Thank you so much!I feel much better today. Can somebody tell me,as a supporting evidence when you first mailed I-130 petition, what did you guys sent? I did not sent anything as a supporting evidence because the person did my I-130 told me I don't need it,that supporting evidence is later on for the Consulate interview.now I got RFE :bonk:

Hang in there... once you submit whatever it is they want it shouldn't be much more of a wait :)

As a side-note, this is precisely the reason I wasn't all for turning this thread into a new NVC thread. This whole process had been traumatic enough, no need to subject people still waiting or with RFEs through conversations about the next level... Just my opinion :)

you're absulutely right.I am happy for them but I feel like left behind. They all deserved, went thru a lot.Maybe I stay away a while.I saw the message right after I left work and coulnd't hardly wait to come home and read the message on my laptop.. RFE...It's not a good feeling!

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling taxes as married

The USC was married in 2010 and should NOT file single. The status will generally be "married filing separately" if he doesn't want to file jointly. Filing jointly will be an advantage tax-wise. You will have to do a couple of extra steps this year.

•You will complete your joint tax return leaving a blank where a SSN or itin would go for your spouse. The 2010 UK income will be converted to US $$ and reported (under less common income on TurboTax). It is self reported as is the conversion rate. Form 2555 or 2555EZ will be filled out for the foreign income exclusion. They want to know worldwide income, but then you get to exclude up to $91k-ish.

•You will write a statement saying you are a US citizen and he/she was a non-resident alien on the last day of 2010 and you both elect for him/her to be treated as a resident alien for tax purposes. That's required for him/her to file jointly with you as he/she is not a resident yet by immigration rules. But for the IRS, the statement will allow him/her to be considered a resident as far as filing taxes goes. Otherwise a non-resident can not file a joint return. You both sign the statement and each list you name, address, and id number (SSN and A-number). Staple it to the end of your return.

•You complete a FORM W-7 ticking reason "e" and giving your name and SSN on the line beside it. You must provide identity with the w-7 and his/her passport will be enough. The IRS says this "If you submit an original valid passport (or a notarized or certified copy of a valid passport) you do not need to submit any other documents. If you do not submit a passport document, you must provide a combination of documents (at least two or more) that are current and that (1) verify your identity (that is, contain your name and a photograph), and (2) support your claim of foreign status."

•Mail you tax return (signed by both), the statement, the W-7 and identity document to

Internal Revenue Service
ITIN Operations
P.O. Box 149342
Austin, TX 78714-9342

NOTE: This a special division and not where you would normally file your return. They will process the itin in Austin and add the itin number to the tax return you sent with it. Then the tax return will be processed. It will take a little longer.

You have the best answer! That is what IRS told me exactly!I don't know where other people getting their wronng info?Married filing separately, easiest way.
Thank you so much, for the best and correct answer.

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 Spouse Visa Process & Problems

Hi Everybody

Hope someone can help out!
My husband is American, I’m German.
We married lately and now we decided to emigrate to USA.
Our life and Job situation seems now perfect to make a break in Germany and start a new one in USA.
So we are completely on the beginning. We even didn’t send the I-130 yet!
I, as a woman who likes to know exactly the way and likes to be prepared have some questions to the whole process. Specially because, emigrating to USA means beside the Green Card process also to make some arrangements and finish stuff here, like giving up our apartment, the jobs, quit insurances etc.
I preferred the whole process would take 3-4 month, but unfortunately it takes about a year, which is already a problem for us!

1. Question: Does anybody knows what to do if we don’t have any addresses in USA (for filling the forms)?
2. Question: What should my husband write in the I-864 form? He never really lived in USA and never worked or got paid in USA. So how can he prove his sponsoring? (We both are self-employed and we have enough savings to have a tart in USA. It’s clear, that we’ll get a job asap there to be able to live. Otherwise, if nothing works as planed, we’ll come back to Germany before living in USA as homeless people or s.t. like that!)
3. Does anybody knows if there is a legal chance to go to USA before I have the Green Card and start finding a job, earning money (to have a credit card record to be able to have an apartment), finding an apartment etc.

I hope someone can help me out.
Thanks in advance.

IR-1 / CR-1 Spouse Visa Process & ProceduresCSC to TSC WHAT I'm Doing ! ! !

Maybe everybody start contacting your Congressman an Senator's maybe that will ruffle their
feathers and get on the ball to get these CR-1 Visa done.
I placed a release letter to Senator Barbara Boxer in Ca.
TO expedite my Case at USCIS now waiting for reply to get things going.
You have a rigth to have either contact them to inquire abour your CR-1
They will take the time to contact them.
Maybe if everybody did the same it will get them going.
Sure cant hurt trying better than sitting doing nothing
Its your choice to sit and wait longer or get some thing done.
It dont hurt your paying your tax dollars for them to do their work in Government.

:)

I hear from other VJ members and they are telling us that, it doesn't help any to contact your Congressman.I am planning to contact my Congressman, when I go over the time frame, which is another month.

IR-1 / CR-1 Spouse Visa Process & ProceduresIR-1/CR-1 Visa Status and procedures

Hi everyone,

I petitioned for my wife about 4 months ago.
It was 09/28/10 when my application was received.
It was 09/30/10 when my application was first noticed.
And it was immediately then my check for $355.00 was cashed.
I was following this forum and checking how other people's applications went through and how long it took.
My wife is living in Turkey, and I reside in NY.
As I indicated it has been 4 months form the NOA1 and I haven't heard anything since then. I feel like this might take longer, which I really don't want that to happen. I read from other people like most of the applicants by this time at least gotten NOA2 or some more information. I have not heard anything since then.
Does anyone know, or anyone from Turkey went through this process? Where do you think I am standing? How far am I from hearing or expecting any news?
It has been 4 months and I really would love to hear some good news.
As far as I know, as soon as I get the approval (which may be NOA2, right?) I will receive a 2nd package, and sent the document either to NVC or directly to US Embassy in Turkey.
Can anyone answer these questions if they know any of my situation.
I appreciate all your help.

First of all you need to fill your timeline,so we know which service center your file is located.I am going same procedures IR1?CR_1 visa like you.I am with Texas Service Center and I have been waiting over 5 months. You can not send any paperwork to nowhere untill USCIS approves you.Once USCIS approves you, than they will send your case to NVC.'Till than you just have to sit and wait like rest of us.

IR-1 / CR-1 Spouse Visa Process & ProceduresImpacts of TSC to CSC transfers in Oct/Nov/Dec applicants?

i think the best bet is not to clog the CSC by transferring all these 36000 back and instead have TSC process them and just because CSC has resources does not mean that Oct/Nov/Dec applicants have to be pushed back at the expense of TSC transfers coming to CSC.

Don't forget ,we were all at CSC first, before we got transferred to TCS.I quess it's only fair we (6 months or more)waiting should get approved before Oct.,Nov.,Dec. filers.

I got this message from TSC today saying all applications will have a response within 2 weeks:

"Unfortunately, our office is closed today because of the ice/snow storm that has hit Texas, but I did not want you to wait to hear from me. The I-130s are the priority for the Texas Service Center and we will have an action taken on every petition within the next 2 weeks. On a separate note, we are working with our call centers to ensure a more accurate and consistent delivery of information so hopefully your experience will not be repeated."

Great news!!! let's wait couple of weeks and see what happens. It's hard to believe but who knows...

I sent affidavits, photos, and of course the marriage license along with google chat logs. Now you guys are making me nervous. At least in theory they SHOULD respond quickly after you forward them the evidence they requested, so you guys are nearly done. I'm wondering for those who got approved, what kind of evidence of bonafide marriage did they include in their applications? Why are some newlyweds getting RFEs while other's aren't? Perhaps they are training themselves on the RFE process?

I didn't sent anything with my petition,I thought that part is for US Consulate, when beneficiary goes for interwiev. They are doing background check, why do they need all the pictures and evidence for.All my conversations,e-mails,text massages with my husband is in Turkish language.Good luck to them,if they can understand

Got the email from Officer Garza about a week ago and yet my case still hasn't been touched after the email. Sad part is I had a dream last night that I received an email stating my case was approved and then I woke up, checked my Iphone and nada. This situation has gotten me and wife depresses, stressed and frustrated and the same time. This has been the worst experience I've ever had so far. All I want is for me and my wife to be together.

I hear you,my husband and I,we are so frustraded also. You're not alone.

I really hope you're right about it being days or weeks (this turnaround time between TSC and NVC has got me really worried for what will happen after approval). Enjoy your time with your wife! I know just what you mean about the concept of "visiting" spouses. The last time I lived with my husband was in December 2009. Since then, I've spent two weeks with him in June of last year, and then two weeks this December/January. Coming back this time was the worst because our time together only reminded me of how we are supposed to always be together. I had really hoped to be through this USCIS stage by now, so every day is harder than the one before.

I only spent 5 days with my husband last May,that is the last time I seen him other than webcam everyday.I only have 2 weeks vacation and waiting for his interwiev day to go to see him and hopefully bring him back with me.I really pray for all of us for our approvals this coming week!
