First time post-er here! 

 

I am the petitioner in currently pending K-1 Fiance Visa case. My petition was accepted to USCIS on October 31, 2013. Since then, I have been checking the status daily and have not yet received any notification for any Requests for Evidence.

With that being said, my questions are fairly straightforward and I will be FOREVER grateful to anyone and everyone who can help me answer them based on your similar experiences. 

 

 

 

1) Assuming,(and hoping and praying) that there are no unexpected delays or Requests for Evidence, are the USCIS estimated wait times (5 mo.) fairly accurate? This month will be 4 months since the acceptance of our petition. 

 

No. It's an average. I have two friends who filed last month and got NOA2 others filed last summer and still waiting.

 

2) Once USCIS has approved the petition and then sends it to NVC, how much longer can we expect to wait before my fiance is notified by the Nicaraguan Embassy for an interview appointment? (**Also, HOW are we notified about all of this? The mail/address system in Nicaragua is extremely unreliable, and I have dealt with plenty of lost and very delayed letters that I have sent to my fiance in Nicaragua. Therefore, I need to know if I will also receive any notices that are mailed out/ emailed/ etc.)

 

I would suggest you go to your countries portal on VJ and look around and look at others timelines.

 

3) Is there any possible way to go ahead and find out what specific documents, vaccinations, fees, etc. that my fiance will need to have ready on the day of his interview? It is my understanding that we (or maybe just he) will receive a packet from the embassy stating all documents that he will need. But i was just wondering if we can go ahead and start working on all of this, including having the money ready for any unexpected fees, in order to attempt to avoid being rushed to get all of these documents in order.

4) My fiance and I have been dating for almost 2 years, but we met in the United States. He was here illegally, but was NOT deported. He left on his own good will to return to Nicaragua and to start the process of getting legal permission to be in the US. That being said, we were honest in our petition about how (and where) we met. Will his previous unlawful presence in the United States disqualify us for this visa? I would like to go ahead and know this now, instead of getting all my hopes up and being extremely disappointed later. 

 

Yes he will have to serve out a ban it could be 5 years it could be 10 years and than you will have to have a waiver. I would seek a lawyer now.

 

I believe these are all my questions...again thank you to whoever is taking the time to read this! I am a little frantic and overwhelmed with all of this. And just want to make sure I do everything right in order to avoid careless mistakes and a denial for any of my filing errors.

One thing I wanted to throw out there since you ask about filing. Besides the withdrawal of the 1st petition by the petitioner, what about if anything has been sent by the petitioner to stop any future petitions for your fiancee'?

 

Consider this. If she came here and realized she made a mistake and decided not to marry. The petitioner might be one angry mad guy and report her to immigration and her name may or may not be flagged. Or,

 

She came here and he changed his mind and decided not to marry her and still he notifies immigration of fraud or whatever. Whether its fact or not its reported and out there. is she on good terms with him. Talked to him. If he found out she already foiund a new love before she even left the US how would he feel (just food for thought).

 

Neither you nor your fiancee' have any idea if he has done this. It's something to consider.

 

Also seems the only thing considered here is that "you meet the 2 year meet requirement". The embassy in the Philippines is no cakewalk and didn't you just meet?

 

If you posted "I meet my girl 3 months ago and we are engaged can i file for her", people here on VJ would be foaming at the mouth to tell you that's too fast, slow down.

 

Just trying to give you some perspective and thinking like a CO (I know you don't want anything but law) but Visa approval or denial has not a dang thing to do with any ones law. The embassy breaks the law 99% of the time with denials and we take it up the butt. So please with the law.

You are a K1 there is no $85 fee for you. The affidavit of support (I-134) you bring with you to interview.

They are a K1 so 100% usually but many CO's want to see the Sponsor at least be at 125%. Depends on Country.

100% but really shoot for the 125% because when you adjust status after marriage it will have to be that.

 

Since you don't have your country or a timeline its hard to say what your embassy wants every embassy is different some for K1 will only take 125%.

 

Look at the new guidelines that came out for 2014.

1. Two things to tell you first have you read through all the interview reviews for your embassy?

 

2. Do you know any couples like you with big age difference (woman older) from your country that are K1 (not married but K1)?

 

I ask this because I know for Nigeria I have studied at length and K1's just don't fly for older woman, younger men. They get denied they marry they get approved. Don't know about your embassy.

 

But look at it like a CO a woman 29 years older and she is engaged (like a young person) shows maybe not committed or you not committed especially if you are young man 20ish.

 

Being married shows more seriousness and commitment.

 

Another thing that caught my eye you are talking K1 and you are calling her your girlfriend.  She is 29 years older girlfriends are high school girls. Why aren't you referring to her as your fiancee'? Just curious. These are things a CO would be suspicious of questioning your commitment and seriousness.

 

You also have not visited long enough you need a good few weeks together. Your embassy is no cakewalk. Good luck.

Long story short, my fiance has a prior conviction for marijuana possession.  On the police clearance it just has that a small fine ($10) was paid because he was in possession of a dependence forming substance.  Fiance said it wasn't his, but he was arrested because it was in the pocket of the clothes he was wearing (I know same story everyone tells, but in his case, I believe him because of the circumstances that led him to wear his friend's clothes).  His friend came to the police station and admitted that it was his and the friend paid the fine, so my fiance didn't think about it again and certainly didn't think it would be on his record.  He can't expunge it because it has only been 5 years and 10 yrs needs to have relapse.  Fiance has never had any criminal charges before or after the incident and he doesn't even smoke pot.  

 

The court advised him that he can get a lawyer and try to get it expunged.  That process may take a few months but with no guarantee that it would work.  He did speak to a lawyer and the lawyer said he'd help (for a fee of course).  Lawyer told him to get an affidavit from the police station confirming his story and the lawyer would write another letter explaining the situation and send it to the police head quarter and get it expunged, but I'm so skeptical.  Of course if it works, I will, but it's just a shot in the dark.  The money isn't the issue, I just don't want to wait months on end for possibly nothing.

 

I want to call the consulate and see if they would give me any indication on whether we should try to get it expunged or if they may waive it since it was a one time offense.  I know it's a long shot- but I thought I would give it a try.  I have read that there is a waiver that he can fill out if he does get rejected, but is this something we can do preemptively?  

 

If anyone has any experience, insight or advice, I'd love to hear it.  Thanks in advance!

 

The consulate can't nor will they ever advise you on a legal matter. Expunged means nothing he would still check yes.

 

So are you saying you filled out a DS-160 and lied about the conviction? So they have a DS-160 with a NO checked. Yikes.

Hello,

 

My fiancee and I started the application process for a K1 visa in April of last year. Our I-129F was approved in August. Since then, we have been stuck: our application was never sent to the national visa center. I called in October to have my application resent, and it was in November. It still has not reached the national visa center. I have been calling several times a week but I just can't get any information or advice. In January I asked for expedited service and was told I would receive it, and that I should receive an update on my case in 30 days. Those 30 days are now up, and I have received no information. I call what seems like everyday and no one ever tells me anything. Sometimes they tell me things which are not correct (e.g. "you haven't called since october" and then try to repeat steps which have already proven fruitless). I feel weak and hopeless and worry that my fiancee and I will have to reschedule our wedding plans which we made well over a year in advance.

 

What can I do? Should I contact a lawyer?

 

When you call USCIS (Not NVC since you requested an expedite and you said it was approved) who do you speak to?

 

Have you asked to speak to a tier 2 supervisor?

 

Did you ask "when did my petition physically leave the service center"?

 

Also have you tried contacting your embassy if you were approved for a expedite they would have sent it straight away them after approval. Send them an email also.

I received this notice but havent received a packet from embassy yet. What to do?

 

Have you called NVC to get your case# so you can proceed and schedule your medical and your interview date. All that online update is saying is you are ready for interview. So you can go and schedule one.

 

Also you realize its in Singapore That SGP. You have Philippine flag up so ope it wasn't a mistake.

 

You and the next post I will ask admin to redact your case#. Never ever display that.

more update : a tier 2 officer actually just called back and asked a lot of questions, then acknowledged we never got the RFE , gave us a reference number, said we would get the RFE resend on the 18th of Feb. but my fiance should still go to the appointment on the 15th and they already might have it there by then. so, my advice so far : definately Infopass appointment first thing but also phone call to the service center. and if anyone wants to avoid a redicilous amount of time waiting in line it seems to be worth it having them call you back. 

I will now post my next update here probably after the 15th. Hoping that in the future it will be of help to others

 

Well that's awesome news really. You are a gem to keep us posted. You have no idea how this could help someone down the road. You suffer so others don't have to.luv.gif Thank God for a Tier 2 who knows their job. Now this is what I suggest (I am sure you are already thinking it but just in case).

 

The RFE letter should reach your Fiance' hopefully before his appointment. You two get it all together what is needed in that RFE he will take to appointment and hopefully they can review and approve on the spot.

You will receive an RFE when they get to your case and you will have to submit delaying your case.

 

Your evidence you speak of isn't require the Letter of intent to Marry is required.

All depends on your state and the waiting period after divorce if final. California 6 months some states don't have one. Nebraska 1 year you have to wait to remarry so you would have to wait because you aren't free to marry when you file thats the BIG sticking point so check with your state.

He's been divorce for over 10 years. He's only 3 years older than me. The only thing I can think of is the status. When we came to the US he field as "divorced" but when we filed with our attorney she told us to file as "single" since he was not legally married. She failed to prepare us for what documents he need to prepare for hence the additional documents they requested. We have only seen each other during the time period he was here visiting. That does not justify for the refusal. We provided them lots and lots of evidence of our relationship.

 

When you say lots of evidence what did you submit with your petition?

 

How long did you spend together in person when you meet?

 

And you say that's was your only meet?

 

Has he ever petitioned anyone before?

 

Have you ever been petitioned before?

You can expect your petition to go back to USCIS (I gather CSC since that?s where it was to start) and it will sit and expire.

You next move instead of waiting for USCIS is get married and file a IR1/CR1. With him not really marrying you say than not marrying you it looks suspect to them.

 

Get married refile. Sorry CR1/IR1 are taking quite awhile you are looking at 12 to 16 months start to finish.

 

Really sorry for your delays

After reading many post on PI I-134 and some stating they know some no job or under guidelines and they were approved I think I can see what?s up.

 

Since the petitioner needs to demonstrate that they can support the beneficiary hopefully at some point. Many (usually college age graduates, nursing, you know) they just are starting out but the future income looks good and the government is confident in their ability to score a well-paying job. Unlike someone who may be established (i.e. maybe older) and last 2 or 3 years shaky income makes the government not have much confidence.

 

And since the I-134 isn?t binding and things can change dramatically from the time of POE and when you file your Affidavit of support no wonder the government is like this on this subject.

I don't think her case even comes close to this level.  Worry and anxiety are not mental illness or psychosis.  And were the hell is she talking about alcohol and drugs?  Your just scaring this poor girl and making it worse for her.

You having nothing to worry about as far as the medical goes.  They are only looking for infectious, contagious diseases.  They really don't care about your mental state or stress level.  Also I am sure the expedited request will be denied.  Then you will just proceed like everyone else.

 

my thoughts to you is to take a deep breath and try to relax.  Maybe spend some time on VJ reaching the next steps and the forms you need.  Make a check list and take notes so you don't forget anything.  This site has really help me stay focus and not forget anything important.  Most of all just think about being with the one you love and how you will look back at all this one day and laugh.

Yeah I agree, you should just go to the interview and present the documents that your fiancé has sent you.  Also he should be able to get unemployment money for awhile.  Depending on his previous income it could be as high as $400 week. 

 

As far as finding a job well that depends on what he does and where he lives.  I work as an Accountant, have over 15 years experience plus my degree and I have been out of work for over 7 months.  I live in California and the job market here sucks.

He definitely doesn't need to be stressing about that!  Our interview was in December and they didn't ask any questions about anything financial.  I had the I-134 with me and they never even asked to see it.  Our friends had an interview the same day and they didn't ask them any financial info or for the I-134 either and the petitioner in their situation is a student with only a part time job.  They did ask us where we worked and what we did but that's it.

Hello all,

 

I have quite a specific question that I couldn't quite answer by looking at others concerns for the G325a. Hopefully someone can shed some light on what I'm worried about.

 

In my last five years of employment history, I spent 75% of this time living abroad in Liverpool, UK on student and post-study work visas.

 

I worked in the UK for most of these years, and for two of those years I was registered and worked as self-employed in the UK.

 

I paid national insurance contributions and tax as income was reported in the UK, nothing was owed and often I got a refund, all good.

 

However, upon returning home to the USA, I discovered that I had received bad advice about my responsibility to report foreign income on my U.S. tax returns to the IRS.  My mother had assured me that it was not necessary to report, and I had allowed her to file some tax returns on my behalf for me while I was living abroad. Boy do i regret this now!

 

Since then I have discovered that this is not precisely true.  

With my standard deductions, I would still be below the reporting threshold for IRS income for most of the years mentioned- so I needn't have reported the income. Great!

However, as I had stock activity 1099s were filed.  

To accompany those 1099s- my mother sometimes filed 1040s for me :(... Not great!

So for at least one year in the last five she filed a 1040 which stated I had no income- when in fact I did. So that year's tax return is technically incorrect.

Also, I've learned since that my self-employed income for two of these years gave me a different kind of filing responsibility- and had a different reporting threshold- much lower- so I may have needed to report all of it and suspect I may have to pay back-taxes for those two years as well :(...

 

Having now established myself back in my home country, I am taking control of my tax issues and I'm meeting with a tax advisor (today actually) to begin sorting this out!

 

My worry is this:

I want to submit our I29f for K1 packet as soon as possible (by the end of this month)...

Although I'm getting right on these back tax issues as well the corrections may not show up in IRS records right away or in time for the first checks on our forms that USCIS will do...

 

Should I be concerned that I'm listing all of this UK employment on my G325a... I definitely want to be 100% truthful about when/where I've worked.

Will flags be raised if my IRS returns reflect a report of 'no income' for a year where I've reported working in the UK on the form, or no record of the two years of reported self-employment in the UK.

Or, as some have hinted/stated on here, do the IRS not 'talk' to the USCIS at this first stage and they probably won't be looking at this kind of info... just making sure i'm not a 'bad guy' from bigger databases...

I can see that they look more into the petitioner (me) than the beneficiary-- but does anyone know if an issue as deep into my records as this has bearing at this point? I'm hoping that something like this wouldn't matter at this initial stage.

 

I was hoping that the tax record wouldn't matter till we get to I134s when I will by that time have record of this matter being on its way to resolved (besides we will be using a joint sponsor at that point).

 

Sorry for this being quite a complex question right out the gate- any help greatly appreciated.

I suspect I am worrying about something that doesn't matter. (again)

 

I am working on our K1 I-129f.

 

In our five year address history- it will show that we have been living apart (me in US, him still in UK) for almost a year now...

For 10 months prior to that I lived in his flat.  All bills etc. were in his name and/or paperless.  I never bothered to change my official mailing address (with my bank, work, university) because I was simply giving him cash for part of the bills and because i maintained a good relationship with my old housemate (best friend) who simply passed on my mail to me when we saw each other...

Prior to that we both had separate addresses in Liverpool (me several because I was on study, post-study visas there for a good few years)...

 

Will it be weird if there is no evidence from our shared address? I literally don't have anything with my name on it for there... have searched!

 

Bear in mind we have plenty of evidence for meeting in the last two years (primary evidence- multiple trips with boarding passes and receipts, passport stamps/visas placing us in the same country many times for visits when living apart and vacations, jobs we worked on together when both living in UK, pictures associated with time-dated event tickets/receipts)... We seemed to have been better at documenting it outside the flat is all!

 

Is it worth offering any kind of explanation (perhaps on our relationship timeline or along with address list) of why I have no postal evidence placing me at our shared address?  Or is it TooMuchInformation not necessary.... 'don't open a door that doesn't need to be opened and confuse things' territory... I suspect perhaps I should simply focus on highlighting the good evidence we do have rather than apologizing for something that just doesn't exist.

 

Thoughts appreciated.

One more nitpicky thing... Can i put the answers for

 

Last address outside the United States of more than 1 year

 

and

 

Last occupation abroad if not shown above

 

on the same attachment sheets as employment history attachment and residence attachment...

writing 'SEE ATTACHMENT 1' or 'SEE ATTACHMENT 2' in those boxes too...

soo 'see attachment' is in all the boxes related to residency and employment

 

seems neater

Would someone please look over my attachment sheet to G-325a Employment History for my beneficiary please...

 

Your advice here will help me with my form too...

There seems to be a lot of back and forth on VJ about how USCIS feels about 'overlaps' in time and I'm trying not to leave any gaps.

 

Also I'm not great with charts so simply wrote it out resume style as uniformly as possible with brief explanatory note at top.

 

Please could someone have a look let me know if what I've done seems acceptable.  I need to email what we want to use to fiance asap so he can sign and mail it to me for the packet!

 

Your help would be greatly greatly appreciated!

I thought the second thing you mentioned might be the safest option...

(the d as in dog note is written very small and i'm hoping they wouldn't find it too odd or hard to see... my grandfather could read it without me telling him what it said so that was a good sign...)

 

Just thought it might look quite weird to have the attachment with his work history signed and not the main form itself.

The attachment is being sent in the overdue post already in transit that i should receive soon with intent letter and photos.

Well it's another post about cross outs on a simple form. Basically I can't sleep and would like some re-assurance...

 

My fiance signed several (3) forms G325A for me when we were together in January.

 

I spent a good while practicing on blank forms before i started printing (neatly) on the forms he signed with the information he gave me.

 

And then i made a little mistake on a form. and another on another. and another. I MESSED UP ON ALL THREE.

There is one that is the most legible. I've only overmarked one letter in an address (a d that looked like an o now looks like maybe neither as i re-wrote too hard on top so below i wrote 'the letter above is 'd' as in dog')

 

And in a see attachment note in the employment list item i started to write 'petitio' for petitioner-- that is crossed out twice (not obliterated, just two lines through very neatly) and wrote 'beneficiary'.

 

I just wanted to make sure it was legible and correct and this one is near as possible without starting over... 

and we are SO CLOSE to being ready to mail in the I-129F packet...

I'd ask him to re-send another signed one in the post but we've already been waiting over a week for an 'express' (HA) delivery from the UK with signed fiance letters photos...

I'm hoping they arrive in the next day or two and I can get this thing done... and NOT have to wait for another form to snail mail its way to me again...
