look at the visa issuance date on the K-1.   that date 'gives' the child up to 1 year to interview for a K-2, going forward.

 

What to do, you ask ?  Go pay the visa application fee at CITIC bank, then register over at ustraveldocs.com/cn   then (your choice) either make a new account there for the K-2 or tag along on the old K-1 account there,

showing the receipt of visa payment,

then self-schedule.

 

Once scheduling occurs, you have an interview letter that can be used at the medical exam place.  Don't forget to get some white books done.   Also, to the best of my knowledge, there'd be a DS-160 on the K-2, not a DS-260.

IMO,

the whole 'thing' is a mistake,

because there is a report on an appeal that you never filed.

 

I claim data error, perhaps even human error that skewed the data.  

 

It's simply wrong. 

 

Get an ISO during the week, this upcoming week, keep drilling with them during that one phone call, insisting that you never filed an appeal; and that the status stored online is absolutely wrong.

 

An ISO can see more in their computer system, compared to a CSR.   Still, must talk to a CSR to get an ISO, it's a PITA.

I would call the USCIS phone number and ask how it is that you were denied an appeal you never filed. I'd also check the status of your original K1 application and see if it is still active. If the agent you speak to seems confused then just call again until you get someone who can give you some information.

but

 

OP needs to talk with an ISO, a Tier 2 Human.   Not the first person that answers the phone, who is as useless as 100 year old toilet paper in a hurricane.   Sure - can touch the surface, but not useful for cleaning up a mess.

 

An ISO has 'god access' on the computer, can see all.  The CSR, the Tier 1 human, only sees what the OP can see online.

I'll have to guess that you've missed the window based on the notice date - usually one is given between 30 to 120 days , and the duration is in writing in that piece o postal mail.

 

You've not mentioned the postal mail piece, so I am dubious about what is what, really.

Go to Canada. Have her take a course at a local university. You haven't exhausted all options. If you want the waiver approved, then, you need to show that you have.

 

Meeting is a requirement for the K-1.

 

Even if you get this waiver approved (which, seeing now that you can work and study, I don't see it happening, it's not as bad as everyone here thought it was), you're going through a very difficult consulate.

I like this approach, actually.

 

Since she needs to do a period of residency on her doctor stuff, IMO getting it done in Canada is superior to getting it done NOT in North America.

 

And the petitioner can get up there and meet her, taking lots of snaps of the two of them together, enjoying poutine and really weak beer.

Ugh. I disagree,

as for K-1 visa chasers,

when a petitioner cannot travel to meet up,

and shows proof of same,

USCIS does take it into consideration.

 

It must be a big reason.  IMO, needing kidney dialysis on a schedule should be a reason for USCIS to grant the waiver of the meet up requirement.

 

But, hey, that's all just my opinion.

 

With it, and 1.25, one can purchase some nice toilet paper and take care o business.

Anyone have any examples of this and what it is typically returned for? Is it as bad as it sounds?

 

After receiving the NOA2, we have started to make wedding plans, taking into consideration the typical timelines and adding some buffer to be conservative. Its been 2 weeks since its been returned and USCIS still doesn't have it in their system, so I don't know the specifics. They said it could take 1 month to get back into their system and then they have up to 120 days to review it. This would obviously blow our current plans out of the water. 

 

Do a search on VJ it has happened many times. Could be forgotten paperwork  could be a previous petition. It will take weeks maybe months so stay on it. Nothing you can do about it.

 

Was there maybe  a previous K1 or IR1/CR1 that was denied or withdrawn or not withdrawn?

I want to get my fiancee over to the US. I have been dating him online for 9 months. I was married but separated when we decided to go from friendship to dating. I fell in love when we were still just friends, before we even started dating. Anyways, My husband got very sick and I cared for him until he passed away in March, 2014. I have a part time job and 2 children and attend college. We have not met in person because my children cannot travel out of the US due to custody agreements and also because they have mental/emotional issues they are receiving treatment weekly for. Also, I do not meet the 100% or the 125% poverty line. I do however have 3 vehicles, own a home, and have 25k in the bank (which I will be using to pay for the visa process and plane ticket if approved!). My fiancee has work experience as a carpenter and an IT degree so work should be easy for him to find once he is legally able to seek employment. Another snag I am worried about is, in my past, an ex boyfriend had abused his child while I was living with him therefore I was brought to court with him in his case which his children and mine were found to be dependent and neglect. There were no sentences and only had to work with social services which ended as soon as I was able to move out of his home with my children. Then last year, my teenage son was unruly and ended up having social services involved which was taken to court. It was not a case of actual dependent/neglect involving child abuse or neglect, it was for the reason of :The child has run away, from home or is beyond the control of the parent or guardian. The outcome was working with social services and getting my son help. The case was dropped after a complete turn around for my son after treatment. I want my fiancee to be with me and my children very badly but am unsure if I would be able to qualify to petition and sponsor him for the K-1 visa. Any advice and feedback is greatly appreciated.

 

I am sorry for your loss of husband.

 

You have a few red flags you should consider.

 

1. You say your husband just dies 3 months ago and now you want to petition someone who meet while still married and who you never have meet. Very risky.

2. You can try and seek a waiver to "not meet" its very hard but not impossible. Considering you are able body (I would gather) to travel and meet him it will be hard to consider.

 

A CO may look at this as why are you rushing so fast. So you may want to sit back and consider some things go to him and meet and progress from there.

 

As it stands now you don't qualify because you haven;t meet. If you want to file without meeting and writing up a letter of waiver on why you can;t meet that's on you. You may get denied than you have to than meet and start all over again.

@Ebunoluwa, what if the Western Union transfer is the other way round as in, the USC is the sender, I believe it doesn't show anything negative.

We have chat logs from '11 till date, fiance has only visited once due to work and school, that was some months back, we also have photos together, with friends and family. Have letters and cards we've exchanged too. And we plan to include them all. I hope it isn't going to be too much.


 

It looks even worst the USC sending especially if she is a woman. And really more if she is older.

 

I can be looked at as if the American is in a romance scammed used for money. We the American sending money to our poor African hunny.

 

It's just not normal for women to be sending money to men and supporting them no matter how much we know its cool and normal. Perception is everything and face it this is Nigeria we are speaking of. Perception!

People get police certificates everyday from UK and no longer live there. No there's no waiver and without the Police certificate you will not be approved.

 

No one can tell you if you will be approved or not. It's good he is going to Nigeria. You meeting his family face to face is a must.

 

Do you have red flags

 

1. Is there a big age difference (10 years or more)

2. Divorce

3. Children from prior relationships

4. Different religions

5. Not meeting immigrants family

 

These are just a few red flags that are issues through Lagos.

 

The Police certificate he can obtain anytime before interview since he doesn't live there its good for a year. he needs to get on that.

Help guys, I've been going over this DS160 form 1,000 times and I just need to ask this one question before I finally submit it today.
There is a question that says: HAVE YOU EVER HAD A LOST OR STOLEN PASSPORT ? Yes or No and then a space to explain. I haven't ever had a lost or stolen passport so my first thought is to check no and move on BUT when I changed over to an electronic/machine-readable passport two years ago my current passport was still valid, therefore they wouldn't let me keep it (understandably). Now, my problem is , that passport had a lot of info needed for this DS160 form in terms of last trips to the US, last dates of visas and some other info like the date of my brief overstay. NONE of which i can remember off the top of my head, so do I check YES in the box and just EXPLAIN that I've never lost or had a passport stolen but I had to surrender it, therefore I do not remember specific dates in some of the questions I've answered on this form.... or just guess to the best of my ability and click NO as my answer.
HELP, WHAT SHOULD I DO???

 

No. The question is to be taken literally. You didn't lose your passport nor was it stolen. Wjy would you muddy the waters and say yes.

 

It's a No. All information in your passport they have loaded anyway. You are fine.

The petitioner called and they said they would resend it - but did not tell us what it was, only that it was a notice. We received our NOA1 Feb 12th 2014, so could this be the NOA2? We received an email however on saturday (shown below) saying the TSC does not re-mail undeliverable receipt notices. Any advice on what this is?

Do you visit the US often to see him or he coming down too see you after all this time or what? That will speak volumes to the bonafide of your relationship.

 

Think like a CO. For whatever reason you were denied (You should be filing FOIA) to get  CO's note and maybe a clue why you were divorced. Now I am seeing same couple and now they are engaged not married why? Looks suspect.

 

Also addressing the reasons you divorced I am sure a CO would like to know that also.

Unfortunately for I-129F petitions they will just let them expire. You won't get a nice point by point letter from USCIS why you were denied and you need to address each point with evidence.

 

You say what to do. Well first what was wrong on the the application address that. get your dates right. CO's do alot of psychological questioning. They ask many times not to get the right answer but to see responses. Someone not knowing the last time their love visited screams of RED Flag and this is just for show.

 

Remember they don't know you. The evidence you presented wasn't enough to convince them otherwise and the questioning went bad.

 

I would have a sit down consult with a good DR attorney.

Hi fellow VJers! I need some assistance/advice in how I should handle this with regards to the K-1 visa. I am the USC petitioner.

 

Background info:

 

My fiancé, from Africa, has 2 birth certificates with different names and DOBs. When my fiance was younger and his parents were still married he had his original correct birth certificate listing his name and date of birth. This original birth certificate listed him taking after his fathers' surname (i.e. John Smith, son of Matthew Smith).

 

A few years later his father decided to take another wife and my fiancé's mother didn't exactly like that so she divorced him (can you blame her lol?). After the divorce, I guess out of anger my fiancé's mother decided to make a new birth certificate and change both my fiancés name, the name of the father listed on the birth certificate and the date of birth (i.e. It now says John Jones son of Christopher Jones instead of the original John Smith/Matthew Smith combination). The father took

 

My fiancé was very young when this happened and he has only used the birth certificate with his current name (John Smith in the example above) for all of his school records, national identity card and passport. He essentially only used 1 identity his whole life.  

 

My questions are:

1) Do we even need to disclose that somewhere there is another birth certificate listing another name for my fiancé, even though he doesn't use the original name at all?

2) My fiancé doesn't have a physical copy of that birth certificate since after the divorce drama his birth father took it back. Do we somehow need to get a copy of the original birth certificate? This is not the same easy (relatively) procedures as in the US, so it's going to take some time if it's possible at all.

3) We didn't put his original name (John Smith in my above example) on the I-129f petition since it really didn't occur to us to include it, but in going thru the questions asked on the DS 160 (regarding alias etc,) we're now wondering if we should put his original name as an alias or if that's unnecessary since he's never used it.

She changed the birth certificate so you will need both for interview and really explain this one.

 

Also the alias should have been listed. It ask for other names you are called by or something like that and you need to list them all. Regardless if you ever went by it. The birth certificate change is his new name.

 

Like my husbands family decided 4 years ago to change their Nigerian last name. Everything was change. He had new Birth certificate, had to get new passport. But family name  previous was listed because that is another name is is known by. Heck for 31 years of his life.

 

So you need to fix that on Ds-160 and for interview bring in a updated I-129F with info.

 

Do not be surprised to be put in AP while they investigate this.

 

I would also get a notarized affidavit from mum attesting to changing the Birth Certificate and why. Maybe dad too saying he took it. Will be interesting to see what actually is on file.

Also on the I-485 I'm confused what to put for USCIS status.

I made a blunder in that I did not apply for a social security number before we were married.  So Social Security says she is no longer in a K1 status but is now K3 or something.

Then I found a website that said after your are married the status is Conditional Permanent Resident, but then another page says you have to apply for that status (using 485 of course).

 

Until you file your I-485 she is out of status once the I-94 expires in 90 days. The I-485 is what will give her the status to work and get license and other things. K3 no she isn't that. You weren't married when she came over so that doesn't apply to you.

 

When they are speaking of supporting documents they are talking evidence you don't need that,  but yes she will have medical and all that and an interview.

 

So she was 21 when you petitioned the mom?

Did you also have her listed on the I-129F petition?

Following-to-Join Benefits

This section is for beneficiaries who became permanent residents through a preference classification.

If you had children who did not obtain permanent residence at the same time you did, they may be eligible for follow-to-join benefits. This means that you do not have to submit a separate Form I-130 for your children. In addition, your children will not have to wait any extra time for a visa number to become available. In this case, you may simply notify a U.S. consulate that you are a permanent resident so that your children can apply for an immigrant visa.

Your children may be eligible for following-to-join benefits if: 

  • The relationship existed at the time you became a permanent resident and still exists, AND 
  • You received an immigrant visa or adjusted status in a preference category. 

If your family member (child) falls into this category and you adjusted to permanent residency in the United States, you may submit the following:

If you are in the United States and have not yet filed to adjust your status to permanent resident, you can file Form I-824 for your child overseas with your Form I-485.  When concurrently filing Form I-824, it does not require any supporting documentation.

If you received the immigrant visa overseas, you may contact the National Visa Center (NVC) for follow-to-join information. Direct such inquiry by sending an e-mail to NVCInquiry@state.gov or by writing to the National Visa Center, ATTN:  WC, 32 Rochester Ave., Portsmouth, NH 03801-2909.

Girl B I hope is up to date about Girl A. I am sure it will come up. Not answering a NOID/NOIR, RFE all that is a ref flag so be ready.
