa thats issued too often if at all. Doesn't get your hunny here any faster and majoritty of time the I-129F petition will be closed by either NVC or Embassy when they see an approved I-130 in the system.

In September 2011 I began dating a Brazilian girl. Things were great and we were in love and in October 2012 I received my USCIS Acceptance Confirmation, that the petitioning process had began. Her behavior began changing during the waiting period and I saw some serious red flags. When I tried to talk to her about the red flags she freaked out and broke up with me. She wanted to get back together shortly after but I thought we definitely weren't ready for marriage. I sent a letter ending the k-1 petition before the initial review was over, I think January or early February 2013, 4-5 months into the processing.

 

I had made a Ukrainian friend that I was talking to shortly after I ended relations with my ex. We were just talking as friends until I went to visit this past August 2013. We became romantically involved and by September I was officially in a long distance relationship again with a foreign girl. Was really something I told myself I would never ever do again. If you met this girl you would understand. Smart, funny, and the most genuinely nice person I ever met. Amazing in every way, and any issue I ever had with my ex, this girl makes up for in spades.

 

I want to marry this girl eventually, not sure when, but when I do I'm really worried that my first petition will interfere with trying to marry this second girl. Some questions..

 

1) Is it true that I need to wait 2 years after my first petition to apply for a 2nd?

2) If so is that 2 years after I first applied? Or 2 years after I canceled. There is a 5 month difference for me.

3) How much longer/rigorous will the process be with the USCIS knowing I applied already? I canceled before the initial review was over, does it help?

4) I haven't told the Ukrainian girl that I had already petitioned for a K-1 in the past. I didn't want to make her jealous. Also the whole situation was embarrassing for me so I really just try to kick it under the rug. If she gets an interview one day will they ask her questions about it? Should I just tell her anyway?

 

Sorry for all these questions.. I have no idea how my life got so complicated. I heard all the jokes "why not just get an american girl blah blah" my life just worked out this way. Every decision I've made was 100% sincere.

You will submit evidence and intent like before. The scrutiny will be at interview. Which bring me to your next question

Well if you are going to eventually petition her you have no choice but to tell her because it will come up at interview. And if she doesn't know that is a guarantee denial.

We wanted to have my fiancé and her daughter come at the same time. Should I have included a separate application for a K-2 visa for the daughter along with the K-1 paperwork I sent in?

 

 

The I-129F is all inclusive. Its not until after you get case# and go to embassy you will do the DS-160 that is the actual Visa application. The I-129F is the petition for you as a US citizen asking to bring your family over.

 

So later you will do the two applications.

Hello, I sent in the application I-129F for my fiancé and her daughter. The amount I wrote the check out for was $340. My fiancé now says I should have wrote the amount out for $680 to pay for her daughter to.

 

How much should I have sent?

 

Our paperwork is in the process of being reviewed. If the amount is wrong should I call them or?

The I-129F is correct amount $340. It's when you apply for Visa it gets separated.

 

Eligible children of K-1 visa applicants may apply for K-2 visas. Separate applications must be submitted for each K visa applicant, and each K visa applicant must pay the visa application fee.

Don't get so bogged down with relationship things. They are asking you to prove the "you have meet in the last 2 years". 

 

Follow what others from Kuwait did. Use the stamps on Visa, Work permits and your lease with both names. Remember show the last 2 years anything else prior won't satisfy them.

 

Also this is also your chance to send extra evidence if you didn't send much.

 

Hurry get that in and you should have approval very shortly after that.

Whether married or not you have to start all over again. I would surely get married. There is nothing to appeal because the error was yours.

 

Be sure whenever you do file you write a letter of withdrawal even though your fiance' needs to contact the previous petitioner to officially take off books. But you should still have letter in there.

 

Let me ask was the previous I-129F filing listed on your application?

We are currently in relationship for 5 months.  I have not known him previously.  And I agree it does seem suspicious.  We have just started discussing the permanence of our relationship and the options....................................................................it seems I may have not told complete truth.sad.png  I will post again when I understand better.

 

It seems you don't really know either the K1 visa process. Do you realize you can be approved as fast as 2 months from filing at embassy and he at interview within 5 months?

 

Do you realize you HAVE to be married within 90 days of him coming to the US? 5 month relationship and you two are ready to marry? (Not doubting I am asking because it seems like a visit is more in order.

 

Also i have to ask the most important question. Have you two meet face to face yet? You can't file until you meet (unless you are approved to have the meet waived)

Okay this doesn't seem right. You went to Pakistan 3 months ago meet a girl and engaged and all that in one visit, while you had a wife back hone REALLY??

 

So was this an arranged marriage?

 

Did you know this woman previously?

 

Does your current wife you are still married to know what you have done?

 

Why didn't you divorce before your naturalization?

 

Is your US citizen wife from your country? Or naturalized also?

 

You have a big big read flag. Does not look good at all.

Am I the only person who is concerned that the fiancee got denied a B2 visa (the easiest visa to get)?

 

What was the reason for her prior denial?

 

FRom India ummm no why would you think its so easy. From countries where we have to apply for Visa to visit is more than 50/50 denial. And some 0ver 90% denial. There's no such thing to a Non-VWP as an easy Visa. It's easier to immigrate than it is to visit for most of us.

 

And B2 denials always the same "no strong ties to country". Is the usdual denial.

We did not get a 221(g) asking us to show more proof of our relationship. The consular gave her a plain letter saying that our petition will be returned to USCIS for review and possible revocation. Our case was in Administrative Processing after the interview for about two weeks and sent back to NVC.

 

I have contacted a senator's office and they said they got a reply from consulate/embassy saying that the consulate can't specify the reason why they refused visa to my fiancee. They probably have no valid reason to specify. I read the consulate should specify a reason, documenting information they found that was not available when the petition was approved, when denying a visa returning the petition to USCIS. In this case how can they send it back to USCIS without any reason?

 

From what I read online I think our petition will take 6 months to a year to get to USCIS and they will send me a letter suggesting that my petition has expired and I am free to apply again, at best.

 

It is very depressing to see all our efforts for that past 8 months killed within a few minute interview. I find this very hard to accept especially thinking about going through all over again or relocate to get married.

I don't even know how it is going to effect my future efforts.

Any suggestions ?

 

  1. Ask your Finacee' what were the questions asked?
  2. What was the focus of the CO? Did they ask alot on a certain subject?
  3. Do you have red flags in your relationship?
  4. age?
  5. religion?
  6. petitioned before?
  7. divorced?
  8. kids from prior relationship?
  9. What did you submit in your petition (not bring to interview but with your petition to USCIS) that shows a bonafide relationship?

 

Many embassies (like my Nigeria and your India, the MENA's and more) you have to show more than we meet in last 2 years". You have to show real good proof of a bonafide relationship.

 

I dare say that a K1 interview is handled like a spousal interview they want to see bonafide, visits, facetime is the # one thing, not just we meet on the beach and want to get married that some can get away with.

I forgot to make a copy of my K1 forms before sending it but I do have originals as we printed each form twice and signed it just in case the first one gets lost in the mail  and we wanted to save time since I live in the US and my Fiancé in London. Does it really matter to have a copy of the forms and how can I go about doing that if it's mandatory.

The extra copies are for you. Not mandatory. Nothing you can do about it now. Doesn't affect anything just nice to have if they lose your petition or you wanted to review some things.

It's not required or necessary. You are trying to prove a bonafide relationship. Show things that point to that.

My fiance and I met in October of 2012 in Thailand while I was volunteering and he was attending school. However, he is from Myanmar, and was attending a mission school (not registered in Thailand) because he is part of an ethnic minority. Therefore, he has no Thai ID of any sort. We have been in a relationship since January 2013 and engaged since 2013 and were together almost everyday from January 2013-April 2013 and then again when I returned to visit in August-October 2013. Because he is from a very rural area in Myanmar, he does not have internet or cell access. We stay in contact through phone calls through his village phone, but have no way of showing proof of that. Because it is so expensive and difficult, when I want to send something to him, I send it with a friend who is going to the area, so I have no proof of letters or gifts that way either. I have read on here that some people have 50+ pages of proof of a continued relationship. I was just wondering what I could do in this unique situation? Praying that he can be here asap so we can be together always!

Your #1 evidence to show a bonafide relationship is visits and pics of you with family and friends.

 

You can write a coverletter with your evidence when you file what you did say about limited access.

 

The biggest thing is for your K1 you have to show you have meet in the last 2 years. So focus on that and build more evidence (the extra stuff) while you are waiting.

 

Do you have receipts of what you have sent him? If not well nothing you can do now. I know many who had no phone logs or internet anything. It does happen.

 

Have you sent cards and letters to each other? (I know international mail is a nightmare but thats one other evidence).

 

But just get that "meet within last 2 year" evidence .

 

Focus on pictures your face to face, what you saw and all the places and show evidence of all that.

@mimolicious See, that, in my book seems kind of contradictory. How long was your relationship up to that point? 

For us, considering how much conversation has been going on for those 7 years, it'd be more like 300 pages instead of 30. 

And that's at a minimum. 

 

I've considered one thing, though: I would like to include copies of both our college transcripts, which show, as outlined in the letter of how we met, that we first met because we attended the same college class in early 2007. I understood that I might not have to include anything else in this initial application that refers to an ongoing relationship, but I think this one would fit. What do you guys think? 

No it doesn't fit in initial application. That is for interview. 2007 is too old and trust me you may confuse the poor person adjudicating your case because they will see they meet in 2007 and they may look at that as the last time you meet.

 

Focus like i said on the last two year meet requirement. Save everything else for the interview. I mentioned the Relationship timeline especially for you so you can tell what happened in the 7 years so they can see in a snap shot have evidence examples if you want (how we meet 2007...the transcripts on and on).

 

I think you are trying to put too much in something and you arre getting way from what you are required to do. I have read too many times folks who been together since childhood and they showed all that but the last two years was lost in all the mess. So they got denied at USCIS some get an RFE and a second chance.

Alright, I think there's something I can do. 

Oh, and forgot to ask, but in terms of email records/logs (just the list of emails sent back and forth, not the individual ones) does it matter whose email account the screencaps are from? I've screencap-ed our email records from my account (the beneficiary's), but should we submit ones from my fiance's account (the petitioner's) as well? 

 

Also, the letter of how we met (I-129F Supplement: Question 34.a.): Should this have a date and a letterhead like the Fiance Letters of Intent? 

Or is a simple signature at the bottom enough? Thanks! 

On eemail account is fine. remember the MOST important thing you need to focus on is showing the "meet within the last 2 years" you would be surprised how nmany people do not clearly show this. So just focus on that emails and such is later stuff for months down the road.

So absolutely no evidence of a previous relationship beyond the 2 years in the application whatsoever?! I'm sorry, I'm just very surprised since I read the opposite a lot beforehand. 

I don't think we have any red flags. Except for the fact that we were both in unpaid jobs and/or temporary unemployed for many years (in my case that had something to do with my F-1 visa and being a full-time student without much spare time). However, with my fiance's new job, we can cover the financial requirements just fine. 

 

I was once held back and questioned at an airport in Atlanta, GA when I wanted to visit him, but after they had grilled me for an hour for reasons that had nothing to do with me, they finally let me go and I could enter the country. I'm not sure if that ordeal is on my record anywhere or if it would be counted as a red flag, even though I did nothing wrong. 

No you didn't have it wrong. As each of us find out every embassy is not created equally. But Germany I see no issue. Just show what you need to.

 

And trust me I had a summary or explanation for every piece of evidebce (I 28 diffent items and 291 pages). Every page I told a story. goofy.gif

 

See for like a Nigerian interview a K1 is really treated like a CR1/IR1 couple. You have to show bonafides of relationship. Visits matter in frequency and longevity.

 

Some countries like yours, Canda, UK minus any Red flags, all a couple needs really is a marriage certificate or a letter of intent.

 

So no red flags you should be fine. But a Relationship timeline I would advise just for the sake of the CO. To see 7 years of a relationship all in one or two pages. They see when you met, when you said I love you, when you meet the families, engaged. Instead of pouring through a mountain of data and maybe missing on april 11, 2007 you said would you marry me. hehe

 

You will be fine.

Hey you guys, 

 

It's me again. As stated in my previous message, we are currently in our initial application process for the K-1. 

To document our entire 7 year relationship, we have accumulated a lot of photos, emails, postcards, facebook messages, skype records, copies of flight records, receipts, movie tickets, train tickets, etc. 

It's all so much, in fact, that we've just had to upgrade our application to a 5" binder in order to fit everything. 

 

A few months ago, we were able to briefly talk to an immigration attorney for free (we can't really afford one, though) and she kept mentioning to put in "everything but the kitchen sink". On the other hand, it's the records of our Skype conversations, which have taken up the bulk of the binder. We could fill several books with them if we wanted to, since, for the most part of our relationship, we used to talk on Skype every day for several hours. 

We have included about one Skype call/chat a day, but it's still so much. 

 

My question is: How does USCIS look at these kinds of things? Is there such a thing as too much evidence? 

Is there a way to lessen the load without the person reviewing this to think "Why did they only Skype once a month?"

Well to answer your question USCIS could really careless. All that evidence really is for the CO at embassy. Everything but the kitchen sink is more for those at hgh fraud embassies, difficult embassies and people with read flags to over come.

 

When it comes to communication shoing shoing a log of calls, or when messages were sent with a brief sampling of what was sent is good.

 

I did a summary by the month I selected 3 conversations and at top of each page summarized what was that month about that was significant.

 

They really are lookig for normal regular communications. Most of us have the IM, Text, SMS, Skype, EMAIL, letters cards showing we talk usually daily thats what they want to see not nescessarily every word.

 

When there were gaps for us (phone lost, disconnected, network bad) I noted it. I left nothing to their imagination.

 

And yes you can do too much because it can also be looked at as hidingsomething. So quality is so muc better than quality.

 

For someone like you guys that have years together a Relationship timeline that pulls out the hiigh points and they can see on no more thane 2 pages your journey.

Mickey?s visa application is denied.  Reason for denial: Investigator did not believe I was committed to marrying Mickey within 90 days of his arrival in the States on the K1 visa. Why? Because at the Feb. 16th interview with the investigator, I stated that I filed a fiancé petition instead of a marriage petition so that my kids could meet him first before we get married and be in attendance at our wedding. Investigator interpreted my words to mean that I needed to ?understudy? my fiancé and that I wasn?t sure about marrying my fiancé.
  • April, 2010 ? Attempt to overturn denial while case still at the Consulate: Letter sent from my attorney ? Marc Ellis ? to the U.S. Consulate in Osaka, Japan along with affidavits from friends and family attesting to the fact that my intention was always to marry Mickey as soon as he arrived here on the K1.  Attorney letter and affidavits never acknowledged by Consulate.
  • April/May, 2010 ? Plan our wedding.
  • May 29, 2010 ? Trip #5 to Osaka, Japan. 
  • June 1, 2010 - Get married!!!!!
  • June, 2010 ? Upon my return to the U.S., file an I-130 petition for my husband to come join me in the U.S. on a CR-1 visa.

Hi,

 

I'm a little confused as to what to include in the Packet 3 to send back to the consular because it asks for form DS-156k, however that form says "the following documents must be attached in order to apply for a fianc(e) non-immigrant visa". Then is lists "your birth certificate, evidence of financial support, police certificate" and so forth. So do I include those in the package that I send back to the CSC?

So than you have passport for the baby than? Not sure about a Visa they need you should verify with the Ghanaian embassy in the US to inquire. But yes you need a Visa in your passport. Or does the country you have passport from require you to have a visa.

 

You're not giving alot of info. so we are going back and forth. If the country requires a Visa (and Ghana does )and you are not a citizen yes u need a Visa to go there. You would apply at the ghana embassy in US wherever they are.

If you are not a citizen of Ghana yes you need a Visa. Green card is just for the US has nothing to do with Ghana.

 

Also does your baby have a US passport? or what country was your child born.

 

As far as shots you should call the health department that does travel shots and ask what is best for a 6 month old. There are no shots that are required just so you know. Just advised like yellow fever, DTP.

hey guys i have 2 questions don't know where im suppose to post this but here goes First, i made 14k last year i don't know if that's OK or not i heard i can send a letter stating that my fiance wont be a public charge with the salary i make i don't know if its BS or not so my question is if its not enough i know i would need a co sponsor so if i made 14k would my co sponsor only need to make the remaining 6k to complete the 19 or 20k for the poverty level or would they need to make the whole 19k? My second question is i been with my fiance for 4 years and just now started the petition do you think when i go for the interview they would ask why it took so long to do the paper work we just wanted to see how things go and save up for the visa and the AOS when he comes here right away? 

 

As the other poster address the Affidavit of support issue you need a co-sponsor. Writing a letter is BS. You have to show it in income.

 

As far as if they will ask that's all dependent on your evidence. More than likely they won't but it can be asked if you show you were unsure.

Hey, guys!!
When filling out the affidavit of support, what forms do I need to prove my income?
Like pay stubs or a letter from my job? Or just tax info?
I got my W2 form today to file my taxes, but I only made just over 12K last year BECAUSE I was visiting my fiancé in England in January, February and march of 2013 and also November 2013- January 2014.

Will this be an issue for my salary requirement? And I am allowed to use savings, correct? I have 14K saved.
Also, I am planning to buy a house soon, so I won't have my savings in the bank...

I'm so worried I won't meet the requirement, as my fiancé failed to meet the requirement for the UK fiancé visa.

Think of a co-sponsor if you don't meet the guidelines because the savings if you are going to use to offset the difference in your pay must be in an account to show them. How else will you they know you have it.

 

And you can't use a house you just bought.

Do you know if after the Fiance Visa is put in my fiance's passport, can he still "visit" the states and come in officially on the fiance visa at a later date or once he has the visa and visits the states then does that automatically starts the 90 days?

 

I ask bc we are planning to get married in July, and have him move here in May.

but he wants to visit in March and this could be after his interview date.. ( we are awaiting the interview date at the moment)

Why not delay the interview if its before you want. Don't send in paperwork to have an interview schedule even. Since you are a VWP he uses that to come and visit in March when he goes back send in the paperwork you need to get the ball rolling on your interview slot.

1) Take a position as a waitress at a local bar / club. Some of those girls clear $ 200.00 to $ 300.00 / weekend night.

 

Add that up. 52 weeks x 2 nights / weekend x 200.00 / night = $ 20,800.00

 

That is enough to sponsor your fiance.

 

2) Talk to a CPA>  Your loans, grants, and scholarships could be classified as INCOME depending on how they are structured. If they are classifed as income, boom, that adds to your bottom line.

 

3) Are you getting child support from a parent, yes, I know that shounds funny, but some devorce decrees are set up where a child will receive child support if they continue trhough college / university. Boom, adds to the bottom line.

Yes, the 2012 ITR is that important.

 

Also, Philippines is really hard on co-sponsors. More are denied than accepted.

 

My question is why is your petitioner making such a small amount of money?

 

If he is evading sending these documents, there is a reason why.

 

Unlike others above, go to the interview. You may /maynot be approved. Take the previous year ITR and the current year pay check stubs along with letter issued by employer. It may just work. I have read cases where it did.

 

The worse thing that could happen is you get a 221G because of it. Then you will have to submit the MISSING documents, but at least the interview is out of the way.

 

Now a reality check:

 

1) Are you award that it is EXTREAMLY hard to live on $20,000.00 / year in the United States?

2) You mentioned he does not have an education. Like the Philippines, it is very very HARD to get good paying salaries in the U.S. without an education.

3) When you arrive, you are not allowed to file for social services for aide. If you file, your I-864 sponsors will have to pay it back. ( although, rarly enforced)

4) His reluctance in sending you the required documents should be of MAJOR concern to you.

 

In closing, my prayers and luck to you. Walk with open eyes and realisitic expectations. Be cautious.
